The reported $31,000 roof replacement and claim that inspectors later found flashing was never replaced are not independently verified by the available case details. Without the contract, inspection report, dated photos, or another direct source, the amount and alleged omission should be treated as claims—not established findings. What can be explained is how flashing, Texas inspection standards, and contract records bear on a dispute like this.
What roof flashing does—and what “never replaced” could mean
Flashing is material used where a roof covering meets a penetration or adjoining surface, such as a pipe, chimney, or wall. Those transitions help keep water out; the Texas Department of Insurance (TDI) warns that “These are critical areas that will allow rain to penetrate if they are not installed and sealed properly.” TDI’s roofing guidance discusses flashing in the re-roofing process.
The phrase “flashing was never replaced” is not precise enough to establish whether the work was defective. It could refer to a particular flashing type, or to components that remained in place. A useful assessment identifies the component, its condition, whether it was reused, and what the contract required.
Does a roof replacement have to include new flashing?
Not necessarily on the evidence available here. A roof replacement alone does not establish that every existing flashing component had to be removed and replaced. The applicable answer can depend on the component’s condition, the contract’s scope, and the instructions for the roofing system.

The National Roofing Contractors Association’s discussion of reroofing under the 2012 International Building Code says certain existing components—including vent flashings, metal edge flashings, drain outlets, collars, and metal counterflashings—may be reused if they are not rusted, damaged, or otherwise deteriorated. It also describes flashing details being reconstructed according to manufacturer installation instructions. This is historical technical context, not a determination of the code or requirements governing an unidentified Texas project. NRCA’s 2012 IBC discussion should not be treated as a current project-specific ruling.
What Texas home inspectors are required to report
Under the Texas Real Estate Commission (TREC) standards, inspectors must report evidence of water penetration and deficiencies in flashing details. That requirement concerns observable conditions; it does not mean an inspector can necessarily determine what work was performed behind or beneath the roof covering. TREC’s Standards of Practice also set limits on access and the scope of an inspection.

- An inspector need not get onto a roof if, in reasonable judgment, access is unsafe or walking on it could cause significant damage.
- The standards do not require an inspector to give an exhaustive list of every deficiency location or determine a roof’s remaining life expectancy.
- TREC says an inspector may spot-check rather than inspect every inch. Its FAQ on drip- and rake-edge flashing says those materials are recommended by most shingle manufacturers but are not required. For any inspection finding, check the report’s date, accessible areas, vantage point, observations, and stated limits. A finding about visible flashing or water intrusion is not automatically proof that concealed flashing was never replaced.
How to assess the work against the agreement
Start with the signed scope, not the project price alone. The $31,000 figure, even if confirmed, does not show what flashing work was promised: roof area, material, roof complexity, decking condition, and included work are not established here. Look for wording such as “replace,” “reuse,” “repair,” or “as needed,” and review exclusions and approved change orders.

Build a record that connects the promised work to the installed work and any damage:
- Contract documents: Keep the signed proposal, scope, exclusions, and approved change orders.
- Work records: Gather invoices and material records that identify what was installed.
- Dated photos: Collect images from before tear-off, during installation, and after completion, especially around chimneys, walls, penetrations, valleys, eaves, and rakes.
- Inspection findings: Obtain the complete report and note its date, access, vantage point, observed water intrusion, and limitations.
- Independent assessment: Ask a qualified roofing professional or inspector to identify the flashing type and condition and explain the basis for the conclusion.
If water is entering, document the interior condition and arrange prompt assessment. A moisture meter may document dampness in accessible materials, but it cannot diagnose a roof defect, prove flashing was not replaced, or establish causation.

What to do before roof covering is installed
For homeowners who want to verify installation, TDI advises contacting the local windstorm field office before the roof covering is installed. TDI’s page describes a free inspection option for a TDI representative; availability and local eligibility should be confirmed directly with TDI. A check before the roof is covered can provide a different opportunity to observe the work than a later inspection.
What Texas law says about covered construction-defect claims
Texas Property Code Chapter 27 says that, in an action subject to the chapter, a claimant must prove the construction defect existed at completion and proximately caused damages. The chapter also contains a contract-disclosure requirement for covered written contracts, subject to scope and exceptions. Whether those provisions apply, and what they mean for a particular dispute, depends on facts including the contract, project dates, notice history, and evidence. See Texas Property Code Chapter 27.
