Can You Legally Trim a Neighbor’s Tree That Hangs Over Your Yard?

You may be allowed to trim branches crossing onto your property, but the boundary, local rules, tree condition, and who pays all depend on where you live.

Often, yes—but the right depends on where you live. In several U.S. jurisdictions, a property owner may trim branches that cross the boundary line, typically at their own expense. That does not give you permission to cut on the neighbor’s side, trespass, or damage or kill the tree. State and local rules, permits, tree-protection orders, and HOA or POA restrictions may also apply.

Before doing any work, confirm your property line and check the law where the property is located. The examples below show why there is no single rule that applies everywhere.

What can you usually trim?

A common approach in several U.S. jurisdictions is that you may trim the portions of a neighbor’s branches that extend over your property, up to the boundary line. This is a general pattern—not a nationwide statute or a guarantee that the same rule applies in your state. The Texas State Law Library describes the right in Texas as common law and says Texas has no statute directly addressing the issue (Texas State Law Library guidance, March 8, 2024).

Do not cross the property line to do the work or cut branches that remain on the neighbor’s side. Texas guidance also warns that improper trimming or damage to the tree or other property may expose you to a damages claim. It says not to enter the owner’s property without permission, except where there is an imminent threat.

How the rule differs by location

Texas The State Law Library describes a common-law right to trim branches crossing the boundary. Do not cut beyond the line, injure or kill the tree, or trespass. Local ordinances and HOA or POA rules may apply. The library says there is no Texas statute directly addressing this issue. Source
Florida University of Florida IFAS says an adjoining owner may trim encroaching branches at their own expense, up to the property line. The handbook discusses Florida cases and notes that some questions—including aspects of damage to the tree after self-help—are unsettled. Confirm current controlling law before relying on it. Source
Georgia The Attorney General’s consumer guidance says the adjoining owner generally handles routine trimming. Dead or dying trees and trees that are imminently dangerous may be treated differently. The neighbor or hired company must not trespass or damage the tree. Source, March 17, 2026
Louisiana Civil Code article 688 allows a landowner to demand that the neighbor trim encroaching branches or roots at the neighbor’s expense. The right applies when the encroachment interferes with enjoyment of the property; it is not an unconditional cost-shifting rule. Source, article 688
Queensland, Australia Government guidance provides boundary-abatement rights as well as formal notice and tribunal procedures. Protection orders, notice requirements, thresholds, timing, and QCAT procedures apply. This is an example of local variation, not a rule for U.S. properties. Source, January 9, 2024

Who pays—and when the neighbor may have to act

For ordinary overhanging branches, some jurisdictions put the cost of trimming on the affected neighbor. That is not universal. Georgia’s guidance generally assigns routine trimming to the adjoining owner, while Louisiana article 688 specifically allows a landowner to demand trimming at the neighbor’s expense when the encroachment interferes with enjoyment of the property. Georgia also identifies dead or dying trees and imminently dangerous trees as different situations. Check local law rather than assuming the neighbor must pay or that you can trim every limb yourself.

Queensland illustrates how a formal process can replace informal self-help. For certain branches overhanging more than 50 cm and less than 2.5 m above ground, the government guidance describes a written notice requiring at least 30 days and a neighbor’s payment liability of up to AUD $300 per year under that procedure. Those figures apply to that Queensland process only; they are not U.S. rules.

Check these rules before arranging tree work

  • Confirm the boundary. Do not assume the fence marks the legal property line. If the boundary is uncertain, resolve it before cutting.
  • Check local requirements. Municipal ordinances, permits, protected-tree rules, and HOA or POA covenants may restrict work even when branches cross the line.
  • Assess the tree and the risk. For a large, elevated, structurally important, hazardous, or protected tree, ask a qualified local arborist or the relevant local authority for guidance. This legal overview is not a pruning method; do not climb or use powered equipment based on it.
  • Speak with the neighbor where practical. A discussion may help you agree on the scope, timing, and who will hire a professional. If there is a serious dispute, seek advice from a lawyer familiar with local property law.

A practical way to proceed

  1. Identify the governing location. Start with the state or country, then check city or county rules that may apply to the property or tree.
  2. Verify the line and the proposed cut. Establish which branches cross onto your land and ensure the planned work stays on your side.
  3. Check restrictions and hazards. Confirm whether a permit, protection order, covenant, or special process applies. If the tree is high, hazardous, or otherwise complex, contact a qualified professional or local authority instead of attempting the work yourself.
  4. Choose the appropriate next step. If the rules permit trimming and the work is safe, arrange limited work to the boundary. If responsibility, danger, or legal rights are disputed, use the applicable local procedure or consult a local lawyer.

What this does not establish

The guidance summarized here does not establish one nationwide rule requiring a neighbor to pay, a right to cut every overhanging limb, or a general claim based on fallen leaves or fruit. Those questions depend on local law and the specific circumstances. For a consequential dispute, confirm current local law rather than relying on another jurisdiction’s rule.
