USDA’s Firefly Petunia Decision: What It Means and Where to Buy

USDA APHIS found Light Bio’s described firefly petunia not subject to 7 CFR part 340 after its plant-pest risk review. Here’s what that means, how subtle the glow is, and what the seller says about care and availability.

USDA’s Animal and Plant Health Inspection Service (APHIS) determined that Light Bio’s described bioluminescent petunia is not subject to the federal regulations in 7 CFR part 340, after finding no plausible pathway for increased plant-pest risk compared with conventional petunias. That is a product-specific regulatory status determination—not a blanket USDA approval of genetically engineered plants. Light Bio says its 2026 sales season has ended and it expects the plants to return in spring 2027.

What USDA decided about the firefly petunia

In a regulatory status review letter to Light Bio, APHIS considered the particular genetically engineered petunia described in the company’s request. The agency assessed its biology and trait, including possible effects on the plant’s distribution, density or development; plant pests and pest reservoirs; beneficial organisms; and weediness.

APHIS concluded: “APHIS did not identify any plausible pathway by which your modified petunia would pose an increased plant pest risk relative to comparator petunia plants.” The letter’s conclusion was: “Accordingly, your petunia is not subject to the regulations under 7 CFR part 340.”

The determination applies to the petunia developed exactly as described in Light Bio’s request. The letter also extends it to progeny from crosses with nonmodified plants or with other modified plants that are themselves not subject to those regulations. It is not a general determination for every genetically engineered plant or every future version of this petunia.

What the review does—and does not—cover

APHIS’s review addressed plant-pest risk under its regulatory authority. The letter describes the genetic changes involved in the plant’s self-generated light, as well as a marker gene, but it should not be read as an independent assessment of consumer food use. More broadly, APHIS regulates certain genetically engineered organisms that may pose plant-pest risk in contexts such as importation, interstate movement and environmental release; the agency’s general guidance distinguishes permits from notifications. That broader regulatory framework is separate from the specific status review of Light Bio’s petunia.

How the petunia glows—and how visible it is

Light Bio describes the plant’s light as bioluminescence: it is produced within the living plant, rather than being fluorescence that depends on an external ultraviolet source. The company says the plant glows continuously, but the light is soft and visible to the human eye only in total darkness. Younger flowers and new growth are said to be brightest.

Expect a subtle effect, not a bright lamp-like glow. A grow light can support indoor plant growth, but it does not make the petunia glow.

Growing a firefly petunia indoors or outside

Light Bio describes the plant as a compact, mounding annual with white blooms, about 8–10 inches tall and wide. The seller recommends pots and containers, full sun (six or more hours), well-draining soil, evenly moist conditions and petunia fertilizer with chelated iron.

Indoor light and basic care

For indoor growing, Light Bio recommends several hours of direct sunlight or a bright grow light. A grow light is an optional way to provide the light needed for growth when a suitable sunny window is unavailable; it is not a viewing aid for the bioluminescence. Keep the soil evenly moist and use a well-draining mix. Follow the fertilizer label and the seller’s petunia-specific feeding guidance.

Outdoor growing

Choose a sunny spot or container location that receives at least six hours of sun, and avoid soil that stays waterlogged. The seller characterizes the plant as an annual, so plan on seasonal rather than permanent garden performance.

Where to buy one—and when it may be available

Light Bio announced the start of U.S. consumer sales on February 1, 2024. Its current site says the 2026 season has closed, the plants are back in the greenhouse, and the company expects a return in spring 2027. Seasonal stock and timing can change, so check Light Bio’s official store or authorized retail locator for current availability rather than relying on a promised delivery date.

Light Bio says shipping is currently limited to the contiguous 48 states, with shipments scheduled around USDA hardiness zones. Check the seller’s current terms for eligibility and timing before ordering.

Are firefly petunia seeds real?

Light Bio says it sells the bioluminescent technology only in live plants and does not sell or authorize seeds. The company says genuine plants are available through its website and authorized retail partners, and warns that third-party seed listings are unauthorized. It also says the patented plants are sold for personal use and that unauthorized propagation or breeding is prohibited. These are the company’s product and use terms; consult them before buying or attempting to propagate a plant.
