Permit requirements and penalties depend on the city, county, and type of work. Before building, remodeling, or demolishing, contact the building department responsible for the property address and confirm which approvals you need. If work is already underway or complete, ask that department how to address it; an application or fee payment alone does not mean the work is approved.

Do I need a permit?

It depends on the work and the rules that apply at the property. Construction, additions, alterations, demolition, grading, and changes to regulated building systems can require permits. Local codes also set exceptions, so a small project or repair is not automatically exempt—and not every project requires the same approvals.

Seattle’s Department of Construction and Inspections, for example, says most projects in several construction categories require permits and points to code exceptions. That is Seattle guidance, not a rule for every jurisdiction. Ask the building department for the property whether your exact scope requires a building permit or separate electrical, plumbing, mechanical, zoning, historic-district, or site-specific approval.

Can I start work while plan review is not complete?

Do not treat a submitted application, an invoice, or ongoing plan review as permission to begin. If a permit is required, wait until the authority has issued it, then follow its inspection and completion requirements. The exact application path varies: some limited-scope work may qualify for a permit without construction-plan review, while other projects need plans and additional approvals first.

  1. Identify the authority. Use the property address to find the city or county building department that governs the site.
  2. Describe the exact project. Explain what will be built, altered, removed, or installed, and provide the property details the department requests.
  3. Confirm approvals and submittals. Ask which permits, plans, and other approvals apply, and whether the project qualifies for a no-plan or limited-scope permit.
  4. Wait for issuance. Pay required charges and obtain the issued permit before starting work that requires one.
  5. Arrange inspections and final sign-off. Schedule inspections at the stages specified by the authority and complete any required final inspection or other completion approval.

These steps describe a practical pattern, not a universal procedure. San Diego’s Development Services Department says an inspection can be scheduled once the invoice is paid and the permit issued, and describes a “No-plan Permit” for work that does not require construction-plan review. Miami Beach describes plan review and required approvals before issuance, followed by inspections appropriate to the work. Check the current process for your own property.

What are the penalties for work done without a permit?

There is no single national penalty amount. Depending on local rules and the circumstances, enforcement can include a stop-work order, fines, a requirement to apply for permits and inspections, or other corrective action. Skipping a required final inspection can also create an enforcement issue. These official local examples illustrate why the property’s jurisdiction matters; they are not estimates of what another owner will owe.

Jurisdiction Published example Important limit
Seattle, Washington The Seattle Department of Construction and Inspections states: “If you build without a permit, you may be fined up to $500 per day.” The department also says it may issue a stop-work order for starting a building, addition, or remodeling project without a permit. The department’s webpage does not state a publication year. The amount is Seattle-specific, and the wording describes a possible maximum, not an automatic charge for every case.
New York City NYC 1 RCNY §102-04 sets a civil-penalty scheme for work without a permit and stop-work-order violations. Under the rule, a subsequent work-without-permit violation within one year after a penalty is imposed may carry twice the otherwise applicable penalty, subject to the maximum. These are New York City rules. The applicable amount and any waiver depend on the rule’s terms and the facts; a waiver of a civil penalty does not itself remove the permit requirement.
Miami Beach, Florida The city’s Building FAQs describe a $1,000 penalty plus a double permit fee for a second offense, and a $2,000 penalty plus a double permit fee for subsequent offenses. These are Miami Beach figures from the city FAQ; the page does not state a publication year. They are not general Florida or national amounts.

Seattle’s published maximum is stated per day, while Miami Beach’s cited figures concern repeat offenses and add a double permit fee. They are different local schemes, not directly interchangeable amounts. Confirm the current rule with the authority handling the property and any notice.

How do I legalize construction that is already complete?

Contact the local building department promptly. Give it the property address, describe the work, and ask how to apply for an after-the-fact permit or resolve any existing notice. Do not assume that paying a fine or permit fee, or filing an application, makes the construction legal.

Depending on the jurisdiction and work, resolving an unpermitted condition can involve an application, drawings, plan review, fees, corrective work, inspections, and access to concealed construction. Placer County’s policy describes stopping work while addressing an unpermitted condition and providing plans and inspection access; Riverside describes permitting, plans, and inspections for applicable unpermitted residential work. These are local examples, not a single legalization process.

The authority may require changes before approving the work, and legalization is not guaranteed. If the construction cannot meet applicable requirements, removal or demolition and restoration may be among the outcomes available under the local process. Ask the assigned building official what applies to the actual property before concealing or altering the work further.

Should I hire a contractor or design professional?

That depends on the project and local requirements. Some scopes require plans from a registered design professional or work by a licensed trade contractor; other jurisdictions or project types may allow an owner-managed application. NYC’s Department of Buildings, for example, says a registered design professional must submit permit application plans before a general contractor begins specified alterations to one- and two-family homes. That requirement is specific to the NYC project scope described by the department, not a general rule for homeowners elsewhere.

If you hire help, verify credentials and insurance for the relevant jurisdiction and work. Agree in writing who prepares the plans, applies for each permit, coordinates inspections, corrects deficiencies, and obtains final sign-off. Confirm these responsibilities with the building department rather than assuming the contractor’s involvement closes the permit.

Which route should I take?

Situation Route to ask the authority about What to confirm
Work has not started Apply for the required permit before work begins. Required plans and approvals, fees, inspection stages, and what counts as issuance.
Work is limited in scope Ask whether a no-plan or other limited-scope permit is available. Eligibility, required documents, inspections, and whether other approvals still apply.
Work is already underway or complete without a required permit Ask about an after-the-fact permit or process for resolving an existing notice. Whether work must stop, what plans or access are needed, corrective work, fees, and inspection requirements.
The work cannot meet applicable requirements Ask what correction, removal, or restoration options the authority allows. The official’s required outcome and the approvals needed to complete it.

Which route is available—and its costs, schedule, code requirements, and consequences—depends on the property and local rules. The authority with jurisdiction makes that determination.
