What to Do When Your New Apartment Has Unreliable Heat, Water, or Electricity

If essential services keep cutting out after you move in, take safety concerns seriously, notify the landlord promptly, keep a dated record, and check local rules before changing rent or arranging repairs.

If heat, water, or electricity keeps cutting out in a new apartment, first make sure nobody is in immediate danger. Then notify the landlord or property manager through the lease’s emergency or repair channel, record what is happening, and contact the local housing or tenancy authority if the problem is not addressed. Repair deadlines, minimum service standards, rent remedies, and relocation rights vary by location—do not assume you can withhold rent or arrange repairs at the landlord’s expense without checking local rules.

What should you do first?

  1. Check for immediate danger. If you smell gas, see sparks or smoke, find flooding near electrical equipment, or face another immediate threat, get to safety and contact the appropriate emergency service or utility emergency line. Do not investigate or repair a suspected hazard yourself.
  2. Notify the landlord or property manager promptly. Use the designated emergency number for urgent risks and the written repair method in your lease or tenant portal. State which service is affected, when it began, whether it is intermittent or fully out, and whether anyone may be at risk.
  3. Make only safe, simple checks. Do not operate building equipment or keep using an appliance that appears faulty. Stop if a breaker trips repeatedly, you notice heat, sparks, burning, visible damage, or water near electrical equipment.
  4. Keep a dated record. Note the times, duration, affected rooms or fixtures, observations, and every contact with management. Save messages, call logs, work orders, and utility outage notices. Take photos or video only when safe.
  5. Escalate if the service is not restored. Contact the relevant local housing inspector, code-enforcement body, tenancy regulator, tenant union, or legal aid service. Ask what it can inspect or enforce and what records it needs.
  6. Get local advice before changing rent or arranging work. Rules for repair-and-deduct, rent reduction or withholding, lease termination, and temporary relocation differ. Do not take one of these steps based on a general guide alone.

When is an unreliable utility an emergency?

Intermittent service can become an immediate safety issue depending on the cause and conditions. A gas odor or suspected leak, dangerous electrical fault, fire, or flooding near electrical equipment calls for urgent help—not troubleshooting. Follow instructions from emergency responders or the utility. Do not use candles as substitute lighting during an outage, or use an outdoor generator, grill, or fuel-burning appliance indoors.

Dangerous indoor temperatures or a household member’s medical vulnerability can also make a loss of heat or power urgent. If you are unsure whether the situation is an emergency, move to a safer place and contact the appropriate local emergency service or utility emergency line. Technical safety procedures differ by hazard and location; use guidance from your local fire or utility authority rather than attempting a repair.

Who should you call: the landlord or the utility company?

Notify the landlord or property manager because they need to know about failures in the apartment or building, and local tenancy rules may require prompt notice. Check your lease and move-in information to see who opens and pays for each utility account, and which services are included. Do not assume the landlord controls an outage affecting the utility provider’s network: check the provider’s outage or emergency channel as well.

NSW Fair Trading treats failures of gas, electricity, or water supply, and breakdowns of essential hot water or heating, as urgent repairs in New South Wales residential tenancies. It says, “The tenant must notify the landlord or agent of urgent repair needs straight away.” That is a NSW rule, not a universal deadline.

What checks are safe to make?

Electricity

If the electrical panel is accessible, dry, and safe to approach, and you know how to check it, a tripped breaker may help explain a limited outage. Do not touch a panel if it is wet or damaged, or if you smell burning or see sparks. If a breaker trips again, stop and report it; do not repeatedly reset it. If one appliance appears to be involved, unplugging it may be reasonable only if you can do so safely. Do not continue using an appliance that causes a trip.

Water

Note which taps or fixtures are affected and whether the issue is a complete outage, low or intermittent flow, or a visible leak. If water is near electrical equipment, keep away and treat the situation as a safety risk. Do not attempt repairs that could worsen a leak or create another hazard.

How should you document an apartment repair problem?

Use a dated log that separates what you observed from what you did and whom you contacted. For example: “Oct 4, 8:15 p.m.—no hot water at kitchen or bathroom taps; texted property manager at 8:30 p.m.; response promised by morning.” For a heating problem, note the affected room and indoor temperature; an indoor thermometer can help document readings, but it does not fix the problem or replace a repair request. If local standards depend on outdoor conditions, record those too.

  • Record when the service fails and returns, and how long each interruption lasts.
  • List the affected outlets, taps, appliances, rooms, or parts of the building.
  • Save emails, texts, portal messages, call logs, work orders, and utility outage announcements.
  • Photograph or film visible damage only when doing so is safe.
  • Keep copies of notices, receipts, and any instructions you receive.

Liverpool City Council asks tenants reporting disrepair to provide evidence such as photographs, videos, and messages. Its guidance is specific to Liverpool, but a clear, dated record can help explain a repair issue wherever you live.

What if the landlord does not respond?

Contact the local housing or code-enforcement agency, tenancy regulator, tenant union, or legal aid service. Ask which body handles your type of complaint, whether it can inspect the property, what evidence it needs, and whether an urgent process applies. Use an official municipal or government website to find the current complaint route.

For example, New York City’s Department of Buildings directs tenants reporting withheld heat or hot water to the city’s Department of Housing Preservation and Development through 311 or 311 online. That contact route and the city’s heat-season rules apply to New York City; elsewhere, find the corresponding local authority.

Can you withhold rent or pay for repairs yourself?

Do not assume that unreliable heat, water, or electricity automatically gives you the right to withhold rent, deduct a repair bill, hire a contractor, end your lease, or move out. Local rules can make a remedy depend on the type of failure, the notices you gave, the landlord’s opportunity to respond, and a required process.

The cited rules illustrate the differences: Texas repair-and-deduct provisions depend on specified notice and condition requirements; British Columbia tells tenants to contact the landlord or emergency contact and follow its emergency repair process; and New York warns that withholding rent can lead to a nonpayment case even when a tenant raises habitability. Before changing rent payments or commissioning work, contact a local tenant legal service or regulator and keep records of notices and expenses.

Why location changes the answer

Minimum standards, response deadlines, responsible parties, complaint routes, and remedies are set by local law and may also depend on your lease and utility arrangements. When checking your options, establish:

  • Who supplies and pays for each utility under the lease and local rules.
  • Whether the problem is a complete outage, intermittent failure, equipment breakdown, or unsafe condition.
  • Whether local law classifies it as an urgent repair or an emergency.
  • What notice method, response period, and repair process apply.
  • Which authority handles inspections and complaints.
  • Whether local law permits repair-and-deduct, a rent reduction, rent withholding, lease termination, or temporary relocation—and the steps required.

Local examples: standards and complaint routes are not universal

Location What the official guidance says Scope
Toronto The city says landlords must provide heat from October 1 through May 15 sufficient to keep rental units at least 21°C. It also says landlords must provide access to hot and cold water, electricity, heat, and fuel, subject to its stated rules. These are Toronto requirements; the retrieved city page states no publication year for the 21°C figure.
New South Wales Failure of gas, electricity, or water supply and failure of essential hot water or heating are listed as urgent repairs. The minimum standards also address adequate plumbing and drainage, electricity or gas, and hot and cold water. Applies to NSW residential tenancies; tenants are told to notify the landlord or agent straight away.
New York City Tenants reporting withheld heat or hot water are directed to HPD through 311. Use the city’s route and rules only for New York City.
Liverpool, England The council advises reporting disrepair quickly, using the landlord’s emergency contact for immediate risks, and providing evidence such as photos, videos, and messages when reporting to the council. Local council guidance for Liverpool.
