What workers can do when a construction site shuts down or wages go unpaid

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a construction site closes and your employer still owes you money, preserve your records, identify which pay period is delinquent, and contact the correct labor agency. A shutdown by itself does not show whether you were laid off, fired, or temporarily sent home, and it does not determine which wage law applies. Federal, state, local, contract, and worker-classification rules can all change the answer.

For possible violations of federal minimum-wage or overtime law, the U.S. Department of Labor (DOL) Wage and Hour Division (WHD) accepts complaints at 1-866-487-9243. Its complaint and investigation services are free. If the regular payday for your last pay period has passed, contact WHD and your state labor department rather than waiting for the site to reopen.

Start with the facts: a closed site and unpaid wages are separate questions

A project can stop for many reasons: the owner may suspend work, a general contractor may replace a subcontractor, weather or permitting may delay the job, or the employer may have run out of money. None of those facts alone establishes that employment ended or that wages were legally withheld. Keep communicating in writing and ask when, where, and by whom you are expected to report.

Analyze the pay problem separately. Determine the exact dates and hours you worked, the date you were supposed to be paid, and whether the missing amount is regular wages, overtime, a promised rate, or a contract wage. Federal law covers minimum wage, overtime, and recordkeeping for covered employees; state and local laws may provide more protection. The DOL’s Construction Industry Compliance Assistance Toolkit explains that coverage depends on the employment relationship and applicable law, not simply on a “contractor” label or the fact that the work occurred on a construction site.

What to do in the first day

  1. Build a payment timeline. Write down every date worked, start and finish time, meal break, job title or trade, hourly or piece rate, amount received, and date each payment arrived. Note the normal payday and the first missed payday.
  2. Identify every business involved. Record the worksite address, your direct employer, general contractor, subcontractor, staffing company, and payroll contact. Save names, phone numbers, emails, and license or invoice information shown on paperwork.
  3. Preserve evidence outside the worksite. Photograph or download schedules, time sheets, pay stubs, checks, bank deposits, texts, emails, safety or closure notices, and any message telling you not to return. Keep copies in personal storage, not only on a company device.
  4. Ask a focused written question. Send a text or email asking whether the closure is temporary, whether you remain employed, where to report, and when outstanding wages will be paid. Keep the response; do not argue about legal conclusions in the first message.
  5. Check the regular payday. Federal law generally does not require an immediate final paycheck. If the employer’s regular payday for the final pay period has passed, the DOL says to contact WHD or the state labor department. State deadlines can be earlier or otherwise different.

WHD specifically advises workers to keep their own daily records when employer records are incomplete. Its complaint instructions describe the information an investigator needs and explain how to submit a concern.

Choose the agency that can address your claim

Where to start Issues it can address Timing and cost Contact
U.S. DOL Wage and Hour Division (WHD) Possible federal minimum-wage, overtime, recordkeeping, and covered federal-contract wage violations Federal FLSA claims generally have a two-year limitation period, or three years for a willful violation. Complaints and investigations are free. 1-866-487-9243
State labor department State minimum wage, overtime, wage-payment, final-paycheck, and other state-law claims Deadlines and final-pay rules vary by state; a state rule may be more protective than federal law. Find the labor office for the state where the work occurred; DOL’s worker resources page lists federal guidance.

You may be able to contact both agencies. A federal complaint does not automatically resolve a separate state-law claim, and a state agency may have authority over a final-pay or wage-payment rule that the FLSA does not cover. Because your state is not identified here, do not assume a universal final-pay date or state filing deadline.

How to report unpaid construction wages to WHD

Prepare the information

Before calling, assemble your timeline and copies of available records. Include the employer’s legal or operating name, address, phone number, the worksite and its address, the dates you worked, hours and breaks, rate promised, amounts paid, and the dates and amounts of missing payments. Tell WHD if you worked for a subcontractor and identify the general contractor or project owner when known.

File and protect your confidentiality

Call 1-866-487-9243 or use the process on the How to File a Complaint page. WHD says complaints are generally confidential, subject to limited exceptions. Give the investigator a reliable way to reach you and update the agency if your address or phone changes.

Understand what the federal claim covers

The federal minimum wage is $7.25 per hour, but a higher state or local minimum wage can control. Overtime under the FLSA generally concerns covered work over 40 hours in a workweek. Construction workers are generally not within the Part 541 white-collar exemptions, according to Fact Sheet 17P, but the agency still must determine coverage, the employment relationship, and the hours and pay involved.

Do not wait for an investigation to begin before preserving evidence. WHD states that the FLSA limitation period is generally two years for non-willful violations and three years for willful violations, and it encourages prompt filing so an investigation can occur before time expires.

When a final paycheck is missing

Federal law generally does not mandate immediate payment when employment ends. The relevant federal trigger in the DOL’s Last Paycheck guidance is that the regular payday for the final pay period has passed without payment. At that point, contact WHD and the state labor department. State law may require payment sooner, impose a waiting-time remedy, or set a different rule for a discharge, resignation, or job abandonment.

A closed site does not itself prove that you were terminated. Ask the employer in writing whether you are laid off, transferred, scheduled for another project, or still expected to report. Keep working-time records through the last day you actually performed work; do not claim hours you did not work merely because the project was closed.

Check for Davis-Bacon coverage on federally funded construction

Some federal or federally assisted construction contracts are covered by the Davis-Bacon and Related Acts (DBRA). Coverage depends on the contract and project, not simply on the word “construction.” On a covered project, the applicable prevailing-wage determination and the worker’s classification matter. Contractors generally must pay covered laborers and mechanics weekly.

Question Why it matters
Is the project a covered federal or federally assisted contract? DBRA requirements apply only when the statute and contract cover the project.
Which wage determination and classification apply? The required prevailing wage can differ by locality, trade, and classification.
Were wages paid weekly? Covered contractors generally must pay laborers and mechanics weekly.
What can enforcement do? WHD can investigate and seek withholding of sufficient federal contract funds; specified violations can lead to contract termination or debarment.

Ask WHD whether the project is covered and provide the project name, funding agency, contract information, and your classification if you have them. The agency’s construction worker protections FAQ and Fact Sheet #66 explain the complaint and enforcement framework. Do not assume every public-looking or large project is a Davis-Bacon job.

If the shutdown involved a safety hazard

Wage recovery and workplace safety are different tracks. If the site closed because of an immediate danger, a structural problem, chemical exposure, or another hazard, obtain hazard-specific guidance from OSHA or the applicable state-plan agency. The DOL’s Resources for Workers page points to worker resources, but the facts here do not establish whether a worker may refuse a particular assignment or what action is lawful in a specific emergency.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Document the notice, the hazard description, who gave the instruction, and when you reported it. Do not enter a dangerous area merely to retrieve records; ask the employer how records and personal tools will be returned safely.

Protect yourself from retaliation

Save any threat, reduction in hours, discipline, blacklisting statement, or discharge that follows a wage complaint or an inquiry about pay. Record the date, speaker, witnesses, exact words, and any schedule or payroll change. WHD says covered laws prohibit retaliation for protected activity. Tell the investigator that a retaliation event occurred and ask which agency or process should receive that part of the claim.

Continue to communicate professionally and keep copies of every message. Do not secretly record conversations unless you know the recording rule where you are; written follow-up such as “This confirms you told me not to report on Tuesday” creates a safer record.

Common situations and the next move

The site closed, but the regular payday has not arrived

Keep your hours and ask in writing when payroll will run. A closure is not proof of nonpayment until the applicable payday passes, but preserving records now prevents a later dispute.

The regular payday passed and nothing was paid

Call WHD, contact the state labor department, and submit the timeline and records. Identify whether the missing amount includes overtime, a promised rate, or a final paycheck so the agency can route the issue correctly.

A concise recordkeeping checklist

  • Employer, subcontractor, general-contractor, and worksite names and contact details.
  • Worksite address and project name.
  • Every work date, start and finish time, meal break, and total hours.
  • Promised rate, pay received, payment dates, and missing amount.
  • Schedules, time sheets, pay stubs, checks, bank records, texts, emails, and closure notices.
  • Date the regular payday passed and any explanation the employer gave.
  • Any threat, discipline, schedule cut, or discharge after you raised the pay issue.

Keep the original files and a separate backup. Give copies to an agency and retain the originals for your own records.

What a realistic outcome looks like

An agency may investigate, seek unpaid federally required wages and overtime, and address retaliation or covered contract violations. It cannot turn every business dispute into a federal wage case. A state agency may be the better route for a state final-pay rule or a higher state minimum wage. If the project was DBRA-covered, WHD may pursue withheld contract funds and other statutory remedies. The result depends on coverage, classification, records, the employer’s response, and the law in the state where you worked.

The safest course is to act promptly, document the work and missed pay precisely, contact both potentially relevant labor agencies, and keep the shutdown, wage, safety, and retaliation issues clearly separated.
