What to Know About Builder Warranties and New-Home Defects

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A builder warranty is a written, limited promise about specified construction components—not a guarantee that every problem in a new home will be repaired. Coverage, deadlines, exclusions, and dispute procedures come from the signed warranty and related purchase documents, while state and local law can add requirements. The most important practical step is to report a suspected covered defect in writing before the applicable period expires and keep a dated record of everything that follows.

Builder warranty and home warranty: two different products

A builder warranty normally accompanies a newly built or substantially remodeled home. It addresses permanent construction components such as concrete floors, plumbing, electrical work, exterior finishes, and other items identified in the warranty. The builder, a third-party warranty company, or both may handle the obligations.

A separately purchased “home warranty” is generally a service contract. It commonly concerns repairs or replacement of household systems and appliances in exchange for a contract price and a service fee or deductible. It is optional, costs extra, and may overlap with a builder warranty or a manufacturer’s warranty. Buying one does not automatically make an existing defect covered, and a service contract does not replace reading the builder’s documents.

What new-home builder warranties commonly cover

The Federal Trade Commission (FTC) describes limited coverage for workmanship and materials on specified components. Its examples are useful for orientation, but they are not a promise about your home. The signed warranty controls.

Component or problem category Common example in FTC guidance What to verify in your documents
Workmanship and materials One year for many components, including siding, stucco, doors, trim, drywall, and paint The exact definition of a defect, the start date, exclusions, and whether a component has a shorter or longer period
Heating, ventilation, and air-conditioning systems Two years, generally Which parts are included, whether labor is included, and whether a manufacturer handles some claims
Plumbing and electrical systems Two years, generally Whether the warranty covers the whole system or only installation workmanship and specified parts
Major structural defects Some builders offer coverage for up to 10 years The warranty’s structural-defect definition, engineering requirements, exclusions, and claim deadline

These periods are common examples reported by the FTC in 2021, not universal terms. A warranty may use different periods for different components or measure time from a date other than the day you move in. Find the stated start date and the expiration date for each category.

Read the warranty before you need it

Keep the signed warranty with the purchase agreement, construction specifications, change orders, inspection reports, and any closing documents. Identify these provisions while the documents are easy to obtain:

  • Covered components and defect definitions: Determine whether the language addresses defective materials, defective installation, failure to perform, or only specified conditions.
  • Start date and duration: Record the applicable period for each component rather than relying on a single “one-year warranty” description.
  • Exclusions: The FTC notes that household appliances and components covered by a manufacturer’s warranty are typically excluded from builder warranties. Some small cracks may also be excluded.
  • Notice method: Check whether the warranty requires an online portal, a particular form, certified mail, or notice to a warranty company instead of the builder.
  • Repair standard and remedies: Look for language describing the builder’s opportunity to inspect and repair, replacement options, or limits on damages.
  • Dispute procedure: Find any mediation or arbitration clause, filing deadline, fee schedule, and rule on whether a decision is binding.

Do not assume that a builder’s verbal assurance changes the written warranty. Ask for important commitments in writing and save the response.

Defects worth reporting

A defect can be visible, intermittent, or discovered only when a system is used. Examples that may fall within a written warranty—depending on its language—include leaking plumbing, electrical installation problems, HVAC performance issues, failed doors or windows, damaged finishes, or a structural condition that meets the warranty’s definition. The key question is not whether a problem is inconvenient; it is whether the condition matches a covered component and defect definition during the applicable period.

Separate ordinary operation from a potential warranty issue. A paint scuff caused after closing, routine wear, or a product covered by a manufacturer’s warranty may be treated differently from defective installation. If you are uncertain, report the condition and ask the warranty administrator to identify the applicable exclusion in writing.

How to make a builder-warranty claim

Use a consistent written process so you can prove what happened and when. A phone call can alert the builder, but it should not be your only notice when the warranty requires written communication.

  1. Locate the controlling documents. Gather the signed builder warranty, purchase and construction documents, closing statement, and any separate manufacturer warranties. Note the coverage period for the affected component.
  2. Describe one defect at a time. State the location, symptoms, dates observed, frequency, and any immediate safety concern. Explain what happens when the system is operated, without speculating about the legal cause.
  3. Attach supporting evidence. Include clear photographs, videos when an issue is intermittent, inspection findings, invoices, and relevant plans or specifications. Keep the originals.
  4. Send notice using the required method. Follow the warranty’s instructions exactly. The FTC identifies certified mail with a return receipt as one way to document delivery when mail is permitted. If an online portal is required, save the confirmation screen or email.
  5. Request a written response and inspection date. Ask the builder or warranty company to confirm receipt, identify the assigned representative, and state the next step. Do not discard damaged material before an inspection unless it creates a safety hazard.
  6. Track every interaction. Maintain a chronological log with the date, person contacted, promises made, photographs exchanged, inspection results, and repair dates.
  7. Review the completed repair. Compare the result with the original symptom and the warranty’s repair standard. Report incomplete or recurring problems promptly, referencing the original claim number.

Build a defect file that can survive a dispute

Create a folder—digital or paper—with a copy of every document and a simple index. Include:

  • The signed warranty and all amendments, specifications, and change orders.
  • A defect list organized by room or system, with the date first noticed and whether the condition is worsening.
  • Photos that show both the close-up problem and its location in the room or exterior.
  • Written notices, delivery confirmations, portal receipts, emails, letters, and responses.
  • Inspection reports, contractor estimates, repair invoices, and permits when applicable.
  • Notes of conversations, including names, dates, and the exact commitment made.

If moisture is suspected, a pinless moisture meter can document readings as an optional tool. A reading does not diagnose the source of moisture or establish warranty coverage; preserve the surrounding photographs and professional findings as well.

Deadlines: why the governing date is not always obvious

The warranty may measure time from substantial completion, the certificate of occupancy, closing, possession, or another event. Different components can have different expiration dates. A notice deadline, a repair deadline, and a legal limitation period are separate concepts, and the available period can depend on your state, financing program, home type, contract, and the facts of the defect.

General FTC examples cannot establish the deadline for your claim. Mark every component’s end date on a calendar and submit written notice early enough to satisfy the contract. State-specific deadlines and legal remedies require jurisdiction-specific advice; do not assume that a warranty extension, a builder’s inspection, or an attempted repair automatically preserves every legal claim.

When the builder does not fix the problem

Many new-home warranties require a staged process. The first stage may be an inspection and opportunity to repair. If the parties disagree about coverage or repair quality, the warranty may require mediation before arbitration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Mediation

A neutral facilitator helps the homeowner and builder or warranty company explore a settlement. The mediator does not normally impose a decision, so an agreement depends on both sides. Check whether the warranty sets a filing fee, time limit, or required pre-mediation notice.

Arbitration

Arbitration places the dispute before a neutral decision-maker under the rules named in the contract. The FTC cautions that arbitration can cost up to several thousand dollars depending on complexity. Review who pays filing, hearing, inspection, and expert fees; whether the decision is binding; and whether you must complete mediation first. For claims against a third-party warranty company on an FHA- or VA-financed home, FTC guidance describes a choice between court and arbitration; selecting arbitration binds the homeowner to the decision.

Preparing for either process

  • Organize the defect file in date order and label each photograph.
  • Separate structural allegations from finish or system complaints.
  • List the correction requested and the builder’s response to each item.
  • Bring the contract clause that defines coverage and the clause that governs the dispute.
  • Get advice from a qualified professional in your jurisdiction before signing a release or accepting a settlement.

The FTC also notes that out-of-pocket costs such as temporary lodging during a major repair are usually not covered. Do not incur substantial expense assuming reimbursement; ask for the written basis for any payment or denial.

Manufactured homes use a different federal process

HUD’s Manufactured Home Dispute Resolution Program concerns manufactured homes and is not a general builder-warranty program for site-built houses. Under the federal process, a homeowner generally must report an alleged defect to the manufacturer, retailer, installer, HUD, or the State Administrative Agency within one year after the home’s first installation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

HUD encourages a dated report, such as email, fax, or certified mail. The program has its own eligibility rules and does not replace the terms of a manufacturer, retailer, installer, or state warranty. Do not apply the manufactured-home installation deadline to an ordinary site-built home.

HUD Form HUD-92556 asks for a detailed list of construction defects, supporting documentation, efforts to obtain correction, separate identification of structural defects, and the date the builder or warranty company was first notified in writing. Its instruction states: “List, in detail, the construction defects in the property. Include any documentation supporting the claim.”

Should you buy an additional home service contract?

Compare the service contract with coverage you already have before paying. A useful comparison should include:

Question Why it matters
What is the total price and per-service fee or deductible? A low annual price can be offset by repeated service charges.
What systems, appliances, parts, and labor are covered? A contract may cover only part of a product or exclude the failed component.
Are there caps, exclusions, or pre-existing-condition provisions? Limits can leave you paying for the most expensive portion of a repair.
Who chooses the technician and how are claims handled? Restricted networks or authorization steps can delay repairs.
Can you cancel, and what refund applies? Cancellation terms determine whether unused coverage is recoverable.
Does the builder or manufacturer already cover the item? Overlapping coverage may add cost without adding a practical remedy.

The FTC warns that service contracts can make repairs difficult to obtain and are not automatically worthwhile. Read the exclusions and claims procedure before signing, especially for a newly completed home.

A practical move-in and warranty checklist

  • Obtain the final, signed warranty and record each component’s start and end date.
  • Photograph finishes, equipment labels, utility areas, drainage, and accessible structural elements at move-in.
  • Keep the builder’s contact information, warranty-company contact information, and manufacturer warranties together.
  • Report suspected defects in writing and preserve delivery proof.
  • Maintain a dated log until each repair is verified.
  • Read mediation and arbitration terms before a disagreement escalates.
  • For a manufactured home, determine whether the federal dispute program applies and calculate the one-year installation-based reporting period.
  • Obtain jurisdiction-specific legal advice when a deadline, release, major structural issue, or substantial repair cost is involved.

What homeowners should take away

Builder warranties are limited, component-specific contracts. The FTC’s one-year, two-year, and up-to-10-year examples illustrate how coverage is often structured, but only your executed documents establish what is covered and for how long. A timely written notice, detailed evidence, and a complete communication log protect your position. Treat a paid home service contract as a separate product, and use the distinct HUD process only when the home and defect qualify under manufactured-home rules.
