If sidewalk work blocks your driveway, first document the obstruction, then ask the crew or project contact when vehicle access will return and what temporary arrangement is available. If you cannot get a clear answer, contact the city or county department responsible for public works, transportation, street use, or permits. The applicable permit and project rules depend on your location; there is no nationwide notice period or guarantee of uninterrupted driveway access established here.
What to do first
- Record the conditions. Note your address, the date and time, how long access has been blocked, any posted notices, the contractor or crew name, and any permit or project number. When it is safe, photograph the obstruction and posted work information. Do not step into an excavation or cross construction barriers to take pictures. If the work happens in stages, note which part of the driveway or sidewalk is affected and whether access changes between work periods. Those details can help the agency compare what is happening with the schedule or access plan.
- Ask for the access plan. Speak with the crew or use the project contact on a notice. Ask when vehicle access is expected to resume and whether a safe temporary crossing or alternate arrangement can be provided. If the crew cannot answer, ask who is managing the project and how to reach them. Be specific about when you need access and whether the plan applies overnight as well as during active work. Ask how residents will be told if the schedule changes. Do not attempt to drive across an excavation or move barriers yourself.
- Contact the local agency if the issue remains unresolved. Start with the city or county public-works, transportation, street-use, or permitting department. Provide the address and any project or permit details, and ask the agency to identify the responsible contact and confirm the approved work period and access arrangements. If you are unsure which department is responsible, ask the first office you reach to direct you to the permit or project contact.
- Report unsafe pedestrian routing separately. If the sidewalk is closed, the detour is inaccessible, or pedestrians are being directed into an unsafe route, notify the project contact or local agency promptly. Ask what accessible pedestrian route is approved. Do not assume that resolving vehicle access also resolves pedestrian safety.
- Keep a follow-up record. Save notices, photos, messages, complaint or reference numbers, and responses. If construction damages private property or causes a specific loss, ask the agency what local process applies; the guidance covered here does not establish a general compensation remedy. A written record of when access was blocked, what you were told, and any later changes can make follow-up clearer.
Can a contractor legally block driveway access?
There is no single answer for every driveway. Local governments regulate work in public streets and sidewalks through permits, right-of-way rules, and project conditions, but the examples available from different cities do not establish a nationwide right to uninterrupted access or a universal maximum closure period. Whether a particular closure is allowed depends on the location, permit, approved work schedule, and project-specific requirements.
As an Amazon Associate I earn from qualifying purchases.
For example, New York City says sidewalk construction generally requires a permit, and Raleigh requires a permit to occupy the public right-of-way. Boston describes permits that can restrict access to part of a street or sidewalk for a specified period. Those examples show why it is useful to identify the permit and issuing agency; they do not determine the rules for a project elsewhere. New York City sidewalk guidance, Boston street permitting, and Raleigh right-of-way permits.
If the blockage is expected to last weeks, including the month-and-a-half scenario some residents ask about, duration alone does not settle legality. Ask the agency to confirm the approved work period and whether the permit or project plan addresses driveway access, notice, or alternate access. A long closure can be disruptive and still require review under local rules; the sources here do not support a legal conclusion without the specific jurisdiction and project documents.

In practical terms, separate three questions: whether the work has local authorization, whether the schedule and restrictions match that authorization, and what access arrangement the project provides while work is underway. A posted notice or a verbal estimate may help identify the project, but neither by itself answers all three. Ask the responsible agency to clarify the applicable conditions rather than relying on another city’s rules or an informal assumption about what contractors may do.
Why the permit and project plan matter
Sidewalk construction commonly requires permission to work in or occupy public space, but the type of permit and its conditions vary. A permit may identify the responsible contractor, work area, approved hours, restrictions, traffic-control arrangements, or ways to contact the agency. Ask which permit or project authorization covers the work and how to inspect or confirm its conditions.
Notice and temporary-access requirements are also local. A Carson City contractor notice document calls for advance contact when work restricts access or blocks a driveway or sidewalk, urges alternate access where possible, and says access should be restored during non-working hours. A Torrance specification excerpt sets its own advance-notice and temporary-driveway-access requirements. These are examples of local project requirements, not rules that apply across the country. Carson City standard details and specifications and Torrance specification excerpt.

If the project is divided into phases, ask which phase affects your driveway and whether the expected access arrangement changes from one phase to the next.
Do not read the Carson City or Torrance examples as a guaranteed notice window for your own address. Some local specifications, including those from Carson City and Torrance, address advance notice and access; they do not show that every municipality uses the same number of days, restores access at the same times, or offers the same alternative. Your own permit, project documents, and local rules are the relevant sources to check.

Questions to ask the crew or project contact
- What is the project or permit number, and which agency issued it?
- When is the driveway expected to be blocked, and when is vehicle access expected to return?
- Will access be restored outside active working hours, or is the driveway expected to remain unavailable overnight?
- Is there a safe temporary crossing, alternate entrance, or other arrangement for residents?
- Who should residents contact if the schedule changes or the proposed arrangement is not safe?
- What pedestrian route is available while the sidewalk is closed, and is it accessible?
Write down the answers and the name or role of the person who provided them. If the work has already begun, ask for the current plan and the next expected update rather than assuming a posted completion date guarantees driveway access on that day. If an alternative is mentioned, clarify what it means in practice: when it is available, who can use it, and whether it is a vehicle-access arrangement or a pedestrian route. These are separate issues.
How to escalate a blocked driveway
Find the responsible local department
Use the city or county’s public-works, transportation, street-use, or permitting department as a starting point. Explain that sidewalk work is blocking vehicle access to a specific address. Give the project or permit number if one is posted, and ask the department to identify the permit holder or project manager and the approved work period. Boston’s permit information covers permits that restrict street or sidewalk access, while New York City states that sidewalk construction generally requires a permit; these illustrate the role of local permitting agencies, not a single process for every community. Boston street permits and NYC sidewalk information.
Make the report specific and actionable
Include the address, dates and times access was unavailable, the nature of the obstruction, the contractor or crew information, relevant photos, and any prior contact with the project team. State what you need answered: the approved schedule, the access plan, and the appropriate contact for updates. Request a complaint or reference number so you can connect later messages to the same issue.
Keep the report focused on observable facts: where the work is, what access is blocked, when it began, and what the notice or crew said. If the issue is that a promised access time has passed, state the time you were given and when you checked again. This helps distinguish a missed schedule from a general question about future work.
Follow up through the same channel
If the first contact does not resolve the question, reply with the reference number and ask whether the agency has reviewed the permit or contacted the project manager. If a closure continues beyond the schedule you were given, report the changed condition with the date and time. Avoid making assumptions about the contractor’s legal authority based only on a conversation with an individual crew member; ask the responsible agency to clarify the applicable project conditions.

Keep pedestrian access and vehicle access distinct
A blocked driveway is a vehicle-access problem; a closed sidewalk or unsafe detour is a separate pedestrian-access issue. Work-zone paths may need to comply with accessibility requirements. New York City says pedestrian paths around work zones must comply with applicable accessibility laws, including the ADA. Raleigh says sidewalks should remain accessible when possible under relevant requirements, and Alexandria describes protected pedestrian access and a maintenance-of-traffic plan for public-right-of-way work. NYC sidewalk work-zone guidance, Raleigh right-of-way guidance, and Alexandria temporary traffic control guidance.
If the detour is blocked, inaccessible, or puts pedestrians in conflict with traffic or construction activity, report the specific hazard promptly to the project contact or agency. Ask where pedestrians, including people who use mobility devices, are expected to travel. Do not enter the work zone to find a route or improvise a crossing through an excavation.
When reporting this issue, describe the pedestrian route itself, not only the driveway obstruction. For example, explain if the sidewalk is closed and no accessible detour is apparent, or if the route appears to direct people into traffic or through the work area. Ask the project contact to identify the approved route and how it is protected. A temporary vehicle crossing, if one is offered, does not by itself show that the pedestrian detour is safe or accessible.
What to check in the local rules
Because terms vary by permit and jurisdiction, compare the actual project documents rather than borrowing another city’s requirements. The most useful items to verify are:

- Permit and issuing agency: Identify the authorization covering sidewalk or right-of-way work and the department responsible for it.
- Notice: Check whether the local permit or project specification requires advance notice to affected residents and what form it must take.
- Work hours and duration: Confirm approved work periods, expected phases, and any restrictions on how long access may remain blocked.
- Temporary vehicle access: Look for requirements or plans for temporary crossings, alternate access, parking, or restoration of access outside working hours.
- Pedestrian routing: Find the approved detour and how accessibility and protection from traffic are addressed.
- Complaint channel: Record the agency contact and the method for reporting a missed schedule, unsafe condition, or change in the work plan.
These points also provide a useful way to compare two project plans or local guidance documents: check who issued the permit, what notice is required, which hours and duration are allowed, what vehicle alternatives are provided, and how pedestrians are routed. Do not infer one item from another. For example, a permit requirement does not by itself tell you the notice period or whether alternate parking is arranged.
Do not treat a notice period or access requirement from another city as binding where you live. The Carson City and Torrance documents show that local specifications can address advance notice and driveway access, but the controlling terms for your situation are those adopted by your jurisdiction and attached to the relevant project.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What if the work causes damage or a financial loss?
Keep evidence of any damage or specific loss, including photographs, dates, receipts, and correspondence. Then ask the responsible agency which local process applies and whether claims are handled by the city, county, contractor, or another party. The municipal examples here do not establish a general right to compensation, a national claims process, or a result for any particular resident. For a legal assessment of your situation, the governing law and project documents in your location matter.
Do not assume that a disruption automatically qualifies for reimbursement, or that the same office that issued a permit handles claims. Ask which process applies locally and what information is needed. If your concern is only that access is inconvenient or unavailable, keep the access issue and any documented damage or financial loss clearly distinguished when contacting the agency.
Frequently Asked Questions
Can a contractor block my driveway for a month and a half?
There is no universal maximum closure period established by the municipal examples here. The answer depends on your location, the permit, approved schedule, and project conditions. Ask the local agency to confirm the work period and whether the documents address driveway access, notice, or alternate access.

How much notice is required before sidewalk work blocks a driveway?
Notice requirements vary by jurisdiction and project. Carson City and Torrance materials include local examples of advance notice and driveway-access provisions, but they do not establish a nationwide notice period. Check the permit or project specification that applies to your address.
Who should I contact if the crew cannot tell me when access will return?
Contact the city or county public-works, transportation, street-use, or permitting department. Give the address and any posted project or permit number, and ask the agency to identify the project contact and confirm the approved schedule and access arrangement.
What if the sidewalk detour is unsafe or inaccessible?
Report it promptly as a separate pedestrian-safety issue to the project contact or local agency. Describe the route and ask for the approved accessible pedestrian path. Do not enter the work zone or cross barriers to find another route.
Can I claim compensation for a blocked driveway?
The available sources do not establish a general compensation right or a single claims process. If there is property damage or a specific loss, document it and ask the responsible agency which local process applies and who handles it.
The Bottom Line
Document the blockage, ask the crew or project contact for a specific vehicle-access plan, and contact the local permitting or public-works agency if the answer is unclear or the schedule changes. Check the actual permit and project conditions: notice, work hours, temporary access, and accessible pedestrian routing vary by place. A long closure or an example from another city does not, on its own, determine whether your project is allowed or whether compensation is available.
