If roadworks coincide with waterlogging, treat the situation as a safety incident first: keep people away from moving or contaminated water and the work site, then report it through the route that matches the likely source. Photograph the flow and damage from a safe place, record the roadworks details and your report reference, and ask the highway authority to inspect its drainage and identify the works promoter. The timing alone does not prove that construction caused the flooding or establish legal liability.

1. Make the area safe before investigating

Act on immediate danger

If water threatens life, could cause an immediate injury, is entering your home, or makes the road unsafe, use your local authority’s urgent flood or highway reporting route. Kent County Council, for example, publishes separate urgent contacts for situations where flooding presents an immediate risk. Use the instructions for your own council rather than waiting for a routine online form: Kent County Council’s highway drainage guidance.

  • Do not walk or drive through moving water. Depth, current, hidden holes, open chambers and contaminated water may be impossible to judge.
  • Stay out of an active roadworks area, even if barriers have moved or the site appears unattended.
  • Keep children, older people and anyone with mobility difficulties away from the water’s edge.
  • If water is close to electrical equipment, gas appliances or a boiler, avoid contact and use an appropriate emergency service or qualified professional.

Record conditions without putting yourself at risk

From a dry, secure location, note the date and time, recent rainfall, where the water first appeared, its direction of flow, how deep it appears, and whether it is approaching a building. Photograph road signs, barriers, contractor or utility details, nearby gullies and visible damage. Never step into traffic or the work zone to obtain a better image.

2. Decide which organisation should receive the report

In England, the reporting route depends on the apparent water source. If sources overlap or you cannot tell, report the incident to the council and ask which organisation is leading. The national route is set out in GOV.UK’s flood reporting guidance.

What appears to be flooding First report to Information to give
Public road, highway gully or public drain Local council or highway authority Exact road location, nearest address or landmark, water depth or extent, blocked or overflowing gully, and any danger to traffic or buildings
Blocked sewer or burst water main The local water company Street address, visible discharge or smell, manhole or pipe location, time first noticed, and whether sewage or drinking-water infrastructure appears involved
Main river, reservoir or the sea Environment Agency Watercourse or coastal location, direction of flow, level or extent, and immediate risks
Small river, brook or stream Local council Watercourse name or nearest landmark, bank or culvert condition, and whether flow is overtopping or backing up
Private drain serving the property Property owner responsible for that drain Which property or private system is affected, symptoms, and any access or maintenance history

Use the council route for a flooded road even when nearby construction is visible. A council can redirect the case if inspection shows that a sewer, water main, watercourse or private drain is the actual source.

3. Understand what “roadwork” means

GOV.UK distinguishes street works—work by utilities and other undertakers on or under a road—from road works carried out to repair or improve the highway. The distinction helps you identify who may be operating at the location, but it does not by itself prove that the project caused the waterlogging. See the GOV.UK collection on street works and road works.

Possible causes include a blocked or damaged highway drain, a sewer, a burst main, a diverted or obstructed watercourse, groundwater, intense rainfall, a private drainage failure, or several of these together. Water may follow a temporary trench, but it may also be coming from an unrelated asset that failed at the same time.

In England, highway authorities provide and manage highway drainage. Flood-risk authorities also have powers to manage flood risk, but the official guidance describes those powers as permissive: it does not promise that an authority must take action in every flood. The operational lead for surface-water and groundwater flooding is normally the lead local flood authority. The relevant maintenance guidance is GOV.UK’s flood-risk asset maintenance and inspection guidance, published 31 January 2025.

4. Make a report that can be investigated

Include the location and timing

Give the road name, house number or nearest landmark, postcode if known, and the precise point where water is collecting. State when you first noticed it and whether it began during rainfall, after the rain stopped, or while work was taking place. Say whether the water is on the carriageway, pavement, driveway, garden or inside the building.

Describe flow and drainage

  • Direction of flow and where it appears to originate.
  • Whether a gully is covered, blocked, overflowing, damaged or missing.
  • Whether water is coming from a trench, manhole, pipe, slope or watercourse.
  • Whether the water remains after rainfall has ended or returns repeatedly.
  • Any smell, discolouration or indication that sewage or a water main is involved.
  • Whether the water blocks safe passage, threatens a building or creates an ice risk.

Cheshire East Council identifies water at risk of entering a building, standing water that obstructs safe passage, water remaining after rainfall and ice risk as reportable gully or drain conditions. Its process assesses risk and may jet the system when action is needed; response priorities vary by council. The examples are described on its gullies and drains page.

Attach safe evidence and keep the reference

Attach dated photographs or video taken from a safe place. Include a wide view showing the road layout and a closer view of the gully, barrier, sign or flow path. Keep copies of your submission, photographs, emails, call times, names or teams contacted, and every report number. Do not clean away physical evidence before photographing it unless leaving it creates a safety risk.

5. Ask the highway authority to check the road and the works

When you report to the council or highway authority, ask for two linked checks:

  1. Inspection of the highway drainage, gullies, culverts and any visible damage or obstruction.
  2. Identification of the roadworks or street-works promoter, the undertaker responsible for the site, and the appropriate contact for the work.

Give the exact location, the time water began, the work dates or signs you observed, your photographs and any previous report reference. Ask whether the authority can tell you what drainage response it made, whether an inspection occurred, and which organisation is coordinating with the works promoter.

The Department for Transport’s coordination code sets out how local authorities and undertakers coordinate street works. The code was updated on 19 March 2026, with the March code applying from 10 April 2026. It is available at Co-ordinating street works. Coordination rules help establish who is working where and how works should be managed; they do not automatically determine that a contractor or utility is legally liable for your loss.

6. Preserve evidence if water reaches your property

Once everyone is safe, make a simple incident file. Record the first and last time water was present, the highest visible level, rooms or outdoor areas affected, and whether water entered through a door, wall, drain or another route. Photograph marks before cleaning, and retain invoices or receipts for essential cleanup, drying, temporary protection and repairs. Note any changes after the roadworks crew, council or utility altered the site.

Keep the evidence factual. “Water began flowing from the excavation at 18:20” is stronger than stating that the excavation caused all damage. A roadworks-related coincidence does not settle causation. An authority or works promoter may need to compare drainage records, rainfall, previous incidents, site plans and inspection findings.

7. Use temporary protection carefully

Kent County Council directs residents to flood-preparation advice that includes where to request or buy sandbags. Sandbags can be an optional, short-term measure when local advice and the site make them suitable. They are not a guaranteed barrier, do not protect every building, and cannot replace reporting the incident, fixing a drainage fault or leaving an unsafe area. No particular product or brand has been established as universally effective. Follow local instructions about collection, placement and disposal: Kent’s highway drainage information.

Do not block a highway gully, cover a manhole, move barriers or place objects in the carriageway. Those actions can redirect water, create a traffic hazard or interfere with an inspection.

8. If the first report does not resolve the problem

Check whether the source was assigned correctly

Ask the council which asset it inspected and whether it considers the source to be highway drainage, a sewer, a water main, a watercourse, groundwater or private drainage. If the council identifies a water company asset, make a separate report to the water company and retain both references. If it identifies a main river, reservoir or coastal source, use the Environment Agency route. For a small stream or brook, return to the council.

Request information about the response

Lead local flood authorities can investigate flooding. Government investigation guidance also recognises that highway authorities may provide information about highway flooding, drainage response and what they did. Ask for the inspection outcome, relevant drainage or maintenance findings, and the name of the team handling any continuing investigation. The guidance is at Investigating a flood: guidance for lead local flood authorities.

Escalate with a concise chronology

If waterlogging persists, send a dated chronology rather than repeated general complaints: rainfall and first observation, photographs, reports and references, inspections, changes to the works, and ongoing risks. State the outcome you need—such as a drainage inspection, identification of the works promoter, or confirmation of which organisation is investigating. This makes it easier for the receiving team to distinguish a new hazard from a duplicate report.

9. Practical decision examples

Water pours from a blocked road gully during rain

Keep clear of traffic, photograph the overflowing gully from a safe place, and report the flooded road or public drain to the council. Mention any nearby excavation and ask for highway-drainage inspection. If the council finds a sewer connection or burst main, transfer the report to the water company while keeping the council reference.

Clear water rises from a trench after the rain stops

Do not enter the excavation. Report the location and flow to the council and the contact displayed on the works sign, and ask which undertaker is responsible. The timing may justify an inspection, but only the investigation can establish whether the trench, a damaged service or another source is involved.

Foul-smelling water emerges from a manhole

Keep people and pets away and report a suspected blocked sewer to the water company. Also tell the council if the discharge is flooding the public road or creating a traffic hazard. Describe the smell and appearance without touching the water.

A stream overtops beside the road

For a small river, brook or stream, contact the council; for a main river, reservoir or the sea, contact the Environment Agency. Include the watercourse, direction of flow and whether a culvert, bank or road crossing is overtopping. Notify the council as well if the road itself is becoming dangerous.

10. The essential checklist

  • Move people away from moving, contaminated or electrically hazardous water and from the work site.
  • Use the urgent local-authority route when there is an immediate risk to life, a building or road safety.
  • Photograph and describe the flow, drainage points, works signs, rainfall and damage from a safe location.
  • Report according to source: council for flooded roads and public drains; water company for blocked sewers and burst mains; Environment Agency for main rivers, reservoirs and the sea; council for small watercourses; property owner for private drains.
  • Ask the highway authority to inspect drainage and identify the works promoter.
  • Keep report numbers, contacts, dated images and cleanup or repair records.
  • Use sandbags only as a locally appropriate temporary measure, never as a substitute for reporting or evacuation.
  • Do not assume that simultaneous roadworks prove causation or liability; request an evidence-based inspection or investigation.
