Do not assume that a failed house-ownership application ends your land claim or automatically means demolition. In Vietnam, the first step is to obtain the written refusal, identify whether it concerns the house, the land-use right, or both, and ask the local authority to assess those rights separately. Article 148 of the 2024 Land Law provides different documentation routes for houses, including older buildings and cases involving a required permit. Under a procedure in Decree 151/2025, some owners who lack a specified construction-authority confirmation issued before July 1, 2025, must declare that the house meets the conditions to remain. That declaration is reviewed with the rest of the file; it is not automatic approval or legalization.
Start with the written refusal, not the phrase “no permit”
A verbal explanation such as “the house has no construction permit” is not enough to determine your legal options. Request the written refusal, deficiency notice, or decision from the office handling the registration. Record the legal article cited, the property address, the application number, and whether the authority rejected:

- ownership certification for the house;
- certification of the land-use right;
- both rights in one application; or
- a document or condition that the authority says is missing.
The country, province, and commune or ward matter. The official Vietnamese ministry answer that most closely matches this scenario was issued on October 11, 2026, about a house built without a permit in 2013. It expressly answered only as a matter of principle because no case file was supplied. That means it cannot decide whether your house required a permit when and where it was built, whether the parcel qualifies, or whether a local correction or review procedure is available.
Ask the authority to state whether the problem is the building, the parcel, or both. A refusal to record house ownership is not the same legal result as a refusal to recognize land-use rights.

Separate the land-use right from house ownership
Vietnamese registration treats the land-use right and ownership of an attached house as related but distinct matters. The Ministry of Agriculture and Environment states that where a parcel satisfies the conditions for a Certificate but the house does not yet satisfy the conditions for ownership certification, the Certificate may be issued for the land-use right without certifying house ownership. The ministry’s Vietnamese wording is:
“Trường hợp thửa đất đủ điều kiện cấp Giấy chứng nhận nhưng nhà ở chưa đủ điều kiện chứng nhận quyền sở hữu thì cấp Giấy chứng nhận đối với quyền sử dụng đất mà chưa chứng nhận quyền sở hữu nhà ở.”

This is a possible route, not a guaranteed outcome. The land must independently meet the applicable requirements, and the authority must still examine matters such as the origin of the land, documents supporting the right, planning, disputes, and any statutory exclusion. Ask for a separate written assessment of the land application if the house is the only stated obstacle. If the house later meets the requirements, you can apply to register the attached asset rather than reopening the land question from the beginning.
How Article 148 of the 2024 Land Law affects an unpermitted house
Article 148 of Law No. 31/2024/QH15 does not create one blanket rule that every house without a permit must be rejected. It sets different documentary routes according to the building’s history and the documents available. The route can depend on whether a construction permit was legally required, when the house was built, whether it falls within provisions for older houses, and what ownership or transfer papers exist.
First determine whether a permit was required
“No permit” can describe several different situations: a permit was not required for that type of work; a permit was required but never obtained; a permit existed but cannot now be located; or the house was altered beyond the approved scope. The authority must apply the rule that was in force for the location and date of construction. Do not present a missing permit as proof that the construction was unlawful, and do not treat a permit exemption as proof that the house qualifies for certification.

Older-house provisions may use different evidence
Article 148 includes a route for certain older houses. Evidence of the house’s construction date, lawful origin, current condition, and ownership history can therefore matter as much as a permit. A house built in 2013, for example, cannot be assessed solely by asking whether a current permit can be produced; the authority must identify the applicable historical and current requirements for that property.
Houses for which a permit was required
Where a permit was required, the documentation route may call for confirmation that the house is eligible to continue existing, together with other evidence required by the law. The exact confirmation and the authority competent to issue or verify it should be stated in the written notice. Supplying a declaration or other document does not remove the need to satisfy planning, land, ownership, safety, and other legal conditions.
The post-July 1, 2025 declaration procedure
Decree 151/2025/NĐ-CP, dated June 12, 2025, contains a procedure relevant to a described category of cases in which the owner does not have the specified confirmation from the construction-management authority issued before July 1, 2025. For that category, responsibility for declaring that the house meets the conditions for continued existence rests with the owner.
The practical meaning is limited but important:
- You must make the declaration required by the local procedure and make it truthfully.
- You should retain evidence supporting the stated construction date, present condition, ownership, planning status, and any permit or approval history.
- The registration authority still reviews the declaration against the property and the other legal requirements.
- A declaration is not a promise that the Certificate will be issued and is not an automatic legalization of construction.
Ask the local office whether your file falls within this category, which form or wording it requires, and which supporting documents must accompany it. Do not substitute an informal letter for the prescribed declaration, and do not sign a statement that ignores a known planning conflict, dispute, prohibited location, or material alteration.

Check the refusal against Article 151 exclusions
Even when the land documents and house history appear complete, Article 151 of the 2024 Land Law lists circumstances in which a Certificate may not be issued. The ministry materials identify, among other issues, construction after a prohibition and construction inconsistent with approved planning, subject to the exact statutory exceptions. Your notice may rely on a different ground, such as a dispute, an unresolved ownership transfer, or an inability to establish the land-use right.
For each ground in the notice, ask four focused questions:

- What exact fact did the authority find: the date of construction, the location, the planning status, the ownership chain, or something else?
- Which article, implementing rule, or local administrative instruction is being applied?
- Is the defect curable through a supplemental document, correction, survey, or separate land application?
- If it is not curable, is there an administrative review or other local procedure, and what filing period applies under the notice?
Do not infer a remedy from a general statement that the house is “illegal.” The consequence depends on the specific statutory ground and the facts established in the file.
Three routes that should not be confused
Use the following comparison to identify what decision you are actually seeking:
| Route | What is decided | Key questions | Possible next step |
|---|---|---|---|
| House and land together | The Certificate records the qualifying land-use right and eligible house ownership. | Does the house meet the Article 148 route for its age, permit category, documents, planning status, and condition? | Supply the required evidence or declaration and request a written reassessment. |
| Land-use right only | The Certificate records the parcel but does not certify ownership of the house. | Does the parcel independently satisfy land requirements even though the house does not? | Ask for the land decision separately; apply later to register the house if it becomes eligible. |
| Construction-law enforcement | A competent authority considers a violation, corrective measure, penalty, or demolition under construction and administrative-violation law. | Has a separate enforcement notice been issued, and what legal fact does it allege? | Obtain the written basis promptly and seek local legal advice on the response. |
These routes can occur at different times. A registration refusal does not itself order demolition. Conversely, a separate enforcement proceeding may continue even if you obtain a land-use Certificate.
Documents and facts to assemble before refiling
Organize one file for the land and another for the house, while keeping documents that connect them. Include:
- land-use-right certificates, allocation or lease decisions, sale or transfer instruments, inheritance records, tax or payment records, and cadastral information;
- house ownership, purchase, transfer, inheritance, renovation, or completion documents;
- any construction permit, exemption, approved drawing, acceptance record, or correspondence with the construction authority;
- evidence of the house’s construction date, such as dated contracts, utility records, older photographs, tax records, or other reliable contemporaneous material;
- current photographs, measurements, and a description of additions or changes;
- planning information, boundary surveys, and documents showing whether the parcel or building is affected by a prohibited area or approved-plan conflict;
- records of disputes, complaints, mortgages, inheritance claims, or other competing rights; and
- the complete application, deficiency notices, refusal, and any appointment or receipt issued by the authority.
Do not alter, backdate, or selectively omit documents. Inconsistent dates or descriptions can create a separate credibility problem and make it harder to determine which legal route applies.
Step-by-step response after a refusal
- Get the decision in writing. Request the signed refusal or deficiency notice and the legal reason, not only an oral explanation.
- Classify the rejected right. Mark whether the notice concerns house ownership, land-use rights, or both.
- Confirm jurisdiction. Identify the responsible province and commune or ward office and ask which current local procedure handles the application.
- Build the chronology. Record land acquisition, construction, alterations, transfers, disputes, and every filing date.
- Ask which Article 148 route applies. Specifically ask whether the house is treated as an older house, a permitted or permit-exempt building, or a building for which a continued-existence confirmation or declaration is required.
- Check the Decree 151 category. If you lack the specified construction-authority confirmation issued before July 1, 2025, ask whether the owner declaration procedure applies and obtain the required form.
- File a truthful, supported declaration if required. Attach evidence for the construction date, current condition, planning status, and ownership; keep a stamped copy or electronic receipt.
- Request separate land consideration. If the house is ineligible, ask whether the land-use right can be certified without recording the house.
- Address curable defects. If the notice identifies a missing document, survey, correction, or clarification, submit it through the stated channel and keep proof of delivery.
- Escalate fact-specific issues. If the notice alleges prohibited construction, a planning conflict, a dispute, a penalty, or demolition, have a Vietnam land-registration or construction lawyer review the file and the applicable local response procedure.
Does a failed certification application mean demolition?
No. The ministry distinguishes registration from construction-law enforcement. Whether a violation occurred, whether a corrective measure is available, and whether demolition is ordered are matters for the competent authority under construction and administrative-violation law. A registration office’s refusal to certify house ownership is not, by itself, a demolition order.

If you receive a separate inspection record, penalty decision, remedial order, or demolition notice, read its deadline and stated legal basis immediately. Respond through the procedure named in that document and obtain local advice before making structural changes or signing an admission. Do not assume that a pending registration application pauses enforcement; the documents must be read together.
What the official guidance can—and cannot—decide
The ministry’s October 11, 2026 answer supports two practical conclusions: an unpermitted house cannot be assessed by a single automatic rule, and land-use rights may sometimes be certified separately from house ownership. It does not establish that a particular 2013 house, or any other house, qualifies. Qualification still turns on the actual parcel, construction date, permit requirement, planning, condition, ownership evidence, disputes, and the legal ground stated by the local authority.
Use the written notice to convert a general refusal into a defined question: which right failed, under which article, on which fact, and what document or procedure could change the result. That is the information needed for a lawful re-filing, a separate land application, or a response to enforcement.
Frequently Asked Questions
Can I apply for the land-use Certificate if the house-ownership part was refused?
Ask the authority to decide the two rights separately. Vietnam’s ministry guidance says land-use rights may be certified without recording house ownership when the parcel independently meets the applicable conditions.
Does signing the continued-existence declaration legalize the house?
No. For the relevant Decree 151/2025 category, the owner’s declaration supplies a required statement for review. The authority must still examine the property and all other legal requirements.
What if the refusal only says “no permit” and cites no article?
Request a signed notice identifying the legal ground, the rejected right, and any missing document. Without that information, you cannot tell whether the issue is permit status, planning, ownership, or another Article 151 exclusion.
Is a 2013 unpermitted house automatically covered by the older-house route?
No. Construction date is one factor. The authority must determine the applicable Article 148 route, the permit requirement at that location and time, current condition, planning status, and ownership evidence.
Should I treat a registration refusal as a demolition notice?
No. Demolition or other corrective action requires a separate decision by the competent authority under construction and administrative-violation law. Read and respond to any enforcement document independently.
