Treat the notice as a deadline-driven enforcement matter: identify the issuing authority and exact allegation, stop any work covered by a stop-work direction, confirm what correction or review is required, and obtain local technical help when plans, safety, concealed work, or occupancy are involved. The correct remedy depends on the property’s jurisdiction and the notice itself.
Start with the notice, not assumptions
“Unauthorized construction” is not one universal legal category. A municipality may be alleging work without a building permit, construction that conflicts with planning permission, a building-regulation breach, unsafe conditions, unauthorized occupancy, or a violation of a specific stop-work order. Each can have a different process, deadline, inspection requirement, and appeal right.

- which work or condition is alleged to be unauthorized;
- whether the issue concerns a permit, planning approval, building regulations, safety, occupancy, or several of these;
- what work must stop immediately;
- which documents, revised drawings, fees, inspections, or remedial measures are required;
- whether concealed work must be opened for inspection; and
- how to request a meeting, correction review, variance, or appeal.
Record the name, role, date, and substance of each conversation. Follow up important answers by email so the file contains a written record.
Observe a stop-work direction
If the notice or a posted order says work must stop, do not continue the covered activity unless the order or the authority expressly permits a limited action, such as making the site safe. Continuing can create a separate violation and weaken a later appeal or permit application. Ask whether temporary weatherproofing, shoring, security, or emergency safety work is allowed and obtain that permission in writing.

Protect people and the evidence
Keep occupants, workers, and visitors away from unsafe areas. Do not remove structural members, close walls, pour concrete, bury services, or otherwise conceal work that an inspector may need to see. Photograph existing conditions with dates, preserve plans, invoices, contracts, inspection reports, and correspondence, and keep a log of work already performed. If there is an immediate risk of collapse, fire, electrical danger, gas release, or flooding, call the appropriate emergency service and then notify the enforcing authority.
Identify exactly what kind of approval is missing
Building permit or building-regulation approval
A permit system generally controls technical construction work such as structural changes, additions, alterations, electrical or mechanical installations, and changes that affect life safety. The authority may require drawings, calculations, specifications, licensed professional involvement, inspections, and correction of work that cannot be shown to comply.
Planning or land-use permission
Planning rules address whether the development is allowed at that location and in that form: for example, use, height, setbacks, exterior appearance, or site coverage. A building permit does not automatically cure a planning breach, and planning approval does not replace technical building approval. Ask the authority which approval track applies before commissioning drawings or paying fees.

Safety, occupancy, or use restrictions
An enforcement file can focus on danger or unlawful use rather than paperwork alone. The authority may require evacuation, prohibit occupancy, limit a particular area, or demand immediate protective measures. Do not move people back into a flagged space until the responsible authority confirms that occupancy is allowed and identifies any conditions.

Work contrary to an existing approval
Even where a permit was issued, construction can be flagged if the built result differs from approved drawings or conditions. Compare the notice with the stamped plans and inspection record. The remedy may be revised plans, a new approval, removal of non-compliant work, or a formal amendment rather than a first-time permit.
Choose a response path with the authority
Most cases involve one or more of three paths. They are not mutually exclusive: you may correct a condition while seeking approval for the remaining work, or appeal a factual error while preparing a compliant alternative.
1. Correct or remove the violation
This route is appropriate when the work clearly cannot be approved, when the authority requires restoration, or when safety demands immediate remedial work. Obtain a written scope from the authority before demolition or reconstruction. Ask what inspection must occur before each stage is covered and how completion will be documented.
2. Seek the required approval or revised plans
Ask whether the jurisdiction accepts an application for work already undertaken, an as-built submission, a regularization or completion certificate, a revised permit, or another corrective approval. Availability, fees, documentation, and inspection requirements vary; an authority’s willingness to review an application is not a promise that the work will be approved. Be prepared for plans that show existing conditions, calculations for structural elements, photographs, product information, and opening-up of concealed work.

3. Request review or appeal
Use the procedure named on the notice if you dispute the facts, the legal basis, the person responsible, or the required remedy. File in the specified form, with the required fee and supporting documents, before the deadline. State precisely which finding you challenge and attach evidence such as approved plans, dated photographs, inspection records, surveys, or proof that the cited work belongs to another project.
Do not assume that filing an appeal automatically lets construction continue. The effect depends on the jurisdiction and notice type. Confirm in writing whether the order remains operative while review is pending.
What to prepare for an approval or correction review
A well-organized submission helps the authority decide what exists and what must change. Assemble:
- a measured site plan and floor plans showing the current condition;
- approved drawings, permit cards, planning decisions, and inspection records, if any;
- a chronological construction account identifying who did what and when;
- structural calculations and details where load-bearing work was altered;
- specifications and certificates for fire, energy, electrical, plumbing, mechanical, and accessibility systems as applicable;
- dated photographs, including images taken before areas were enclosed;
- contracts, invoices, and contractor or designer details; and
- a proposed correction schedule that separates urgent safety work from later finishing work.
Never alter records to make the project appear permitted. Explain uncertainties, identify concealed elements that cannot be verified, and ask the authority what investigative opening or testing it requires.
Jurisdiction examples: why the notice controls
Official guidance illustrates how different the procedure can be. These examples are jurisdiction-specific and do not set a general rule for another property.

| Jurisdiction | What the official guidance establishes | Timing or effect |
|---|---|---|
| Seattle | The Department of Construction and Inspections may issue a stop-work order for construction started without a permit and may impose fines or other enforcement. The city’s response guidance describes correction periods and escalation for unresolved violations. | Notices of violation usually allow 30 to 60 days to correct, according to Seattle guidance. Unresolved violations can lead to fines, closure, and required evacuation. |
| North Carolina | Under G.S. 160D-404, a stop-work order must identify the work or activity to stop, state the reasons, and specify conditions for resuming. The statute provides remedies to restrain, correct, or abate a development violation and, in specified circumstances, prevent occupancy. | Covered work may not continue in violation of the order while an appeal is pending. The statute’s requirements apply to its North Carolina setting. |
| England | For specified building-regulation breaches, official guidance provides appeals against compliance notices and stop notices. | An appeal must be made within 21 days. A compliance notice is suspended on appeal; a stop notice is not suspended merely because an appeal was lodged, although an applicant may seek a direction suspending it. |
The Seattle periods and the England 21-day period are examples, not universal deadlines. The controlling date is the one in your notice and governing local rules.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Can you get a permit after construction?
Sometimes an authority will accept an after-the-fact or regularization route; sometimes it will require removal, redesign, or a different approval. There is no reliable cross-jurisdictional entitlement to legalize completed work. Seattle’s public guidance confirms that unpermitted work can trigger enforcement but does not establish a universal process by which every completed project can be approved later.
Ask the authority these specific questions:
- Is an application for existing or completed work available for this type of project?
- Must a licensed architect, engineer, surveyor, or other qualified professional prepare the submission?
- What parts of the work must be exposed, tested, or opened before inspection?
- Are separate planning, fire, accessibility, environmental, electrical, or utility approvals required?
- What fees, penalties, or bonds apply, and when are they due?
- What happens if the work fails inspection?
- May the building or affected area be occupied while the application is reviewed?
Obtain written answers before spending money on remedial construction. An application does not itself authorize continued work or occupancy unless the authority says so.

When to hire local professional help
Choose assistance that matches the problem and local licensing rules. An architect or building designer can document existing conditions and prepare revised plans. A structural engineer is appropriate when walls, beams, foundations, roofs, or other load-bearing elements changed, or when concealed work cannot be verified safely. A code consultant can coordinate multiple technical requirements. A permit expediter can organize submissions and agency appointments where that service is recognized locally. A lawyer experienced in local planning or construction enforcement can assess an appeal, ownership liability, or litigation risk.
Ask any professional to define the scope in writing: site visit, measurements, calculations, drawings, agency meetings, inspection attendance, appeal drafting, and construction oversight are separate services. Verify credentials, insurance, and authority to practice in the property’s jurisdiction.
Common mistakes that make an enforcement case worse
- Ignoring the notice because the work is already complete.
- Assuming a contractor’s statement that “no permit was needed” resolves the owner’s responsibility.
- Continuing work after a stop-work direction or treating an appeal as automatic permission.
- Covering concealed work before the authority has inspected it.
- Applying for a permit without disclosing existing construction or submitting drawings that do not match the site.
- Confusing planning permission with building-regulation or technical approval.
- Allowing occupancy before the authority confirms that it is lawful and safe.
- Missing a deadline while waiting for a contractor, consultant, insurer, or lender.
A practical sequence from notice to resolution
- Day one: scan and preserve the notice, identify the issuer and deadline, and stop covered work.
- Next contact: call or email the authority, confirm the case file, and request the required correction, inspection, and review steps in writing.
- Site assessment: secure hazards, photograph conditions, and avoid concealing or disturbing evidence.
- Technical review: engage the appropriate local professional if the work is structural, concealed, technically complex, or disputed.
- Decision: select correction, an available approval route, an appeal, or a combination, based on the authority’s written requirements and the notice deadline.
- Submission and inspections: provide truthful drawings and records, pay stated fees, expose work when directed, and attend every required inspection.
- Closeout: obtain written confirmation that the violation is corrected, the order is lifted, and occupancy or use is permitted before treating the case as finished.
What to ask before you sign or build anything else
Before authorizing further construction, make sure you can answer: Which authority controls the matter? What exact condition must change? Is work currently prohibited? What approval or appeal deadline applies? Which inspections and professionals are required? Can anyone occupy the building? What document will prove closure? If any answer is unclear, pause and obtain clarification from the issuing authority rather than relying on a generic online checklist.
