When a home build, addition, or renovation falls behind or the price rises, do not rely on verbal promises or react by abruptly stopping payment. First preserve the contract and project records, then require a written explanation, updated schedule, and itemized cost-to-complete. Compare every requested extension or increase with the signed agreement and change orders, verify completed work before progress payments, and escalate through the correct local building or consumer process if the problem is not resolved.
The contract and the law where the property is located determine what you can require. Rules described for New South Wales, Victoria, California, Utah, and Florida are examples of different systems, not one nationwide rule.

1. Stabilize the situation before making a decision
Protect the property and your position while you establish the facts. If exposed wiring, unstable structures, water intrusion, gas work, or other immediate hazards are present, keep people away from the area and contact the appropriate licensed professional or emergency service. Safety takes priority over a payment dispute.
Do not lock out the contractor, hire a replacement, terminate the agreement, or withhold every payment solely because the project is late. Those actions can trigger damages, additional costs, lien exposure, or a claim that you breached the contract. Obtain local advice before taking a step that cannot easily be reversed.

Create one project record
Make a single digital and paper folder containing:
- The executed contract and every attachment, including plans, specifications, allowances, provisional sums, permits, and the promised completion date.
- All signed change orders, emails, text messages, meeting notes, invoices, receipts, payment confirmations, inspection reports, and warranty documents.
- A payment ledger showing the amount billed, amount paid, date, claimed milestone, and any disputed balance.
- Dated photographs and video of work in progress, stored with the original files and captions identifying the location and date.
Build a timeline of agreed milestones, actual completion dates, missed dates, requests for additional money, owner decisions, and your responses. Preserve original messages and invoices rather than editing them. Consumer Affairs Victoria recommends retaining relevant documents, conversation records, and photographs when a building dispute arises; the same discipline makes any jurisdictional process easier to understand.
2. Demand a written status and recovery plan
Send a calm, specific email and keep a copy. Ask for facts rather than an assurance that the project is “nearly finished.” Request:

For each requested increase, please provide the affected scope, quantity, invoice or estimate, and the revised total price. I will review the documents and respond in writing.
This is practical correspondence, not a statutory notice. A local regulator or lawyer can tell you whether a formal notice, prescribed form, or deadline applies.
3. Read the signed contract before accepting an extension or increase
California’s Contractors State License Board gives a useful baseline: “A contract should contain everything agreed upon by you and your licensed contractor.” Locate the provisions that answer these questions before you approve anything:

| Contract issue | What to locate | Question to ask |
|---|---|---|
| Price structure | Fixed price, cost-plus, allowances, provisional sums, taxes, and exclusions | Is the requested amount already covered, an allowance adjustment, or genuinely additional work? |
| Scope | Plans, specifications, inclusions, brands or performance requirements | Does the claimed extra change the agreed scope or correct an existing obligation? |
| Delay | Excusable events, owner-caused delay, notice procedure, extension calculation, liquidated damages | Was notice given on time, and does the stated event qualify under this clause? |
| Changes | Who may authorize a variation, required form, pricing method, and schedule effect | Is there a signed change order rather than an informal conversation? |
| Payments | Milestones, retainage or holdback, invoices, inspection rights, and dispute procedure | Is the claimed milestone complete and compliant? |
| Completion and termination | Practical completion, cure notice, termination grounds, notice method, and replacement-work rules | What notice and opportunity to cure are required before stronger action? |
Ask the contractor to identify the exact clause supporting a time extension or price increase. NSW guidance says to review delay clauses before agreeing to an extension and to check for a clause permitting a price increase. It also notes that, under most contracts, a price cannot be changed unless the work is varied. That is a New South Wales-oriented statement, not a rule to apply automatically elsewhere. A contractor’s general explanation about inflation, shortages, or industry conditions does not by itself prove that a particular increase is contractually allowed.
4. Put every change to scope, price, or time in writing
Before non-emergency work starts, require a change order that states:
- The added, removed, or substituted work and the affected drawing or specification.
- Materials, quantities, labor, taxes, allowances, credits, and the exact price adjustment.
- The effect on each milestone and the revised completion date.
- Any effect on warranty, energy performance, appearance, permits, or maintenance.
- Payment timing and signatures or other acceptance required by the contract.
Utah’s sample construction contract calls for a written description and written estimate of cost and time impact before non-emergency change work proceeds. California CSLB advises recording changes to scope, materials, equipment, or completion date in a written change order. Victoria describes local statutory variation requirements that, in applicable cases, involve written agreement and a new price or completion date. Those examples illustrate the value of written documentation; they do not create a single rule for every location.
If an urgent repair is needed to prevent injury or serious property damage, document the emergency, authorize only the necessary work, and request the price and schedule effect as soon as practicable. Do not sign a blank or open-ended authorization.
5. Verify work before making progress payments
Follow the payment schedule in the signed agreement. Before paying an invoice, walk through the claimed milestone and compare it with the plans and specifications. Record incomplete, defective, or inaccessible work in writing and ask what amount is undisputed.

- Match quantities and approved changes with the invoice and your payment ledger.
- Request underlying invoices or receipts when the contract or applicable law permits.
- Keep proof of payment and note any reservation of rights in your written response.
NSW guidance says progress payments should follow the contract and be made only after the work is complete. Consumer Affairs Victoria advises checking completion and compliance before each progress payment and warns against paying in advance; it notes that advance payments may not be covered by home warranty insurance. If you believe an invoice is wrong, obtain local advice before withholding money: a payment default can lead to interest, suspension, termination claims, or lien action depending on the jurisdiction.
6. Choose an escalation route deliberately
Give the contractor a written opportunity to respond by a reasonable date. Keep the message factual and attach the relevant contract page, photos, schedule, or invoice rather than sending a long accusation. If direct discussion fails, choose the process that fits the problem.
| Route | Best suited to | Trade-offs to check |
|---|---|---|
| Independent inspection or building consultant | Unclear completion, suspected defects, disputed quantities, or a need for an objective scope assessment | Cost, report quality, licensing, and whether the report will be accepted in a later process |
| Regulator or consumer agency | Licensing concerns, required notices, misconduct, or information about local remedies | Eligibility, jurisdiction, evidence requirements, and whether the agency can order money or only investigate |
| Mediation or building dispute service | A disagreement where both sides may still negotiate a schedule, price, or rectification plan | Fees, attendance requirements, confidentiality, and whether an agreement is enforceable |
| Tribunal or court | A claim requiring a binding order, damages, debt recovery, or enforcement of a settlement | Filing limits, legal costs, evidence, service rules, and limitation periods |
NSW directs unresolved residential building disputes to Building Commission NSW and describes possible rectification orders for specified work. Victoria has its own building dispute-resolution pathway. Agency names, forms, eligibility, and remedies can change, and starting a complaint may not pause a contractual or statutory deadline. Use the building or consumer regulator for the property’s location as your anchor.

Termination and replacement contractors
Termination clauses often require a particular notice, a cure period, and an opportunity to correct the breach. NSW guidance warns that termination is available only in limited circumstances and that a builder may seek damages or expenses if a homeowner terminates improperly. Utah’s sample contract demonstrates a notice-and-cure approach, but it is a Utah example, not a universal procedure. Before engaging a replacement contractor, obtain advice on notice, access, storage of materials, measurement of incomplete work, and responsibility for extra cost.

Liens and unpaid project participants
In Florida, The Florida Bar explains that unpaid contractors, subcontractors, suppliers, and laborers may have lien rights. Other jurisdictions use different statutes, deadlines, notices, and release documents. A payment dispute with your contractor can therefore affect parties you did not hire directly. Ask local counsel or the relevant authority how to verify lien filings, obtain releases, and protect title before making a final payment or refinancing.

Contractor disappearance or insolvency
If the contractor stops responding, abandons the site, or appears insolvent, preserve every notice, invoice, payment record, photograph, and unfinished-work estimate. Contact the local regulator and your home warranty or construction insurer promptly. Policies may have notice and claim deadlines, and coverage for advance payments or unfinished work varies by location and policy wording. Secure the property without destroying evidence, and get advice before disposing of materials or allowing another contractor to alter defective work.
8. A jurisdiction-aware checklist
Use this as a sequence, then verify the local rules that apply to your address:
- Collect the signed agreement, plans, specifications, permits, schedule, change orders, invoices, receipts, and payment ledger.
- Create a dated timeline and photograph completed, incomplete, and damaged work.
- Request the cause of each delay, updated milestones, recovery options, and an itemized cost-to-complete in writing.
- Identify the contract clause or signed variation supporting every extension or increase.
- Reject informal substitutions or added work until price, quality, warranty, permit, and schedule effects are written down.
- Inspect each payment milestone and pay only as the contract and applicable law require.
- Set a written response date, then contact the local regulator, mediation service, tribunal, insurer, inspector, or lawyer as appropriate.
- Before withholding payment, terminating, replacing the contractor, or making a large final payment, obtain advice on local deadlines, lien rights, and notice requirements.
What the available evidence can—and cannot—tell you
There is no current, directly comparable statistic establishing what share of homeowners experience a delay or over-budget outcome. Figures displayed on an NSW information page and attributed to older ABS March 2022 material and a Procore builder survey provide historical materials-cost context; they are not current individual-project outcome rates and cannot predict your case. Your signed documents, dated records, and local rules are more useful than a national-sounding percentage.

1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteThe practical standard for a fair resolution
A workable resolution identifies the remaining scope, a credible completion sequence, the contractual basis for each cost, and a payment plan tied to verified work. If the contractor can substantiate the event and the change in writing, you can negotiate knowingly. If the explanation, records, or workmanship do not support the request, your organized file gives a regulator, mediator, inspector, or court a clear factual starting point.
