If road construction damages your driveway, retaining wall, lawn, trees, drainage, or other private property, document the condition immediately, identify who controls the road, and submit a formal property-damage claim through that entity’s current procedure. A project phone call or service complaint may not count as a legal claim, and the contractor, government agency, utility, or insurer responsible can vary by road and project.
Preserve the evidence before making permanent repairs, obtain written repair estimates, and check the exact filing deadline for your location. The examples below show why you must follow local instructions rather than assume that a state transportation department, contractor, or city handles every construction-related loss.

Make the area safe without disturbing evidence
If the damage creates an immediate danger—such as an open excavation, exposed utility, unstable driveway edge, blocked access, or flooding—stay out of the work zone and contact the road authority or emergency service appropriate to the hazard. Take photographs only from a safe location. Do not move barriers, enter an active work area, or confront a crew while machinery is operating.
Photograph and record what changed
Take wide photographs showing the property in relation to the road, project limits, signs, and traffic controls. Add close images of cracks, settlement, tire ruts, broken curbs, damaged irrigation, uprooted plants, soil contamination, drainage changes, or other specific conditions. Record:

Who controls the road and project?
Start with the agency named on project signs, then verify which government or private entity owns or controls that particular road. A state transportation department may not handle a city street, county highway, subdivision road, or utility excavation. Minnesota’s Department of Transportation (MnDOT), for example, says it is not responsible for damage on city streets, county highways, or county roads and directs claimants to the local government instead.
Call the city, county, or state public-works or transportation office and ask for:
- the road owner or controlling authority;
- the project manager and project number;
- the prime contractor and any utility involved;
- the formal property-damage claim form and submission address; and
- the inspection, repair, or restoration contact.
If an agency says the contractor or insurer must handle the matter, ask for that direction in writing and save the name, telephone number, email address, and date of the conversation. A contractor’s field representative may be useful for arranging an inspection, but that conversation does not necessarily satisfy the government’s formal claim requirement.

Notify the project and file through the official process
Send a factual written notice
Write to the responsible authority and the project contact as soon as practical. State what happened without guessing about legal liability. Identify the location, dates, construction activity, observed damage, and requested next step. Attach photographs and ask whether the contractor will inspect or restore the property. Keep a complete copy of your submission and every response, including delivery confirmations.
Connecticut’s construction manual describes forwarding property-damage claims and notifying a contractor and insurer when damage is within project limits. Its January 2022 procedures request the claimant’s identity and contact information, the date and time, precise location, account of the cause, and description of the property damage. Verify the current Connecticut process before relying on that manual, because procedures can change.
Do these 3 things before closing this tab:

A call, email to a district office, or routine service request may alert the agency but still fail to meet a tort-claim or property-damage filing rule. MnDOT expressly distinguishes communication with a district office from filing its tort claim form and supporting materials. Follow the current form and instructions for the entity that controls the road, even if a project representative has already inspected the site.
Build a repair-cost file
Request written estimates before repairing whenever the condition can safely remain. Ask contractors to describe the work, materials, quantities, labor, access issues, and whether the estimate covers restoration to the prior condition. If emergency work is necessary to prevent injury or further property loss, photograph the condition first and keep the emergency contractor’s explanation, itemized invoice, proof of payment, and receipts for temporary measures.

MnDOT identifies an itemized paid invoice or two written estimates as supporting material for its tort-claim process. That is a Minnesota example, not a universal requirement. Other jurisdictions may request different documentation, and an agency may inspect before authorizing work. Do not assume that an estimate guarantees reimbursement or that a contractor’s verbal promise to repair is approval to proceed.
What should your report or claim contain?
Use the local form first. A well-organized packet commonly includes:
- your name, mailing address, telephone number, and email;
- the property address and precise location of the damaged feature;
- the date and time of the incident or discovery and the construction activity observed;
- a concise chronology, separating what you saw from what you infer;
- project, contractor, utility, or sign information;
- dated photographs and, where useful, a simple marked site map;
- written estimates, paid itemized invoices, receipts, and proof of emergency expenses;
- prior-condition evidence such as dated photographs or landscaping records;
- copies of notices, emails, letters, and inspection notes; and
- the remedy requested: inspection, repair, restoration, or review of a monetary claim.
Describe damage precisely. “Landscaping damaged” is less useful than “four mature shrubs removed in the temporary easement, two sprinkler heads broken, and soil compacted along the 18-foot frontage.” Avoid inflating values or attributing fault you cannot establish; inaccurate statements can undermine a legitimate claim.
Who may pay or perform the repair?
Responsibility depends on the road, contract, cause, and applicable law. Potential parties include:

| Possible contact | When it may be relevant | What to request |
|---|---|---|
| City or county | Local road, sidewalk, drainage, or public-works project | Controlling agency, claim form, project manager, and inspection route |
| State transportation department | State-controlled highway or state project limits | State tort-claim or property-damage procedure and deadline |
| Prime contractor | Construction operations, staging, access, or restoration within project limits | Written inspection appointment and contractor/insurer contact |
| Utility company | Utility excavation or work by a utility crew or its contractor | Damage report, repair plan, and formal claim channel |
| Insurer | Agency or contractor directs claims to a liability carrier | Claim number, adjuster, required documents, and inspection terms |
Contract language can require a contractor to protect adjacent property without automatically deciding an individual homeowner’s right to payment. Connecticut’s January 2025 standard specifications require contractors to protect adjacent property and facilities from damaging or disruptive effects of project operations. That is a contract obligation; it is not, by itself, a determination that a particular homeowner will recover money.

Check the current official claim page immediately. Do not rely on the date a crew visits, the date you call, or the date an employee says the matter was “reported.” The following official examples illustrate variation; they are not interchangeable rules:
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →| Jurisdiction and source | Published period | Scope stated by the agency |
|---|---|---|
| Rhode Island Department of Transportation | 60 days | Construction-zone claims on state roads must be submitted within this period; the page does not make it a nationwide rule. |
| Indiana Department of Transportation | 270 days | Indiana law gives this period to file a Notice of Tort Claim for property damage against the state. |
| City of Boston | 30 days | Most road or sidewalk defect claims must reach the City within this period; other negligence-based claims can have different timing. |
| New York City Department of Transportation | 90 days | Claims for damage allegedly done by the City should be filed with the Comptroller within this period. |
These periods concern different jurisdictions and claim categories. They do not establish a universal deadline for damage to a private driveway or landscaping. The applicable time limit may depend on the responsible entity, notice requirements, governmental-immunity rules, contract terms, and whether the claim concerns a construction operation, a road defect, or another event.
Restoration, inspection, and permanent repairs
Ask for restoration before hiring someone, when practical
Ask whether the project contractor will inspect and restore the driveway, lawn, trees, irrigation, drainage, fence, or other feature. Keep the property in its damaged condition long enough for a reasonable inspection when safety allows. Request a written scope, schedule, materials, and warranty for any proposed work. If the project offers restoration rather than cash, compare the scope with your documented pre-construction condition.
Repair hazards and access problems carefully
You do not have to leave a dangerous condition untouched. Stabilize an unsafe edge, cover an exposed line, or arrange temporary access when necessary, but document the original condition first and preserve receipts. Tell the agency what emergency action you took and why. Permanent replacement before inspection can make causation or the amount of loss harder to evaluate.
Common failure points and how to avoid them
- Sending the claim to the wrong agency: verify road control instead of assuming the state DOT owns every major route.
- Relying on a phone call: submit the required form and keep proof of delivery.
- Waiting for the project to end: damage can worsen and a short notice period may expire while work continues.
- Entering the work zone: gather evidence from a safe location and request an escorted inspection.
- Repairing without documentation: photograph first and retain estimates, invoices, and receipts.
- Assuming a contractor’s promise is payment approval: obtain the inspection and repair commitment in writing.
- Using a deadline from another city or state: confirm the current rule for your exact road and claim type.
A practical decision path
- Today: protect people, photograph the condition, record dates and locations, and save project notices.
- Next: identify the controlling road authority and project manager; ask who receives formal property-damage claims.
- Promptly: send written notice, request an inspection, and obtain the official form and deadline.
- Before permanent work: collect written estimates and preserve the site unless emergency mitigation is required.
- File completely: submit the form, evidence, estimates or invoices, and correspondence through the specified channel.
- Track the matter: keep confirmation numbers, inspection dates, adjuster details, and copies of every communication.
- Escalate based on the written response: if the agency denies responsibility, identifies another entity, or misses an agreed inspection, request the reason and next appeal or claim contact in writing.
What a claim can—and cannot—promise
A claim asks an agency, contractor, or insurer to investigate and assess responsibility and loss. It is not a guarantee of payment, replacement at your preferred specification, or acceptance of the cause you allege. The cited government procedures describe review and supporting evidence; they do not promise compensation in every case. Keep documenting the condition and comply with the exact local instructions while the matter is evaluated.
