What to Do When a Home Remodel Runs Over Budget or Falls Behind Schedule

Pause before approving more money, collect the signed contract and every project record, then compare the claimed increase or delay with the written scope and change-order rules. Ask the contractor for an itemized explanation and a dated recovery plan in writing. If the facts cannot be reconciled, escalate through your state or local consumer-protection office and obtain advice from a construction lawyer in your jurisdiction before stopping payment, terminating the contract, or hiring someone else. Your contract and local law—not a universal rule—determine the remedy.

Start with a pause and a complete record

Do not agree on the spot to a large extra payment or sign an amendment you have not read. A rushed signature can make it harder to determine which work was originally promised and which costs were added later. Ask for time to review the request and continue documenting the project.

Build the project file

Keep one digital and one physical copy of the documents, with dates whenever possible. Include:

  • The signed contract, original estimate and specifications.
  • Payment schedule, receipts, canceled checks, card statements and financing documents.
  • Every signed change order, invoice, allowance and material-selection record.
  • Emails, text messages and letters. After a phone call, send a short written recap of what was discussed.
  • Dated photographs and notes showing site conditions, completed work, defects, deliveries and periods when no work occurred.
  • Permit, inspection and approval records.

The Federal Trade Commission advises keeping notes and copies and confirming phone conversations in writing. Iowa’s consumer guidance also lists receipts, canceled checks, financing papers, screenshots, invoices and signed change orders as useful records. A notebook or digital project planner can help organize this material, but organization does not decide who is legally responsible.

Record what happened while it is fresh

Write a dated timeline: the promised start and completion dates, milestones reached, selections you approved, requests you made, notices of delays, payments made and the contractor’s current explanation. Note who was present and what remains visibly unfinished. This establishes a shared factual baseline; it does not by itself prove that either side breached the contract.

Compare the claim with the written agreement

Separate an approved scope change from an unexplained variance. Read the contract before debating whether an amount or date is “reasonable.” The comparison should cover the original scope, materials and allowances, price, payment milestones, estimated dates and the required change-order process.

Contract point What to compare Question to ask
Scope of work Original inclusions, exclusions and drawings versus work now requested or billed Is this genuinely added work, or was it already promised?
Materials and allowances Specified products or allowance amounts versus selections and invoices Did a homeowner selection exceed an allowance, and was the difference approved?
Price and payments Contract price, amounts paid, invoices and proposed balance Which line creates the increase, and what document authorizes it?
Dates and milestones Estimated start, completion and milestone dates versus actual progress What event moved each date, and does the contract address that event?
Permits and inspections Contract responsibilities and inspection status Is a permit, failed inspection or required correction affecting the schedule?
Change-order procedure Required written form, signatures, pricing method and schedule notice Was the required approval obtained before the extra work began?

Ask the contractor to connect every added cost or delay to one of four evidence-based categories: a homeowner-requested change, a selection above an allowance, an unforeseen site condition, or a material, subcontractor, permit or other project delay. Do not assume a category automatically validates or invalidates the claim; the contract and applicable law control.

Request an itemized accounting and recovery plan

Make the request specific and non-accusatory. The FTC recommends trying to resolve the problem directly before seeking outside help, and written communication gives both sides the same reference point.

You can write:

Please send an itemized accounting of the amount above the current contract, identify the contract clause or signed change order supporting each item, show work completed and payments received, and provide a dated plan for the remaining work.

Require enough detail to make a decision

For the budget, request the original line or allowance, current claimed amount, amount already paid, change-order number and approval date, supporting invoice or quote, and remaining cost. Ask whether tax, permit fees, subcontractor charges or credits for deleted work are included.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For the schedule, request completed tasks, outstanding tasks, dependencies, materials on order, inspections needed, homeowner decisions still pending, responsible party for each dependency and revised milestone dates. If the end date remains uncertain, request a weekly written status update with changes highlighted.

Treat a revised budget or schedule as a proposal to review against the existing agreement, not as an automatic replacement for it. Keep your request and the response in the project file.

Review every change order before approving it

A usable change order identifies the added or removed work, price or pricing method, materials, effect on completion dates and the signatures or approvals required by the contract and local law. Check that credits for deleted work are shown and that the document does not leave blank spaces or undefined allowances.

  • Match the description to plans, specifications and your actual request.
  • Confirm whether the price is fixed, unit-based, time-and-materials or an estimate, and what records will support a final amount.
  • Identify the exact schedule effect rather than accepting “延” or “to be determined” language.
  • Ask what happens if the stated condition is not found or costs less than expected.
  • Do not sign a blank, incomplete or pressured document.

State rules differ. Pennsylvania’s Attorney General describes a state-specific time-and-materials rule requiring written agreement for costs beyond the initial estimate plus 10 percent. That example applies only under Pennsylvania law; it is not a nationwide threshold. Confirm current requirements with the relevant state agency or a qualified local lawyer.

Understand the contract and jurisdiction limits

Iowa example

The Iowa Attorney General recommends that a home-improvement contract spell out scope, materials, price, start and completion dates, cleanup, permits, inspections and the change-order process. Iowa guidance also distinguishes consumer-protection concerns from private disputes that may require legal advice or court action. Use those points as a checklist, not as proof that Iowa rules apply where you live.

New York example

New York guidance says home-improvement contracts should include project specifics, a payment schedule and a timeline. Erie County explains that New York contracts may address whether estimated dates are “of the essence,” which can affect the significance of a missed date. The New York Attorney General and Erie County Division of Consumer Protection materials are state and county-specific; do not treat them as a national standard.

No universal remedy

The available official guidance does not establish a universal average cost overrun, standard delay period, automatic refund or automatic penalty. Whether you may withhold a payment, cancel, demand a particular correction or recover damages depends on the contract, payment status, facts and local law.

Choose a path based on the facts

Situation Practical next step Protect yourself by
Documentation reconciles the increase or delay Negotiate a written revised scope, budget or schedule Listing every change, credit, milestone and approval in the signed document
Some items are supported, others are unclear Approve only documented items, seek clarification on the rest Keeping disputed amounts and unresolved work identified in writing
Contractor is unresponsive or work appears abandoned Send a dated written notice and seek consumer-agency or legal guidance Preserving photos, payment records and the contract before conditions change
Large, complex or high-stakes dispute Consult a local construction or consumer-law attorney Bringing the complete project file and asking about available remedies

Before stopping payments, terminating the agreement, hiring a replacement contractor or allowing another crew to cover defective work, obtain advice specific to your contract and jurisdiction. An action that seems protective can affect notice requirements, warranty claims, lien rights or evidence.

Escalate in a documented sequence

  1. Send a concise written request. State the amount or dates in dispute, attach the relevant contract provision or change order, and set a reasonable date for the contractor to respond.
  2. Hold a focused meeting. Use the written comparison, not memory. Identify which items are agreed, disputed or awaiting documents. Follow up with a recap and list of promised actions.
  3. Use a written recovery agreement when possible. Specify scope, price, payment milestones, completion dates, dependencies, inspection obligations and what happens if a milestone is missed.
  4. Contact the appropriate local or state office if direct resolution fails. The FTC identifies state or local consumer-protection offices and dispute-resolution programs as possible resources. The New York Attorney General also provides a complaint route for that state.
  5. Get local legal advice for serious disputes. Erie County notes that large or complicated projects may warrant an attorney. A lawyer can interpret termination, notice, payment, lien and damages provisions under the law where the property is located.

Government agencies may provide information, mediation or complaint handling, but they do not necessarily decide a private contract dispute or guarantee recovery.

Keep the site safe and preserve evidence

If work has stopped, secure the property against weather, water intrusion and unsafe openings without destroying evidence. Photograph conditions before protective work and keep receipts for emergency measures. Do not conceal defective work or authorize demolition solely to move the project along until you understand how doing so could affect inspection or a claim.

Continue recording deliveries, site visits, inspection results and communications. Keep payment records separate from ordinary household files so you can show exactly what was paid, when and for what stated purpose.

Prevent the same problem on the remaining work

For any revised agreement or future project, insist that the written contract state:

  • Detailed scope, drawings, specifications, exclusions and allowances.
  • Material-selection deadlines and the price effect of substitutions or upgrades.
  • Start, milestone and completion dates, with the contract’s treatment of delays.
  • Payment milestones tied to identifiable completed work rather than paying the full project amount up front.
  • Permit, inspection, cleanup and site-protection responsibilities.
  • How changes are priced, approved and credited, and who may authorize them.
  • Notice procedures for delays, concealed conditions and disputed invoices.
  • Required insurance, licensing and dispute-resolution language where applicable.

Read every clause before signing and keep the final signed version with all attachments. A clear agreement cannot prevent every surprise, but it makes the next decision—approve, renegotiate or escalate—far easier to evaluate.
