If your homebuilder is late or has gone silent, do not begin by cancelling the contract or stopping every payment. First create a dated record, read the contract’s deadlines and notice rules, send one specific written request, and then use the regulator, dispute process, warranty, or completion-protection route that applies where the property is located. Delay rights differ for custom builds and developer-built homes, and a step that is valid in one jurisdiction can put you in breach in another.
What to do in the first 24 to 48 hours
Your immediate objective is to establish facts and preserve options. A builder’s silence is concerning, but it does not by itself prove abandonment, breach, insolvency, or a right to terminate. Work through these steps in order.

Write down the contract date, promised completion milestone, approved or requested extensions, the last date you personally verified work on site, the last message or call from the builder, amounts paid, unpaid progress claims, and every promised update. Add the names and roles of people you contacted. Date each entry and distinguish what you observed from what someone told you.
Take photographs from a safe, lawful location. Do not enter an active site without permission or bypass fencing, personal-protective-equipment rules, or other safety controls. Images should show the overall site and identifiable details such as installed windows, unfinished services, stored materials, or weather protection. Keep the original files so their dates and metadata remain available.

Preserve the complete project file
Save the signed contract, plans, specifications, amendments and variations in one folder. Add invoices, receipts, bank-transfer records, progress claims, emails, texts, letters, call notes, delivery confirmations, extension requests, permits, inspection records, warranty certificates, insurer details, and agency correspondence. A spreadsheet, cloud folder, or paper project log works; no particular purchased logbook is required.
The Federal Trade Commission (FTC) advises new-home owners to keep correspondence and records of communications when pursuing a warranty matter. New South Wales guidance likewise tells owners to retain the initial contract, invoices, and receipts. Those records can be essential whether you later deal with a regulator, insurer, mediator, tribunal, or lawyer.

Read the contract before demanding a remedy
Find the clauses below and copy the relevant wording into your timeline. Contract labels differ, so search for “completion,” “extension of time,” “delay,” “notice,” “progress payment,” “default,” “termination,” “dispute,” “mediation,” “arbitration,” “warranty,” and “insurance.”
| Contract item | What to verify | Why it matters |
|---|---|---|
| Completion date and construction period | Is the date fixed, an estimate, or tied to a starting event? Are practical-completion and handover defined separately? | You need the correct milestone before alleging that it was missed. |
| Extensions of time | Which causes qualify, what evidence is required, and how must the builder request or obtain approval? | An extension may be valid only if the contract’s process was followed. |
| Delay consequences | Look for liquidated damages, delay payments, credits, or exclusions for specified events. | These provisions can affect a claim, but they do not automatically settle a dispute. |
| Formal notices | Identify the notice address, email, delivery method, and any required wording or response period. | A message to a salesperson may not be a legally effective notice. |
| Progress payments | List each stage, the work that must be complete, supporting documents required, and any “as invoiced” language. | Payment timing and evidence can affect both default allegations and insurance cover. |
| Dispute and termination terms | Check cure periods, mediation, arbitration, adjudication, tribunal rights, and replacement-builder procedures. | Skipping a mandatory step can weaken your position or create extra cost. |
| Protection documents | Locate structural or builder warranties, insurer certificates, insolvency cover, and claim deadlines. | A workmanship warranty and a fund that helps complete an abandoned build are different products. |
New South Wales guidance says a missed deadline without an agreed extension may support damages or breach, but also warns that termination is available only in limited circumstances and can expose an owner to a claim for damages and expenses, including lost profit. The UK Consumer Code for New Homes version 5 requires qualifying developers to provide reliable construction-timing information and describes termination for unreasonable delay according to the contract. Those examples are limited to their stated jurisdictions and schemes.
Send one clear written request
After checking the notice clause, send a factual letter or email through the required channel. Keep proof of delivery. State the missed milestone, summarize prior attempts to make contact, and ask for information that can be answered rather than a general promise to call.
Subject: Written request for construction status and revised completion schedule
Our contract dated [date] provides for [milestone/date]. As of [date], [describe the observable status and missed milestone]. I attempted to contact you on [dates and methods].
Please provide by [reasonable response date]:
- the reason for the delay;
- the current status of work and outstanding items;
- a proposed revised schedule with dates;
- details and supporting information for any extension-of-time request; and
- the name of the person responsible for responding.
Please confirm how any proposed variation or payment request relates to the contract. I reserve my rights under the contract and applicable law.
Consumer Affairs Victoria’s building-dispute guidance describes this as its second step: “If you cannot resolve the problem by speaking to the builder directly, send them a letter or email, formally outlining the issue and requesting a response.” That page was updated 30 April 2024. The FTC similarly recommends putting a warranty repair request in writing. A template cannot replace local advice when a large sum, a strict deadline, termination, or a threatened claim is involved.
Handle progress payments carefully
Reconcile every amount paid against the work that was actually completed and the contract stage named on the invoice. In New South Wales, government guidance says to make progress payments as agreed and only after the relevant work has been completed. Where an “as invoiced” clause applies, it advises seeking invoices or receipts that evidence labour and costs.

Do not pay an extra amount merely because the builder demands it, but do not automatically stop a scheduled payment either. Withholding a contractual amount can create a default allegation; paying an unsupported claim can increase your exposure. Ask in writing which milestone supports the claim, what work is complete, and what variation authorizes any changed price. Obtain jurisdiction-specific advice before deviating from the payment schedule.
Keep a separate payment ledger showing the invoice number, date, amount, claimed stage, amount paid, payment date, and your supporting evidence. This makes it easier to identify whether the dispute concerns delay, defective work, an unapproved variation, or a genuine completed milestone.

United States
There is no single federal remedy identified for an ordinary site-built home construction delay. Start with the state consumer-protection office listed through USAGov, then identify the state contractor or building regulator and licensing body. Check the contract’s required mediation, arbitration, or court process, and ask whether a private builder warranty or completion-protection program covers your project.

Manufactured homes can have separate federal and state complaint routes; do not assume a site-built contract procedure applies to a manufactured home. The regulator may accept a business complaint without deciding your private damages claim, so preserve your contract and payment evidence for any parallel legal process.
New South Wales
When direct efforts fail, owners can contact Building Commission NSW about a building dispute. For qualifying work, the process can include a targeted inspection and rectification steps, with some matters proceeding to the NSW Civil and Administrative Tribunal (NCAT). The inspection is directed to the items in dispute rather than a guarantee that every aspect of the project will be examined.
NSW guidance also describes potential Home Building Compensation Fund cover when a builder becomes insolvent, dies, disappears, or has a licence suspended, subject to eligibility and the policy certificate. Notify the insurer in writing promptly if that situation may apply; delay in notifying can affect a claim. Defect warranty periods depend on the contract date and the category of defect, so verify the applicable period rather than relying on a generic number.
Victoria
Consumer Affairs Victoria says homeowners should first try to resolve the issue directly, then formally request a response by letter or email. If the builder still does not respond within a reasonable time, the Building and Plumbing Commission offers a dispute-resolution pathway. Whether a delay is reasonable can depend on whether its cause was beyond the builder’s control and unforeseeable when the contract was made. Keep your timeline, photographs, correspondence, and contract ready for the application.

United Kingdom new homes
The Consumer Code for New Homes version 5 applies to qualifying developers within its scope. It requires reliable information about expected construction timing and addresses termination for an unreasonable delay as defined by the contract. Confirm that the developer and your purchase fall within the code and read the contract’s definition, notice method, and remedy before acting.
Separate a workmanship warranty from completion protection
The FTC explains that “A builder warranty comes with new home construction or a remodel.” Such a warranty generally concerns permanent parts of the new construction and sets out claim procedures. A home warranty is an optional service contract more commonly associated with existing homes. Neither label, by itself, promises to finish an abandoned project or pay every cost caused by delay.
Read the certificate for covered events, exclusions, claim deadlines, required inspections, mediation, arbitration, and limits. The FTC notes that some warranty disputes go to binding arbitration after mediation. Follow the stated process and retain delivery proof. If the builder has disappeared or entered insolvency, look for a separate completion or insolvency policy rather than assuming the workmanship warranty responds.
Decide whether to stay, terminate, or replace the builder
| Option | When it may fit | Risks to resolve first |
|---|---|---|
| Stay with the builder under a written recovery plan | The builder responds, can explain the cause, provides a credible schedule, and remains financially and operationally capable. | Record revised milestones, approved variations, payment evidence, and consequences for another missed date. |
| Use regulator or mediation processes | You need structured communication, an inspection, rectification direction, or a lower-cost dispute step. | Check jurisdiction, eligibility, scope, filing deadlines, and whether the process decides delay damages. |
| Terminate or engage a replacement builder | The contract and local law provide a valid termination path after required notice and cure steps, or insolvency protection directs a takeover. | You may face claims for damages and expenses, duplicate costs, security and permit issues, unfinished-work valuation, and disputes over materials already paid for. |
| Withhold a disputed sum | Only after the contract and local advice support that position. | A payment default can affect termination rights, interest, credit arrangements, or protection coverage. |
Before authorizing another builder to enter, obtain a condition report and an inventory of materials. Confirm who owns stored materials, whether permits and inspections can transfer, how temporary weatherproofing will be handled, and whether your insurer requires notice. Do not treat a replacement quote as proof that the first contract has ended.

- Relying only on phone calls and having no dated written record.
- Agreeing to an extension without checking the contract’s approval and compensation terms.
- Sending a termination email without the required notice, cure period, or delivery method.
- Paying an unsupported progress claim or stopping a contractual payment without advice.
- Entering a site, moving materials, or hiring another firm before documenting condition and ownership.
- Assuming a warranty, regulator, or compensation fund automatically pays for delay or completes the home.
- Waiting to notify an insurer after learning that the builder may be insolvent or unavailable.
When to obtain legal or professional advice
Seek advice promptly if the builder threatens a claim, a payment deadline is imminent, the contract contains arbitration or adjudication language, you are considering termination, the project is financed by a lender, or the builder appears insolvent. A local construction lawyer or qualified consumer adviser can interpret notice deadlines, calculate delay or completion exposure, and coordinate with an insurer or tribunal. Bring the contract, variations, payment ledger, timeline, photographs, and all correspondence so the adviser can work from evidence rather than recollection.

What if the builder took my deposit and disappeared?
Preserve proof of the deposit and contract, document the site, send the formal written request through the contract notice method, and check immediately for insolvency or completion-protection coverage. Report the matter to the relevant state or local regulator and obtain advice before declaring the contract terminated or paying a replacement firm.
Can I sell the property while construction is delayed?
That depends on the contract, title, financing, permits, and disclosure rules where the property is located. Ask your lender and a local property lawyer before listing; a buyer may need complete records of the unfinished works and the builder dispute.

What if weather or material shortages caused the delay?
Check the contract’s extension-of-time clause and the required evidence and notice. The cause may affect whether time is extended, but it does not remove the need for a current schedule or a response to your written request.
Should I contact the police?
A construction delay is ordinarily a contract or consumer dispute, not automatically a criminal matter. Contact law enforcement if you have evidence of a separate crime or an immediate safety threat; use the regulator, insurer, dispute process, or court route for contractual remedies.
