Do not buy land on the strength of a road announcement, broker’s promise or hand-drawn alignment. Before paying a deposit, identify the exact parcel in the official records, match it to the ground, obtain the latest approved road and land-acquisition files, and have a Bangladesh land lawyer and qualified surveyor document the result. A planned road may be real but revised, delayed, or routed outside the plot; a plot outside the acquisition line may still face construction, access or commercial-use restrictions.
Why a planned road changes the due-diligence question
“Near the new highway” can describe several very different situations: the road may be only a proposal; the approved alignment may have moved; part of the plot may be in an acquisition schedule; or the entire plot may remain privately owned but fall within a reserve or control line. Each situation affects usable area, access, construction permission, compensation exposure and price differently.

No national statistic establishes how much land prices rise beside a road, how often a proposed project is completed, or what compensation a particular owner will receive. Treat any forecast of a guaranteed price increase or acquisition payout as a sales claim until the responsible authority confirms the underlying record.
Start with the exact parcel, not the road name
Ask the seller for the complete legal identity of the land. Record each item exactly as it appears in the documents:

- district and upazila;
- mouza and survey name or number;
- khatian number and type of khatian;
- plot (dag) number;
- recorded area, boundaries and the seller’s share;
- every deed in the seller’s title chain;
- mutation records and current land-tax or holding receipts; and
- inheritance papers, powers of attorney, company resolutions or other documents explaining the seller’s authority.
Names, areas, plot identifiers and boundary descriptions must agree across the chain. A tax receipt proves payment, not ownership. A mutation entry is important evidence but does not cure a defective deed, an undisclosed co-owner or a competing claim. A lawyer should search for mortgages, leases, court cases, prior transfers, government interests, unpaid dues and restrictions before you commit money.
Use a written title opinion
Give a Bangladesh land lawyer legible copies of the root deed and every subsequent transfer, khatian and mutation record. Ask the lawyer to state in writing who can sell, what interest is being sold, whether all heirs or co-owners have joined, and which encumbrances or disputes remain unresolved. Require the opinion to identify missing links rather than describing the title as “clear” without explaining the basis.
Match the mouza map to the land on the ground
The DLRS Integrated Online Map Purchase System is the official channel for obtaining mouza maps and land-survey documents. Obtain the relevant map and survey material for the same survey and mouza cited in the deed. The map helps identify and compare the parcel; it does not by itself prove the seller’s title or show the latest road alignment.
Have a surveyor reconcile three things
- Record: Compare the map’s plot number, shape, adjoining plots and recorded area with the deed and khatian.
- Ground: Locate the plot using reliable survey methods, inspect boundary posts and occupation, and identify neighboring possession, ponds, roads, canals and structures.
- Difference: Measure and explain any shortfall, overlap, shifted boundary or access strip. Obtain a signed plan and field notes showing what was measured and when.
Do not assume a fence, concrete marker or broker’s coloured line is an official boundary. If the map, deed and possession conflict, stop the purchase until the lawyer and surveyor explain the conflict and the legally effective correction.
Obtain the approved road records and their current version
Identify the implementing authority first. For a Roads and Highways Department (RHD) project, contact the project office or the RHD office named in the project documents. For another road, use the responsible public agency. Ask for copies or inspection access to:
- the latest approved alignment map and any approved revisions or change orders;
- project approval documents;
- the approved land schedule listing mouza, survey, khatian and plot numbers;
- land-acquisition proposals and correspondence;
- survey, boundary-marking and notice records; and
- the authority’s current statement of whether the parcel is affected, and by how much.
The RHD Citizen’s Charter describes land-acquisition proposals as being processed under the Acquisition and Requisition of Immovable Property Act, 2017 and calls for approved project documents and a land schedule. Use that schedule to check the exact identifiers, not merely the village or road name.

Check the Deputy Commissioner’s acquisition file
Ask the Deputy Commissioner’s office for the parcel-specific file, including any section 4 notice, later notices, case number, hearing or objection record, award status and payment status. Confirm that the notice names the same district, upazila, mouza, survey, khatian and plot shown in your documents. Ask whether an acquisition case was withdrawn, revised, split or still pending.
An alignment can be revised after publicity. A notice or schedule that cannot be tied to your exact plot is not proof that your land will be acquired. Conversely, the absence of a broker’s notice is not proof that no official proceeding exists; check the authority’s file immediately before signing.
Understand survey stakes and entry notices
Under the RHD framework, an empowered person may enter land to inspect, survey, study, mark boundaries and place boundary stakes for an expressway or highway project. Written notice to the owner or occupier must be given at least seven working days in advance. Damage caused by that work is compensable under the Act’s terms.
Survey stakes show that an authorised activity may be occurring; they do not, alone, establish a final acquisition boundary or an award. Photograph stakes and notices, note dates and locations, and request the written notice and project plan. Do not remove or move markers while a dispute is being investigated.
Check reserve lines, control lines and construction limits
The highway legal framework prohibits construction within the highway reserve line. It defines the reserve line as ten metres from the right-of-way unless the government sets a different line by gazette. It also restricts specified construction, markets or commercial use within a government-gazetted control line.
These are not a universal “ten-metre setback” for every road. Ask the authority for the right-of-way width, the gazetted reserve line, any gazetted control line and the specific restrictions for the road and location. Confirm whether a driveway, boundary wall, drainage work, filling, shop, warehouse or subdivision would require permission or be prohibited even if the plot is not acquired.

The RHD legal framework states in Bengali, “মহাসড়কের সংরক্ষণ রেখার মধ্যে কোনো স্থাপনা নির্মাণ করা যাইবে না।” In English: no structure may be built within the highway reserve line. Apply the current gazette and project record, because a different line may have been formally set.
How acquisition and compensation work
The Acquisition and Requisition of Immovable Property Act, 2017 provides notice to interested parties and a process for determining compensation. For market value, the Act refers to comparable properties in the vicinity and their average value during the twelve months before the section 4 notice.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteThe Act provides statutory additional compensation of 200% over market value for acquisition for a government purpose and 300% over market value for acquisition for a private institution. These are provisions applied through the actual proceeding; they are not a guaranteed payout to a buyer. Eligibility, the legally recognised interest, classification of the acquisition, valuation, deductions, objections and payment all depend on the case.
Why a buyer cannot price in a guaranteed award
- The purchase may occur after the relevant notice, or the buyer may not hold the interest recognised in the proceeding.
- Only part of a plot may be acquired, leaving a smaller or less usable remainder.
- The authority may revise or cancel the alignment.
- Comparable-property evidence and the valuation date are tied to the statutory process, not to a broker’s current asking price.
- Co-ownership, inheritance, mortgages or litigation can delay or divide payment.
Ask the Deputy Commissioner’s office for the case and award status, and have your lawyer explain who would be entitled to any payment under a proposed transaction. Never represent a projected award as certain in a resale or loan application.
A practical pre-purchase sequence
- Assemble the seller’s file. Collect deeds, khatians, mutation records, tax or holding receipts, identity documents, inheritance papers, powers of attorney and any site plans. Make a schedule of every inconsistency.
- Commission the map and field check. Obtain the official DLRS mouza map and engage a competent surveyor to locate the plot, check area and boundaries, and map access and neighbouring possession.
- Identify the project authority. Obtain the latest approved alignment, project approval, land schedule and revisions from RHD or the responsible agency.
- Search the Deputy Commissioner’s file. Request section 4 notices, acquisition case records, objections, awards, payment information and any parcel-specific correspondence.
- Inspect restrictions. Confirm right-of-way, reserve line, control line, gazette changes, access points, drainage and construction or commercial-use limits.
- Resolve discrepancies in writing. Have the lawyer and surveyor issue separate written findings on title, boundaries, acquisition exposure, usable area and access.
- Only then negotiate terms. Identify the exact land in the contract and make completion and payment conditional on satisfactory title, survey and acquisition checks.
What to put in the sale agreement
Local counsel should draft the agreement, but the commercial protections should be explicit:
- full district, upazila, mouza, survey, khatian and plot identifiers;
- the area and share being sold, with the attached survey plan;
- the seller’s warranty about undisclosed transfers, liens, litigation, acquisition notices and government restrictions;
- a right to cancel and recover the deposit if the title, map, ground survey or authority search is unsatisfactory;
- an obligation to disclose any new notice or authority communication before completion; and
- clear responsibility for taxes, registration, possession and release of any encumbrance.
A clause saying “near the proposed road” is not a substitute for an authority-confirmed alignment or a measurable access obligation.

Compare two plots without being misled by the road
| Decision factor | What to verify | Why it matters |
|---|---|---|
| Title and encumbrances | Complete deed chain, co-owners, mutation, disputes and liens | A low price does not cure defective or disputed title |
| Alignment certainty | Version and date of the approved map, plus revisions | An announcement or old sketch may no longer reflect the route |
| Acquisition status | Exact plot in the land schedule, notices, case and award status | Exposure and any compensation depend on the actual proceeding |
| Area affected | Surveyed acquired portion and usable remainder | A partial taking can destroy access or development value |
| Access and restrictions | Right-of-way, reserve/control line, driveways, drainage and use limits | Unacquired land may still be difficult or unlawful to develop |
| Boundary certainty | DLRS map matched to field markers and neighbouring possession | Mismatch creates disputes and reduces usable area |
| Price versus legal risk | Price per verified usable area after all checks | Compare real, usable land rather than headline acreage |
Choose the plot with the stronger verified position, not the one with the most exciting road story. Record the document dates and the official answers for every candidate so that a later revision can be detected.
Red flags that should stop payment
- The seller will not provide the root deed, khatian or identity documents.
- Plot numbers differ between the deed, map, mutation and tax receipt without a documented correction.
- The seller relies on a broker’s sketch, a social-media announcement or an unverified “inside” alignment.
- Survey stakes are present but no written notice or project file is produced.
- The claimed area cannot be located on the mouza map or is occupied by someone else.
- An acquisition notice names a neighbouring plot and the seller says that is “close enough.”
- The price assumes compensation or road appreciation that no authority has confirmed.
- You are pressured to pay a non-refundable deposit before the lawyer and surveyor report.
Pause, document the issue and obtain an independent explanation. Do not try to solve a title or boundary conflict by paying more quickly.
Keeping the check current
Road alignments, acquisition files, gazettes and land records can change. Recheck the authority records immediately before registration and again if completion is delayed. The Ministry of Land’s land-acquisition page, last updated 1 May 2025, lists implementation instructions and checklist resources for the 2017 Act; request the applicable forms, notices and file status directly rather than relying on an intermediary’s verbal assurance.
This guidance is national-level information, not a title opinion or confirmation of any particular road. Without a district, road name, project, mouza, khatian and plot number, no project alignment or acquisition status can be determined. A local lawyer and surveyor must convert the document review and field survey into advice for the specific transaction.

Buy only after the exact parcel, title chain, DLRS map, ground boundaries, latest approved alignment, acquisition file and reserve/control-line restrictions have been checked in writing. A road plan can create opportunity, but until the official records and professionals confirm the position, it is a risk—not a guaranteed gain or compensation cheque.
