Do not enter the construction site, confront workers, wade through unknown water, or build a makeshift diversion that could send water onto another property or into a drain.
This guidance is for properties in the United States. The federal Clean Water Act provides a baseline, but the correct permitting authority and complaint process depend on your state, tribe, municipality, and the project’s location. Local rules can cover smaller sites or impose controls beyond federal requirements.

First, protect people and property from immediate hazards
Construction runoff can be ordinary stormwater carrying soil, but it may also transport debris, concrete washout, oil and grease, chemicals, or other waste. Treat fast-moving, deep, contaminated-looking, or electrically hazardous water as unsafe.
- If water threatens people, buildings, roads, vehicles, gas lines, or electrical equipment, keep everyone away and contact the appropriate local emergency service.
- Do not walk or drive through water when you cannot judge its depth, current, contamination, or effect on the ground beneath it.
- Keep children and pets away from pooled or flowing runoff until the area is assessed and cleaned.
- Do not trespass onto the construction site to inspect a pipe, silt fence, basin, pump, or discharge point.
Emergency response and environmental reporting are separate. A dangerous situation may require an immediate emergency call even if you also file a stormwater complaint later.

A safe response sequence
- Observe from a lawful, safe location. From your property, a public right of way, or another place where you are permitted to stand, identify where the water entered, where it traveled, and whether the flow is continuing.
- Record the basic facts. Write down the property or project address, date and time, weather if relevant, direction of flow, affected areas, and whether the discharge is intermittent or ongoing.
- Take photographs or video without taking risks. Capture the flow path, deposited sediment, water color, displaced or bypassed controls, blocked inlets, and damage. Include wide views that show location as well as close views of material. Do not handle containers, soil, or liquids to obtain a sample.
- Describe visible material without guessing. You can report “gray slurry,” “rainwater carrying tan sediment,” “an oil-like sheen,” “concrete residue,” or “floating trash.” Do not identify a chemical unless a qualified authority has done so.
- Report promptly to the local stormwater or construction authority. Start with the municipal stormwater, public works, code-enforcement, or environmental office. Explain that construction runoff has reached your property and ask which department accepts the complaint.
- Request an incident or complaint number. Ask how to submit photographs, whether an inspector will be assigned, and how to report continuing discharges. Keep the confirmation and the name or title of the person who received it.
- Escalate when the local route is unclear or the discharge continues. Contact the state environmental agency or the EPA regional office for direction if the municipality cannot identify the permitting authority, does not accept the complaint, or the discharge remains unresolved.
- Preserve a complete record. Keep copies of forms, emails, photographs, video files, agency replies, inspection dates, cleanup invoices, repair estimates, and notes of when conditions changed.
What to include in a complaint
An agency can act more efficiently when the report is factual and specific. A useful submission normally contains:
- The project or construction-site address, nearest intersection, and your property address.
- When you first observed runoff and the dates and times it has recurred.
- Whether the flow is active now and whether it crosses a boundary, enters a ditch, pond, stream, or storm drain.
- A concise description of the visible path and affected features, such as a driveway, basement, landscaping, well area, culvert, or drainage swale.
- Photographs or video taken from a safe, lawful vantage point, with the original date and time preserved when possible.
- Visible indications of additional pollutants, including concrete washout, an oil sheen, unusual odors, trash, or chemical containers. Describe only what you observed.
- Any immediate safety issue, structural damage, blocked access, or threat to utilities.
Do not exaggerate, speculate about the contractor’s intent, or state that a law was violated unless an authorized regulator has made that determination. “Sediment entered my yard from the active site at 3:20 p.m.; the flow is still continuing” is more useful than an unsupported accusation.
Who handles the report?
The right office depends on the project’s permit and the local government’s stormwater program. Use this as a routing guide, not as a nationwide guarantee of a particular phone number or form.
| Situation | First contact | What to ask for |
|---|---|---|
| Runoff from a nearby development, grading project, or subdivision | Municipal stormwater, public works, or code-enforcement office | Which department accepts construction-runoff complaints and the complaint number |
| The municipality cannot identify the permit or will not accept the report | State environmental or water-quality agency | Whether the state administers the applicable NPDES permit and where to submit evidence |
| The site is in an area where EPA is the permitting authority | EPA regional office, after documenting the local response when practical | Which EPA construction-stormwater complaint channel applies to the location |
| Immediate danger to people, roads, buildings, or electrical equipment | Appropriate local emergency service | Immediate hazard response; make the environmental report separately |
EPA’s municipal stormwater guidance describes regulated municipal programs as having construction-runoff controls and procedures to receive and consider public information. That does not mean every city uses the same department, web form, response time, or inspection process.
When federal construction-stormwater rules may apply
Under the federal framework, stormwater permit coverage is generally required for construction activity disturbing at least one acre. It can also apply to a project disturbing less than one acre when that work is part of a common plan that will ultimately disturb at least one acre. State, tribal, and local requirements may apply at smaller sites or impose additional conditions.

Many states and tribes administer National Pollutant Discharge Elimination System permits; EPA is the permitting authority in specified areas. The project’s location therefore matters as much as its size. Ask the local or state authority which permit covers the site rather than assuming that a one-acre calculation settles the question.
At the time of the cited EPA material, EPA reported that a proposed 2027 Construction General Permit had been published on August 3, 2026, with the public-comment deadline extended to September 17, 2026. EPA also stated that the 2022 Construction General Permit expires on February 16, 2027, and that a finalized successor would replace it in EPA-permitted areas. Permit status is time-sensitive; verify the current federal page and the applicable state permit before relying on a permit date or requirement.
What construction operators are generally expected to control
Federal construction and development requirements address erosion and sediment controls, pollution prevention, stabilization of disturbed areas when work will pause for the specified period, dewatering, and restrictions on unmanaged waste discharges. EPA identifies sediment, debris, chemicals, oil and grease, and concrete washout as construction-related pollutants.
Runoff that looks like “just mud” can still carry enough sediment to reduce light for aquatic plants, clog fish gills, smother habitat and spawning areas, or impede navigation. Those effects are reasons to report promptly, but muddy water alone does not prove a permit violation. The responsible regulator must compare site conditions with the permit, local ordinance, and facts observed during an investigation.

The menu is not an all-purpose repair manual. Controls are selected for the site’s slope, soil, drainage, weather, phase of work, and receiving waters. If you can safely see that a silt fence is down, a basin is overtopping, or water is bypassing an inlet protection device, describe that observation and its location in your report. Do not enter the site or attempt to reinstall, pump, trench, or reinforce a control yourself.

- Do not dig a trench, pile soil, place sandbags, or build a berm without qualified advice about where the redirected water will go.
- Do not pump sediment-laden water into a street, storm drain, neighboring parcel, stream, or wetland.
- Do not wash deposited soil, concrete residue, oil, or unknown material into a drain.
- Do not collect or transport suspected hazardous material unless emergency or environmental professionals instruct you to do so.
- Do not trespass, threaten workers, block equipment, or rely on an informal promise that the problem will be fixed.
A temporary measure that protects one area can flood another or create a separate discharge. If a building, foundation, septic system, well, retaining wall, or utility is at risk, seek advice from the relevant emergency, drainage, environmental, or engineering professional before altering the flow.
Cleanup, damage, and compensation questions
Once the area is safe, ask the local authority whether it wants the site left undisturbed for inspection. Photograph conditions before moving sediment or repairing surfaces, except where immediate action is necessary to prevent further danger.
Keep receipts for professional cleanup, testing, temporary protection, repairs, and damaged materials. The federal sources do not establish who must reimburse a homeowner, whether a private claim exists, or what deadline applies. Liability and compensation depend on state law, local ordinances, property boundaries, permits, contracts, insurance, and the facts of the discharge. For substantial damage, obtain location-specific advice from a qualified attorney, insurer, engineer, or environmental professional rather than assuming that a stormwater complaint will produce payment.

The flow is continuing during rain
Report it while it is observable, state that it is ongoing, and provide safe photographs showing where it leaves the site. If the water threatens people, utilities, roads, or structures, use emergency services first.
You see concrete washout, an oil sheen, chemicals, or unusual odors
Do not touch the material or enter the site. Tell the stormwater or environmental authority exactly what is visible and whether it is entering a drain or waterway. Use emergency channels if there is an immediate threat.
The local office says it is not responsible
Ask which agency issued or oversees the construction permit and request a referral. If no clear route is provided, contact the state environmental agency or EPA regional office with the project location and your existing complaint number.
Keep a simple incident file
- One timeline showing dates, rainfall or other relevant conditions, and each occurrence.
- Original photographs and videos plus notes identifying the viewpoint.
- Copies of every submission, confirmation, agency reply, and inspection reference.
- A sketch or map showing the apparent source, entry point, flow path, and affected areas.
- Invoices, estimates, and photographs documenting cleanup or repair costs.
This record helps an agency distinguish a one-time deposit from a recurring discharge and gives any later insurance, engineering, or legal review a reliable chronology.
