What to Do if Construction Runoff or Drainage Changes Flood Your Property

Put safety first, document the water’s path, and report the event to the local office that handles stormwater or construction-site runoff. Do not assume a nearby project caused the flooding until an inspection establishes what changed. A written record, local investigation and, when necessary, a qualified drainage assessment are more useful than an improvised barrier or excavation.

1. Make the area safe before investigating

If water is entering a home, move people and pets away from moving water and wet electrical equipment. Do not walk through water when electrical hazards may be present. Contact emergency services for an immediate threat to life or the building, and contact the utility when electrical infrastructure may be affected. Keep children away from drainage channels, culverts and fast-moving runoff.

After the immediate danger has passed, avoid disturbing sediment, debris or damaged materials until you have photographed them, unless removing them is necessary to prevent further harm. Basic safety steps are appropriate in any flood, but emergency authorities—not a construction office—should direct an active rescue or utility response.

2. Create a contemporaneous record

Start an event log while the sequence is still clear. A record supports an agency inspection, repair planning or an insurance discussion; it does not, by itself, prove that construction caused the flooding.

Record the event

  • Date and approximate start and end time.
  • Rainfall conditions, including whether rain was intense, prolonged or absent immediately before the water appeared.
  • Where water first appeared, the direction it traveled and where it pooled or entered a structure.
  • Approximate depth, affected area and whether the flow crossed a driveway, yard, foundation, basement or other opening.
  • Visible soil, muddy water, construction debris, blocked inlets, altered swales, piles of fill or recently changed grades.
  • Whether the condition is new, more severe than previous events, or repeated after particular stages of site work.

Photograph consistently

Take wide images that show the property and the suspected flow path, then closer images of sediment, erosion, blocked drainage and damage. Photograph from the same locations during and after later events so water levels can be compared. Preserve the original files and note the time each image was taken. Do not enter a dangerous area to obtain a better angle.

Preserve financial and communication records

Keep invoices, receipts, repair estimates, drying or cleanup records and photographs of damaged contents. Save emails, text messages and letters exchanged with the builder, site manager, neighbors, insurer or public agencies. Write down the name, department, date and substance of each telephone conversation. Avoid editing messages or making statements that present causation as settled fact.

3. Report the flooding to the right local office

Begin with the municipal stormwater or drainage department. Depending on the jurisdiction, construction-site runoff may instead be handled by building or code enforcement, a public-works department, a county office, or a state-authorized environmental agency. If you cannot identify the department, call the city or county main line and ask for the office that receives construction-runoff or drainage complaints.

What to ask when you report

  1. Which office has jurisdiction over runoff from this project and over changes to drainage on private property?
  2. Does the project have applicable stormwater, grading, building or erosion-and-sediment approvals?
  3. How should photographs, the event log, repair documents and a location map be submitted?
  4. Can an inspection be requested, and what reference or complaint number will be assigned?
  5. What additional information is needed, such as the parcel address, project name, contractor or dates of site work?

Regulated municipal stormwater programs generally include procedures for receiving public information, inspecting construction sites and enforcing applicable requirements. That does not guarantee that a particular city or county will use the same process, investigate a private drainage dispute, or find a violation. Ask for the local procedure and keep the reference number.

4. Notify the builder or site operator in writing

Send a factual notice to the project owner, builder or site manager after making the local report, or at the same time when continued runoff is causing damage. Identify the affected address, dates and locations, and attach a small set of representative photographs. State what you observed without asserting an unproven conclusion.

For example, describe that water began crossing a particular side of the property after a grading change, that muddy runoff entered a basement on a stated date, or that a previously dry swale now overflows. Ask the operator to preserve relevant site records and to coordinate with the local authority. Keep proof of delivery and copies of every attachment.

Ask the agency—not the operator alone—whether site plans, grading approvals, permits or stormwater controls can be reviewed. For projects covered by construction stormwater requirements, the operator is generally responsible for preparing and implementing pollution-prevention controls. A private exchange, however, cannot substitute for the authority’s inspection or determine compensation.

5. Understand which rules may apply

Federal Clean Water Act stormwater rules provide context, but they do not identify the correct local office or decide a private claim. EPA states: “A Clean Water Act permit is required for stormwater discharges from any construction activity disturbing:” at least one acre, subject to the regulatory conditions that follow. Coverage generally also reaches a smaller area that is part of a common development plan expected ultimately to disturb one acre or more.

What covered construction sites generally must do

Construction permits commonly require erosion and sediment controls, stabilization of disturbed soil and controlled dewatering. The exact requirements depend on the permit, discharge, project design and authorization. State-authorized agencies and local governments may impose stricter thresholds, additional approvals or different complaint procedures.

What the federal threshold does not tell you

  • A project below one acre is not automatically exempt from every state, county or municipal rule.
  • Reaching the threshold does not prove that runoff from the project caused a particular flood.
  • Permit coverage does not guarantee that flooding will not occur or establish a right to compensation.
  • A permit question and a private drainage, easement or property-damage dispute are separate issues.

EPA’s current construction-permit information reports that the 2022 Construction General Permit expires on February 16, 2027. It also reports that the comment deadline for the proposed 2027 permit was extended to September 17, 2026. These dates concern the federal permit program, not a determination about your project; verify the current status with the relevant permitting authority because program details can change.

6. Choose between an administrative investigation and technical diagnosis

These are different paths and may be needed together. A public complaint asks an agency to determine whether its rules, approvals or enforcement authority apply. A technical assessment asks what physical change is moving water and what design would safely address it.

Response path Best use Questions to ask Limit
Administrative investigation Suspected violation, unapproved grading, blocked drainage or need for an official inspection Does the office handle construction runoff? Can it inspect? How are photos submitted? Is there a reference number? The office may lack authority over a private dispute or may find no violation even when damage occurred.
Technical diagnosis Unclear flow path, repeated flooding, altered grades or need to design a repair Is the professional locally qualified? Do they understand grading and stormwater rules? Will the assessment trace the changed flow path and account for soil, slope, rainfall and structures? An assessment explains physical conditions; it does not decide legal liability or insurance coverage.

When the cause remains uncertain, consider a locally qualified drainage or civil engineering professional with experience in grading and stormwater. Ask for a written scope that identifies the changed flow path, contributing site conditions, observed evidence and practical alternatives. EPA’s control examples are intended for stormwater programs and construction operators; they are not a direction for a homeowner to install a particular device or modify a construction site.

7. Do not treat the symptom with an unplanned project

Runoff controls are site-specific. Soil, slope, precipitation, surface elevations, inlets, culverts and the layout of buildings all affect the correct response. A barrier, pump, trench, fill placement or diversion installed without a drainage assessment can redirect water onto another property, obstruct an outlet, worsen erosion or create a new safety problem.

Do not enter the construction site, alter its controls or remove sediment-control materials yourself. Ask the responsible agency or site operator to address conditions under the applicable approval. Temporary protection on your property should be limited to measures that do not put people at risk or alter drainage in a way that creates additional harm.

8. Handle insurance, repairs and possible legal issues separately

Notify your insurer promptly enough to comply with your policy’s notice requirements and ask what photographs, estimates and mitigation records it needs. This article cannot determine whether a policy covers surface water, flood, sewer backup, retaining-wall failure, cleanup or resulting damage; coverage depends on the policy, endorsements, exclusions and facts.

For easements, altered natural drainage, boundary disputes, liability or compensation, seek advice from a lawyer licensed in the property’s jurisdiction. The applicable rules can turn on location, permits, historic flow, ownership, notice and the specific damage. Keep the agency reference number and technical records available, but do not assume an inspection result alone resolves a legal claim.

Frequently asked questions

Who do I call about construction-site runoff?

Call the municipal stormwater or drainage department first. If the municipality does not handle construction runoff, its main line should direct you to building or code enforcement, public works, the county office or the state-authorized permitting agency responsible for the project.

Does a project under one acre need no permit?

No. The federal construction-stormwater threshold generally starts at one acre, including qualifying common development plans, but state and local requirements can be stricter or different. Ask the relevant permitting authority about the project and its discharge.

Will an EPA-related permit prove the builder owes me money?

No. Permit coverage and compliance are regulatory questions. Responsibility for private damage, drainage rights, insurance and compensation depends on local law, property facts and the available evidence.

Should I install a pump or flood barrier immediately?

Only take safe, temporary steps that do not redirect water or create another hazard. A permanent pump, barrier, trench or diversion should follow a site-specific assessment rather than an assumption about the cause.
