First, identify the apartment’s country and state, then read the signed sale or allotment agreement. The contract’s possession date, grace period, permitted extensions and notice rules—read with the law and project-registration record for that location—determine whether the builder is actually late and what you can seek. Send a dated written request for the reason, outstanding approvals and a firm handover schedule; preserve every contract, payment and communication record. Refund, interest, compensation and termination rights are jurisdiction-specific, so obtain local advice before signing revised terms, withholding payments or ending the agreement.
Start by pinning down the legal deadline
A builder’s phone call or site-office promise does not by itself change your legal position. Locate the exact agreement you signed—sale agreement, allotment letter, construction-linked contract and any later addendum—and find the clauses dealing with completion and possession.
As an Amazon Associate I earn from qualifying purchases.
- Contractual date: record the calendar date (or the event-based formula) by which possession was promised.
- Grace period: note its length, whether it is automatic, and what notice the builder must give.
- Permitted extensions: identify force-majeure wording, authority delays, utility connections and other listed events. Check whether the clause requires proof or a written notice within a stated time.
- Delay remedy: look for interest, liquidated damages, rent reimbursement, refund or termination language, and any procedure for claiming it.
- Variation documents: check whether you signed a later date, waiver, settlement or consent to revised specifications.
Compare the contractual date with the project’s official registration entry, approved completion schedule and recorded construction or occupancy status in the project’s jurisdiction. A registration portal can reveal a revised schedule, but it does not automatically rewrite your private contract. Save a dated copy or screenshot of whatever the official record shows.
Jurisdiction check: write down the country, state or province, city, project registration number and the authority that regulates the development. Without that information, no reliable answer can be given about compensation, limitation periods, filing fees or the correct complaint forum.

Send a written demand for a usable answer
Once the deadline has passed—or is clearly at risk—send an email and, where available, a contractually recognized delivery (such as registered post or the builder’s customer portal). Address the legal entity named in your agreement, not only a salesperson. Keep proof of delivery.
Your message should request four concrete answers:
- The factual cause of the delay, with the work affected and the period of impact.
- Every construction, completion, occupancy or utility approval still outstanding, including the authority handling it.
- A realistic revised date for completion, inspection and handover, with milestones rather than an indefinite promise.
- The contract clause and supporting notice on which the builder relies for any extension.
Ask the builder to confirm each answer in writing and to state how it will address any contractual delay remedy. Avoid accusatory language that obscures the requests; a clear chronology is more useful if the matter later goes to a regulator, tribunal or court.

- Identify the apartment, agreement date and promised possession date.
- State that possession has not occurred (or is at risk) and give the number of days or months elapsed, calculated from the contract.
- List the four questions above and set a reasonable response date consistent with local law and the agreement.
- Reserve your rights without asserting a remedy you have not verified under local law.
Build an evidence file before the dispute escalates
Create one chronological folder, with a backup, and keep originals. Include:
- The signed agreement, allotment letter, specifications, floor plan, amendments and side letters.
- Every payment receipt, demand notice, bank record and statement showing amounts paid or outstanding.
- Advertisements, brochures, promised amenities and written representations that formed part of your decision.
- Construction photographs, inspection reports, site updates, official project-register entries and approval notices.
- Emails, letters, messaging-app exports, call logs, meeting notes and complaint acknowledgments.
- Receipts for rent, temporary accommodation, storage, loan interest or other costs you are claiming as loss. Record the dates and why each expense resulted from the delay.
Do not alter screenshots or rely on an undated printout. Keep the original electronic file and note who supplied each document. If several buyers are affected, maintain your own file even when a residents’ group circulates common material.

Assess whether waiting is sensible
Ask for evidence of progress, not just a new month. Useful indicators include the percentage of construction complete, utility connections, inspection bookings, occupancy or completion certificates and a sequence for snagging and key handover. A date that depends on an approval the builder has not applied for is not a dependable schedule.
At the same time, consider your personal position: whether you need the apartment, how long you can fund alternative accommodation, whether your mortgage or financing commitment continues, and whether the project can realistically be completed. These facts affect the best remedy but do not replace the contract and local law.
Compare the main paths before choosing one
| Path | When it may fit | Checks before acting |
|---|---|---|
| Wait under a documented schedule | Construction and approvals show credible progress and you still want the apartment. | Confirm the revised milestones, written extension basis, interim costs and any delay remedy. |
| Negotiate a possession date and delay settlement | You can accept a revised handover if the compensation and protections are adequate. | Have the amendment reviewed; check whether it waives past claims, changes specifications or releases the builder on signing. |
| Seek possession while preserving a delay claim | The apartment is usable but late delivery caused a contractual or statutory loss. | Check the effect of accepting keys, inspection certificates and any “full and final” receipt under local law. |
| Withdraw and seek a refund | The delay is substantial, the agreement or statute permits exit, and you no longer need the apartment. | Verify the legal trigger, notice method, refund timing, interest rules and financing consequences before serving notice. |
| File with a regulator, tribunal, ombudsman or court | The builder will not provide a credible answer or refuses a lawful remedy. | Identify the competent forum, limitation deadline, evidence requirements, fees and whether it can order money, performance or only discipline. |
There is no universal “best” option. Compare the legal basis and contract terms, realistic completion prospects, your need for the home, likely cost and duration, evidence and limitation deadlines, and the effect of any amendment you sign.
Do not give up rights by accident
- Revised-date form: a new date may also waive accrued delay claims or restart a limitation clock.
- Full-and-final receipt: signing it may be treated as settlement, depending on local law.
- Termination notice: an invalid notice can create a dispute about whether you—not the builder—ended the contract.
- Payment decisions: stopping instalments, cancelling a direct debit or accepting possession can have financing and contractual consequences. Obtain local advice first.
- Verbal assurances: “next month” is not a reliable variation unless the contract and applicable law recognize it.
Ask an independent property lawyer or legal-aid service to review any waiver, amendment, settlement, termination notice or proposed possession document. The adviser should be qualified where the property is located and should see the complete agreement, not a marketing summary.

Use the forum that belongs to the project’s location
Complaint channels differ even between neighboring jurisdictions. A regulator may investigate licensing or discipline a contractor without deciding your money claim, while a tribunal or court may award compensation but not supervise construction. Confirm jurisdiction, deadline and remedy before filing.
India: Real Estate (Regulation and Development) Act, 2016
India’s Real Estate (Regulation and Development) Act, 2016 was enacted on 25 March 2016 and enforced from 1 May 2016. Section 18 addresses a promoter’s failure to complete or give possession in accordance with the agreement date. In broad terms, an allottee who withdraws and one who remains have different statutory consequences involving refund and interest, subject to the Act, state rules and the facts of the case. Do not quote a rate or promise a payout without checking the current rules and the project’s state.

In Pioneer Urban Land and Infrastructure Ltd. v. Govindan Raghavan and connected matters (Supreme Court of India, 11 January 2021), the Court considered delayed apartments, one-sided buyer-agreement terms and the relationship between consumer and statutory remedies. Its judgment states: “the remedy available in that Act is in addition to and not in derogation of the provisions of any other law for the time being in force.” That statement does not guarantee that every forum is available in every fact pattern or that a claim will succeed. A lawyer should assess jurisdiction, election-of-remedy issues and the current project record.

NSW Government guidance for residential building disputes recommends communicating about the delay, checking the contract before agreeing to an extension and retaining the original contract, invoices and receipts when escalating. It directs unresolved building disputes to Building Commission NSW. The guidance is specific to NSW residential building disputes; do not transfer its contract, insurance or termination rules to an apartment purchase elsewhere.

GOV.UK advises a complainant to approach the relevant company first and, if the response is unresolved or unsatisfactory, use the appropriate ombudsman or scheme. For new homes, it lists the New Homes Ombudsman Service. Check that the developer and transaction fall within that scheme’s scope and follow its current time and evidence rules.

The Ministry of Construction and Housing describes a Registrar process for complaints against registered contractors, including practical contract breaches such as late apartment delivery. It states that the process is disciplinary and does not decide financial disputes or resolve a dispute between a property owner and contractor. A disciplinary complaint therefore may not recover your rent, interest or refund; identify the separate civil or consumer route that applies.
Prepare for a formal complaint or claim
- Make a one-page chronology from the agreement date to the latest missed promise.
- Attach the contract clause, payment proof, written demand and delivery evidence.
- State the outcome sought precisely: a documented handover schedule, possession, refund, interest, compensation or another remedy allowed by the forum.
- Check filing and limitation dates independently; a builder’s ongoing discussions may not stop a statutory clock.
- Submit only to a forum that can grant the remedy you seek, and keep the filing receipt and all responses.
If several buyers are affected, coordinated evidence can show a common delay, but each buyer’s agreement, payments and losses still require an individual assessment.
Questions to answer before your next conversation
- What exact date and clause establish possession?
- Has the builder issued a contractually valid extension notice, and what event supports it?
- Which approvals remain, and who is responsible for obtaining them?
- What will accepting a new date, keys or a settlement do to existing claims?
- Which local body can order the outcome you need, and when must you file?
Take these questions, the complete evidence file and the proposed documents to an independent local adviser. That step is especially important when the builder disputes the date, offers a waiver or new agreement, refuses a written demand, or pressures you to terminate or accept possession immediately.
