What to Do After a Building Is Declared Unsafe to Occupy

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Leave the building or remain outside, obey the written order, and contact the authority named on the notice. Ask exactly what areas are closed, whether supervised retrieval of medication or identification is possible, what repairs and inspections are required, and which agency must formally rescind the order. A landlord’s reassurance, a completed repair, or an unofficial inspection is not permission to return.

1. Treat the order as a no-entry instruction until the issuing authority says otherwise

If a fire official, police officer, building department, emergency manager, or inspector has ordered a building vacated or posted a warning sign, follow that direction immediately. Do not cross barricades, remove colored tape, force a door, or enter through another part of the property to collect belongings. The American Red Cross states: “If you had to leave your home, return only when local authorities advise that it is safe to do so.” It also warns: “If a building inspector has placed a color-coded sign on the home, do not enter it until you get more information, advice and instructions from your local authorities.”

Move farther away and call emergency services from a safe location if you smell gas, hear hissing, see an active fire, notice a collapsing wall, encounter downed electrical lines, or observe another immediate danger. A building that appears quiet or undamaged from the street can still have unstable floors, hidden fire damage, energized wiring, compromised gas lines, or structural movement.

Some disaster tags are advisory evaluations rather than the final legal determination by the local authority having jurisdiction. FEMA’s post-disaster building-safety material describes tags that warn a structure may be unsafe and restrict entry except as specifically authorized, while noting that an evaluator may not be the authority that has determined structural integrity. Treat every warning seriously and ask the named local authority what the tag means in that jurisdiction.

2. Identify the exact scope of the notice

From outside the restricted area, photograph or save the notice if you can do so safely. Record the agency name, property address, date and time, stated hazard, case or reference number, contact details, and every restriction. A notice may apply to one apartment, a floor, a stairwell, a detached structure, or the entire property.

Notice or situation What it can mean Who controls access Your next question
Full vacate or no-entry order Occupancy is prohibited throughout the area identified on the order. The issuing authority or authorities What formal steps will rescind the order, and how will occupants be notified?
Partial closure Only the listed unit, room, floor, wing, or system is restricted; other areas may still have conditions attached. The agency named on the notice, sometimes with another agency’s order also in effect Which doors, routes, utilities, and common areas are closed?
Advisory evaluation tag A warning based on a preliminary or post-disaster assessment; it may not be the final legal clearance decision. The local authority having jurisdiction determines what the tag permits. Is this an advisory tag, a mandatory order, or both, and is any entry authorized?
Authorized escorted retrieval An official has approved a limited visit for essential items under stated conditions. The official named in the written or recorded authorization What date, route, escort, time limit, protective measures, and items are allowed?
Repairs reported complete Work may be finished, but the order remains active until each issuing agency accepts the correction. The agency that issued each active order Has every order been inspected and formally rescinded?

New York City’s Department of Buildings, for example, says a vacate order can cover part or all of a property and prohibits entry without Department approval while active. That is a city-specific rule, but it illustrates why the wording and jurisdiction on your own notice matter more than a general internet explanation.

3. Use this first-day sequence

  1. Leave or stay out. Take only items already in your possession. Do not delay evacuation to pack, inspect damage, or switch off systems unless an emergency official directs you to do so.
  2. Secure the notice information. From a safe location, record the agency, address, date, hazard, scope, case number, contact person, and update method. Keep the original notice and clear photographs in more than one place.
  3. Call the issuing authority. Ask whether the order is mandatory, partial, advisory, or temporary; which areas are closed; what hazards remain; whether utilities have been disconnected; and which agency has final authority.
  4. Ask about essential access. Specifically ask about medication, identification, mobility aids, vital records, service animals or pets, and items needed for children or medical treatment. Request an escorted retrieval procedure rather than relying on verbal permission from a landlord or neighbor.
  5. Arrange safe accommodation. Contact local emergency management, municipal housing services, and the American Red Cross or an equivalent disaster-relief organization. Explain the number of people, accessibility needs, pets, transportation limits, and any medical requirements.
  6. Notify the people who need to act. Tell your landlord or property manager, insurer, employer or school if displacement affects attendance, and family members who may otherwise attempt to enter. Keep a log of names, dates, case numbers, and instructions.
  7. Preserve expenses and evidence. Save receipts for lodging, transportation, storage, meals, replacement clothing, medication, and other necessities. Make an inventory from memory, prior photographs, receipts, cloud records, or documents already outside the building.
  8. Follow updates through the official channel. Do not treat a social-media post, contractor message, neighbor’s statement, or a repair photograph as a clearance notice. Ask how residents will be told when the restriction changes.

4. Find shelter and temporary housing without assuming a universal benefit

Emergency shelter, transportation, hotel placement, accessibility support, pet arrangements, rental assistance, and longer-term relocation are administered locally and may depend on the cause of the displacement and household eligibility. Ask each agency what it can provide, for how long, and what documents are needed.

New York City’s emergency housing services, for instance, may assist eligible households displaced by a fire or a city-issued vacate order. That contact route and eligibility standard apply to New York City, not automatically to another state or municipality. Elsewhere, the responsible agency may be a county emergency-management office, a housing department, a fire-department relief coordinator, or a voluntary organization.

  • Do not assume that government will pay a fixed number of hotel nights or replace all living expenses; the applicable program and your insurance policy control.

5. Retrieve medication, identification, and other essentials only with authorization

An active no-entry order overrides an informal invitation from the owner. Ask the issuing authority whether a controlled visit is possible and whether the owner, a building official, fire officer, engineer, or other escort must arrange it. New York City guidance says essential retrieval, including medication and identification, may be allowed depending on the structure’s condition; in some cases the owner must coordinate with the Department of Buildings.

If access is approved, obtain the conditions in writing or through a recorded official contact. Confirm the appointment, entrance, route, time limit, escort, permitted items, utility status, and what to do if conditions worsen. Follow the escort’s instructions and leave immediately when told.

Basic equipment does not make an unsafe building safe. If officials authorize entry while the power is out, the Red Cross recommends a flashlight rather than an open flame. Watch for loose electrical lines, damaged gas piping, foundation cracks, unstable stairs, sagging ceilings or floors, standing water, broken glass, and smoke or chemical residue. Do not improvise structural shoring, restart utilities, or move heavy debris during a retrieval visit.

6. Document the loss without entering unsafely

Keep the notice, inspection papers, emails, text messages, photographs, receipts, insurance claim number, and names of officials together. Write a timeline beginning with the order and note every call, promise, deadline, and missed appointment. Photograph exterior damage only from a safe, lawful location. Do not enter solely to create an inventory or collect proof.

The Red Cross recommends photographing damage and saving receipts when it is safe to do so. The U.S. Fire Administration’s “Helping Community Residents After a Home Fire” resource covers first-day actions, insurance, valuing property, replacing documents, and salvage; its page was last reviewed April 1, 2023. Ask your insurer which records are required, whether an adjuster must inspect before cleanup, and what claim deadlines apply.

  • List people displaced, rooms affected, major possessions, prescription needs, and documents that must be replaced.
  • Keep receipts for emergency purchases even if you do not yet know whether the policy or a public program will reimburse them.
  • Ask before discarding damaged contents; insurers or officials may need to inspect them.
  • Store digital copies of records in a cloud account or with a trusted person outside the property.

7. Understand who must repair and who can clear the building

Residents should not direct structural repairs or assume that a contractor’s statement means the order is lifted. The property owner normally must correct the cited conditions, obtain required permits and licensed design or inspection professionals, complete the work, and request the government inspection or dismissal required by the notice.

New York City’s tenant guidance states: “After the condition(s) is corrected, the property owner must request that the DOB Vacate Order be lifted.” The Department may inspect and rescind the order if appropriate. If fire, building, health, or another agency issued separate orders, each agency may have to dismiss its own order before reoccupation.

Miami’s unsafe-structure process similarly tells owners to meet with the citing inspector, review the case, retain required licensed professionals, obtain permits, complete work and inspections, and secure confirmation of compliance. It warns owners not to wait for a hearing when immediate action is required and notes that requirements and deadlines vary by violation. These are local examples, not a nationwide procedure.

What an owner should ask the inspector

  • Which conditions and code sections remain open?
  • Are an engineer, architect, specialty contractor, or laboratory test required?
  • Which permits, inspection milestones, and deadlines apply?
  • Will the agency issue a written rescission, and how will occupants receive it?
  • Did any other agency issue an independent order that also needs dismissal?

8. Protect your position as a tenant

A displacement can affect rent, lease duties, relocation, repairs, and access rights differently depending on local law, tenancy type, the cause of damage, and the wording of the order. Do not simply stop paying rent, sign a lease surrender, waive claims, or accept a move-out agreement without location-specific advice.

New York City advises tenants that rights differ by rent-regulation status and the nature of the damage. It describes a rent-reduction application for certain rent-stabilized or rent-controlled tenants who cannot live in the apartment and points eligible tenants toward a helpline and free legal services. Other jurisdictions may use entirely different procedures.

Seek a local tenant attorney, legal-aid office, or housing agency if a landlord pressures you to re-enter, refuses to coordinate an authorized retrieval, demands payment for an uninhabitable unit, threatens retaliation, or disputes responsibility for temporary housing. Bring the order, lease, rent records, photographs, and communication log.

9. Handle insurance and financial questions carefully

Notify the insurer promptly under the policy’s actual notice requirements. Ask about additional living expenses, contents coverage, emergency advances, storage, debris removal, replacement documents, deductibles, and claim deadlines. Coverage depends on the policy, cause of loss, exclusions, endorsements, and facts; no general rule guarantees reimbursement.

Keep public-aid applications and insurance claims separate but consistent. Report the same dates and facts, retain confirmation numbers, and tell each program about payments received from another source when asked. If you own the building, document mitigation steps and approvals before undertaking major work. If you rent, do not authorize demolition or permanent repairs yourself unless the owner and relevant authority have clearly assigned that responsibility.

10. Return only after formal clearance

Before moving back, obtain confirmation that every active order affecting your unit or building has been rescinded or otherwise released. Ask who performed the final inspection, the date of the decision, the reference number, which areas are approved, and whether utilities, elevators, fire alarms, plumbing, or other systems have separate conditions.

Do not rely on a contractor’s completion certificate, a landlord’s text, a neighbor’s return, or the removal of a sign unless the issuing authority confirms that its order is no longer active. When multiple agencies were involved, ask each one for its status. Keep the clearance with your records and verify any continuing restrictions on rooms, utilities, occupancy load, or construction zones.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Once officials authorize re-entry, proceed cautiously. Check for visible hazards, use a flashlight instead of candles during a power outage, keep children and pets away from damaged areas, and report new cracking, odors, sparks, water intrusion, or movement immediately. An authorization to enter is not permission to bypass an area that remains cordoned off.

What varies by location

This guidance is U.S.-oriented because the cited authorities are U.S. agencies and organizations. The written order and the authority having jurisdiction where the building stands control. Local rules determine whether the notice is called a vacate order, unsafe-structure order, condemnation, red or yellow tag, emergency closure, or another term; who may enter; how rent is adjusted; what aid is available; and how an appeal or inspection works.

If the notice is unclear, ask the issuing office to explain it in plain language and to identify the exact document that authorizes return. For disputes involving lease termination, rent, liability, benefits, or a landlord’s conduct, obtain advice from a qualified professional in your city or state.
