apartment snagging

What to Do About Defects in a Newly Built Apartment

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Put safety first, preserve evidence, and notify the right parties in writing. If the defect could cause injury, fire, flooding or electric shock, keep people away and contact local emergency or qualified safety services rather than waiting for a routine warranty visit. For non-emergency defects, photograph and describe the condition before it is repaired or covered, submit a dated itemised report to the developer or housing authority, and keep every document and response. The deadline, warranty and escalation route depend on your country or state, contract, building type and the defect itself.

1. Deal with immediate danger before ordinary snagging

Signs that need urgent action

  • Suspected structural movement, major cracking, falling masonry or a balcony, ceiling or stair that appears unsafe.
  • An active leak close to sockets, wiring, a switchboard or other electrical equipment.
  • Gas odour, smoke, a failed fire door or alarm, blocked escape route, or another fire-safety concern.
  • Rapid flooding, sewage release or any condition that could make the apartment unsafe to occupy.

Move occupants away from the affected area as appropriate. Call the local emergency number, fire service, utility emergency line or a qualified safety professional for the hazard involved. Notify building management and the developer as soon as it is safe, but do not wait for an ordinary defects process. The official sources do not establish one universal emergency protocol, so local emergency advice takes priority.

When the issue is not an emergency

Keep using the apartment only as far as it is safe. Do not dismantle finishes, open electrical equipment, remove waterproofing or attempt a structural repair to “prove” the problem. Disturbing the condition can create a safety risk and destroy useful evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

2. Preserve evidence before anything changes

Make a room-by-room defect log

Give each item its own number. Record the room, wall or fitting, the date you first noticed it, whether it is getting worse, and how it affects use. Describe observable facts rather than diagnosing the cause: “water appears below the bedroom window after rain” is stronger than an unsupported conclusion about failed flashing.

Photograph and film methodically

  • Take a wide photograph showing the location in the apartment, followed by close images of the defect.
  • Include a ruler or other scale where size matters and photograph any visible date or model marking.
  • For leaks, staining, movement or intermittent faults, record a short video and note the weather, time and what triggered the problem.
  • Keep the original files, an organised copy and a simple index matching each file to the log item.

Keep handover and inspection records, plans, specifications, the sale contract, warranty certificates, invoices and receipts. NSW Government advice to retain relevant records is sensible evidence practice, but your contract or local law may require particular notices or forms.

Consider an independent inspection

An independent building professional can help when defects are numerous, technically disputed, expensive or potentially structural. Compare candidates on:

  • Local licence, registration or other qualification and experience with your building type.
  • Independence from the developer, builder and repair contractor.
  • Scope: apartment only, balconies and services, or common elements as well.
  • Whether the report includes photographs, measurements, relevant standards and a clear defect schedule.
  • Access needed, total cost and whether the report is suitable for the warranty provider, regulator, tribunal or court you may use.

There is no single inspection credential that applies worldwide. In Miami-Dade County, for example, county guidance recommends bringing someone knowledgeable in building trades, such as a licensed engineer or architect; that is local advice, not a universal mandate. See Miami-Dade County guidance on newly constructed homes.

3. Report every defect in writing

Use the developer’s stated portal, form or email address. If the apartment is part of a public-housing process, use the housing authority’s procedure as well. A phone call can alert someone quickly, but a written notice creates a dated record.

  1. Identify the property. Include the address, apartment number, purchaser or owner name, handover or key-collection date and your preferred contact details.
  2. List items separately. Number each defect and give its exact room or location, date first observed, photographs or video filenames and any effect on safety or use.
  3. State the outcome requested. Ask for inspection, a written diagnosis, compliant repair or replacement, and reinstatement of finishes where appropriate. For an urgent hazard, say plainly that it requires immediate attendance.
  4. Request a schedule. Ask the recipient to confirm receipt, identify the person handling the claim, propose an inspection date and provide a repair plan.
  5. Preserve proof of sending. Save the sent email, portal confirmation, uploaded files, postal tracking and every reply in one folder.

GOV.UK’s home-buying guidance says: “You should report back any issues to your developer and ask for them to be addressed before you move in.” Read the full guidance at How to buy a home. If you have not moved in, report visible snagging before occupation where practical; do not delay an urgent safety report while waiting for a handover inspection.

A concise defect-report format

Subject: Defect notice – Apartment [number], [address] – [date]

Item 1 – [room/location]
First noticed: [date]
Description: [observable condition]
Effect: [safety, water ingress, loss of use, finish or other impact]
Evidence: [photo/video filenames]
Requested action: inspection and compliant repair

4. Control access and document the repair

Agree access in writing. Ask which company and workers will attend, what areas they will open, whether water or power must be isolated, and how the apartment will be protected and cleaned. Photograph the condition immediately before work starts and again when it ends. Keep a visit log with dates, names, promises, materials used and outstanding items.

Do not hand over keys indefinitely. Singapore’s Housing & Development Board (HDB) specifically advises owners not to give their flat keys to a repair contractor for security reasons. Arrange supervised or formally recorded access under your local process.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not assume that you may withhold a purchase payment, refuse handover, hire your own contractor and deduct the bill, or sign a release after a partial repair. Those remedies depend on the contract and local law and can affect later claims. Ask for the proposed resolution in writing before authorising work that could change responsibility or evidence.

5. Identify the warranty and the responsible party

Read the sale contract and handover pack alongside every warranty. Check the notification method, exclusions, access rules, repair procedure, dispute clause and any time limit. Also check appliance and equipment warranties, building insurance and owners’ corporation or management documents.

Problem type Documents or parties to check Important qualification
Paint, joinery, tiles or other finish Developer snagging process, contract specifications and workmanship warranty A finish warranty may not cover movement, water entry or a concealed building-system failure.
Plumbing, drainage, heating, cooling or electrical performance Developer or builder warranty, installer warranty, equipment manufacturer and building manager Record the symptom and conditions; do not assume the visible component is the cause.
Waterproofing, façade, balcony or suspected structural movement Structural or building warranty, developer, builder, insurer and owners’ corporation for common elements Coverage and notice periods vary widely; obtain qualified technical advice for a serious or disputed issue.
Fire doors, alarms, access systems or other shared services Building manager, owners’ corporation or housing authority, developer and relevant regulator The responsible party may be the common-property manager rather than the individual apartment owner.

Ask a refusing party to identify the warranty clause, specification or inspection finding on which it relies. A “structural” warranty does not automatically cover every cosmetic defect, and the developer may not be the only party with obligations.

6. Check the deadline that actually applies

There is no universal new-build defect deadline. The following examples describe distinct local processes; they do not replace your contract or statutory rights.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Location and process Published timing or advice What it does—and does not—mean
Singapore HDB new flats HDB states a one-year Defects Liability Period beginning at key collection and advises reporting items within one month of key collection and before renovation. It says repairs usually take less than two weeks. These are HDB process statements for relevant flats. “Less than two weeks” is HDB’s usual reported completion time, not a guarantee for every defect. See HDB’s rectification guidance.
New South Wales, Australia NSW Government describes the defects and liability period for new-home contracts as usually 13 weeks. “Usually” is a general description of the contractual period. Check the signed contract and any statutory rights before relying on it. See NSW guidance on keeping new work trouble-free.
United Kingdom GOV.UK recommends reporting snagging to the developer before moving in and checking what the warranty includes. The guidance does not establish one warranty term for all new-build homes. Contract, warranty provider and applicable consumer or construction law control.
Victoria, Australia Consumer Affairs Victoria explains that post-settlement problems may be covered by applicable protections. Victorian government material describes rectification and enforcement mechanisms that vary by building height and project. The framework is changing. Verify current start dates, eligibility and procedures before filing. See building problems after settlement, warranties and guarantees and Victorian accountability information.

Count from the event named in the rule—such as key collection, settlement, practical completion or discovery—not from a guess. Keep reporting newly discovered items even if an earlier notice is being investigated, and obtain local advice on limitation and notice periods for court or tribunal claims.

7. If the developer does not fix the defect

Send a controlled follow-up

After the promised response date, send a dated reminder that cites your original notice and lists unanswered items. Request a decision, inspection date and completion schedule. Describe any worsening condition and attach new evidence. Keep the tone factual; a clear chronology is more useful than accusations.

Choose an escalation route by authority and remedy

Route Questions to check first Possible result
Developer, builder or warranty provider Is the defect within scope? Was notice timely and in the required form? Has access been offered? Inspection, repair, replacement or a written coverage decision.
Building regulator or local authority Does it cover this building type and alleged code or safety breach? What evidence and notice are required? Investigation, compliance or enforcement action; it may not award all private losses.
Consumer agency or ombudsman Is the trader and transaction eligible? Is conciliation required before a claim? Negotiated resolution, recommendations or referral under that scheme’s powers.
Tribunal Are parties, defect types, claim value and filing deadline within its jurisdiction? An order for repair or payment where the tribunal has that power; technical reports may be needed.
Court What limitation period, pre-action notice and costs exposure apply? Binding orders or damages, with greater procedure, expense and risk.

Standing and deadlines differ, especially where the defect is in common property. For a serious, costly, time-sensitive or technically disputed matter, obtain advice from a locally qualified building professional and lawyer before accepting a settlement, authorising remedial work or filing.

8. Common-property defects need a different contact

Water entering through a façade, roof, balcony above, shared pipe, lift lobby or fire system may affect the whole building. Notify the owners’ corporation, strata or condominium manager as well as the developer, and ask who is authorised to commission an investigation. Keep your apartment log, but do not present a shared-system problem as solely an internal repair. The governing documents may assign notice, access, insurance and recovery rights to the building body.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

9. Mistakes that can weaken your position

  • Waiting for a convenient inspection date while a leak, electrical fault or structural movement continues.
  • Reporting “poor workmanship” without a location, date, photograph or requested remedy.
  • Renovating, repainting or replacing a component before the developer or warranty provider has inspected it.
  • Giving unrestricted keys to a contractor or allowing unrecorded visits.
  • Assuming a one-year or ten-year warranty applies because another apartment or country uses that period.
  • Signing a completion, waiver or full-and-final settlement document without understanding what claims it releases.
  • Missing a tribunal, warranty or statutory notice deadline while negotiating informally.

10. A practical sequence you can follow today

  1. Make the area safe and call the appropriate emergency service for an immediate hazard.
  2. Create a numbered defect log and photograph or film each item before repair or renovation.
  3. Collect the contract, specifications, handover record, warranties, insurance and prior correspondence.
  4. Send an itemised written notice through the named developer, builder, housing authority and, where relevant, building-manager channels.
  5. Request written confirmation, an inspection date, proposed scope and completion schedule.
  6. Provide controlled access, record every visit and photograph the result and any remaining defect.
  7. Check the applicable warranty, contract and local deadline; notify every potentially responsible party.
  8. If the response fails, escalate to the appropriate warranty provider, regulator, consumer body, ombudsman, tribunal or court after confirming eligibility and notice requirements.

The safest general rule is simple: preserve the condition, communicate in writing and match the remedy to the law and documents governing your apartment. A local professional can supply the technical or legal judgment that a general guide cannot.
