California has no single statewide permit for shoreline protection. A project in the coastal zone generally needs a coastal development permit (CDP), and its location and construction methods may also trigger U.S. Army Corps of Engineers (USACE), California Water Board, and California Department of Fish and Wildlife (CDFW) approvals. The exact combination depends on the site, jurisdiction, design, materials, and effects on water and natural resources.
Start by identifying the site’s coastal jurisdiction
Before choosing a permit pathway, establish where the project is and which agency has authority over that ground and water. Coastal-zone boundaries, local Coastal Act authority, port boundaries, and areas where the California Coastal Commission retains jurisdiction can overlap or meet. A project that crosses a jurisdictional boundary may require coordination rather than a single application to one agency.

In the coastal zone, development generally cannot begin until a CDP is issued by the responsible local government or the Coastal Commission. “Development” is broader than building a new wall: the Coastal Act definition can include changes in the intensity of land or water use. Once a local government has a certified Local Coastal Program (LCP), most CDP authority is delegated to that city or county. In the ports of Port Hueneme, Long Beach, Los Angeles, and San Diego, port governing bodies exercise similar authority under certified Port Master Plans.

The Commission retains permit jurisdiction in specified areas, including tidelands, submerged lands, and public trust lands. If a design extends across local and retained jurisdiction, ask the Commission and local coastal authority how the CDP process should be coordinated; do not assume the local permit alone covers the full footprint.

Jurisdiction questions to settle first
- Is the parcel or work area in the coastal zone, and which certified LCP or Port Master Plan applies?
- Does any part of the proposed work occupy tidelands, submerged lands, or public trust lands where the Commission retains authority?
- Does the work affect areas under a port authority’s jurisdiction or require a port lease or other authorization?
- Does the project include access routes, staging, or material placement outside the apparent construction footprint?
What a coastal development permit must address
A CDP is not simply permission to construct a particular type of shoreline device. Coastal Act section 30235 provides for qualifying revetments, breakwaters, groins, harbor channels, seawalls, cliff-retaining walls, and similar construction that alters natural shoreline processes when required to serve coastal-dependent uses or protect existing structures or public beaches in danger from erosion. The device must also be designed to eliminate or mitigate adverse impacts on local shoreline sand supply. These criteria are not blanket approval: other Coastal Act policies remain relevant, and the project must be evaluated on its facts.
That distinction matters for new development. A protective device intended to serve an existing structure or public beach is not automatically justified merely because a shoreline is eroding. The project purpose, what is at risk, whether the structure is existing, and whether alternatives can address the hazard all matter to the agency’s review. Coastal Act section 30253 also directs new development to be sited away from coastal hazards to minimize risk to life and property in areas of high geologic, flood, and fire hazard.
Evidence and design issues that may shape review
Coastal agencies may consider whether existing development could be relocated; where the device would sit and how large it would be; technical reports using the best available sea-level-rise projections; alternatives such as beach nourishment or dunes; effects on sand supply; mitigation; maintenance and monitoring; and the proposed authorization duration. These are examples of review considerations, not a universal checklist of studies required for every application.

Because a shoreline device can alter natural processes beyond the point where it is built, sand movement and neighboring shoreline effects deserve attention alongside protection of the property or public beach at issue.

When a USACE permit may be required
A CDP does not answer whether the federal government also regulates the work. USACE administers two authorities that can apply to shoreline protection, with different triggers:
| Federal authority | General trigger | What to examine in the project |
|---|---|---|
| Rivers and Harbors Act section 10 | Structures or work in, over, or under navigable waters | Where the structure and construction activities fall in relation to navigable waters |
| Clean Water Act section 404 | Discharge of dredged or fill material into waters of the United States | Whether the work places or discharges fill or dredged material into regulated waters |
A shoreline structure may trigger section 10, section 404, both, or neither, depending on location and activities. For example, the label “seawall” or “riprap” alone does not settle the question: the work footprint, waters involved, and whether dredged or fill material is discharged are material. Ask the relevant USACE district about the actual design rather than treating the CDP as a substitute for federal authorization.
General permits versus individual review
USACE nationwide permits cover certain qualifying activities with no more than minimal individual and cumulative adverse environmental effects. Depending on the project and district, a nationwide or regional general permit, a letter of permission where available, or an individual permit may be the relevant route. General authorization is conditional: review the current permit terms and California district regional conditions, and confirm whether the proposed activity satisfies them. Do not assume a seawall, revetment, or fill placement qualifies just because a general permit exists.
A USACE jurisdictional determination can identify whether, and where, aquatic resources are treated as regulated. The Los Angeles District recommends obtaining one during planning. Check current district jurisdiction maps and the applicable definition of waters because jurisdictional boundaries and governing rules can change.

Water Board review: section 401 and state discharge requirements
California Water Boards may have a separate role when a federal permit and a discharge are involved, and state water-quality requirements can apply independently. Section 401 water quality certification is for an applicant seeking a federal license or permit for an activity that may result in a discharge to waters of the United States. The relevant federal authorization and discharge determine whether this pathway applies; a CDP alone does not resolve it.
Under the Porter-Cologne Water Quality Control Act, the State and Regional Water Boards also regulate discharges of dredged or fill material to waters of the state. Some categories of project may be covered by general orders if they meet the order’s requirements. A project outside general-order eligibility may need an individual application. A project’s eligibility should be confirmed rather than inferred from the fact that a similar project received general coverage.
The responsible Regional Water Board depends on geography and project scope. Confirm which region covers the site, whether the project crosses regional boundaries, what federal authorization is sought, and whether state procedures or exclusions apply. Water Board review is not interchangeable with the Corps’ review: the agencies administer distinct authorities, even when their reviews relate to the same construction activity.
When CDFW notification or an LSA Agreement may apply
Fish and Game Code section 1602 creates a separate notification pathway for work that may substantially divert or obstruct natural flow; substantially change or use material from the bed, channel, or bank of a river, stream, or lake; or deposit specified debris where it may pass into those waters. CDFW may require notification before the activity. If the department determines the activity may substantially adversely affect fish or wildlife resources, it may prepare a Lake or Streambed Alteration (LSA) Agreement with protective measures.

This pathway is not limited to a continuously flowing stream. CDFW expressly includes ephemeral and episodic streams, desert washes, and watercourses with subsurface flow. A dry channel at the time of a site visit therefore does not by itself establish that section 1602 is irrelevant. The question is whether the proposed activity and watercourse meet the statutory and agency criteria.
Use CDFW’s current EPIMS process and contact the regional office when it is uncertain whether notification applies. Describe the proposed alteration, channel or bank work, materials, and potential debris movement. CDFW notification is not a substitute for a CDP, Corps permit, or Water Board authorization where those separate requirements are triggered.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Species review, CEQA, and local approvals
Protected-species requirements depend on species presence, effects, and the project’s federal involvement. If listed species may be incidentally taken, CDFW authorization under the California Endangered Species Act may be necessary. Federal Endangered Species Act review or authorization may also be implicated depending on the species, effects, and federal action. The existence of a species permit pathway does not establish that a listed species is present at a particular shoreline site; that requires site-specific evaluation.
The California Environmental Quality Act (CEQA) may apply when a public agency considers a discretionary approval. Whether a project is exempt, requires further environmental review, or faces other review obligations is a project-specific determination, not a statewide outcome for all shoreline protection work.

Also check ordinary local requirements. Depending on the site and work, these may include grading, building, encroachment, coastal-zone consistency, and construction permits, plus port approval or a lease or other authorization. Local requirements vary, so identify them with the city or county, port, or other authority with control over the work area.
Emergency repairs are not a general exemption
Emergency procedures can expedite authorization, but they are tied to particular orders and eligibility requirements. The State Water Board lists emergency permitting orders for projects involving discharges of dredged or fill material, including bank stabilization and repair or replacement of structures. Particular orders have notification deadlines. USACE emergency regional permits and matching state certifications may also be relevant.
Before relying on an emergency pathway, verify the current written order, the applicable district, the project’s eligibility, required notices, and any reporting conditions. An urgent repair does not automatically waive otherwise applicable requirements, and an emergency pathway should not be treated as coverage for later permanent work unless the specific authorization says so.

- Map the site and authorities. Identify the coastal-zone boundary, applicable LCP or Port Master Plan, port jurisdiction, and any Commission-retained area such as tidelands, submerged lands, or public trust lands.
- Describe the complete work. Record the structure type, dimensions, location relative to mean high tide and waters, construction access and staging, and all proposed dredging or fill placement.
- Check federal water triggers. Determine whether work or a structure is in, over, or under navigable waters and whether dredged or fill material would be discharged into waters of the United States. Ask USACE whether a jurisdictional determination would help define the regulated area.
- Check state water and channel triggers. Ask the relevant Water Board about section 401 certification and state discharge requirements. Separately assess whether the work could alter a river, stream, lake bed, channel, or bank for CDFW section 1602 purposes.
- Identify resource and land-use reviews. Consider protected species, wetlands, public trust lands, public access, cultural resources, CEQA, local permits, and any port authorization relevant to the site.
- Confirm the pathway with each responsible agency. Provide consistent plans and project details to the local coastal authority, Commission or port as applicable, relevant USACE district, Water Board, and CDFW. Ask which authorizations and notices apply before scheduling construction.
- Do not mobilize until applicable approvals are in place. A generic permit checklist cannot establish site-specific jurisdiction, general-permit eligibility, or emergency coverage.
What this screening framework can—and cannot—tell you
The likely permit combination is determined by parcel boundaries, coastal and port jurisdiction, the design and construction methods, resource delineations, and the project’s purpose. This statewide framework can help identify agencies to contact, but it is not a legal opinion or a project-specific jurisdictional determination. It does not establish an exact processing time, cost, chance of approval, or exemption for any parcel. Those questions require confirmation from the agencies responsible for the actual site and proposed work.
