A mining claim and a power-line right-of-way are different federal land-use interests. A claim concerns eligible locatable minerals on land open to mineral entry; a right-of-way (ROW) authorizes a transmission facility to use specified public land. A claim does not, by itself, convey ownership of the surface or establish a veto over a proposed line. Nor does the existence of a proposed line automatically settle the status of a claim. The answer for any route depends on the parcel’s land status, the claim’s validity and filing history, applicable withdrawals or special laws, and the agencies’ review of the ROW application.
What does each right or authorization cover?
Federal land can be subject to different legal regimes at once. Mineral entry and transmission development are not the same use, and a document authorizing one does not automatically authorize the other. On Bureau of Land Management (BLM)-administered public land, BLM processes applications for high-voltage electric transmission as rights-of-way under Title V of the Federal Land Policy and Management Act (FLPMA) and 43 CFR Part 2800. A mining claim, by contrast, relates to certain locatable minerals and is governed by federal mining laws and land-status rules.

| Question | Mining claim | Transmission line |
|---|---|---|
| What interest is involved? | Rights relating to eligible locatable minerals on land open to mineral entry. | Authorization to use specified public land for a transmission facility under a ROW grant. |
| What process applies? | Claim location and recording, subject to mineral eligibility, land status, and any special procedures. | A complete ROW application and development plan, followed by applicable planning, environmental, and other regulatory review. |
| What must be checked on a particular parcel? | Mineral character, whether the land is open to entry, claim location and timely recording, and any withdrawal or special land regime. | Route and application details, applicable land-use plan, environmental review, and route-specific restrictions. |
| What continues after approval? | Recording, maintenance, and operating obligations depend on the governing rules and circumstances of the claim. | Grant conditions and ongoing requirements for operations, maintenance, vegetation, access, and fire prevention. |
BLM’s guidance on where mining claims may be located explains that only public-domain minerals are locatable through a claim and that the land must be open to mineral entry. Claims cannot be used to locate acquired minerals through the ordinary claim process; BLM identifies prospecting permits as the route for acquired minerals. Eligibility is not established just because land is federally administered or lies in a state where claims are commonly found.

Can a power line cross a mining claim?
The existence of a mining claim alone does not answer whether a proposed line can be authorized, what conditions would apply, or how any effects on mineral activity would be handled. The claim process and the transmission ROW process are separate. The relevant question is how the specific claim, land status, proposed route, and applicable agency decisions interact—not whether one label automatically defeats the other.

Do not infer from the word “claim” that the claimant owns all surface land or has unilateral control over every other use. Likewise, do not assume a ROW will extinguish or override a valid claim. The available BLM guidance establishes separate frameworks but does not create a universal priority rule for every overlap. A particular dispute may turn on the claim’s validity and timing, the ROW application and grant, the land’s status and any withdrawal, and the governing laws for that place.
BLM’s 2016 policy defines high-voltage electric transmission lines for its guidance as lines of 100 kilovolts (kV) or larger. That figure describes the threshold used in that policy; it is not a statement that every line below it is exempt from all federal land-use requirements. For a proposed project, check the applicable agency process and current rules rather than treating the policy threshold as a general permit test. The policy is available in BLM’s guidance for processing high-voltage transmission ROW applications.
How BLM reviews a transmission right-of-way
For a line proposed on BLM-administered public land, the applicant needs a federal land-use authorization. BLM says it begins processing a high-voltage transmission application after receiving a complete application, including a sufficiently detailed plan of development. The agency must also consider its land-use plan, environmental requirements, and other applicable rules. Submission is not the same as approval, and a route may require revision or encounter constraints as those reviews proceed.

- Identify the land and route. Determine which parcels the proposed facilities and associated activities would cross and which agency administers each tract. Federal land is not one uniform category; surface and subsurface responsibilities and special designations can differ.
- Establish mineral and claim status. Check whether the land is open to mineral entry, what minerals are involved, whether any claim was located and recorded, and whether a withdrawal or special statute applies. A claim’s presence on a map is not, by itself, a complete validity determination.
- Prepare the ROW application. BLM’s cited policy calls for a complete application and sufficiently detailed plan of development. The materials must describe the proposed project sufficiently for the agency to conduct its review; exact requirements should be confirmed with the responsible BLM office for the project.
- Complete agency review. BLM evaluates the application against land-use planning, environmental requirements, and other applicable regulations. A route’s feasibility therefore depends on more than the existence or absence of a claim.
- Meet grant conditions during construction and operation. If BLM grants the ROW, the holder must follow the grant and applicable ongoing requirements, including rules for maintenance, vegetation management, access, and fire prevention.
BLM’s November 18, 2016 policy is agency guidance, not a substitute for current regulations or field-office direction. It is specifically about proposed high-voltage lines of 100 kV or larger. For an active project, applicants and affected land users should confirm current requirements with the relevant BLM office and review the applicable land-use plan and project documents.
How claim location, recording, and withdrawals affect the analysis
Land must be eligible before a claim can be located
BLM describes claims as available only for qualifying locatable minerals on land open to mineral entry. It lists federally administered lands in 19 states where a mining claim or site may be located, including certain National Forest System lands. That state count is not a blanket eligibility rule: a particular parcel must still be open, and the mineral and surface status must be checked. BLM is responsible for subsurface minerals on both BLM public land and National Forest System land, but that does not mean every such parcel is open to a new claim.
Federal recording has a deadline, and county requirements may be sooner
After a claim is located, BLM says it must be recorded with both the BLM state office and the relevant county office. The federal deadline is 90 days after location; a county’s filing deadline can be shorter. Details and current filing instructions are on BLM’s claim and site recording page. A missed deadline or incomplete record can matter to the claim’s status, so a route review should examine the actual filing history rather than rely only on a claimant’s description or a map display.

Power-site withdrawals have special procedures
Some land has been set aside for power development. The 1955 Mining Claims Rights Restoration Act allows mining, developing, and using minerals on certain public lands withdrawn for power purposes, but BLM describes restrictions and special notice and filing procedures. For the procedures described by BLM, a claimant marks the certificate “Filed under PL 359”; placer mining cannot begin until 60 days after the certificate is filed with BLM. BLM also says the Federal Energy Regulatory Commission (FERC) and the surface-management agency have 60 days to respond to notice, and a hearing may be planned if proposed mining would interfere with existing energy uses. These are specific withdrawal procedures, not a general waiting period for every mining claim or transmission project. See BLM’s recording and power-site withdrawal instructions for the agency’s details.

Which route constraints can change the outcome?
Land designations can limit where a ROW may be granted, independently of any mining claim. BLM’s transmission policy states it cannot grant a ROW through congressionally designated Wilderness. It also describes a non-impairment standard for Wilderness Study Areas and says most high-voltage line projects will not be able to meet that standard. Those constraints make route selection and land-status review central to project planning; a claim search alone will not reveal them.
Other project-specific constraints arise from the applicable land-use plan, environmental review, and other regulatory requirements. A route that appears available on a general map may therefore require further analysis or a change in alignment. Conversely, the existence of a claim does not, by itself, show that a route is prohibited. BLM’s policy for transmission applications sets out the agency’s planning and review context in its high-voltage transmission ROW guidance.

What obligations apply after a power line is built?
Authorization is not simply a one-time construction approval. FLPMA Section 512, added in 2018, led to regulations covering operations, maintenance, and fire prevention for power-line ROWs and adjacent federal land. BLM says the final rule was published April 12, 2024, and took effect May 13, 2024. Covered operating plans or agreements address inspection, operation, maintenance, and vegetation management—including hazard trees—to support reliability, public safety, and fire-risk reduction.
BLM’s implementation material identifies subjects such as routine and emergency maintenance, access and staging, vegetation work, fire communications, and fire stipulations. These continuing responsibilities matter to construction planning because the ROW must be managed after installation, not just built. The agency’s Electric Power Lines Rights of Way page provides its overview of Section 512 and implementation. The applicable grant and project documents determine how the requirements are implemented for a particular line.

A landowner, claimant, project proponent, or concerned member of the public should assemble records for the exact parcel and compare them with the proposed project documents. A claim number or route map is a starting point, not a complete legal answer.

When the issue is an actual conflict over a specific claim or route, the records should be reviewed together by a lawyer familiar with federal public-land and mining law. BLM’s general guidance explains the systems, but does not resolve the legal status or priority of rights on an unidentified parcel.
The practical answer
A mining claim is about eligible minerals; a transmission ROW is permission to use specified federal land for a line. Neither label alone determines whether construction may proceed across a particular location. The decision turns on parcel-level facts, claim and filing records, withdrawals or special designations, the ROW application and grant, and required agency review. For BLM land, assess those elements separately and then evaluate how they interact under the rules applicable to that route.
