What Middle-Income Renters Should Look for in an Apartment Lease

A practical U.S. apartment lease checklist for renters: calculate the full cost, verify responsibilities and deadlines, and check local tenant rules.

Before signing an apartment lease, calculate the full move-in amount and all-in monthly cost, then check the rules for rent, fees, utilities, repairs, deposits, renewal, guests, pets, and ending the lease early. Ask for unclear charges or promises in writing, keep a complete copy of the signed lease and addenda, and verify legal questions with the tenant agency for the property’s state or city. This is general U.S. information: a clause appearing in a lease does not by itself establish that it is lawful.

What to look for before signing an apartment lease

Read the entire lease, including attachments and building rules incorporated by reference. Do not rely only on the advertised rent, a verbal explanation, or the first page. For each cost or obligation, identify what you must do, when it is due, how it is calculated, and whether it recurs or can change.

For a useful side-by-side comparison of apartments, assess each one against the same household budget and the rules that apply at its location:

  • Total cash required before move-in.
  • Recurring all-in monthly cost, including separately billed services.
  • Lease length, renewal process, and notice requirements.
  • Utility responsibility and maintenance procedures.
  • Deposit conditions and possible move-out deductions.
  • Restrictions and the cost or process for leaving early.

For a middle-income household, the practical question is not simply whether the advertised rent fits the budget. Add the one-time cash needed to get the keys, recurring costs that may be billed separately, and any charges that depend on how you use the apartment. Then consider whether the lease’s deadlines and restrictions fit your plans. A lower advertised rent may not mean a lower total cost if utilities, parking, or other recurring charges are separate; compare the written terms rather than assuming services are included.

USAGov advises tenants to read the lease carefully before seeking outside help and points renters to state tenant-rights agencies and handbook resources: USAGov tenant rights. The Consumer Financial Protection Bureau (CFPB) notes that tenant rights are usually set out in the rental agreement and state or local law: CFPB tenant and debt collection rights.

How much will you owe before moving in?

Make a written move-in budget before committing. HUD renter education lists several possible upfront costs, but a particular property may charge only some of them, and local law determines which charges are permitted. Ask the landlord to identify each amount, its due date, who receives it, and whether it is refundable.

  • Application or screening charge.
  • Security deposit and any separately named deposit or fee.
  • First month’s rent and, if required, last month’s rent.
  • Pet deposit or recurring pet rent.
  • Renters insurance, if the lease requires it or you choose to purchase it.
  • Utility or internet setup charges and any other move-in fees.

Separate one-time costs from monthly ones, and distinguish refundable deposits from nonrefundable charges. Renters insurance, internet, and utilities can add to the ongoing household expense even if they are not collected by the landlord. HUD’s renter education discusses these categories as potential costs, not charges every renter will face: HUD renter education and counselor training.

Ask the property manager to put the move-in total in writing, including the amount due and the date each payment is due. A useful budget separates money paid before move-in from expenses that recur after you take possession. Also note which costs go to the landlord and which may be paid to a utility, internet provider, or insurer. This makes it easier to compare apartments on the same basis without treating every possible HUD-listed category as a charge that applies to every property.

What fees should be listed in the lease?

Compare the advertised rent with every recurring or conditional charge named in the lease or its addenda. Record the base rent, due date, accepted payment methods, any stated grace period, late charges, returned-payment charges, and other recurring fees. Ask how any variable charge is calculated and when it may change.

CFPB says a landlord cannot demand charges that were not agreed to or that state or local law prohibits. That does not mean every written fee is valid: the applicable law depends on the rental’s location and circumstances. Check unclear or disputed charges with the state or local tenant agency rather than assuming the lease settles the question.

For each fee, ask what it covers, whether it is one-time or recurring, when it is payable, and whether it can be refunded. If a fee is conditional, such as a late-payment charge, check the event that triggers it and how the amount is determined. Keep a copy of the written explanation along with the lease. Do not assume a fee is allowed simply because it is printed in a contract, or assume it is prohibited without checking the applicable state and local rules.

Who pays utilities and handles repairs?

Utilities and services

Make a list of electricity, gas, water, sewer, trash, internet, parking, laundry, and building or amenity fees. For each item, establish who opens the account, who pays, and whether the service is separately metered or allocated among residents. If a bill is allocated or variable, ask for the calculation method and where it is described in the lease.

HUD notes that a rental agreement can assign utility responsibility to the renter. Confirm that responsibility in the lease rather than assuming that a service is included in rent.

Check the service details that affect your actual monthly budget: whether a utility account must be opened in your name, whether the landlord bills you, and whether a shared bill is divided by a stated method. If the lease or an incorporated rule is unclear, ask for an explanation before signing. The available information does not establish one standard billing method or a universal list of utilities that a landlord must cover.

Repairs, routine care, and reporting

Identify how to submit ordinary maintenance requests and where to report urgent problems. Check which routine care tasks the lease assigns to you, and keep copies of requests and replies. HUD notes that most repairs and maintenance generally fall to the landlord, while the lease may assign reasonable care tasks to renters. CFPB says landlords cannot refuse necessary repairs, but the precise legal standard and available remedies depend on local law.

Document the apartment’s condition at move-in with dated notes and photographs, including existing damage. Keep that record and later maintenance correspondence with your lease. Do not assume a generic checklist determines a landlord’s legal duties or the steps you must take if a repair is not made.

Before moving in, make sure you know how to report a problem and how to preserve a record of doing so. For urgent issues, use the contact method the lease or property manager identifies, then save the message or other confirmation. A written record can help you keep track of what was reported and when; it does not replace local procedures or determine what remedy may apply.

What should you check about the security deposit?

Record the deposit amount and read the lease’s stated rules for deductions and return. If the lease uses separate names for a deposit, fee, or pet charge, ask whether each amount is refundable and under what conditions. Check how to provide a forwarding address and what process the lease describes for returning the balance.

Photograph the apartment at move-in and move-out, retain receipts, and save written communications. Deposit limits, itemized-accounting rules, and return deadlines are often governed by state or local law; the federal sources reviewed do not establish one nationwide deposit amount or deadline. Consult the tenant agency or local tenant guide for the property’s location.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep your dated condition record and communications together so you can refer to them at move-out. Read the lease’s stated deduction and return process, but verify local rules on deposit limits, accounting, and timing rather than treating a lease term as a nationwide rule. The available federal sources do not give a universal deadline or deposit cap.

How do lease dates, renewal, and notice work?

Check the exact start and end dates. Then find out whether the lease renews, converts to month-to-month, or ends on its stated date, and what written notice either side must give. Verify the required delivery method for notice—such as a specified address or method—and the deadline for it to count.

Look for language explaining whether rent can change at renewal and how that change is communicated. The federal overview cited here does not establish a single nationwide notice period or rent-increase limit. Confirm the relevant state and city rules with the appropriate tenant agency.

Put any notice deadline on your calendar after you confirm how and when notice must be delivered. Do not assume that a conversation or an email counts if the lease specifies a different delivery method. If a renewal, month-to-month conversion, or rent-change term is unclear, ask for an explanation in writing and verify the local rule before relying on a particular deadline.

Which household rules and restrictions matter?

Review rules that affect your household and daily use of the apartment, including:

  • Approved occupants, guest limits, and any process for adding a resident.
  • Pets, related deposits or monthly rent, and applicable restrictions.
  • Smoking, parking, storage, laundry, and building amenities.
  • Decorating, alterations, and responsibility for appliances.
  • Subletting, assignment, or replacing a tenant.

Read every addendum and any building rules incorporated into the lease. If a disability accommodation or another protected issue is relevant, federal fair-housing protections may apply; the CFPB summarizes federal protections and notes additional protections in federally assisted housing. For a particular situation, seek authoritative, case-specific guidance rather than treating a general checklist as a legal determination.

These rules can affect whether a home works for your household even if they do not appear in the rent line. For example, check whether a regular guest or a future additional occupant needs approval, and whether pet-related costs recur or are one-time. Read the actual attached rules instead of relying on a summary from a listing or conversation.

Can you break the lease early, and what will it cost?

Find the lease’s terms for early termination, replacement tenants, assignment, and subletting. Check the notice required, the process to follow, and how any charge is calculated. If the landlord agrees to an exception or a different arrangement, ask for it in a signed writing and retain the copy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not assume that an early-termination charge is enforceable—or invalid—based on a general article. The rules depend on the property’s location and circumstances; the source material here does not establish a nationwide early-exit rule. Ask the relevant state tenant agency or a local legal-aid provider about the applicable requirements before acting.

If your plans may change during the lease, compare the written exit options before signing rather than relying on an informal assurance that you can leave later. Find out whether the lease addresses a replacement renter or subletting, what steps and notice apply, and how a stated charge is calculated. The available information does not supply one standard fee or a nationwide right to end a lease early.

What if a rental screening report affected the terms?

If a screening report led to a rental denial, a higher deposit, or another adverse term, CFPB says the landlord must provide notice and the screening company’s contact details. You can request a free copy of the report from that company within 60 days, check it for inaccurate or outdated information, and dispute errors in writing with the company that created the report and the source of the incorrect information.

Keep the notice and your written dispute with your rental records. The 60-day period applies to requesting the free report from the screening company; check the notice for the company’s contact details. If you find inaccurate or outdated information, CFPB’s guidance is to dispute it in writing with both the reporting company and the source of the inaccurate information.

How to review and keep a complete lease record

  1. Collect the full document. Get the proposed lease, every addendum, and any building rules it incorporates. Check that you have all pages and attachments before reviewing.
  2. Build the cost picture. Write down move-in charges, recurring costs, due dates, payment methods, and any variable bills. Ask for the calculation of charges that are not clear.
  3. Mark obligations and deadlines. Note maintenance-reporting steps, household restrictions, notice requirements, renewal terms, and early-exit procedures.
  4. Resolve ambiguity in writing. Ask the landlord to clarify unclear terms or promises and keep the response. If an agreement changes the lease, request a signed written record.
  5. Verify location-specific questions. Use the state or local tenant agency or handbook for rules on fees, deposits, notice, rent changes, repairs, and termination.
  6. Save the final record. Keep the complete signed lease, all addenda, written promises, payment receipts, and dated move-in condition records. These are prudent records, not a claim about a universal statutory requirement.

After signing, keep the complete final version rather than only the first page or a draft. Addenda and incorporated building rules can contain obligations that are not obvious in a rent summary. Save payment receipts, written promises, and dated condition notes in the same record set so you can find them if a question comes up later.

Where to get help with a lease question

Start with the state tenant-rights agency or handbook for the rental’s location. If the dispute is significant or the language is difficult to interpret, possible help channels include local legal aid, a local bar association referral, and HUD-approved housing counselors that offer rental counseling. Confirm that a counseling agency provides rental counseling before relying on it.

USAGov says HUD’s Multifamily Housing Complaint Line applies when HUD insures or manages the property, so it is not a general complaint route for every rental. CFPB provides tenant-rights information and points renters toward legal help and HUD housing counseling.

CFPB also says a landlord cannot force a tenant out by changing the locks without a court order. If you face a dispute or possible removal, read the lease and seek local, situation-specific help rather than relying on a general checklist. State and local procedures matter, and USAGov identifies the state tenant agency, legal aid, and other local resources as possible places to start.

Frequently Asked Questions

What should I look for before signing an apartment lease?

Read the complete lease and addenda. Check the full move-in and monthly costs, payment and late-fee terms, utilities, repairs, deposits, lease dates, renewal and notice rules, household restrictions, and early-exit terms. Ask for unclear promises or charges in writing and verify legal questions with the tenant agency for the property’s location.

What fees should be listed in my lease?

Review base rent, recurring fees, conditional charges such as late or returned-payment charges, and any move-in fees or deposits. Ask when each is due, whether it recurs or is refundable, and how a variable amount is calculated. A fee appearing in a lease does not by itself establish that it is permitted; state and local law may apply.

Who pays utilities and handles repairs?

The lease may assign utility responsibility to the renter. Check who opens and pays each account and how any shared or variable bill is calculated. Confirm how to report routine and urgent repairs and which care tasks are assigned to you. Local law determines the precise duties and remedies.

How much will I owe before moving in?

Possible costs include an application charge, security deposit, first and last month’s rent, pet deposit or pet rent, renters insurance, and utility or internet setup costs. Not every property charges all of these. Ask for the specific total, due dates, payees, and which amounts are refundable.

Can I break my lease early, and what will it cost?

Check whether the lease addresses early termination, replacement tenants, assignment, or subletting, and how it sets notice and charges. There is no single nationwide early-exit rule established by the reviewed sources. Verify the law for the property’s location and get any agreed exception in a signed writing.

What happens when my lease ends?

Check whether it renews, converts to month-to-month, or ends on the stated date, and what written notice each side must give. Verify the delivery method and deadline, and check how rent may change at renewal. Notice periods and rent-increase rules depend on location.

Can my landlord charge this fee?

A landlord cannot demand charges that were not agreed to or that are prohibited by state or local law, according to CFPB guidance. Whether a specific written charge is allowed depends on the circumstances and location. Check with the relevant tenant agency rather than assuming the lease alone resolves it.

What can I do if a rental screening report led to a higher deposit or denial?

CFPB says the landlord must provide notice and the screening company’s contact details. You can request a free report from that company within 60 days, check for incorrect or outdated information, and dispute errors in writing with the company and the source of the inaccurate information.

The Bottom Line

Before signing, compare apartments by total move-in cash and all-in monthly cost, then confirm payment terms, utilities, repairs, deposits, renewal, notice, household rules, and early-exit procedures. Keep the complete signed lease and records, and check state and local rules before concluding that a fee, deadline, or remedy is lawful.
