What the Building Safety Levy Means for Developers, Contractors and Homeowners

England’s Building Safety Levy is payable by the client commissioning a qualifying development—not automatically by its contractor or by the homeowner. Scope, rates and exemptions depend on project details.

The project client—the person or organisation commissioning construction—is legally responsible for paying England’s Building Safety Levy when a qualifying development is chargeable. Contractors are not liable simply because they carry out the work, and homeowners do not owe the levy merely because they buy, own or occupy a home. The levy took effect on 1 October 2026; whether a project is in scope and how much is due depends on its building-control application, development type, local-authority rate, chargeable floorspace, land status and any applicable exemption.

What is the Building Safety Levy?

The Building Safety Levy is a charge on certain new residential developments in England. The Building Safety Act 2022 gave the Secretary of State power to impose a levy to meet building-safety expenditure; the Building Safety Levy (England) Regulations 2025 implement that charge. The 2025 regulations and the Building Safety Levy (Amendment) (England) Regulations 2026 came into force on 1 October 2026. The levy does not apply UK-wide: the rules described here are for England.

The government’s policy is for the development sector to contribute towards the costs of life-critical building-safety remediation. Its 2025 impact assessment said £5.1 billion had been allocated from general taxation for remediation and set out a levy target of £3.4 billion over around 10 years. That £3.4 billion is an estimate of intended future revenue, not money already collected or a guaranteed final total. The assessment also forecast Exchequer impacts of £55 million in 2027–28, £245 million in 2028–29 and £345 million in 2029–30. These were forecasts certified by the Office for Budget Responsibility, not receipts to date. Read the government’s 2025 impact assessment.

Who pays the Building Safety Levy?

The client is the statutory payer

The regulations place payment responsibility on the client: the person or organisation commissioning the construction project. In a typical development commissioned by a developer, that developer will commonly be the client, but the legal test is the commissioning relationship—not a job title. Local authorities administer the levy by calculating and collecting it.

Contractors are not automatically liable

A main contractor or subcontractor does not become the statutory payer merely by undertaking construction. The client and contractor can agree how the commercial cost is handled in their contract, but that allocation does not change who the regulations identify as responsible to the collecting authority. A contractor should therefore distinguish a contractual obligation to absorb or account for a cost from statutory liability for the levy itself.

Homeowners do not receive a direct levy bill

Buying, owning or living in a home does not by itself make a person liable for the levy. The government’s impact assessment recognises that development costs can affect viability and may be absorbed by landowners, developers or consumers. Any resulting effect on prices, land values, supply or development decisions is uncertain; the rules do not prescribe a fixed amount to add to a home’s price, nor do they make the purchaser the levy payer.

Does the Building Safety Levy apply to my development?

Start with the building-control application or notice, the project’s proposed output and the relevant dates. The main thresholds are 10 or more new dwellings, or 30 or more new bedspaces in purpose-built student accommodation (PBSA), in specified building-control approval applications or initial notices. Meeting a threshold does not alone establish that a charge is due: charging conditions, exemptions and the detailed regulations still apply.

  • New dwellings: the principal threshold is 10 or more.
  • Purpose-built student accommodation: the principal threshold is 30 or more new bedspaces.
  • Work that creates neither: an extension or improvement that provides no new dwelling or PBSA bedspace is generally outside the charge.

Projects submitted before 1 October 2026 need particular care. Transitional provisions can affect whether the levy applies, and the 2026 amendment regulations provide that certain Part 3 amendments do not apply to specified later variation applications or commencement notices linked to an original application made before 1 October 2026. A later notice date alone is not enough to determine liability. Check the original application date and the relationship between the original application and subsequent notices against the applicable provisions. The 2025 regulations and 2026 amendment regulations, together with the official guidance, set out the legal framework.

Projects to check before assuming they are out of scope

A scheme may appear below a threshold or exempt, but the relevant route can still require information so the collecting authority can establish that no charge is due. Do not rely solely on a project description, planning label or general use of the term “brownfield.” Confirm the building-control route, the kind and number of new units or bedspaces, the application dates and any specific exemption conditions.

For example, the threshold and type of development are separate checks: a residential proposal must be assessed by its number of new dwellings, while PBSA is assessed by new bedspaces. A project that meets the relevant number still needs to be tested against charging conditions and exemptions. Conversely, an extension that produces no new dwelling or student bedspace is generally outside the charge, although information may still be needed to confirm that position.

How is the levy calculated?

The amount is based on a rate per square metre of chargeable residential floorspace. The applicable standard rate varies by local-authority area, and the published schedule provides an area-specific rate. This is not a single national fee per dwelling. A reliable project estimate therefore requires, at minimum, the collecting authority, the relevant site category and the chargeable floorspace.

Calculation factor What to establish
Local-authority area Identify the authority and the applicable rate in its published schedule.
Site category Determine whether the standard rate or qualifying previously developed land rate applies.
Chargeable floorspace Measure eligible residential floorspace by gross internal area, including qualifying resident communal areas and excluding specified non-chargeable areas.
Project scope and exemptions Check dwelling or PBSA bedspace numbers, charge conditions and any exemption before treating the calculation as payable.

In practical terms, two developments with the same number of homes can have different levy calculations if they are in different local-authority areas, have different chargeable gross internal areas, or fall into different site categories. A qualifying previously developed site uses half the standard rate, but it is not enough simply to compare the projects’ descriptions as “brownfield” or “greenfield.” The schedule and site evidence determine which rate is relevant. No project estimate should be treated as final without checking the applicable rate and floorspace basis.

What counts as chargeable floorspace?

Chargeable floorspace is measured as gross internal area and covers new residential floorspace, including qualifying dwellings, PBSA and relevant communal areas for residents. Resident-only areas such as stairways, lobbies, plant rooms and an occupants-only gym may count. Areas intended for general public use do not. Floorspace for social or supported housing and accommodation that is exempt is excluded under the guidance. The unit schedule and building plans should therefore distinguish resident-only facilities from publicly accessible or otherwise excluded space.

This distinction matters when assembling plans for the calculation. Identify the area and purpose of each shared facility, rather than assuming that all common space is treated alike. A lobby used only by residents may count, while an area intended for general public use does not. Keep the gross-internal-area measurement and the treatment of excluded accommodation clear so the collecting authority can check the calculation.

Is brownfield development discounted?

A qualifying previously developed site is charged at half the standard rate. The discount has a specific regulatory test; describing a site as “brownfield” in ordinary conversation does not establish eligibility. At least 75% of the land within the planning-permission redline must meet the defined previously developed land criteria, assessed at the relevant date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The definition generally concerns land that has a building on it, or had one on or after 1 July 1948. It excludes specified cases, including land used for agriculture or forestry, mineral extraction or landfill, unlawful operations, and land with a wholly underground building. The 2026 amendments clarify parts of the definition and how land is calculated. The guidance also states that permitted development rights are charged at the discounted rate.

For a site-level decision, compare the planning redline against evidence of the qualifying land uses and structures, and calculate the qualifying share rather than treating the whole site as eligible by default. If the 75% test is not met, the reduced rate is not established by the site’s informal label alone. The official guidance explains the rate and land tests.

What projects are exempt?

The impact assessment lists exemptions that include developments with fewer than 10 dwellings; affordable housing; prisons and criminal justice accommodation; schools; children’s homes; care homes; hospitals; domestic-abuse refuges; hotels; hostels; almshouses; temporary accommodation for homeless people; hospices; and dwellings built by non-profit registered providers of social housing.

This list is not a substitute for the legal wording. An exemption depends on the regulatory conditions for the relevant type of development. Do not assume that every affordable, public-sector or socially beneficial scheme qualifies simply because of its description or intended occupants. Check the current regulations and guidance for the precise eligibility criteria and the evidence the authority requires. Even where the project is exempt or no charge is payable, chargeability information may still need to be submitted so the collecting authority can verify the position.

How does the application, payment and review process work?

The client supplies the required levy information as part of the applicable building-control process. The route may involve local-authority building control, a registered building control approver or the Building Safety Regulator. The collecting authority calculates the amount and issues either a liability notice or a no-charge notice. Payment timing and certificate arrangements vary with the route; follow the current route-specific guidance and the collecting authority’s instructions.

  1. Identify the correct building-control route and dates. Record the original application or notice date and any later variation or commencement notice, especially where the project spans 1 October 2026.
  2. Provide project and levy information. Supply the information required for the project type, including the relevant dwellings or PBSA bedspaces, floorspace and any exemption or land-status evidence.
  3. Review the authority’s notice. Check whether the authority has issued a liability notice or a no-charge notice and verify the calculation and assumptions against the project information.
  4. Pay and retain the required evidence. Meet the applicable payment deadline and follow the building-control route’s requirements for certificates.
  5. Challenge a disputed decision through the prescribed process. A client may request a review of liability or calculation and then appeal to the First-tier Tribunal.

What happens if information or payment is missing?

  • Required information not supplied can result in the application or notice being rejected.
  • Non-payment can prevent a completion certificate or, under the registered-approver route, lead to rejection of a final certificate.
  • If liability or the amount appears wrong, use the prescribed review and appeal process rather than assuming that a contractual allocation settles the authority’s calculation.

The notice and certificate steps make it important to plan for levy information as part of the building-control submission, rather than leaving it until completion. The client should coordinate with the design, commercial and building-control teams on unit counts, plans, floorspace evidence and any claimed exemption or land discount. The exact submission and payment sequence is route-specific, so use the current instructions rather than assuming one timetable applies to every project.

What to gather before estimating a project’s levy

A project-specific figure cannot be derived from the national threshold alone. Assemble these details before asking for or checking a calculation:

  • The local-authority area and the rate schedule applicable to the project.
  • The number of new dwellings or PBSA bedspaces, and whether the development meets the relevant threshold and charging conditions.
  • The planning-permission redline and evidence relevant to the 75% previously developed land test.
  • Gross internal area for chargeable residential space, with resident communal areas distinguished from general-public areas and excluded floorspace.
  • The exemption category, if one may apply, and evidence that satisfies its precise conditions.
  • The building-control route, the original application date, and dates and links to any subsequent variation or commencement notices.

Rates, project facts and transitional provisions can change the result. For a live development, verify the current local-authority schedule and route-specific instructions against the official guidance and legislation rather than relying on a generic per-home estimate.

Frequently Asked Questions

Who pays the Building Safety Levy?

The client commissioning the construction project is the statutory payer. A developer will commonly be the client for its own scheme, but the regulations use the commissioning relationship rather than a job title. Local authorities calculate and collect the levy.

Does the Building Safety Levy apply to my development?

The principal thresholds are 10 or more new dwellings or 30 or more new bedspaces in purpose-built student accommodation, in qualifying building-control applications or notices. Charging conditions, exemptions and the application date also matter. An extension that creates neither a dwelling nor a PBSA bedspace is generally outside the charge.

Will contractors or homeowners have to pay it?

Contractors and subcontractors are not statutory payers merely because they perform the work, although a contract can allocate the commercial cost differently. Homeowners are not directly liable simply because they buy, own or occupy a home. Any indirect effect on prices or land values is uncertain, not a fixed legal charge on purchasers.

How is the levy calculated?

The authority applies the rate for the relevant local-authority area to chargeable residential floorspace measured by gross internal area, with applicable exclusions and any qualifying rate reduction. The amount depends on the site category, area, project facts, chargeable space and exemptions; there is no single national fee per home.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is brownfield development discounted?

A qualifying previously developed site is charged at half the standard rate. At least 75% of the land within the planning-permission redline must meet the regulatory land criteria at the relevant date. The ordinary label “brownfield” does not by itself prove eligibility.

What projects are exempt?

The impact assessment lists categories such as affordable housing, specified public and care accommodation, hotels, hostels, hospices and some social-housing-provider dwellings, as well as developments with fewer than 10 dwellings. The precise regulatory conditions control, and information may still be required to confirm an exemption or no-charge result.

The Bottom Line

The levy is an England-only charge on qualifying new residential development, and the client commissioning the project—not automatically its contractor or a homebuyer—is responsible for paying it. Thresholds, transitional dates, local rates, chargeable floorspace, a narrowly defined previously developed land discount and exemption conditions all affect the result. For a live scheme, check its original building-control application date and route, current local-authority schedule, site evidence and gross internal area against the official regulations and guidance.
