A failed structural or fire safety audit does not automatically mean a building must close or be evacuated. It means a defect or shortcoming has been identified and must be assessed against the relevant safety and legal requirements. The next step may be advice and a repair plan, or—if the risk and legal powers justify it—a statutory notice, restrictions on access or work, or prosecution. The outcome depends on the finding, the building and its location.
What does “failing an audit” mean?
There is no single legal procedure called “failing an audit.” The phrase might refer to a private engineer’s assessment, a fire safety inspection, a building control inspection of work, or an inspection under a specific building safety regime. A private auditor’s report identifies findings; it is not, by itself, a government closure order.

The response turns on what was inspected, who has legal responsibility, how serious and immediate the risk is, whether the building is occupied, and which authority has jurisdiction. The examples below focus mainly on England and Wales. The higher-risk building requirements described later apply to England.
What may happen after a failed audit?
The auditor or authority records the deficiency and considers it against the applicable standard. The possible outcomes differ according to risk and enforcement powers:
#1 Best Overall
| Finding and situation | Possible next step | What it means for occupants or work |
|---|---|---|
| A deficiency that does not call for immediate statutory action | Advice or a non-statutory notice/action plan setting out corrective steps and a suggested timescale | It does not itself impose a statutory closure requirement. The authority may follow up; failure to take appropriate action can lead to formal enforcement. |
| A fire safety breach requiring formal action | A statutory enforcement notice identifying the alleged breach and required or suggested remedial measures | The notice sets out what must be addressed. It may allow more than one way to achieve compliance. |
| A fire risk assessed as so great that access must be stopped or restricted | A prohibition notice | It takes effect immediately. The authority determines whether access is prohibited or restricted; this is not the automatic result of every failed inspection. |
| Building work that does not comply with building regulations, or presents a serious risk in defined circumstances | A compliance notice requiring corrective action by a deadline, or a stop notice requiring work to stop | A stop notice applies to work, not automatically to the whole occupied building. The actual notice defines what must stop or be corrected. |
| A contravention in an occupied higher-risk building in England | A Building Safety Regulator compliance notice; an imminent danger may lead to an urgent action notice with a shorter correction period | An urgent action notice remains effective during an appeal unless the tribunal suspends it. |
For fire safety enforcement in England, the Home Office guidance says authorities should act proportionately to risk, taking account of the condition of precautions, cooperation and compliance history. A non-statutory notice may be used to encourage compliance before statutory action. Authorities can follow up, and failure to take appropriate action can lead to a statutory notice. The notice and the law governing it determine the recipient’s obligations and any deadline.
Can a building be closed or evacuated?
It can be, but a failed audit alone does not establish that closure or evacuation is necessary. For fire safety in England and Wales, an authority may issue a prohibition notice if it considers the fire risk so great that access should be prohibited or restricted. Such a notice takes effect immediately. The restriction depends on the authority’s assessment and may concern access to all or part of the premises.
Building regulations stop notices address work in defined circumstances, including work that may present a risk of serious harm or failure to comply with a prior compliance notice. They should not be described as automatic orders to vacate an entire building. For structural concerns, an engineer may recommend temporary safeguards or limits on use while the defect is assessed, but the supplied official guidance does not establish a universal closure rule or reopening test for every structural finding.

What happens when the finding is structural?
Establish the risk and the remedy
A structural audit is not necessarily a building control enforcement action. A competent structural engineer may need to determine the defect’s cause and severity, whether temporary safeguards are needed, and what permanent repair is appropriate. The specific remedy depends on the structure and the evidence; there is no single repair method that follows from the word “failed.”
Who pays for remedial work?
For faulty building work in England, government building regulations guidance says the relevant building control body may require the person responsible to pay to fix it. That statement should not be generalized to every defect in an existing building or every private audit. Responsibility and cost allocation depend on the facts and applicable legal duties.

For specified multi-occupied residential buildings in England with fire or structural safety defects, government remediation guidance describes regulatory powers intended to secure remediation and interim measures. Interim measures may protect residents while remediation progresses; the stated goal is a sustainably safe and liveable condition. The measures required in a particular building depend on its risks and the regulator’s powers.

Who must act on the findings?
The person or organisation legally responsible depends on the building, the work and the duty involved. A notice identifies its recipient and the alleged breach or required action; a private report may identify a client, owner or dutyholder without itself deciding legal liability. Do not assume that the auditor, landlord, contractor or building owner is automatically responsible for every repair. Check the report and any statutory notice, and obtain qualified advice if responsibility is disputed.
For building regulations enforcement in England, the relevant building control body may require the person responsible to pay to correct faulty work. That power is tied to the applicable building work and enforcement regime, not a general rule assigning all building maintenance costs to one party.

What if a notice is ignored or work is not corrected?
Failure to comply can escalate the matter. Under England’s building regulations enforcement guidance, failing to comply with a compliance notice or stop notice is a criminal offence, with a maximum penalty of an unlimited fine and/or two years in prison. The building control body may also require the responsible person to pay to fix faulty work.
For fire safety, prosecution may be brought where the legal criteria are met. Home Office enforcement guidance says this may include a breach so serious that people would be exposed to a risk of death or serious injury in a fire. Government fire safety guidance describes penalties including fines or imprisonment, with major penalties reaching unlimited fines and up to two years in prison. Those maximums do not automatically apply to every defect or notice.

Appeal rights, forums, deadlines and whether a notice is suspended depend on the notice type. In England and Wales, a person served with an enforcement, prohibition or alterations notice under the Fire Safety Order may appeal to the magistrates’ court within 21 days of service, according to Home Office guidance published in 2026. A fire notice is generally suspended while an appeal is pending, but a prohibition notice is not suspended unless the court directs otherwise.

For a Building Safety Act compliance notice under the relevant England regime, an ordinary compliance notice is suspended pending a tribunal appeal; an urgent action notice is not, unless the tribunal orders otherwise. The Building Safety Act 2022, section 103, provides that an ordinary compliance notice is of no effect pending final determination or withdrawal of the appeal. These appeal rules are specific to their respective regimes and should not be transferred to other notices.
- Read the whole notice promptly, including its service date, deadline, required steps, appeal route and any stated effect on access or work.
- Make sure it reaches the people in the organisation who need to act on it.
- Do not ignore a notice while disputing it. Get advice quickly and use the appeal route stated in the applicable guidance or notice.
Do higher-risk buildings have extra reporting duties?
In England, the Building Safety Regulator’s reporting guidance defines a higher-risk building for this reporting regime as one at least 18 metres tall or with at least seven storeys, and with at least two residential units, or a hospital or care home. This definition is specific to the reporting regime; it does not apply to every building safety rule or jurisdiction.
A specified safety occurrence involving structural failure, fire safety during design or construction, or fire or smoke spread during occupation must be reported when it creates the stated risk of death or serious injury to a significant number of people. The guidance requires a report within 10 calendar days after notice, even if the occurrence is remedied immediately, subject to a stated exception for some issues remedied during ongoing construction. This is not a reporting duty for every minor defect or every building.
