The D.C. Circuit heard arguments on June 5, 2026, but the case has since moved on: it affirmed an injunction restricting above-ground construction on August 7, and the Supreme Court stayed that injunction on August 31 while the government pursues possible review. The Supreme Court did not decide whether the project is legal. Whether the stay remains in effect after the government’s certiorari process cannot be confirmed from the available docket record, which shows proceedings only through August 31.
What happened after the June 5 hearing?
The National Trust for Historic Preservation challenged the federal project replacing the White House East Wing and adding a ballroom. The D.C. Circuit heard arguments on June 5, 2026, then on August 7 affirmed a modified preliminary injunction issued by the district court. The appellate court also vacated its administrative stay. The court’s ruling was preliminary, not a final judgment resolving every claim. Read the D.C. Circuit’s August 7 opinion.

The Supreme Court changed the immediate effect of that injunction on August 31 by staying it pending the government’s timely petition for certiorari and the Court’s disposition of that petition. A stay pauses the injunction’s operation during the specified proceedings; it does not itself decide the underlying legal dispute. Read the Supreme Court’s August 31 opinion.
Can the ballroom plans continue?
The answer depends on the operative court order and any later action in the Supreme Court. The Supreme Court’s August 31 stay put the district court injunction on hold while the government’s certiorari process unfolds, if the petition is timely filed. The available docket record does not establish whether the government later filed that petition or whether the Supreme Court took further action after August 31. It therefore does not confirm the project’s current procedural status beyond that date. Check Supreme Court docket No. 26A203 for subsequent filings and orders.

That procedural distinction matters: the D.C. Circuit affirmed restrictions in a preliminary injunction, while the Supreme Court temporarily stayed those restrictions during a further review process. Neither ruling, as described in the opinions, is a final Supreme Court decision that the project is lawful. The Supreme Court stated, “Today, we do not pass upon the legality of the government’s East Wing project.”
What did the appeals court rule?
The D.C. Circuit concluded at the preliminary-injunction stage that Congress had not given the Executive unfettered authority to reshape and reconstruct the White House. It wrote: “Whether or not a massive ballroom should be constructed is for Congress to decide and is not a matter for Executive self-help.” The opinion affirmed a modified injunction restricting above-ground construction, subject to exceptions described in the order and opinion. The ruling addressed the basis for preliminary relief; it was not a final decision on every claim in the case.

The Supreme Court’s later stay did not erase the appellate court’s reasoning or resolve the merits. It altered the injunction’s operative effect while the specified Supreme Court proceedings were pending and addressed the government’s likelihood of prevailing on the Trust’s standing to sue, along with the other stay factors.

In its August 31 opinion, the Supreme Court described the project as replacing the East Wing. It said the first phase—demolition—was completed in December 2025, and described the ongoing phase as involving a new East Wing, a below-ground military installation and an above-ground ballroom. These are details stated by the Court in its opinion, not an independent assessment of construction progress.

What should readers watch next?
The key procedural question is whether the government filed a timely petition for certiorari and what the Supreme Court did with it. The Court’s stay was tied to that process. Because the available docket record shows proceedings only through August 31, 2026, readers should consult the live docket before drawing conclusions about later filings, orders or the current effect of the injunction.
