Before excavation, establish whether the site can support the design, how water will be managed, what approvals apply, and which qualified professionals must be involved. There is no safe universal DIY design or construction sequence for an unspecified site.
Is a backyard cave safe to build?
It may be possible to create a cave-like retreat with engineered earth-sheltered construction, but appearance does not make an excavation safe. Soil can collapse, and the right protective approach depends on conditions at the actual site. OSHA identifies cave-ins as the primary trenching and excavation hazard and says soil analysis should generally inform protection decisions.
OSHA describes sloping, benching, shoring, and shielding as ways to address cave-in risk. These are designed protective approaches, not interchangeable DIY options or comfort features. Its construction eTool also flags safe entry and exit, underground utilities, nearby structures, equipment, falling loads, and hazardous atmospheres as excavation concerns. Site-specific evaluation and design should happen before soil is disturbed.
Federal construction rule 29 CFR 1926.652(a)(1) generally requires employers to protect employees in excavations from cave-ins with an adequate protective system. The regulation states exceptions for excavations entirely in stable rock and for excavations less than five feet deep when a competent person finds no indication of a potential cave-in. Those workplace provisions are not blanket permission for a homeowner to excavate, nor do they establish that a proposed retreat is safe.

What must be assessed first
- Soil and site conditions: Have qualified professionals evaluate the soil, slope, and other site conditions that affect excavation and structural design.
- Utilities and nearby features: Identify underground utilities and consider nearby structures before planning excavation.
- Protection and access: Have the required excavation protections and safe access designed for the project rather than choosing a method by appearance or convenience.
- Use and occupancy: Define who will use the retreat and how they will enter and leave; those details belong in the design and approval process.
- Local approvals: Ask the local building authority what permits and reviews apply to the actual proposal.
How will you keep water out?
Earth-contact construction needs a planned route for water. A membrane alone should not be treated as a complete drainage plan: poor drainage can make water intrusion difficult to control even when a membrane is used. Drainage details must be designed for the site, including where collected water goes and whether the discharge is allowed.
San Diego’s retaining-wall information bulletin says drainage should discharge to a stormwater collection system and/or be arranged so stormwater does not flow onto adjoining properties. That is San Diego-specific guidance, but it illustrates why the outlet and effects on neighboring land belong in the plan—not just the choice of a drainage component.

Perforated drainage pipe for a French drain may be a relevant component if a qualified design calls for it. Pipe alone does not prevent water intrusion or make a structure safe. The appropriate sizing, filter layers, slope, outlet, and connection are project-specific; the cited guidance does not validate a particular product or complete DIY system.

Permit rules depend on where the project is and what is actually being built. Retaining-wall rules are not a substitute for checking requirements for an earth-sheltered occupied space, excavation, drainage, or site development. Contact the authority having jurisdiction with a description and preliminary plans before committing to a design.

Two local examples—not general rules
- Portland, Oregon: The city says a building permit is required for a retaining wall more than four feet high, measured from the bottom of the footing to the top of the wall, or for a wall supporting surcharge. Complex sites or slope stabilization may also require site-development review, and engineering information is part of the application.
- San Diego, California: The city’s retaining-wall bulletin describes plan and permit submittal requirements and drainage expectations. Its rules and process apply to San Diego, not automatically to other jurisdictions.
These examples show why a threshold from one city should not be applied elsewhere. Ask local officials which reviews apply to the project, including retaining-wall, building, drainage, and site-development approvals as relevant.

How to move from idea to a responsible plan
- Describe the intended retreat. Record its intended use, approximate location, access, and relationship to nearby structures. Treat this as a project brief, not a construction plan.
- Consult the local building authority. Ask which permits and reviews may apply before excavation or design decisions narrow your options.
- Arrange site and design evaluations. Seek qualified geotechnical or structural engineering input and consult qualified excavation or retaining-wall professionals as appropriate. The professionals should evaluate site conditions, structural design, excavation protection, and water management.
- Resolve drainage and discharge. Include the proposed water path and outlet in the design, and confirm that the discharge approach meets local requirements and will not send stormwater onto adjoining property.
- Proceed only under approved, site-specific plans. Do not treat general online guidance, a drainage product, or a workplace safety exception as a substitute for the required design, permits, and protections.
