How to claim compensation for vehicle damage caused by a pothole in Scotland

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Send the claim to whoever manages the road. For a Scottish trunk road or motorway, that will normally be the operating company for the relevant region: BEAR Scotland in the north-west and south-east, or Amey in the south-west and north-east. For other roads, contact the local council responsible for that road. Your report should identify the exact place and time, describe the damage, explain why you think the authority is responsible, and include evidence you already have. Compensation is not automatic, and you should never return on foot to photograph a dangerous road or motorway.

The route classification is the first decision. The steps below show how to identify the recipient, preserve useful evidence safely, make a specific claim, and interpret inspection standards and published statistics without assuming that a pothole automatically creates liability.

1. Identify who manages the road

Scotland has no single pothole-claims address. Responsibility depends on whether the incident occurred on a trunk road or motorway, and on which part of the network you used. Check the current GOV.UK guidance titled Claim for damage to your vehicle before submitting, because operating-company arrangements and contact details can change.

Where the pothole was Usual claim recipient What to verify
Scottish trunk road or motorway in the north-west or south-east BEAR Scotland, under the current trunk-road operating arrangement Confirm that the route and boundary are covered by BEAR Scotland and follow its current claims procedure.
Scottish trunk road or motorway in the south-west or north-east Amey, under the current trunk-road operating arrangement Confirm the route and follow Amey’s current claims procedure.
Any other Scottish road The local council that manages the road Use the council’s current roads or claims instructions; forms, evidence requirements, deadlines and response times vary.

Do not assume every A-road is a trunk road

Many trunk roads carry A-road numbers, but an A-road number by itself does not prove that the operating company is responsible. A road can be managed by a council even when it is an A-road. Motorways are part of the trunk-road network, but the exact managing body and regional boundary should still be checked before you send a claim.

Record the route before details fade

Write down the road name, direction of travel, nearest junction, roundabout, bridge, property or other fixed feature, and any marker-post number. If you know the route’s trunk-road designation, include it. A precise location helps the recipient match your account to inspection and repair records.

2. Understand what a successful claim requires

A damaged wheel, tyre, suspension component or other vehicle part is not, by itself, proof that the road authority must pay. Transport Scotland explains that operating companies must take reasonable care to maintain the trunk-road network safely, while road users must also exercise reasonable care. A claim concerns damage allegedly caused by a defect; the guidance does not promise compensation whenever a vehicle strikes a pothole.

The question the authority will investigate

The authority or operating company will need to consider what defect existed, where and when it existed, whether it should reasonably have been detected, what action was required, and whether your driving and circumstances also matter. Your claim should therefore establish a factual timeline rather than simply state that a pothole was present.

Why wording matters

Use measured language: state what you saw, what you felt, and what failed. Explain why you believe the defect caused the damage, but do not present an unverified conclusion as an established fact. For example, identify a sudden impact followed by loss of tyre pressure, warning lights or steering vibration, then attach the repairer’s findings. That is more useful than saying only that the road was in poor condition.

3. Gather evidence without putting yourself in danger

Both GOV.UK and Transport Scotland ask for a specific location and time and for supporting evidence that you already have. There is no universal evidence checklist for every council, so preserve what exists rather than delaying a report while trying to create a perfect file.

Information to write down immediately

  • Date and exact or approximate time of the incident.
  • Road name and number, direction of travel and nearest junction or identifiable feature.
  • Marker-post number, if visible and safely obtained from inside the vehicle.
  • Weather, lighting and traffic conditions if they help explain visibility or control.
  • What you saw in the road and how the impact occurred.
  • Which parts of the vehicle were affected and whether the vehicle became unsafe to drive.

Documents and images to preserve

  • Photographs or dashcam footage captured safely at the time, without stopping where stopping is prohibited or dangerous.
  • Vehicle-recovery records, breakdown notes and inspection reports.
  • Repair estimates, invoices and receipts that identify the failed component and the work performed.
  • Tyre or wheel measurements and photographs supplied by a repairer, if relevant.
  • Insurance correspondence and any incident reference number.

Never revisit a motorway as a pedestrian

Transport Scotland’s instruction is explicit: “Please do not revisit the scene as a pedestrian to take photographs.” Returning to a live road can expose you and other drivers to serious danger. On the motorway network, Transport Scotland says that revisiting as a pedestrian would be a criminal offence. If you did not obtain a photograph safely at the time, explain that fact and rely on your location record, dashcam material, witness information and repair documentation.

4. Submit the claim step by step

  1. Classify the road. Decide whether it was a trunk road or motorway and establish the operating region, or identify the council responsible for a non-trunk road.
  2. Open the current official claim instructions. Use the GOV.UK route guidance for initial responsibility. For a trunk-road claim, follow the current procedure of BEAR Scotland or Amey as applicable. For a council road, use that council’s own roads-claims process.
  3. Prepare a concise incident account. State the date, time, road, direction, nearest junction or marker, what happened and what was damaged.
  4. Explain the alleged connection. Describe the defect and why the impact appears to have caused the damage. Distinguish what you personally observed from what a mechanic later diagnosed.
  5. Attach existing evidence. Include safe images or dashcam footage, repair or inspection paperwork, estimates, invoices and witness details where available.
  6. Ask for a written acknowledgement or reference. Keep a copy of everything submitted and note the date and method of submission.
  7. Respond to requests for clarification. If the authority asks for a map point, additional invoice or vehicle information, answer specifically and keep the exchange with your claim file.

Do not send the same incident to multiple bodies simply because responsibility is uncertain. If you later discover that the recipient was wrong, ask where the claim should be redirected and retain the original submission date and evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. What trunk-road maintenance standards do—and do not—prove

Transport Scotland’s trunk-road FAQ says inspections occur at intervals not exceeding seven days. For a Category 1 carriageway defect, the operator must make the road safe by 06:00 the following morning. Where a temporary repair is used, the stated period for a permanent carriageway-surface repair is 28 days.

Those are contractual maintenance requirements for the trunk-road network. They are not an automatic entitlement rule. A defect may have been reported or inspected without establishing that the operator breached a duty in your particular circumstances, and compliance with a response period does not itself prove or disprove causation. Conversely, a repair record or inspection gap is evidence to be considered, not a guaranteed payment trigger.

Why inspection records can be difficult to interpret

The Scottish Information Commissioner’s Decision 045/2025, which concerned an individual Glasgow claim and difficulties matching records, illustrates why a road inspection entry should be read in context. A record may use a different location description, refer to a nearby defect, or cover a different inspection date from the event you reported. If you receive records, compare road names, carriageway direction, marker posts and timestamps rather than treating a similar-looking entry as conclusive.

6. Describe the vehicle loss realistically

Claim the damage that can be connected to the incident and supported by documents. Depending on the inspection, that might include a tyre, wheel, suspension or steering component, recovery and necessary repair costs. The official Scottish figures include tyre-damage claims, so a replacement tyre can be a possible repair outcome; they do not establish a particular tyre brand, price or reimbursement promise.

Get the vehicle inspected before buying parts

A visible puncture may coexist with wheel or suspension damage, while a harmless-looking mark may not be the cause of a later fault. Ask the repairer to record the failed parts, measurements and photographs and to distinguish impact damage from pre-existing wear. Use the vehicle manufacturer’s specification when a tyre or wheel must be replaced. Do not buy a product merely because it is associated with pothole damage; a claim does not require a pressure gauge, accessory or particular retailer.

Keep financial evidence

Retain itemised estimates, invoices, payment confirmations and recovery charges. If you use insurance, keep the insurer’s assessment and any excess or settlement information so that you do not describe an insured loss as an unreimbursed cost. The authority’s procedure will determine which expenses it considers, so avoid assuming that every consequential cost will be accepted.

7. Historical Scottish figures: useful context, not your odds of success

Official releases show how claim volumes have varied, but they are not a live nationwide success rate and cannot predict an individual decision.

Scope and publication Claims recorded Successful or settled claims How to read the figure
A75 and A77, three-year period reported by Scotland TranServ in the Scottish Government’s 2019 release 239 vehicle-repair claims: 58 on the A75 and 181 on the A77 Seven settled claims across both routes A narrow historical route example, not a Scottish acceptance rate.
Scottish trunk-road claims, Scottish Government release covering 2018–2024 2018: 935; 2019: 178; 2020: 162; 2021: 621; 2022: 403; 2023: 659; 2024: 209 2018: 673; 2019: 83; 2020: 66; 2021: 211; 2022: 147; 2023: 228; 2024: 44 The release says operating companies handle trunk-road claims directly and notes information gaps. It is not a live 2026 tally.
A75 and A77 tyre-damage claims in the same three-year historical period 49 on the A75 and 163 on the A77 Not stated as a separate settled total Shows that tyre damage appears in recorded claims; it does not promise reimbursement or indicate a particular tyre cost.

Totals can reflect different reporting, categorisation and decision timing. Comparing the number of successful claims with the number submitted in the same year can therefore be misleading, and neither release supplies an individual claimant’s probability of success.

8. Council roads: check local rules instead of relying on a national deadline

The official guidance directs claims for non-trunk roads to the responsible local council, but it does not establish one Scotland-wide form, deadline or processing time. Councils may ask for different photographs, maps, estimates, insurance information or claim forms. Their published instructions may also change.

Questions to check on the council’s current page

  • Which roads department or insurer receives vehicle-damage claims.
  • Whether the council requires an online form, email, postal submission or a specific reference.
  • What location information and supporting documents are mandatory.
  • Any stated time limit and how the council defines the incident date.
  • How to submit additional evidence and how decisions are communicated.

Do not apply a deadline quoted for one council to another council, and do not assume that the trunk-road inspection standards apply to a local road.

9. If the claim is questioned or refused

Read the reason, not just the outcome

A refusal may concern responsibility for the route, the location, whether the defect was recorded, causation, the condition of the vehicle, or the evidence supplied. Ask for the decision and its factual basis in writing if the process does not already provide that information. Compare the explanation with your incident timeline and repair report.

Correct factual errors promptly

If the authority has the wrong carriageway, date, junction or vehicle part, send a short correction with the supporting document and your claim reference. Avoid adding speculation or changing the account to fit a preferred outcome.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Consider other routes for an unrecovered loss

Notify your motor insurer when required by your policy, even if you intend to pursue the road authority. If the financial loss is significant or the facts are disputed, obtain independent legal advice about the options available to you. Neither the existence of a pothole nor a published maintenance interval replaces an assessment of the particular evidence.

10. A practical incident-record template

You can use the following headings in your notes or adapt them to the recipient’s form:

Date and time:
Road name and number:
Direction of travel:
Nearest junction, landmark or marker post:
Weather, lighting and traffic:
What I saw and how the impact occurred:
Immediate symptoms (tyre pressure, warning light, steering, noise):
Vehicle recovery or safety action:
Inspection findings and damaged parts:
Repair estimate or invoice:
Photographs or dashcam files captured safely:
Why I believe the road defect caused the damage:
Claim reference and submission date:

Keep the account factual and chronological. If a field is unknown, say that it is unknown rather than guessing a marker post or exact measurement.

11. Common mistakes that weaken a pothole claim

  • Sending it to the wrong body: classify the route before submitting.
  • Giving a vague location: “somewhere on the A-road” is not enough; add direction, junction, landmark or marker.
  • Returning to photograph the defect: do not create a pedestrian hazard or commit a motorway offence.
  • Claiming an uninspected fault: obtain a repairer’s diagnosis and preserve the paperwork.
  • Treating standards as automatic liability: seven-day inspections and response periods are contractual context, not a guaranteed award.
  • Using historical totals as a success forecast: the published figures are route- and year-specific and include information gaps.
  • Assuming one council’s deadline applies everywhere: check the current instructions for the council managing that road.
  • Discarding damaged parts or receipts: preserve evidence until the claim and any insurance assessment are resolved.

12. The decision in one view

For a trunk road or motorway, identify the operating region and use the current BEAR Scotland or Amey claim process. For another Scottish road, use the responsible council’s current procedure. In either case, provide a precise location and time, a factual damage account, safe supporting evidence and a clear explanation of why the defect appears to have caused the loss. Authorities assess the individual circumstances; payment is never guaranteed merely because a pothole damaged a vehicle.
