Before building or lighting a backyard fire pit, check the rules with your local fire and building authorities. Permits, clearances, approved materials, fuel limits and burn restrictions vary by location, and there is no single setback or pit dimension that applies everywhere. Once you know what is allowed, plan a flat, open site, a nonflammable base, a contained enclosure and a safe way to extinguish the fire.
Check local rules before choosing a design
Ask your local fire authority whether your plan is treated as a fixed, site-built solid-fuel pit or a portable product. Confirm whether you need a permit and check required clearances, construction materials, allowable fuel, weather restrictions, attendance rules and extinguishing equipment. Check again before each use for temporary burn bans or other fire restrictions.
Local examples show why online dimensions should not be treated as universal standards:

| Kansas State Fire Marshal | Advises at least 10 feet from structures or neighboring yards and says 25 feet is preferable. Its guidance also describes a six-inch minimum center depth and two-foot width. |
These are jurisdiction-specific examples, not interchangeable code requirements. Ask which rules apply to your property and pit type before settling on a layout.

Choose a safe site and prepare the surface
Find a flat, open location
Choose a level area well away from structures, combustible materials and overhead branches. Keep the pit clear of low limbs and do not set a movable pit on a slope. Measure clearances using the definitions and distances given by your local authority; rules may treat buildings, vegetation, property lines, fences and decks differently.
Make a nonflammable area
Use a surface accepted by local rules and appropriate to the design. Raleigh identifies concrete, dirt and gravel as possible nonflammable surfaces. Kansas mentions patio blocks or concrete, and advises against placing a pit on a wooden deck or directly on grass. Keep nearby combustible material outside the required clearance area.

Build a contained enclosure from approved materials
Use concrete, stone or another noncombustible material approved for fire-pit use in your jurisdiction. Keizer says the bottom of its pits may be sand or mineral earth; that local guidance is not a universal specification. Follow instructions for the selected design and ask officials whether the materials and installation are acceptable.
Do not treat an example dimension as an engineered plan. Keizer’s maximum three-foot diameter and minimum four-inch depth apply to its district. The cited sources do not establish a universal footing, drainage detail, wall thickness or masonry assembly for all designs and locations.

A University of Tennessee Extension drawing describes an outdoor fireplace, a different and more involved structure, rather than a standard open fire pit. Its masonry and firebrick details should not be repackaged as a generic open-pit plan. The legacy plan also tells readers to check city or county regulations before construction: Mississippi State University Extension outdoor fireplace plan.
Review the installation before lighting a fire
- Confirm the completed pit and its placement meet local requirements.
- Clear combustible material from the required area and check overhead for branches.
- Keep appropriate extinguishing equipment ready. Park City, for example, specifies at least 10 gallons of water for its fires.
- For a built pit, consider a fitted spark screen. Raleigh recommends a screen that fits the enclosure; measure the finished opening when selecting one.
- Do not light a fire during excessive wind or an active local restriction.
Use the pit safely
Keep the fire contained within the enclosure and attended by an adult. Burn only fuel allowed by local rules. Raleigh recommends dry wood and advises against accelerants, garbage and garden clippings; Kansas warns against flammable lighting liquids. Avoid starting a fire when wind could carry embers or spread flames.

When finished, extinguish the fire completely and follow local requirements for when it may be left unattended. Park City requires the fire to be cold to the touch before it is left; do not assume that rule or any other local example applies where you live.
