A compulsory purchase order (CPO) is a legal process that can allow a public authority to acquire land without the owner’s agreement, but the authority must have statutory powers, justify the acquisition and obtain confirmation before implementing the order. If your home, land or property rights may be affected, check the order’s map and schedule, note the objection deadline, and get advice promptly: the process has separate stages for objections, possession and compensation.
Where the rules apply—and what a CPO means
This guide focuses on England. The Ministry of Housing, Communities and Local Government’s detailed compulsory purchase guidance, updated 17 June 2026, covers the process in England. Some of the government’s plain-English process guidance and residential compensation guidance discuss England and Wales, but they are older: the process guide dates from 17 December 2021 and describes legislative coverage through the Neighbourhood Planning Act 2017; the residential compensation guide was last updated 2 October 2023. For a live case, the current law and the specific notices matter. The sources covered here do not establish the procedure in Scotland or Northern Ireland, so do not assume the English process applies across the UK.

A CPO is an order made under a statutory power by an acquiring authority—for example, a public authority seeking land for a project. The order does not itself transfer possession. It must first be confirmed by a confirming authority, which considers whether the case for acquisition and the required process are adequate. If confirmed, the acquiring authority must then implement it through a permitted route. You may still be able to negotiate a sale by agreement, including after confirmation.

What happens, from proposal to possession
The stages are distinct: planning and proposing an acquisition, making and publicising the order, objections and a decision, implementation, then compensation. The government’s plain-English process guide notes that years may pass between first becoming aware of a proposed acquisition and possession. Timing depends on the case; confirmation is not the same thing as an immediate move-out date.
- The authority identifies land and considers agreement. An acquiring authority assesses what land a project needs and may first try to buy it by agreement. It must rely on an applicable statutory power and justify the proposed acquisition. The Ministry’s current England guidance emphasizes using the correct power, following the required process and considering ways to mitigate impacts on affected people, such as relocation options or a resident charter.
- The authority prepares and submits the order. The CPO is accompanied by material including a schedule and map identifying the relevant plots. A Statement of Reasons usually explains why the authority seeks the land. The authority submits the order to the confirming authority for a decision.
- Notices invite objections. Notices explain how and where to object and give a deadline. The deadline must allow at least 21 days. Read the notice itself: it sets the instructions and date for your case.
- The confirming authority considers the case. It may consider the order at a public inquiry or through written representations, and may confirm, modify or reject it. A remaining objector is an objector whose objection is still outstanding at this stage. The process guide describes a right for remaining objectors to be heard at a public inquiry; written representations are an option where all remaining objectors agree.
- A confirmed order is implemented—or the parties agree terms. Confirmation permits the authority to proceed but does not itself take possession. Implementation may use agreement, notice to treat and notice of entry, a general vesting declaration, procedures for short tenancies, or action in response to a blight notice. The route affects how and when land vests or possession is taken.
- Compensation is assessed and paid. The amount depends on the interest acquired and the loss caused. If the parties cannot agree compensation, a disputed land-compensation claim may be referred to the Upper Tribunal (Lands Chamber).
Check whether your property or rights are included
Use the individual order’s map and schedule rather than relying on a project description or a general announcement. Match the plot boundaries against your property and check whether the schedule correctly identifies you and the interests you hold. The schedule may list owners, tenants, occupiers and people with affected rights where known.
- Check whether the whole property or only part of it is shown, and whether the boundary cuts across land you use.
- Review whether your freehold, lease, tenancy, occupation or other affected rights appear accurately.
- Consider access, services and other rights connected with retained land, not just the footprint being acquired.
- Read the Statement of Reasons to understand why the acquiring authority says the land is required.
- Keep the notice, map, schedule and all correspondence together, and record when each item arrived.
If the schedule appears wrong or omits an interest, raise the issue promptly with the authority and include it in any objection where relevant. A plot map can show physical boundaries, but it does not by itself establish every person’s legal interest or determine compensation.

Object by following the method and deadline in the notice. The deadline must be at least 21 days, but do not treat that minimum as an extension: the stated closing date controls unless the authority or applicable procedure says otherwise. Make sure your objection arrives in the required form and at the specified address or channel.

- Power drill cordless with 1/2" single sleeve ratcheting chuck provides tight bit gripping strength, making bit changes faster and more secure
- Identify the land and your connection to it. Give the plot number or other land description from the order, and explain whether you are an owner, tenant, occupier or holder of an affected right.
- Set out your grounds clearly. Explain why the confirming authority should not confirm the order as made, or why it should be changed. Focus on matters relevant to the authority’s decision, rather than using the objection solely to argue over the amount of compensation.
- Support the points with documents. Depending on the issue, relevant material may include plans, records of rights, correspondence or other documents that explain the impact or factual dispute.
- Submit in time and retain proof. Follow the notice’s instructions, keep a copy of what you sent and record evidence of submission or delivery.
Objections about whether the order should proceed are not the same as compensation disputes. The latter may be resolved separately, including through the Upper Tribunal, and a disagreement about compensation alone may not be a matter the confirming authority can decide when considering whether to confirm the order.
Inquiry or written representations
The process guide describes remaining objectors as having a right to be heard at a public inquiry. Written representations may be used instead where all remaining objectors agree. This is not a general promise that every member of the public has the same individual hearing right. If you object, ask how your objection is being treated, whether it remains outstanding, and what arrangements apply to the decision in your case.
What if the CPO is confirmed?
A confirmed order can be challenged for validity in the High Court, but the deadline is short: the government’s plain-English process guide says a challenge must be brought within six weeks following newspaper publication of the confirmation notice. It identifies possible grounds such as the authority exceeding its powers, failing to follow procedure or reaching its decision improperly. This is not a complete account of court procedure. If you are considering a challenge, seek legal advice immediately and verify the deadline and requirements that apply to the notice.

How the main implementation routes differ
The process guide identifies several ways an authority may implement a confirmed order. The route affects the mechanics of acquisition, including when possession is taken or title vests. The exact procedure and consequences depend on the applicable law, the notice and the facts of the case.
| Route | What it means in broad terms | What to check |
|---|---|---|
| Purchase by agreement | The authority and affected owner agree the acquisition terms instead of relying on an unagreed transfer route. | Confirm what land and interests are included, the agreed terms, and how possession and payment are timed. |
| Notice to treat and notice of entry | A formal route involving notices that initiate the process for treating for the land and entering it. | Read each notice carefully and get advice on its effect and the dates that apply to your interest. |
| General vesting declaration (GVD) | A declaration route under which land vests in the acquiring authority on the relevant vesting date. | Check the declaration, the stated vesting date and how it affects your ownership, occupation or other rights. |
| Short-tenancy procedures or action following a blight notice | Other procedures may apply to short tenancies or where a blight notice is involved. | Check which procedure the authority is using and obtain advice relevant to your tenancy or claim. |
A general vesting declaration is therefore not just another name for confirmation: it is one possible implementation route. For the residential compensation guide’s valuation-date rule, a GVD vesting date is one of the relevant dates; see the compensation section below.
What compensation may cover
The government’s plain-English process guide describes the overriding principle of compulsory purchase compensation as “equivalence”: compensation should reflect the claimant’s loss. That principle is not a promise of a particular amount, nor does it mean every claimed expense or consequence will qualify. Eligibility and calculation depend on the claimant’s legal interest, the acquisition and the evidence.

| Possible head of claim | When it may matter |
|---|---|
| Value of land acquired | When land or a property interest is taken; the relevant interest and valuation date matter. |
| Disturbance | For eligible losses or expenses caused by the acquisition and sufficiently connected to it. |
| Loss payments | Where the claimant and circumstances meet the relevant eligibility rules. |
| Severance or injurious affection | Where only part of a holding is acquired and the remaining land is affected, subject to the applicable rules. |
For residential claims, the guide says the valuation date is the earliest of: the relevant possession date after notices; the vesting date under a general vesting declaration; or an earlier date when compensation is agreed. This date is a valuation rule, not a universal prediction of when payment will arrive.
Advance payments
The 2021 process guide describes an advance payment on account after confirmation: 90% of agreed compensation, or 90% of the acquiring authority’s estimate if possession occurs before compensation is agreed. That figure is presented in the guide under those conditions; it is not a guaranteed payment in every case. Check the current statutory conditions and requirements before relying on it for a live claim.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Build a well-supported claim and manage costs
Keep a record from the first contact with the authority. Save correspondence, notices and plans; document the property’s condition; and keep receipts and evidence for expenses or other losses. A compensation claim is stronger when it shows both what happened and how the acquisition caused the claimed loss.
- Record dates, conversations and decisions, and follow important calls with a written note.
- Keep invoices, receipts, estimates and relevant property records.
- Explain the direct connection between each expense or loss and the acquisition.
- Take reasonable steps to limit avoidable loss. The residential guide’s moving-services example is to obtain at least two reputable quotes and, where the service is equivalent, choose the cheaper one.
Reasonable fees for preparing and negotiating a compensation claim can generally be reclaimed when a CPO is confirmed and implemented. This does not make every fee automatically recoverable. Ask an adviser to explain the fee basis, what work is proposed and when costs may be claimed.

Objection costs are usually initially the objector’s responsibility. A remaining objector whose objection succeeds may seek reasonable costs, according to the government process guide. That possibility is not a guarantee that all costs will be repaid.
When a compensation dispute goes to the Upper Tribunal
If the acquiring authority and claimant cannot agree the land-compensation amount, the Upper Tribunal (Lands Chamber) can determine the disputed claim. Its procedure guide, updated 13 July 2026, says either the claimant or the authority may start a reference. The Tribunal guide also cautions that it is not a substitute for legislation or professional advice.
This is a different track from objecting to whether the CPO should be confirmed. Keep the issues separate: use the CPO objection process for relevant objections to the order, and address an unresolved compensation valuation through negotiation or the appropriate compensation procedure.
Choosing professional advice
A CPO can involve planning, property rights, valuation and procedural deadlines. Choose an adviser with experience in both compulsory purchase and the relevant property type, and check their professional standards, fee basis and the circumstances in which fees may be recoverable. The residential guide points readers to RICS’s Find a Surveyor service; rural landowners may seek agricultural valuation expertise through CAAV. A firm’s offer of an initial discussion or free advice is not a substitute for checking its experience, scope and terms.
The Ministry’s current England guidance notes that “there is no single, published document called the compensation code.” In practice, do not assume that one guide answers every question about a particular claim. The relevant legislation, current guidance, order documents and your own legal and valuation circumstances must be considered together.
