In England and Wales, compensation for a compulsory purchase is assessed from the value of the legal interest acquired, then adjusted for other eligible losses. Depending on the case, these may include disturbance, statutory loss payments, and a reduction in the value of land the claimant keeps. There is no universal per-acre rate: the result depends on the acquisition procedure, valuation date, planning position, claimant’s interest and evidence.
First identify which country’s rules apply
Compulsory purchase compensation is governed by jurisdiction-specific law. The detailed calculation described here is for England and Wales, where the starting point is an open-market valuation of the acquired interest under statutory rules. It is not a formula that can be applied unchanged in Scotland or Australia.

Scottish Government guidance describes a separate statutory framework. It refers to market value at the relevant date, with changes attributable to the compulsory purchase and underlying scheme disregarded; equivalent reinstatement may apply in appropriate cases. Severance, disturbance and injurious affection may also be relevant there, but England and Wales procedures should not be assumed to govern a Scottish claim.

Australia has no single calculation established by the official material cited here. Commonwealth acquisition rules and New South Wales guidance describe their own potential compensation heads, including severance in New South Wales. The applicable state, territory or Commonwealth regime must be identified before estimating compensation.

What makes up the compensation figure in England and Wales?
The total is assembled from the heads of compensation that apply to the particular claimant and acquisition. The main possibilities are the value of the interest taken, eligible disturbance losses, statutory loss payments and, when land is retained, compensation for proven depreciation due to severance or injurious affection.
| Head of compensation | What it addresses | When it may be relevant |
|---|---|---|
| Market value | The open-market value of the legal interest acquired at the applicable valuation date. | The core valuation of the land or rights taken. |
| Disturbance | Eligible losses caused by dispossession or otherwise caused by the compulsory purchase, rather than represented directly by land value. | For example, certain moving, conveyancing, legal or professional costs, subject to the relevant rules and facts. |
| Statutory loss payments | Payments provided by statute for qualifying claimants. | Only where the claimant and circumstances meet the relevant eligibility conditions. |
| Severance or injurious affection | Depreciation in the value of land the claimant retains. | Where the acquisition or scheme has a demonstrable effect on retained land. |
These heads are not automatically available to every owner or occupier. A claimant’s legal interest, use of the property and the circumstances of the acquisition affect both eligibility and amount. The UK government’s residential compensation guide describes the overriding principle as “equivalence”: compensation is intended to reflect the loss, not to produce a standard windfall or a fixed payment for each acre.
How the land or rights taken are valued
Establish the interest being acquired
Begin by identifying precisely what the acquiring authority is taking and who holds each relevant interest. The acquired interest may be less than ownership of an entire parcel: for example, the acquisition might concern only part of a holding or particular rights. The value of that interest—not an assumed value for the whole property—is the starting point.

Clarify whether the claimant is an owner, occupier or holder of another legal interest, and whether the land is used residentially, for a business, agriculturally or in another way. These details help distinguish the claimant’s interest and circumstances from those of other people affected by the same acquisition. Two people connected to one site should not assume they have identical claims simply because they are affected by the same scheme.

Apply the statutory market-value basis
The statutory starting point is what the acquired interest might be expected to realise if sold on the open market by a willing seller. This is a hypothetical market valuation, not simply an authority’s estimate of development value or a standard agricultural rate. The figure depends on the interest, the relevant date and the evidence available for that valuation.
The valuation also applies the statutory “no-scheme” principle. In broad terms, value effects attributable to the acquiring authority’s scheme are disregarded. Statutory planning assumptions may also matter: existing planning permission and qualifying assumptions about what permission might have been granted in a world without the scheme can affect the assessment. The planning position therefore needs to be considered under those rules, rather than treating either the current use or a hoped-for development as decisive by itself.
Choose the correct valuation date
The date is determined by the acquisition route, so it is important to identify which procedure is being used before selecting market evidence. UK government process guidance identifies these dates:
- Where the authority uses a notice to treat and notice of entry, the relevant date is the date of entry and taking possession.
- Where it uses a general vesting declaration, the relevant date is the vesting date.
- If the Upper Tribunal (Lands Chamber) determines compensation earlier, the date of that determination can be the relevant date.
Because the date can change which comparable sales or other evidence are pertinent, do not choose evidence based only on when the land was first discussed or when an offer arrived. Read the notices and establish the procedure used in the case.

Which additional losses may be included?
Disturbance costs
Disturbance concerns losses caused by dispossession and other losses caused by compulsory purchase that are not directly measured as land value. Official guidance gives examples including the cost of vacating and moving to replacement premises, conveyancing costs, legal and other fees, and professional fees. The claimant’s circumstances and the applicable rules determine whether a particular item qualifies and what amount is supported.
For a residential claimant, relocation-related costs may be among the relevant matters. For a business or agricultural claimant, the nature of the activity and the effects of being displaced may shape the losses to consider. These categories do not establish that every cost, business loss or expense will be reimbursed. Separate the amounts actually incurred or reasonably evidenced from assumptions about what ought to be recoverable.
Statutory loss payments
Some eligible claimants may receive statutory loss payments in addition to compensation based on market value. The category of payment and its conditions depend on the claimant’s status and circumstances. Treat this as a possible statutory entitlement to check against the applicable eligibility rules—not as a universal percentage of the land value or an automatic payment to every owner or occupier.

When a claimant retains some of the holding, the assessment may need to consider whether that retained land has lost value because of the acquisition or scheme. This is separate from valuing the part actually taken. The claimant must establish the relevant effect and its impact on value; the mere fact that a scheme is nearby does not create an automatic additional award.

Severance
Severance is value loss arising because the acquired land has been separated from the land kept. For example, a road through a field might leave part of the field without vehicle access. The relevant question is not just whether land has been divided, but whether that division has caused a compensable reduction in the value of the retained interest.
Injurious affection
Injurious affection concerns depreciation caused by construction or use of the acquired land for the scheme. The impact must be connected to that construction or use and shown to affect the value of land the claimant retains. Evidence of the effect and its valuation significance matters more than simply describing the scheme as disruptive.

Gather documents showing who owns or occupies the property, the nature of each relevant interest, and the exact land or rights being acquired. Note whether the authority is taking all or only part.
- Read the notices and identify the route. Keep the relevant notices together and establish whether the process uses notice to treat and notice of entry or a general vesting declaration. That information is needed to identify the valuation date.
- Organize market and planning evidence. Assemble relevant comparable market evidence for the interest and date in question, along with information about existing planning permission and the planning assumptions that may apply under the no-scheme rules. A comparison based solely on acreage or current use may miss important valuation factors.
- Document occupation and activity. Note how the site is used and collect records relevant to residential, business or agricultural circumstances. This context helps assess whether disturbance losses or particular statutory payments may be relevant.
- Itemize claimed disturbance. Keep records for relocation, conveyancing, legal and other professional costs, and describe how each item relates to dispossession or the compulsory purchase. Do not assume that listing a cost alone establishes eligibility.
- Assess effects on land retained. If some land remains, document any change to access, layout or other conditions that may affect its value. Explain the connection between the acquisition or scheme and the claimed depreciation.
A chartered surveyor or specialist compulsory-purchase valuation adviser may be relevant where the value, planning assumptions or effects on retained land need professional assessment. A solicitor may be appropriate when a dispute or procedural issue is central. The right expertise depends on the question that needs resolving; neither appointment guarantees a particular outcome.

Why acreage alone cannot produce a reliable estimate
Acreage is only one physical feature of land. It does not identify the legal interest being acquired, the relevant valuation date, the market evidence, the planning assumptions, the claimant’s eligibility for other heads of claim, or the effect on land kept. The official framework describes categories and valuation rules rather than a universal numeric formula.
For the same reason, an authority’s offer cannot be labelled fair or unfair from its total alone. To assess it, compare what interest it values, the date and valuation basis it uses, how it treats planning assumptions, and which additional losses it includes or excludes. Without those details and supporting evidence, a number is not enough to show how the compensation was calculated.
What changes between two apparently similar claims?
Two parcels of similar size can lead to different assessments because the relevant comparison is not acreage in isolation. The important differences to check are:
- the governing jurisdiction and statutory acquisition route;
- the legal interest and the land or rights actually taken;
- the valuation date and the market evidence relevant to it;
- existing planning permission and the applicable no-scheme planning assumptions;
- whether the claimant is an owner, occupier, residential claimant, business or agricultural claimant;
- whether eligible disturbance or statutory loss payments apply; and
- whether the taking affects the value of land retained.
These differences explain why neither an informal per-acre comparison nor another claimant’s total is a dependable substitute for assessing the particular interest and losses in a case.
