For one clearly defined construction project, a direct open procedure is usually the simpler route. A framework is more suitable when the authority has a credible pipeline of related or phased works and can define the future supplier pool, scope, value and call-off rules in advance. The two are not equivalent: an open procedure is a way to compete a contract, while a framework sets terms for awarding later contracts (called call-offs).
Open tender and framework agreement are different procurement tools
“Open tender” is commonly used to describe the UK open procedure. It is a single-stage competitive procedure for a public contract: any interested supplier may submit a tender, subject to the requirements in the procurement documents. The authority evaluates those tenders and awards the defined contract.

A framework is an arrangement for future awards. Under the UK Government’s Guidance: Frameworks, it is a contract between a contracting authority and one or more suppliers that provides for the future award of contracts to those suppliers. Each later contract is a call-off. The framework is not itself the construction project; it establishes the suppliers, terms and selection process that will be used for projects awarded during its life.
A framework can be established through an open procedure or through a competitive flexible procedure. The practical choice is therefore usually one of these:

- Stronger Solid Lead: This work pencil is matched with a 2.8 mm thick lead , which is much thicker and stronger during the drawing process of construction work, it will not break or damage easily
- Marks on Various Surfaces: 3 colors solid construction pencil can marks on various surfaces, such as metal, plastic, wood, paper etc. Ideals for woodworkers, contractors, craftsmen, builders, merchants and masons
- Run a new competition for this particular construction contract; or
- Establish or use a suitable framework and award the work as a call-off under its rules.
The governing law matters. The Procurement Act 2023 uses the term “framework”, while the previous Public Contracts Regulations 2015 used “framework agreement”. Procurement Act closed and open frameworks also differ from PCR 2015 arrangements. Before applying any comparison, identify the UK nation, the procurement commencement date, any transitional provisions and the regime under which the framework was awarded. The framework notice and documents control the actual call-off.
At-a-glance comparison
| Decision point | Direct open procedure | Framework followed by call-offs |
|---|---|---|
| Best fit | One defined contract that can be specified and awarded in a single competition. | A planned series of related, recurring or phased contracts for which a reusable supplier and award structure is worthwhile. |
| Who can compete | Any interested supplier that meets the published requirements may submit a tender. | Only suppliers admitted to the framework may receive call-offs; access depends on the framework type and documents. |
| Competition at award | The project is competed once through the open procedure. | Framework suppliers compete at call-off where the framework requires it. A call-off without further competition is lawful only where the framework’s stated selection process permits it. |
| Initial workload | Design and run the competition for the project contract. | First establish or identify a suitable framework, then run each call-off in accordance with its rules. |
| Repeat use | Further projects normally require further procurements, depending on their circumstances. | One framework can support repeated or phased work if the scope, value, term and call-off design were built for that use. |
| Market access over time | Open to interested bidders for that procurement. | A closed framework does not admit new suppliers after selection. An open framework can reopen at specified intervals, subject to the applicable regime and scheme documents. |
| Main risk | An unclear scope, unrealistic timetable or disproportionate requirements can reduce participation and challenge the process. | Using an ineligible framework, exceeding its scope or value, or bypassing its required competition can invalidate the call-off. |
When a direct open tender is usually the better choice
A single, sufficiently defined project
Choose a direct open procedure when the authority has one discrete requirement—such as a single building, refurbishment or civil-engineering contract—and can describe the works, outputs, constraints, pricing basis and award criteria well enough for one competition. The procedure avoids creating a multi-project mechanism when there is no credible future workload to justify it.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesAny interested supplier can tender in this one-stage process. That broad access can be important where the authority wants the widest realistic construction-market response for the particular project, including firms that would not be present on an existing framework.
No reliable pipeline for future call-offs
A framework requires more than a hope that other projects might arise. If the authority cannot identify likely users, related works, anticipated value or a workable timetable for future packages, a new framework may add administrative and legal complexity without a clear benefit. Tender the known project directly instead of designing a mechanism around speculative demand.
Proportionate requirements and realistic participation
The UK Government’s Guidance: Competitive Tendering Procedures stresses proportionality, competition and transparency. Selection requirements, insurance levels, financial tests, bid information and deadlines should match the contract’s nature, complexity and value. Short or unrealistic tender periods and unnecessarily burdensome submissions can deter small and medium-sized enterprises, reduce innovation and narrow competition.
An open procedure is simple in structure, but it is not automatically proportionate. The procurement documents still need a clear scope, objective selection and award criteria, transparent instructions, a defensible timetable and contract terms that bidders can price. A simple procedure with an impossible specification is not a good procurement.
When the requirement needs a designed multi-stage process
If the construction requirement is genuinely complex and the authority needs dialogue, staged solutions or a more tailored process, the Procurement Act guidance allows a competitive flexible procedure. That is distinct from the open procedure. Do not force a complex design-and-build or technically uncertain requirement into a one-stage tender merely because “open tender” sounds quicker.
When establishing or using a framework can make sense
Recurring or related construction demand
A framework is plausible where the authority expects a sequence of related works: for example, a programme of substantially connected construction packages, repeated building upgrades or a phased infrastructure development. The value comes from setting up the supplier pool and operating rules once, then using them for multiple call-offs.
The future work must still be sufficiently foreseeable. The authority should be able to explain what kinds of works are in scope, which lots or geographic areas are needed, who may use the arrangement and how the likely value was estimated. A framework is not a licence to add unrelated projects later.

Phased programmes with changing packages
Large construction or infrastructure programmes may involve design, enabling works, main construction and completion packages released at different times. Official framework guidance identifies this type of phased development as a possible reason for a framework term longer than the normal maximum, provided the authority can justify and publish the rationale. That is a possible justification, not an automatic construction-sector exemption.
An existing framework that actually fits
Using an existing framework can avoid a new competition only if the authority is an eligible user and the framework covers the proposed works. Check the original notice, framework agreement, lots, specification, pricing mechanism, maximum value, duration, geographical coverage and call-off procedure. A familiar framework name is not evidence of eligibility.
Need for repeatable call-off governance
Frameworks are useful when the authority wants consistent call-off documentation, pricing rules, performance requirements and reporting across a programme. They can also provide continuity of suppliers between phases. Those benefits depend on the framework having been designed for the actual construction market and on the authority following its process every time.
How competition works after a framework is in place
A framework does not automatically mean direct award
Do not assume that admitting suppliers to a framework lets a buyer select any one of them freely. The framework documents must state how a call-off is awarded. Depending on the applicable regime and the framework design, the call-off may be competed among framework suppliers or awarded without further competition using an objective selection method set out in advance.
The UK Government’s competitive-tendering guidance notes that call-offs are generally subject to competition, while the framework guidance explains that a call-off without competition is permissible only where the framework’s selection process allows it. The buyer must follow the stated method, not invent a convenient one for an individual project.

What a competitive call-off normally requires
Where the framework requires competition, invite the suppliers permitted by the framework, issue the call-off information required by its terms, apply the published award criteria and keep a complete record of the evaluation and award. Do not add suppliers that were not admitted, change the lot boundaries or rewrite the award method for a single package.
What a non-competitive call-off requires
Where the framework permits award without further competition, use the prescribed objective mechanism—for example, the ranking, rotation, allocation formula or other method stated in the framework. Document why the method applies and retain evidence that the selected supplier and price were determined in accordance with the framework.
No general commitment to place work
In most cases, a framework does not require the buyer to award a minimum volume of construction work, although the particular framework may contain a commitment. Read the framework’s volume, exclusivity and commitment clauses rather than promising suppliers work that the documents do not guarantee.
Framework types and supplier access
PCR 2015 frameworks
Frameworks awarded under the Public Contracts Regulations 2015 follow the rules and terminology of that regime. A call-off may be restricted to the framework suppliers and must use the selection and competition mechanism established when the framework was awarded. Transitional provisions can affect which older arrangements remain available, so confirm the legal basis before starting a call-off.

Procurement Act 2023 closed frameworks
A closed framework selects its suppliers at the initial procurement and does not admit new suppliers during its life. A buyer considering a closed framework must accept that the available market is limited to the admitted firms, even if a later project would benefit from a new entrant.
Procurement Act 2023 open frameworks
An open framework is designed as successive frameworks on substantially the same terms, reopening to allow new suppliers to join at specified points. Government Commercial Agency practical guidance states that an open framework must reopen at least once in the first three years and at least once in the following five years. Check the actual scheme and statutory requirements: not every framework has this feature, and reopening does not mean a buyer can ignore the framework’s lots, scope or call-off rules.
Why the distinction matters to a construction buyer
Supplier access affects resilience, local-market participation and the ability to bring in specialist capacity for later phases. A closed framework may provide continuity but less opportunity for firms that enter the market later. An open framework can refresh the supplier pool, but the authority must plan around its reopening timetable and comply with the applicable notice and award requirements.
Term limits and long construction programmes
Under the Procurement Act framework guidance, the general maximum term is four years for most frameworks and eight years for utilities or defence and security frameworks. A longer term may be used where the nature of the works requires it, but the authority must publish the rationale. The guidance gives a large, phased construction or infrastructure development with multiple call-offs as an example that may justify a longer duration.
Do not treat “construction” as a blanket exception. For a long programme, map the expected phases, call-off dates, design development, market conditions and completion point. Explain why a shorter framework would not support the works, publish the required justification and ensure the framework documents state the term and any extension mechanics. A long term cannot be used to avoid a new competition for work that falls outside the original design.
A practical decision process
- Identify the governing regime. Confirm the UK nation, procurement start date, Procurement Act 2023 or PCR 2015 basis, transitional arrangements and any sector-specific rules. Verify the regime under which an existing framework was awarded.
- Define the immediate contract. Write down the works, site, estimated value, lots, programme, design responsibility, performance requirements and dependencies. If these cannot be stated clearly, decide whether the requirement needs a competitive flexible procedure rather than a one-stage open procedure.
- Map the future pipeline. List related projects, likely phases, potential users, delivery dates and estimated aggregate value. If there is no credible sequence of contracts, record why a framework would not be proportionate.
- Check for a suitable existing framework. Verify buyer eligibility, supplier and lot coverage, works scope, geographic limits, maximum value, expiry date, fees, pricing rules, insurance and call-off instructions. Obtain and read the actual framework documents.
- Test the competition model. Establish whether the call-off requires a competition, permits direct selection or uses different methods by lot. Confirm which suppliers may be invited and which criteria may be applied.
- Choose the route and design the documents. For an open procedure, publish a project-specific scope, selection and award criteria, timetable and contract. For a framework, define the supplier pool, lots, term, estimated value, future users, call-off process and any longer-term justification before the framework competition begins.
- Run the procurement exactly as published. Apply the stated requirements consistently, answer bidder questions transparently, protect equal treatment and keep an audit trail of decisions. At a call-off, do not add an unadvertised selection test or change the framework’s competition method.
- Record the rationale and monitor use. Document why the route was proportionate, verify each call-off remains within scope and value, monitor term and supplier performance, and publish any notices required by the governing regime.

Common failure modes and how to prevent them
Calling a framework a tender alternative
A framework still has to be established lawfully, usually through a competitive procurement where it is an above-threshold public contract and no exemption applies. Presenting it as a way to avoid competition misunderstands its purpose. Treat framework establishment and each call-off as separate decisions.
Assuming “on the framework” means “available for every project”
Supplier admission does not expand the framework’s scope. A contractor may be on a relevant lot but not eligible for a particular authority, region, work type or call-off method. Check every boundary before issuing an invitation.
Using direct award without an authorised method
A preferred supplier, a good previous relationship or an urgent internal deadline is not a framework selection rule. If the documents require competition, run it. If they permit a non-competitive award, apply the stated objective mechanism and record the calculation.

Phasing does not make unrelated work related. Compare each proposed package with the framework’s original description, lots, value estimate and contract terms. If the work no longer fits, obtain specialist legal and procurement advice before proceeding; do not stretch the framework by assumption.

Designing an unnecessarily burdensome process
Excessive evidence requests, unrealistic deadlines and complex pricing schedules can exclude SMEs and reduce innovation. The competitive-tendering guidance links effective competition and transparency with value for money and integrity. Set requirements that are genuinely needed for the construction risk and contract size.
Ignoring the absence of guaranteed volume
Unless the documents say otherwise, suppliers may receive no call-offs. Forecast demand honestly and avoid representations that imply guaranteed work. A credible framework needs a supplier proposition that remains workable without promising volume the authority cannot provide.
Overlooking expiry and reopening dates
Track framework expiry, call-off deadlines, open-framework reopening windows and any conditions on contracts awarded near the end of the term. A project programme that runs beyond the framework’s lawful window can create a procurement problem even if the initial selection was valid.

| Illustrative requirement | Likely starting point | Why |

| One school extension with a settled design, site and completion date. | Direct open procedure. | It is a discrete contract that can be specified and competed once; a framework would need a genuine future-use case to justify its extra design work. |
| A multi-phase infrastructure development with enabling, construction and completion packages over several years. | Consider a framework, subject to term and scope checks. | The guidance identifies large phased construction or infrastructure work as a possible reason for a longer framework term and repeated call-offs. |
| A housing authority expects recurring refurbishment packages but cannot yet define the work types, locations or value. | Do not assume a framework is ready. | First improve the pipeline, scope, lot and value assumptions; otherwise a direct procurement for the known package may be more defensible. |
| An authority finds an existing framework with the right trade lot but is not listed as an eligible user. | Do not use it without resolving eligibility. | Supplier and work-type fit does not cure an authority-access problem. |
These examples illustrate the decision logic, not a legal determination for a particular project. The actual notices, framework terms, value calculations and applicable legislation decide whether a route is available.
What the official guidance does—and does not—establish
The official materials establish the structural differences between an open procedure and a framework, the need for proportionate competition, the importance of following the framework’s call-off process and the stated term and reopening rules. They do not provide a universal percentage saving, guaranteed tender-duration reduction or construction-performance improvement for frameworks. Do not promise an efficiency gain that the project evidence cannot support.
The UK Government’s framework guidance defines the framework as a contract for future awards. Its competitive-tendering guidance states that effective competition and transparency enable value for money and integrity, and that a complex requirement may use a designed multi-stage competitive flexible procedure. The Government Commercial Agency’s practical guidance distinguishes PCR 2015, Procurement Act closed and Procurement Act open frameworks. The Framework Practice Guide warns buyers to verify the regime before beginning a call-off.
Bottom line for a construction contract
Run a direct open procedure when the need is one clearly defined project and a reusable multi-project structure would add complexity without a credible pipeline. Establish or use a framework when related or phased works are foreseeable, the users and value can be estimated, the supplier pool and lots fit the market, and the call-off rules preserve the competition or objective selection the project requires.
What’s actually slowing this PC down?

In either case, start with the governing regime and the actual procurement documents. An open procedure is not the opposite of a framework, a framework is not automatically a direct award, and neither route is safe when the scope, value, eligibility, term or selection method has been assumed rather than verified.
