Do You Need a Permit to Build a Playhouse in Your Backyard?

A small backyard playhouse may be exempt from a building permit, but local rules vary and zoning or utility approvals may still apply. Check the property’s governing authority before building.

Maybe. Permit rules depend on the city or county governing your property, and there is no nationwide size limit that makes every backyard playhouse permit-free. A small, detached playhouse used only for play may be exempt from a building permit in some places, but attachment to the house, height, utilities, intended use, zoning and setbacks can change the answer. Check with your local building and planning offices before buying materials or building.

Why a playhouse may need more than one approval

“Playhouse” is an everyday description, not a guarantee of how your local government will classify a structure. Officials may apply rules for accessory buildings, sheds or other structures, and a kit seller’s description does not determine the legal category. The details that commonly matter include the playhouse’s area and height, whether it is detached, whether anyone will sleep or live in it, and whether it will have utility connections.

Also distinguish a building permit from permission to place the structure in a particular spot. A building-permit exemption does not automatically waive zoning requirements, setbacks, height limits, lot-coverage limits, easements or other site restrictions. Depending on the property and local rules, separate zoning, planning, electrical, plumbing or other approval may apply.

Local thresholds vary. Some jurisdictions in the examples below use 120 square feet, others use 200 square feet, and their conditions are not identical. These are local examples, not a survey of every U.S. jurisdiction or a rule you can transfer to another property. The cited pages and handout may also be updated, so confirm the applicable rule directly before relying on a threshold.

How local rules differ

The examples below show why the address and design matter. “Exempt” in this table refers to the stated building or construction permit condition; it does not mean that every other approval or placement rule is waived.

Jurisdiction and official source Stated permit rule for playhouses or similar structures Important stated conditions
Marin County, Community Development Agency, “Do I need a building permit?” One-story, detached, non-habitable sheds, playhouses and similar accessory structures of 120 square feet or less do not need a building permit. They must comply with zoning regulations. The page separately describes conditions for swings and playground equipment.
City of Sacramento, Community Development Department, “Residential Accessory Structures” handout, dated February 16, 2023 A building permit is required for non-living detached structures at or above 120 square feet, and for any structure attached to the dwelling regardless of size. Associated gas, mechanical or electrical work requires a permit. The handout includes pool/playhouses among accessory-structure examples.
City of Fresno, “Single Family Homes” An exception is described for a one-story detached playhouse up to 120 square feet and 12 feet in height. Municipal location requirements apply, including a minimum distance of 3 feet from adjacent property lines. The page also states construction and anchoring requirements.
City of Columbus Building and Zoning Services, “BZS Frequently Asked Questions” A one-story detached playhouse of 120 square feet or less is listed as work that does not require a building permit. Accessory structures remain subject to the zoning code for size and location.
City of San Ramon, “Frequently Asked Questions” An accessory building at or below 120 square feet does not need a building permit if no electrical or plumbing work is proposed. The city separately addresses zoning standards for setbacks, height and combined accessory-structure area.
City of Portland Permitting & Development, “Garages, sheds, and accessory structures” Non-habitable accessory structures over 200 square feet or taller than 15 feet need a building permit. Habitable accessory structures need one regardless of size. Smaller non-habitable structures may still need a zoning permit.
City of Tumwater Community Development Department, “When do I need a permit?” A one-story detached playhouse of up to 200 square feet may be exempt from a building permit. Setbacks still apply. The city warns that proceeding without a required permit can lead to penalties and corrective work.
City of Mesa Development Services, “Residential Construction Frequently Asked Questions” A detached shed or playhouse under 200 square feet without electrical, plumbing or mechanical connections can be built without a construction permit. The stated exemption is conditioned on both the size and absence of those connections.
San Joaquin County Community Development Department, “Accessory Structure” A possible exemption is described for a one-story detached playhouse not exceeding 120 square feet. The exemption does not allow violations of planning, zoning or setback rules, and does not include electrical, plumbing or mechanical installations.

The table does not establish a single “safe” size for other locations. It also cannot settle how a particular jurisdiction measures area or height: the cited summaries do not state a common measurement method. Ask whether the official calculation uses interior or exterior dimensions, includes roof overhangs, or uses another definition of footprint. Use the local answer for your design rather than applying another city’s method.

What to check before you buy a kit or start building

Gather enough detail for officials to evaluate the actual proposal. A rough product label such as “small playhouse” is less useful than the dimensions, placement and intended use.

  • Which authority covers the parcel? Confirm whether the property is inside city limits or governed by the county or another authority. The mailing address alone may not settle which office handles permits.
  • What are the proposed dimensions? Record floor area and overall height, and ask how the local code measures each. Include any design features that could affect the footprint.
  • Is it detached? Note whether the playhouse stands apart from the home and other buildings or will be attached or connected. Sacramento, for example, states that a structure attached to the dwelling needs a building permit regardless of size.
  • How will it be used? Explain whether it is only for children’s play or whether anyone will sleep or live in it. Portland’s guidance requires a building permit for habitable accessory structures regardless of size.
  • Will it have utilities? Identify planned electrical, plumbing, gas, mechanical or other utility work, even if it is not included in the initial kit. Local exemptions may exclude some or all such work.
  • Where will it sit? Provide its distance from property lines and other buildings, and ask about setbacks, height limits, lot coverage, easements and special zoning or site constraints.
  • Could another approval apply? Ask about zoning or planning review and any separate electrical, plumbing or other permits, even if the building permit itself is not required.

A kit is not automatically permit-exempt because it is sold as a playhouse or arrives in prefabricated pieces. Compare the kit’s actual footprint, height, attachment, intended use and utility plans with the local rules. If a design changes after you receive an answer, check whether the revised dimensions or features alter the approval requirements.

How to get a reliable answer from your local offices

  1. Identify the permitting authority. Contact the building or permitting department for the property’s jurisdiction. If it is unclear whether city or county rules apply, ask the office to confirm that first.
  2. Describe the proposed structure in writing. Include the address or parcel location, dimensions and planned placement; state whether it is one story, detached, non-habitable, and whether any utilities are proposed. Say if any of those details are undecided.
  3. Ask separate questions about permits and placement. Request a determination about the building permit, then ask whether zoning, planning, setbacks, lot coverage, easements or other site rules apply. Ask which office handles each requirement.
  4. Request the applicable rule or a written response. Ask for a link to the specific ordinance, official guidance or permit page, or request the answer by email. Record the office, date and details you provided so you can confirm the response applies to the final design.
  5. If a permit is needed, ask what comes next before construction. Find out what drawings or other plans are required, which approvals must come first, whether inspections apply and how the proposed work is reviewed. Do not assume that a kit’s instructions supply everything the local office requires.

Ask the building department and planning or zoning office when the answer involves both construction and placement. If one office cannot address a utility connection or another specialized approval, ask which department can. Getting the applicable rule in writing is especially useful when an exemption has conditions or when more than one office is involved.

Common ways a seemingly simple project runs into trouble

  • Using a threshold from another city. A 120-square-foot allowance in one place does not establish a 120-square-foot allowance elsewhere; likewise, a local 200-square-foot rule is not universal. Check the jurisdiction that governs the property.
  • Treating permit exemption as permission to build anywhere. A building permit may not be required while zoning and setbacks still control location. Fresno, for example, describes a minimum 3-foot distance from adjacent property lines for its stated exception; that figure is not a general setback rule.
  • Adding utilities after checking only the basic structure. Electrical, plumbing, gas or mechanical work can change what approvals are needed, and some listed exemptions exclude those installations. Include utility plans in the first inquiry.
  • Assuming “non-habitable” is obvious. Intended use matters. If the playhouse might be used for sleeping or living, explain that to the authority rather than relying on its name or small size to decide the classification.
  • Starting before confirming the conditions. Some exemptions include height, story, construction, anchoring or location requirements. Tumwater warns that building without a required permit can lead to penalties and corrective work, which may mean addressing the structure after it has been built.

If you discover a permit or approval was required after work has begun, contact the local permitting office promptly and ask how to correct the situation. Do not assume that a completed structure will automatically qualify for an exemption or that a later permit will be granted on the original terms.

What to do if the answer is unclear

Do not treat silence, an informal guess or a different jurisdiction’s FAQ as approval. Send the office the dimensions, intended use, attachment and utility details, along with a simple site sketch showing proposed distances to property lines and nearby buildings. Ask which local rule controls and whether the answer covers building, zoning and utility approvals. If the design is unusual or the office says plans are required, ask what level of drawing or professional assistance it expects before spending on construction.

The cited local guidance illustrates the range of possible rules, but it cannot determine the permit status of an unlisted property. The official governing that parcel must evaluate the proposed playhouse under the rules that apply there.
