Can an Unauthorised Building Be Regularised in Telangana?

Telangana’s LRS may regularise an eligible plot in an unapproved layout, but the state FAQ says there is currently no provision to regularise an unauthorised building.

Generally, no. The Telangana Government’s Layout Regularization Scheme (LRS) FAQ says that owners may apply to regularise an eligible plot in an unapproved layout, but that there is currently no provision to regularise an unauthorised building. Regularising a plot does not, by itself, legalise a structure already built on it.

Plot regularisation and building regularisation are different

LRS addresses unapproved layouts and eligible plots within them. It is not a building-regularisation order. The Telangana Government’s LRS FAQ directly addresses someone who has built on an unapproved plot: the plot may be eligible for an application, but the FAQ says there is currently no provision to regularise the unauthorised building.

A separate question is whether the plot qualifies for LRS and whether the owner can apply for building permission. Approval of a plot under LRS may enable a later permission application; it does not retrospectively approve construction or settle an enforcement matter.

Which route might apply to the property?

Issue What the route addresses Key qualification
Unapproved plot or layout LRS plot/layout regularisation The LRS FAQ identifies 26 August 2020 as the relevant cutoff for covered plot owners; eligibility also depends on the 2020 rules, required fees and charges, and the property’s circumstances. Telangana LRS FAQ
Permission for a proposed building on certain unapproved-layout plots A building-permission application through BuildNow, including self-certification for certain qualifying proposals BuildNow describes deed-date conditions of 28 October 2015 for old municipalities and 30 March 2018 for newly constituted municipalities under listed government orders. These apply to that permission context, not as universal cutoffs or substitutes for the LRS cutoff. BuildNow FAQ
Unauthorised building already constructed No general building-regularisation provision is identified in the LRS FAQ Do not treat LRS plot eligibility or a permission application route as approval of existing unauthorised construction. Telangana LRS FAQ

Check whether the plot qualifies before assuming LRS is available

The LRS FAQ says an application may qualify where the sale deed was executed before the relevant notification date, the prescribed fees and charges are paid, and the 2020 LRS rules are met. It specifies 26 August 2020 as the cutoff for the scheme’s covered plot owners. That date belongs to the LRS context; it is not a blanket test for every building-permission application.

The FAQ also identifies exclusions. It says plots affected by a master-plan road will not be regulated, plots carved from approved-layout open space cannot be regularised, and a plot based on a subsequently altered layout is ineligible in the circumstances described. Check the specific property and applicable authority rather than assuming that an old deed or existing building makes a plot eligible.

Building permission still depends on location and application rules

BuildNow describes an online application route for building permission. Its FAQ says self-certification is available for certain compliant individual residential proposals and discusses applications on plots in unapproved layouts subject to the stated dates and other conditions. This is a permission route, not a provision for retrospectively regularising an unauthorised building.

Location restrictions can prevent an application from being considered. BuildNow says plots within the bed or full-tank level of rivers, vagu, lakes, ponds, kuntas or nalas, as shown in the notified master plan, cannot be considered for building permission. For a plot abutting a water body, it says irrigation and revenue no-objection certificates are required. Verify the mapped location with the relevant authority.

Gather the records relevant to the application

The TG-bPASS checklist includes the following documents and conditional evidence. Requirements depend on the application type, so confirm the current list with the competent authority.

  • Site photograph and sale deed or link documents.
  • Property-tax receipt if tax has been paid; VLT receipt if the preceding three years have been paid.
  • Market value certificate if SRO data is unavailable.
  • For an unapproved layout or open plot, ownership or link documents registered before 26 August 2020.
  • Layout approval document if the layout is approved, and building-plan approval document if a building plan was approved.
  • For construction before 1 January 1985, a pre-1985 property-tax receipt, water connection record or electricity bill.
  • BRS approval document if the building was approved under BRS.

See the TG-bPASS document checklist for the application-specific list. These records can help establish what was approved, when it was built, and which route may be relevant; collecting them does not itself confer approval.

What to do if construction is unauthorised or a notice has arrived

  1. Identify the actual defect. Establish whether the issue is an unapproved layout or plot, construction without permission, or a deviation from a sanctioned building plan. These are distinct problems.
  2. Assemble the property record. Gather the sale deed and link documents, site photographs, tax records, any sanctioned plan, and any prior BRS approval. Check the TG-bPASS checklist for conditional records that may apply.
  3. Confirm the competent authority and planning status. Check the applicable layout and master plan, including any water-body restrictions, with the relevant local authority.
  4. If a notice has been issued, act promptly. Obtain the notice, sanctioned plan and property records, then ask the authority and a qualified Telangana property lawyer or architect about the process and deadlines that apply to the case. LRS plot regularisation should not be assumed to dispose of a building notice.
  5. Do not continue construction on an assumption of later approval. BuildNow warns against beginning construction before required permission is obtained. It also describes demolition enforcement for unlawful construction and says false statements or misrepresentation can lead to cancellation or revocation of permission and demolition action. Rules, scheme availability and portal instructions can change. The official Telangana LRS FAQ, BuildNow and TG-bPASS materials cited here were accessed on 4 October 2026; confirm current requirements with the competent authority before acting.
