Zoning review checks whether a project’s use and site arrangement fit local land-use rules; building review checks whether the proposed construction meets applicable building and safety codes. Your project may need both, but local rules determine which approvals apply, which office handles them, and in what order.
The distinction matters even for a small home project: a building permit is not automatically a substitute for zoning clearance, and a project that does not need a building permit may still raise a zoning question. The safest first step is to contact the planning or zoning office and building department that serve the property, describe the work, and ask how the local process applies to your address.

Building permit vs. zoning approval: what each one checks
The City of Berkeley summarizes the distinction this way: “Most development is regulated under two different codes: the Zoning Code and the Building Code.” Those reviews can relate to the same project, but they focus on different requirements. Zoning review is about land use and the way a proposal fits on a site; building-code review is about construction standards and safety for the intended use.
| Review | Main question | Typical matters reviewed |
|---|---|---|
| Zoning approval | Does the proposed use and arrangement of the property comply with local land-use rules? | Allowed uses, setbacks, height, parking, zoning-district rules, overlays, and some design requirements. |
| Building permit | Does the proposed construction meet applicable building-code and safety requirements? | Construction plans, code compliance, and safety for the intended use. |
These are general descriptions, not a universal division of authority. The local government determines what it reviews and how it names each clearance. Berkeley’s Zoning Permits guidance describes zoning review as addressing how development fits its community, while building-code review concerns construction standards and safety.

What does zoning approval cover?
Zoning approval can address whether a proposed use is allowed in the property’s zoning district and whether the site arrangement meets applicable rules. Depending on local requirements and the proposal, the review may involve setbacks, height, parking, district-specific rules, overlays, and some design requirements. These are examples of subjects zoning may cover, not a checklist that applies to every property or project.
In practical terms, zoning asks how the project relates to the land and its local setting. It is distinct from asking whether the construction itself meets building and safety codes. A homeowner should not assume that a project’s modest size or familiar residential purpose settles the zoning question: the local authority still needs to determine which rules apply to the site and proposed arrangement.
What does a building permit cover?
A building permit generally concerns regulated construction and whether the proposed work meets applicable building-code and safety requirements. Building-code review considers construction plans, code compliance, and safety for the intended use. The exact scope of review, permit name, and permit requirements depend on the local government and the work proposed.

A proposal could meet construction standards while still needing zoning clearance, or a zoning review could be relevant even where no building permit is required. Ask each local department what it is reviewing rather than treating one approval as proof that all requirements have been satisfied.
Do you need zoning approval before a building permit?
Possibly, but there is no nationwide sequence. In Berkeley, zoning approval generally comes before a building permit. Los Angeles describes a process in which an application is filed with the building department and required planning clearances are completed before the permit is issued. Some jurisdictions handle zoning clearance within the building-permit review; others require a distinct zoning application or approval.
For example, Los Angeles City Planning’s planning-approval guidance explains how required planning clearances fit into its process. The steps for another city, county, or town may differ. Ask the agencies serving your property whether zoning review is separate, integrated, or required before permit issuance.

“Before” can describe different things in different local processes. One jurisdiction may expect zoning approval before a homeowner applies for a building permit. Another may accept an application through the building department and require planning clearances to be completed before the permit is issued. In a process with concurrent review, the departments may consider related issues during overlapping parts of the review. Those examples do not establish a single sequence for all projects; they show why homeowners should ask about the local application route and the point at which each approval is required.
When you contact the agencies, ask these questions directly:
- Is a zoning or planning review needed for this address and work?
- Is that review part of the building-permit application, or do I need a separate application?
- Must any zoning clearance be complete before I apply for a building permit, or before the permit can be issued?
- Do the planning and building reviews happen in sequence or concurrently for this project?
- Which department should receive the first inquiry or application?
Do not rely on the sequence used by a neighboring city, a previous project, or a general online description as a substitute for confirmation from the agencies with authority over your parcel.
Can zoning approval be required when no building permit is needed?
Yes. A project may need land-use approval even if it does not require a building permit. Portland identifies certain parking-area work and development in some overlay zones as examples of situations in which a zoning permit may apply. That does not mean every parking project or every property in an overlay zone has the same requirements; the local code and site conditions matter.
Do not use “no building permit required” as proof that no approval is needed. Portland’s Zoning Permits guidance illustrates why the zoning question should be checked separately.

Those descriptions do not, by themselves, establish whether zoning rules apply. The relevant question is not only whether construction requires a building permit, but also whether the proposed use or site arrangement triggers local land-use review. Verify both questions with the local agencies instead of inferring an answer from the absence of one permit.

Which office should you contact?
Start with the planning or zoning office and the building department for the exact jurisdiction where the property is located. A mailing address or nearby city name may not identify the agency with authority. The property could be in a county, an incorporated town, or another local jurisdiction with its own rules.
The responsible office and depth of review can also depend on the address, zoning district, and scope of work. San Francisco Planning says review may be concurrent or more extensive depending on the work and zoning district. Loudoun County advises owners inside incorporated towns to check requirements with the relevant town zoning office. Consult San Francisco Planning’s homeowner guidance and Loudoun County’s zoning requirements for examples of how local jurisdiction and project details affect the process.
That jurisdiction check is important before you apply or order work. The local process may be administered by a city, county, or town, and a property’s location can affect which office answers the zoning question. Loudoun County’s direction to owners in incorporated towns is a reminder that the county office may not be the right source for every property within the county. Give the agency the property address and ask whether it serves that parcel.
Likewise, the amount and type of review cannot be determined from the approval’s name alone. San Francisco Planning notes that review can be concurrent or more extensive based on the work and zoning district. Tell the office what you propose to do and ask whether the property’s district or an overlay changes the review. An answer about a different address or a different kind of work may not resolve your own requirements.
How to check requirements before work begins
- Identify the property’s jurisdiction. Confirm which city, county, or town has authority over the address. If you are unsure, ask the local planning or zoning office which agency serves the parcel. Do not assume the mailing address or the closest city name identifies the correct permit authority.
- Describe the project and provide the address. Explain what you plan to build, alter, or change about the property’s use. Give enough detail for staff to identify the site and proposed work. A useful initial inquiry connects the work to the actual address, because the review can depend on location, zoning district, and project scope.
- Ask what approvals apply. Contact both planning or zoning and the building department. Ask whether the work requires zoning approval, a building permit, both, or another local clearance. Keep the two questions separate: land-use compliance and site arrangement on one hand, construction-code and safety review on the other.
- Confirm the sequence and application route. Ask whether planning review is part of the building-permit process, whether a separate zoning application is required, and whether any clearance must be completed before permit issuance. Confirm whether reviews are separate, integrated, or concurrent rather than assuming that one order applies everywhere.
- Ask what materials are needed. Find out whether staff needs construction plans, a site plan, a survey, or other documents for your particular project. Requirements depend on the property and scope. Do not assume that a list used for a different project or jurisdiction is complete for yours.
- Check for other site-specific reviews. Ask whether the zoning district, an overlay, or another feature of the property changes the review. The agencies can tell you which additional approvals apply locally. Portland’s examples show that zoning permits can be relevant to some development even when a building permit is not required.
- Wait for the required approvals before starting. Do not assume that one department’s answer settles the other department’s requirements. Follow the process confirmed by the agencies with jurisdiction, and clarify any remaining question before ordering work or beginning construction.
What to have ready for your first inquiry
The local agencies do not publish a universal application packet, required form, fee, or processing time. They advise making the first conversation specific: provide the property address, describe the proposed construction or change in use, and ask which plans or surveys are needed for that project. If staff says a site plan, survey, construction plans, or other material is needed, confirm what level of detail and which review it supports before preparing or submitting it.
Keep a clear record of the questions you asked and the direction you received, especially where one review is integrated with another or where the order matters. If the work or its scope changes, check whether the earlier guidance still applies. The local agencies—not this general comparison—are the source for the requirements that govern a particular site.

What this comparison does—and does not—tell you
The distinction is useful for framing the right questions, but it cannot determine whether a particular homeowner’s project is allowed or permit-exempt. Local codes, property conditions, project scope, and jurisdiction all affect the answer. The official examples from Berkeley, Los Angeles, Portland, San Francisco, and Loudoun County illustrate different local processes; they do not establish a rule that applies everywhere.

This article also cannot provide a reliable universal cost, timeline, or document list. The official guidance reviewed for this comparison does not establish one fee schedule or standard processing period for all jurisdictions and projects. Ask the office serving your property about its current requirements and any application costs or timing information relevant to your proposal.
Other approvals may also apply to a particular site or project. The examples here are not a complete universal checklist, and they do not establish what additional reviews any specific property needs. Ask the local planning or zoning office and building department to confirm the requirements for your address and proposed work before ordering work or beginning construction.
Frequently Asked Questions
What is the difference between a building permit and zoning approval?
Zoning approval addresses whether the project’s use and site arrangement comply with local land-use rules, which may include allowed uses, setbacks, height, parking, district rules, overlays, and some design requirements. A building permit generally concerns whether regulated construction meets applicable building-code and safety requirements. The local government defines the process and scope.
Do I need zoning approval before I apply for a building permit?
It depends on the jurisdiction and project. Berkeley generally places zoning approval before a building permit. Los Angeles describes a process in which required planning clearances are completed before permit issuance after an application is filed with the building department. Ask the local agencies whether review is separate, integrated, concurrent, or required at a particular step.

Are zoning approval and building permits always separate applications?
No universal application route applies. Some jurisdictions integrate zoning clearance into the building-permit review, while others require a separate zoning application or approval. Ask the offices serving your property which route applies.
Which department should I contact first?
Identify the jurisdiction for the property address, then contact its planning or zoning office and building department. Ask which office should receive your first inquiry or application and whether another clearance must come first. In some places, the relevant town office may handle zoning requirements even when the property is within a county.
What information should I provide when asking about permits?
Provide the property address and a clear description of the proposed construction, alteration, or change in use. Ask which approvals apply, how reviews are sequenced, and whether construction plans, a site plan, a survey, or other materials are needed for your specific project.

Can I use my neighbor’s permit experience to determine my requirements?
Not reliably. Review can depend on the address, zoning district, property conditions, jurisdiction, and scope of work. Use another project only as a prompt for questions; confirm requirements with the agencies serving your own parcel.
Does this comparison tell me what my project will cost or how long approval will take?
No. The local examples do not establish a universal fee or processing time. Ask the jurisdiction with authority over your property for current cost and timing information relevant to your project.
The Bottom Line
Zoning approval asks whether a project’s use and site arrangement comply with local land-use rules; a building permit generally addresses construction-code and safety requirements. A project may need both, zoning review may be integrated into the permit process, and zoning approval can sometimes apply even when a building permit is not needed. Before ordering work or starting construction, give the property address and project description to the planning or zoning office and building department serving that exact jurisdiction, and confirm the approvals, documents, and sequence they require.
