The dispute involved two distinct issues: whether the revised plans met the project’s applicable building-separation requirements, and whether changes affecting existing flat purchasers’ common-area rights had the required consent under the relevant Uttar Pradesh apartment-law framework.
What the Supreme Court decided
In Supertech Ltd v Emerald Court Owner Resident Welfare Association and Others, the Court upheld the order requiring demolition of Towers T-16 and T-17. The case concerned construction approvals and revisions for this particular NOIDA development. It was not a ruling that every building irregularity, wherever it occurs, automatically requires demolition.
The Court’s analysis addressed both planning compliance and the rights of existing purchasers. Those questions are connected by the project’s revisions, but they are separate legal tests: approval of a plan does not by itself answer whether applicable distance requirements were met or whether owners’ statutory interests and consent protections were respected.
Why distance between buildings mattered
Building separation was assessed against the rules applicable to the Emerald Court project, including the relevant NOIDA regulations and building-code requirements. The required distance depends on the governing rules and the buildings’ configuration; the measurements in this dispute should not be treated as a nationwide minimum.

A Free Law case digest reports that T-17 was 9 metres from the existing T-1 and describes that separation as falling short of the larger minimum distances considered in the case. That figure is a project-specific summary from the digest, not a general building standard. The exact comparison depends on the applicable rule and building configuration.
Why existing flat owners’ consent mattered
The revised construction affected the interests of people who had already bought flats, including rights connected with common areas and facilities. The Court considered those interests under the applicable Uttar Pradesh statutory framework for apartment ownership. The issue was not simply whether a developer had obtained planning approvals from NOIDA; the rights and consent protections of existing purchasers also had to be considered.

This does not establish a universal rule that every later change to a project requires the same form of consent. The relevant statutory provisions, the nature of the change, the rights affected, and the project documents matter. The Emerald Court ruling addressed the record and legal framework before the Court.

The Supreme Court’s decision upheld demolition in light of the project-specific approvals, regulatory requirements, purchaser rights, and litigation record. It should not be read as a substitute for checking the governing rules and facts in another development.

What the ruling does—and does not—establish
- It establishes that the Supreme Court upheld the demolition order against T-16 and T-17 at Emerald Court on 31 August 2021.
- It addresses both compliance with applicable building-separation requirements and the statutory interests and consent protections of existing purchasers.
- It does not establish that the 9-metre figure applies to other projects, or that all construction violations necessarily have the same remedy.
- It does not determine the present physical or procedural status of the towers; that status is outside the facts stated here.
