If roadwork damages your driveway, curb, or landscaping, the party that caused the damage is usually the place to start: that may be a public agency, its contractor, a utility, or a private contractor. There is no single nationwide rule guaranteeing who pays. The road’s owner, the project arrangements, local law, and evidence of what happened can all affect the result.
Start by identifying who did the work
Find out which agency manages the road and which company or utility performed the work. Check project signs and permits, then contact the local transportation or public works agency if the responsible crew is unclear. In New York City, the Department of Transportation recommends documenting damage and contacting the company that caused it; its permit search can help identify who performed work: NYC DOT sidewalk guidance.

If several crews were working nearby or the cause is uncertain, ask the agency managing the project to identify the active permit holder and contractor. Send the same written report and evidence to each plausible responsible party while you confirm the correct claim route.
Choose the claim route based on the alleged cause
| Who may have caused the damage | Where to start | What to keep in mind |
|---|---|---|
| City or other public-agency employee | Use the agency’s official claim process and check its deadline immediately. | Filing a claim does not mean the agency has accepted responsibility. Utah Department of Transportation explicitly warns that submitting a claim does not establish liability, and says not to submit a claim to the state when another entity caused the damage: UDOT damage claims. |
| Public-agency contractor | Notify the agency managing the project and ask for the contractor’s inspection and claims contacts. | Local rules and project terms matter. In New York City, the DOT says a City contractor must repair sidewalk damage caused through its own negligence at no cost; that is a specific NYC sidewalk rule, not a nationwide guarantee: NYC DOT sidewalk repair guidance. |
| Utility or private contractor | Report the damage to the company that performed the work, and notify the public agency that issued the permit or manages the road project as appropriate. | NYC directs owners to seek repayment from a utility or private contractor when that party caused the damage: NYC 311 broken sidewalk guidance. |
| Cause not yet clear or more than one party may be involved | Ask the road agency who holds the active permit or contract; provide dated photos and a written account to the agency and potentially responsible companies. | A permit can help identify who performed work, but does not by itself establish who is liable for a particular loss. |
Ask the likely responsible party for an inspection, a repair plan, and the correct claim contact. Keep copies of every report and response. If a public entity may be responsible, use its current official claim instructions rather than assuming that a contractor’s complaint process will protect a government claim.

Document the damage before conditions change
Make a clear record as soon as you notice the problem. Take dated photographs of the damage, the surrounding work zone, and project signs if possible; keep the original files. Write down the property address, when you noticed the damage, what changed, whether work was active nearby, and the apparent nature of the damage. Connecticut DOT’s Construction Manual lists the occurrence date, time, precise location, cause, and property damage among claim details: Connecticut DOT Construction Manual, Version 32. These are useful documentation points, not a universal legal checklist.
- Keep messages, letters, inspection notes, and repair estimates.
- Ask the claim handler whether it wants to inspect the site or review an estimate before permanent repairs begin.
- If urgent work is needed to prevent further damage or a safety hazard, record the condition first where feasible and retain invoices and other records.
Before arranging permanent repairs, preserve evidence and check whether the company or agency wants to inspect the damage. The steps and evidence required depend on the responsible party and local process.

Check deadlines and local rules right away
Claim deadlines differ by jurisdiction and type of responsible party. New York City DOT says claims for damage allegedly done by the City should be filed with the Comptroller within 90 days: NYC DOT sidewalk repair guidance. That deadline is a NYC example only; it does not establish the deadline for another city, state, utility, or private contractor. Confirm the applicable deadline directly with the responsible entity.

Portland’s code assigns abutting owners responsibility for certain sidewalk, curb, driveway, and parking-strip construction and maintenance, with exceptions: Portland City Code §17.28.020. A rule assigning upkeep to a property owner does not, by itself, decide whether a contractor must pay for damage caused by its work.

What can affect whether a claim is paid?
Responsibility cannot be determined from the fact that roadwork happened nearby alone. The exact location and property boundary, who owned or managed the road, who performed the work, the cause and prior condition, applicable permits or project terms, local law, and notice requirements may all matter. Official procedures differ: Connecticut DOT’s Construction Manual describes its own claims routing and contractor notifications, while NYC and Utah publish distinct instructions for their jurisdictions. These examples illustrate why the correct route must be confirmed locally rather than treated as a universal rule.
This is general information, not a determination of a particular claim. For an actual loss, use the current instructions from the agency, utility, or company responsible for the project and seek local legal advice if the amount or responsibility is disputed.
