Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →Responsibility depends on four facts: what was damaged, who owns or maintains that asset, where it is located, and who caused the damage. A city may maintain a sewer main yet have no duty to replace a private driveway or landscaping disturbed during the same project. Check the utility boundary, easements, shared-line agreements, project contract and local claim rules before deciding who pays.
Start by separating sewer maintenance from property restoration
“Who maintains the sewer?” and “Who must repair the property damage?” are related but different questions. A public utility can own a main under a private lot while the property owner owns the sewer lateral, paving, retaining wall, trees or irrigation system above it. A contractor can be responsible for damage it caused even when neither the contractor nor the city owns the damaged asset.

The answer is therefore determined case by case. Identify the damaged item, map its location against the public right-of-way or an easement, establish the pre-work condition, and then read the documents that assign access, maintenance and restoration duties. Local ordinances and the construction contract control the claim route.

Before assigning blame, describe each affected item separately. “The yard was damaged” is too broad for an adjuster or public agency; a claim should distinguish soil settlement, a broken sewer lateral, a crushed driveway apron, a damaged foundation drain and lost plants.

| Damaged asset or area | Questions to answer | Potentially responsible party |
|---|---|---|
| Public sewer main | Is it owned by the city or sewer authority? Did excavation, traffic or equipment damage it? | The utility, its contractor, or another party that caused the damage, depending on the work contract and evidence. |
| Private sewer lateral | Where does the local utility place the ownership or maintenance boundary—house, property line, curb or main? | Often the property owner, unless a local program, easement or negligent contractor shifts the cost. |
| Shared private sewer | Which buildings use the section, and what does the recorded easement or shared-line agreement say? | The participating owners in the proportions stated by the agreement or local code; a party that caused additional damage may face a separate claim. |
| Driveway, sidewalk or parking strip | Is the surface on private land or in a public right-of-way? Was it permitted and documented before work? | The owner, city, utility or contractor according to right-of-way rules, restoration policy and causation. |
| Landscaping, fences, irrigation or special improvements | Were they authorized, shown to the crew and within the work area or easement? | The owner may bear the loss for unauthorized features; an agency or contractor may owe restoration for documented, authorized improvements it removed or damaged. |
| Foundation, retaining wall or other structural work | Was the damage caused by excavation, vibration, settlement, a leak or a pre-existing defect? Is an emergency stabilization required? | The party whose work or failure caused the condition, subject to engineering evidence, contract terms and local law. |
Why location and ownership change the answer
Public main versus private lateral
A sewer main is the larger public pipe in a street, right-of-way or recorded utility easement. A lateral carries wastewater from one building to the main. Many jurisdictions divide maintenance at a point such as the curb, property line or connection to the main, but the dividing point is not nationwide. Ask the local sewer utility to identify the segment it owns or maintains in writing.
Right-of-way and easement areas
An easement grants access for a specified purpose; it does not automatically transfer ownership of everything in the easement. The easement language may permit excavation, require the owner to keep the corridor clear, or assign restoration duties. A project may have a broader temporary construction easement with its own restoration terms. Compare the recorded document with the work order and the plans used by the crew.
Shared private sewers
When several buildings use one private section, responsibility may be divided among the users rather than assigned to the city. A recorded agreement can set percentages, notice requirements and access rights. If no agreement resolves the issue, local code may supply a default allocation, but a person who damaged or worsened the line can still be pursued separately.

What local rules illustrate
Municipal examples show why a rule from one city cannot be treated as national law.

San Francisco
San Francisco Public Utilities Commission guidance places responsibility for maintaining, repairing and replacing a sewer lateral in an easement area on the property owner. The City requires an easement right to access and work on a public main beneath private property. When the utility performs main work, it says it will attempt to restore the easement area to base conditions when practical and, at minimum, backfill it. Special features installed without written permission may be removed at the owner’s expense. This can leave an owner responsible for a lateral while the utility restores only the basic ground condition after main work.
Portland, Oregon
Portland assigns the owner responsibility for breaks between the house and curb, including the sidewalk and parking strip in the right-of-way. The City maintains specified lower-lateral portions from the main to the curb and an applicable easement connection. After notice of a break or leak, Portland gives an owner 30 days to repair or request more time; right-of-way repairs require permits. That 30-day period is a Portland rule, not a general deadline for other jurisdictions.
Portland code also provides a shared-sewer default: repair costs for a damaged common private sewer section are assigned equally among owners whose buildings use it, except for the cost of an individual property’s new public connection. The same code allows the City to seek reasonable costs from a person who damages public sewer facilities and allows owners to seek legal relief from someone who caused or aggravated damage.
Seattle
Seattle guidance emphasizes the recorded easement for a shared side sewer. The document may establish who can enter, who must maintain the line and how repairs are divided. Without reviewing that easement, an owner cannot reliably predict whether the expense belongs to one parcel or all users.

Oklahoma City
Oklahoma City uses a narrow reimbursement standard for a City-main backup. It says reimbursement for damage or cleanup is available only when the City had advance knowledge that its system was at fault and failed to correct it. The process begins through the Municipal Counselor’s office. A private backup, a contractor excavation or a lateral failure may follow a different route.
When a contractor causes the damage
A contractor’s presence at the site does not by itself make the contractor liable for every loss. Causation and the contract matter. Preserve the notice of work, bid or work order, plans, change orders, daily reports and any language describing protection or restoration.
A 2020 Indiana Department of Transportation contract provision illustrates the distinction. It required known utility lines that were to remain in service to be protected. If the contractor damaged such a line, the contractor had to repair or replace it at its own expense, unless the utility owner made the repair, in which case the contractor reimbursed the owner. The provision treated utilities that were not indicated or made known before excavation differently and allowed some resulting costs to be handled as extra work. This is an example of contract allocation, not a universal rule for private sewer projects.
For a driveway, wall or landscape claim, show that the condition existed before work, identify the activity that could have caused it, and connect the timing and physical evidence. An engineer, plumber, arborist or paving contractor may be needed when the cause is disputed. Do not sign a release or accept a final restoration payment until you understand whether hidden damage remains.

What to do immediately after discovering damage
- Make the area safe. Keep people away from an excavation, exposed sewage, unstable pavement or a compromised wall. For an urgent sanitation or structural hazard, contact the utility or local emergency service promptly.
- Record the condition. Photograph and video each item from close and wide angles. Include a ruler or other scale for cracks, dates, the work-zone signs, equipment and any soil or water movement. Write a timeline of when the crew arrived, when the damage appeared and whom you notified.
- Identify the project. Record the agency, utility, contractor, crew supervisor, project number, street address, permit number and all notices. Ask for the project contact and incident-report procedure.
- Notify the managing agency and contractor in writing. Give a factual description, attach photographs and request the claim form, inspection process and restoration standard. Keep proof of delivery and continue to document changes.
- Collect controlling documents. Obtain the deed, title report, recorded easement, shared sewer agreement, utility maps, permits, construction plans, work order and contract provisions that address access, protection or restoration.
- Confirm the sewer boundary. Ask the local utility to state which pipe segment it owns or maintains and where its responsibility ends. A camera inspection or locate may be necessary when the boundary or failure point is unclear.
- Get written repair assessments. Obtain itemized estimates for plumbing, grading, paving, masonry, landscape replacement or structural stabilization. When feasible, obtain the assessment before authorizing non-emergency work, while taking reasonable steps to prevent further damage.
Keep invoices, receipts, temporary-housing or cleanup records and correspondence. Separate emergency mitigation costs from betterment: replacing a damaged driveway with a substantially more expensive design may not be fully recoverable.

Many disputes are about the scope of restoration rather than whether work caused disturbance. A utility may promise to return an easement to “base condition,” which can mean compacted soil or basic pavement rather than mature trees, decorative stone, irrigation controls or a custom surface. Ask for the written standard before work begins.
Document permits and written permissions for sheds, walls, plantings, paving and other improvements in an easement. In San Francisco, special features placed without written permission may be removed at the owner’s expense. A feature that was authorized and shown on the project records presents a different restoration argument.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesDeadlines, permits and escalation
Local filing deadlines can be short and may differ for a tort claim, contract claim, property-damage notice or appeal. Do not assume that the contractor’s promise to “come back” stops a deadline. Ask the agency for its claim deadline and verify the rule with the relevant municipal office or a qualified local lawyer.

Permits can also affect payment. Portland, for example, requires permits for repairs in the right-of-way. Starting unpermitted work may create a code problem or give an agency a reason to dispute the invoice. Obtain written confirmation when emergency work must proceed before a permit or inspection.
If the utility denies the claim, request the denial and factual basis in writing. Provide the easement, photographs, inspection report and estimates that address each reason. Escalate through the agency’s claims office, insurer, public-records process or dispute procedure identified in the contract. A lawyer may be appropriate for substantial structural damage, a disputed easement, a release, or a filing deadline that is close.
Common situations and the likely analysis
A sewer crew leaves ruts and kills lawn
Compare the pre-work condition with the project’s restoration promise. If the work occurred in an easement, the document may allow access but limit restoration to base conditions. A claim is stronger when the lawn was documented, the crew exceeded the permitted route or the contract promises topsoil and reseeding.

Establish whether the driveway sits in private property or the right-of-way, whether the contractor had a duty to protect it, and whether heavy equipment or undermining caused the crack. Obtain a paving estimate and ask the project manager for the contractor’s damage-claim procedure. The utility’s ownership of the pipe does not alone decide who repairs the driveway.
A shared lateral fails after work
First locate the failure and determine whether the project caused it or merely exposed an existing defect. Then apply the recorded shared-line agreement or local default rule. In Portland, owners using a damaged common private section may share repair costs equally, while an individual new public connection is treated separately.
Raw sewage backs up into a house
Identify whether the backup came from a City main, a private lateral or an on-site obstruction. Oklahoma City’s reimbursement example requires advance City knowledge of a system fault and failure to fix it, so a homeowner should not assume that any municipal backup qualifies. Preserve cleanup records and ask the utility for its exact claim conditions.
Questions to resolve before agreeing who pays
- What exact item was damaged, and what was its documented condition before work?
- Who owns and who maintains that item under the deed, easement, utility map or code?
- Is the item in private land, a public right-of-way or an easement?
- Which act or omission caused the damage, and what evidence supports that conclusion?
- Does the project contract assign protection, repair, reimbursement or extra-work costs?
- Was the improvement authorized and shown to the agency or contractor before excavation?
- What notice, permit, claim deadline and appeal process applies in this jurisdiction?
- What restoration level is promised: backfill, base condition, like-for-like replacement or something else?
Because these answers vary by city and project, verify the current rules with the sewer utility and review the recorded documents that affect your parcel. The most reliable claim is specific: it identifies the asset, location, cause, contract or rule, amount requested and supporting records.
