Who Is Responsible for Maintaining Underground Power Cables on Private Land?

There is no universal rule. Responsibility follows the cable’s ownership and the local point of supply or service boundary—not simply the fact that the cable crosses private land. A utility usually maintains its distribution network, while the property owner may maintain a customer service cable, conduit, access area or surface reinstatement on the private side. Have the local electricity distributor identify the cable and boundary before anyone excavates, tests or repairs it.

Why the property boundary is not enough

An underground electricity cable can cross private land and still belong to the electricity distributor. Conversely, a cable serving only one house can be the owner’s responsibility even when the distributor installed or connected it. Ownership, maintenance and repair costs are determined by the local electricity rules, the connection arrangement and the property documents.

Start by separating the parts of the installation:

  • Distribution network cable: a utility asset supplying several properties or forming part of the wider network.
  • Customer service cable: the individual connection from the distributor’s defined supply point to the premises or meter.
  • Conduit, ducts and supports: protective or structural facilities that may be assigned to the customer even where the cable itself is assigned to the distributor.
  • Meter: a separate asset with its own ownership rule.
  • Easement and access area: land-management duties that can remain with the owner or occupier while electrical safety duties remain with the utility.
  • Excavation and surface restoration: costs that may be allocated separately from the cable repair.

A cable’s location therefore cannot answer the question by itself. The distributor’s records, the connection agreement and any easement or title documents are more reliable than visual assumptions.

Find the local point of supply first

The decisive document or rule is usually the one defining the point of supply, connection boundary or service-line boundary. Depending on the installation, it may be at the property boundary, a boundary pit, a service box, the meter socket or another point named in the utility’s service arrangement.

Distribution network versus individual service

Ask the distributor whether the cable is part of its network or is an individual customer service. A network cable can remain utility-owned inside a housing development or other private subdivision where the distributor holds an easement. A service cable can be owner-maintained from a boundary point to the meter or building.

Check the exact component involved

When reporting a problem, identify whether the issue concerns the conductor, the conduit, a pit, the meter, an easement or damaged paving. Different rules can apply to each item. A utility may own the meter but assign the cable entering the meter socket to the customer, or maintain the cable while requiring the customer to maintain the duct that protects it.

How responsibility is divided in documented examples

The following examples show why a local answer is essential. They are not interchangeable rules.

Authority or utility Stated allocation Important qualification
Aurora Energy, New Zealand Owners are generally responsible for low-voltage assets supplying buildings inside the property boundary, including underground lines. The general customer-service-line boundary is where the line crosses the property boundary. Aurora recommends that property owners have customer service lines inspected every five years.
EPCOR, Edmonton, Alberta, Canada The property owner is responsible for underground utility service cables from the property line up to and including the power meter socket. EPCOR states that it owns and maintains the power meter itself.
New South Wales parliamentary response Electricity distributors remain responsible for maintaining the service cable in both overhead and underground systems. Customers maintain on-premises conduit or structures, provide access, and may bear excavation and finished-surface reinstatement costs.
Queensland Electricity Regulation 2006 Customer facilities must be provided where reasonably needed for the entrance, support, protection and termination of an underground service line. Check the current in-force text and the connection arrangement before relying on a provision for a present legal dispute.
Queensland Office of Industrial Relations guidance The property owner or occupier generally maintains the easement area and keeps it unobstructed. The electricity entity remains responsible for safety requirements associated with its electrical assets in the easement.
Nevada Administrative Code, Chapter 704A Utilities can own and maintain specified underground distribution lines within a private development. The example demonstrates that private-land location does not establish ownership.

For example, Aurora’s guidance places the general service-line boundary at the property boundary, while EPCOR’s guidance extends owner responsibility from the property line through the meter socket. The New South Wales allocation is different again because the distributor maintains the service cable while the customer maintains associated conduit or structures. These differences are why a rule copied from another city or country can produce the wrong repair decision.

A practical process for identifying your responsibility

  1. Make the area safe without disturbing it. Keep people away from exposed, damaged or flooded electrical equipment. Do not dig, pull on a cable, remove a cover, test a conductor or attempt a repair.
  2. Contact the electricity distributor. Give the service address, account or connection number, a description of the cable’s route and the symptom. Ask the distributor to identify the asset and state the point of supply or service boundary for that connection.
  3. Ask specifically about every component. Confirm who is responsible for the cable, conduit or duct, pits, meter, supports, easement access and any excavation or surface reinstatement.
  4. Request the written rule or record. Ask for the applicable service standard, connection agreement, diagram, inspection note or other record that supports the allocation. Keep the response with your property files.
  5. Check the title and easement documents. An easement may give the utility rights to enter, operate and maintain network assets while requiring the owner to keep the corridor clear. The easement wording can also identify access routes and restrictions on building or planting.
  6. Use an authorised electrical contractor only after the boundary is clear. If the distributor confirms an owner-maintained section, ask what isolation, permits, excavation controls and reinstatement standards apply. Do not arrange work on a section the distributor has not identified.
  7. Record the final allocation. Note the date, the person or department consulted, the cable identifier, the boundary description and any conditions attached to the repair. This prevents a later contractor from making a different assumption.

What owners commonly have to maintain

Customer service cable

Some utilities assign the private-side service cable to the owner. EPCOR’s stated rule is an example: the owner’s responsibility runs from the property line through the meter socket, while EPCOR retains the meter. Aurora similarly describes owner responsibility for low-voltage assets supplying buildings inside the boundary. These statements apply only within those respective service areas.

Conduit, ducts and entry structures

A cable and the protective path around it can have different owners. The New South Wales parliamentary response says customers maintain conduit or structures on the premises even though distributors maintain the service cable. Queensland rules likewise require customer facilities reasonably needed to provide entry, support, protection and termination for an underground service line. A crushed duct, blocked pit or inadequate entry structure can therefore be the owner’s issue even when the energized conductor is not.

Easement corridor and access

Owners or occupiers may have to keep an easement clear of buildings, stored materials, deep-rooted planting, fences or other obstructions and provide reasonable access. Queensland guidance describes this land-management duty while assigning safety requirements for the electricity entity’s assets to the entity. Never remove an obstruction around electrical equipment without the distributor’s instructions; the clearance and access requirements may be technical and safety-critical.

Excavation and surface reinstatement

Where a repair requires trenching, the party paying for the cable work may not be the party paying to excavate or restore paving, landscaping or other finished surfaces. The New South Wales response specifically notes that excavation and reinstatement of finished surfaces may be the customer’s cost. Obtain a written scope that states who supplies traffic control, excavation, backfill, testing and final reinstatement.

What the utility commonly maintains

A distributor normally controls work on assets that form part of its network, including isolation, fault response and safety clearances. Nevada’s rules illustrate that underground distribution lines in a private development can remain utility-owned and maintained under an easement. The utility may also own the meter even where the customer owns the service cable connected to it; EPCOR expressly makes that distinction.

Do not assume that a utility will repair an owner-maintained cable simply because it is dangerous. Report the condition and ask the utility to confirm the asset boundary. If the distributor identifies a private section, follow its directions for isolation and use a properly authorised contractor.

Inspection and maintenance planning

For an owner-maintained service, keep records of the installation route, depth information supplied by the distributor, inspection reports and previous repairs. Aurora Energy recommends inspection of customer service lines every five years. That interval is Aurora’s recommendation, not a universal requirement; another utility or local rule may specify a different interval or no fixed interval.

  • Arrange an inspection after flooding, ground movement, major landscaping or construction near the route.
  • Watch for damaged pits, settlement, exposed conduit, water ingress, repeated tripping, burning smells or unexplained loss of supply.
  • Keep access points visible and free of stored materials.
  • Before adding a driveway, retaining wall, pool, extension or tree, ask the distributor whether the work conflicts with the cable or easement.

These checks are for planning and reporting. They do not authorise an owner to open electrical equipment or expose a buried cable.

Before excavation or construction on private land

Obtain the distributor’s service plans and locate information before excavation. A plan is not permission to dig directly over a cable, and a surface marker does not prove the exact route or depth. Ask what clearances, permit conditions, isolation arrangements and inspection hold points apply.

  1. Tell the distributor what work is proposed and provide a site plan.
  2. Have the distributor or its nominated locating service identify the relevant asset and easement limits.
  3. Confirm whether the work must be supervised, whether the supply must be isolated and who pays those services.
  4. Use a contractor experienced with underground electrical services and follow the utility’s excavation method.
  5. Obtain approval before backfilling or covering a repaired or relocated service so the required inspection and records can be completed.

If the cable is damaged or the power is failing

Treat any suspected damage as an electrical emergency until the distributor says otherwise. Keep clear of the area, especially after storms, vehicle strikes, flooding or excavation. Do not touch a fallen cable, wet pit, metal fence or other object that may be energised, and do not rely on switching off a household breaker to make an underground service safe.

Call the distributor’s emergency number and describe the location, visible damage, smoke, fire, arcing, flooding or loss of supply. If there is immediate danger to people or property, contact the relevant emergency service as well. The distributor can isolate its network, identify the cable and tell you whether an authorised private contractor is required.

Resolving a responsibility dispute

Ask for the decision in writing and identify the rule, agreement or asset record used. Supply the distributor with your title plan, easement, connection documents and photographs taken from a safe distance. If the parties disagree, use the utility’s formal complaint or dispute process and seek advice from the local energy regulator or a qualified property or electrical-law professional. The correct forum and appeal rights depend on the jurisdiction.

A contractor’s invoice alone does not prove ownership. Before approving extra work, require a scope that separates utility assets, owner assets, conduit, access, excavation, testing and reinstatement. That breakdown makes it easier to challenge a charge without delaying urgent safety work.

Questions to ask the distributor

  • Is this cable a network distribution asset or a customer service cable?
  • Where exactly is the point of supply or service boundary for this connection?
  • Who owns and maintains the cable, conduit, pits, meter and supports?
  • Who must maintain the easement and keep access clear?
  • Who pays for isolation, excavation, fault finding, testing and surface reinstatement?
  • What permits, clearances, inspection stages and authorised contractors are required?
  • Can you provide the applicable connection agreement, service standard or asset record in writing?

The rule to use for your property

Use the local distributor’s identified asset boundary together with the connection agreement and title or easement documents. A private-land location is only a geographic fact; it does not establish ownership. Until the distributor confirms the cable and boundary, do not excavate, expose, test or repair the installation.
