There is no single automatically liable party. In England, the organisation that caused a design or construction defect, the current owner or fire-safety duty-holder, the landlord named in a lease, and the party that must fund or arrange remedial work can be different entities. Responsibility depends on the building’s height and use, the defect’s cause and date, ownership and lease terms, contracts, and the legal route being used.

A building owner can remain responsible for protecting residents while pursuing a developer, contractor or product supplier for the cost of a defect. A remediation order can also be directed at a management company rather than the freeholder if the lease gives that company the relevant repairing obligation.

First establish the jurisdiction and the building

The rules described here are primarily for England. Government redress guidance says Building Liability Orders apply in England and Wales, but the building-management and remediation-order rules explained below should not be treated as a complete statement of law in Scotland, Wales or Northern Ireland. A building-specific conclusion requires local legal advice.

Record the facts that determine which duties and schemes can apply:

  • Number of dwellings and whether the building is self-contained.
  • Whether the problem concerns original design, construction, refurbishment, a later alteration, maintenance or a product.
  • Who owns the freehold, who manages the building and what each lease says about repair.

“Newly built” does not by itself create a universal warranty or transfer every duty to the builder. The design and construction contracts, sale documents, building-control records, fire-risk information and statutory limitation rules all matter.

Responsibility has four separate questions

People often ask who is “responsible” as though that means one thing. In practice, separate these questions:

Question Party commonly involved What it determines
Who caused the defect? Developer, designer, contractor, subcontractor or product manufacturer/seller Potential contractual, negligence, product or statutory claim
Who must keep people safe now? Building owner or other fire-safety responsible person Fire-risk assessment, resident information and immediate risk controls
Who must carry out or fund a repair under a lease? Relevant landlord, which may be a freeholder or management company Whether a remediation order can require specified works
Who manages higher-risk building safety? Accountable person and principal accountable person, where the statutory thresholds are met Ongoing management of fire and structural safety risks

These roles can overlap, but none automatically answers the others. A developer may have caused a defect, while the owner must arrange interim measures and a lease-based landlord must undertake repairs.

The building owner’s immediate fire-safety duty

For flats in England, the “responsible person” is usually the person or organisation that owns the building. It may be a freeholder, housing association, local council, Right to Manage company or management company. A managing agent may perform day-to-day tasks, but appointing an agent does not normally remove the owner’s legal responsibility.

The responsible person must arrange a suitable fire-risk assessment, review it when circumstances change, explain fire-safety arrangements to residents and communicate identified risks and actions. Residents can check their lease, tenancy agreement and management correspondence to identify the responsible person and request the relevant fire-safety information.

The government’s resident guidance advises contacting the owner or manager first if information is missing or concerns remain. If the response is inadequate, an England resident can contact the local fire and rescue service or local council. This enforcement and safety duty applies even where the owner believes a developer, contractor or manufacturer ultimately caused the defect.

This sentence comes from the joint statement issued on 26 July 2023 by the Department for Levelling Up, Housing and Communities, the Building Safety Regulator, the Local Government Association and the National Fire Chiefs Council. It describes the owner’s operational responsibility; it does not decide which party must finally bear the cost in a particular dispute.

When the developer or contractor may be liable

Developer or principal contractor

A developer may be responsible under its contracts, a specific remediation undertaking or another applicable legal claim if its design, construction or refurbishment produced the life-safety defect. Contractors and subcontractors may face claims depending on the work they undertook, the contract, evidence of breach and the applicable limitation period. The existence of a defect does not, without more, prove which company is legally liable.

The Building Safety Act 2022 expanded potential routes for claims involving work on dwellings and buildings containing dwellings. In qualifying circumstances, a court can use a Building Liability Order to extend certain liabilities to associated companies. That mechanism is fact-sensitive: corporate connection, the underlying liability and statutory conditions must all be established.

Product manufacturer or seller

A construction-product manufacturer or seller may face a statutory cause of action where a product was mis-sold, inherently defective or supplied in breach of relevant construction-product regulations, and that failure caused or contributed to a dwelling becoming unfit for habitation. Government redress guidance describes a 30-year retrospective limitation period for cladding products and a 15-year prospective period for all construction products. These are legal routes with conditions, not a finding that any particular supplier is liable.

Later alterations, maintenance and wear

The cause and timing can change the answer. The developer remediation contract excludes issues caused by poor maintenance or wear and tear and issues arising solely from certain later third-party alterations. A later alteration may create a separate responsibility for the party that commissioned or carried it out, while inadequate maintenance can remain an owner or managing agent issue. A competent technical assessment should distinguish original construction from subsequent change.

The Developer Remediation Contract is a limited commitment

The Developer Remediation Contract is not a universal new-build warranty. It is a specific commitment covering qualifying life-critical defects in England buildings that are at least 11 metres high and were developed or refurbished by a participating developer during the 30 years before 5 April 2022.

Where the building and developer qualify, the commitment requires the signatory developer to take necessary action on covered life-critical defects and keep residents updated. It does not cover every fire-safety concern, every building, or defects caused by poor maintenance, wear and tear or certain later third-party alterations. The guidance also requires suitable, experienced, qualified, independent and competent assessors for assessments relied on under the process.

Homes England and the Ministry of Housing, Communities and Local Government reported that 54 developers had signed the contract as of 30 June 2025. Separate guidance published on 1 July 2025 referred to more than 50 signatories at that time; those publication contexts should not be turned into a current 2026 count.

For a genuinely newly completed building, check the construction and sale contracts, any warranty wording, the developer’s participation and the date and nature of the defect. The 30-year look-back in this contract is measured from 5 April 2022 and does not mean every new building automatically qualifies.

When a remediation order may apply

A remediation order is a lease-based route for qualifying buildings in England. The relevant building must be self-contained, or a self-contained part of a building, contain at least two dwellings, and be at least 11 metres high or have at least five storeys.

The defect must meet the statutory relevant-defect criteria, including creating a building-safety risk relating to fire or structure and falling within the applicable period and works definitions. The order is made against a relevant landlord: the landlord identified in the lease as having to repair or maintain something connected with the defect.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That respondent is not necessarily the freeholder. A management company may hold the repairing obligation, and separate parties may be responsible for different parts of the building. An applicant must provide evidence of the building’s qualification, the respondent’s status and the defect. The guidance recommends legal and technical advice when preparing an application.

Higher-risk residential buildings have additional duty-holders

In England, a residential building that is at least 18 metres high or at least seven storeys and contains at least two residential units can fall within the higher-risk building regime. Accountable persons and a principal accountable person may then have statutory duties to manage fire and structural safety risks.

Those roles concern ongoing building-safety management. They do not replace a developer’s remediation commitment, a contractor’s possible liability or a lease-based repairing obligation. The same building can therefore have an accountable person managing risk, an owner arranging works and a developer defending or performing a defect claim.

How to work out who should act: a practical sequence

  1. Map the building. Confirm the address, jurisdiction, use, height, storeys, dwelling count and whether it is self-contained. The 11-metre/five-storey remediation-order threshold and the 18-metre/seven-storey higher-risk threshold depend on these facts.
  2. Identify the current duty-holder. Ask the owner or managing agent for the responsible person’s name, the current fire-risk assessment, identified actions and interim precautions. Keep requests and responses in writing.
  3. Read the legal documents. Check the lease, tenancy agreement, transfer, title information and management agreement for repairing obligations. This step may show that a management company, rather than the freeholder, is the relevant landlord for a remediation order.
  4. Define the defect. Obtain an independent fire-risk appraisal, external-wall assessment or other suitable technical report. Describe the specific construction or product issue, the fire or structural consequence, affected areas and whether later alterations or maintenance contributed.
  5. Trace the original work. Preserve plans, specifications, building-control documents, completion certificates, product information, contractor appointments, photographs, surveys and handover records. Establish when the work occurred and which companies designed, supplied or installed it.
  6. Check scheme eligibility. For an England building at least 11 metres high, check whether the developer signed the Developer Remediation Contract and whether the defect is a covered life-critical design or construction defect. Share existing assessments and relevant building information with the responsible entity and developer.
  7. Choose the legal route. Depending on the evidence, options can include enforcing a lease repairing obligation, seeking a remediation order, pursuing a contractual or statutory claim against a developer or contractor, or examining a construction-product claim. A solicitor should match the facts to limitation periods and statutory conditions.
  8. Keep residents informed. The responsible person should explain risks, precautions, access arrangements and progress. Do not wait for a cost dispute to put urgent safety controls in place.

Evidence that usually matters

  • Fire-risk assessment and review history.
  • Fire-risk appraisal of external walls or other specialist defect assessment.
  • Photographs, intrusive-survey results and records of affected flats or elevations.
  • Title plans, leases and clauses allocating repair and maintenance.
  • Planning documents, building-control records, approved drawings and completion certificates.
  • Construction contracts, appointments, product data, invoices and installation records.
  • Records of refurbishments, alterations, maintenance and complaints.
  • Communications with the owner, managing agent, developer, contractor, insurer and public authorities.

Preserve original files and dates. A report that identifies a dangerous condition may support immediate action but still not establish which company legally caused it; causation, contractual scope and limitation must be analysed separately.

Who pays to fix a new flat’s fire-safety problem?

Payment depends on the route. A signatory developer may undertake covered works under its remediation commitment. A relevant landlord may be ordered to remedy a qualifying defect under the lease-based regime. An owner may have to arrange urgent works first and later seek recovery from a developer, contractor, insurer or other liable party. Leaseholders should not assume that a defect caused by a developer automatically eliminates every service-charge or repair obligation; the lease and the statutory protections governing the building must be examined.

The government has stated that more than £5 billion has been spent on remediating unsafe cladding. That is a rounded national spending statement from the 2025 Code of Practice, not an estimate of the cost or funding position for an individual building.

Non-domestic premises and mixed-use buildings

For workplaces and other non-domestic premises, the responsible person can include an employer, owner, landlord, occupier or another person with control. Where several responsible persons exist, they must coordinate their fire-safety arrangements. Building new premises or carrying out building work must also comply with building regulations, including fire safety in the design.

A mixed-use development may therefore have different duty-holders for residential common parts, commercial areas and occupied workplaces. The construction cause of a defect can be common to the whole project, while operational responsibilities are allocated by use and control.

Common mistakes to avoid

  • Blaming only the builder. The builder may be a potential defendant, but the owner still has immediate safety duties.
  • Treating the remediation contract as a warranty. It has England, height, date, participating-developer and defect-cause limits.
  • Assuming the freeholder is always the respondent. Lease wording can make a management company the relevant landlord.
  • Using a generic inspection. A competent, independent assessment must address the actual fire or structural risk and its cause.
  • Ignoring later work. Alterations, maintenance and wear can affect both causation and scheme coverage.
  • Missing limitation periods. The construction-product periods and other claims have statutory conditions; obtain advice promptly.
  • Waiting for a liability agreement before acting. Immediate risk controls and resident communication are separate from the eventual cost dispute.

When professional advice is justified

Obtain independent technical advice where the defect affects an external wall, compartmentation, fire doors, means of escape or structural protection, or where the available assessment is disputed. Obtain legal advice before issuing a remediation-order application, relying on a Building Liability Order, interpreting a lease, or allowing a limitation period to expire. Government guidance specifically recommends suitable independent assessors and legal and technical advice for these processes.

The decisive answer for a particular new building will come from its location, height and use, the defect evidence, design and construction records, ownership structure, lease obligations and applicable claim deadlines—not from the age of the building alone.
