There is no single party that is automatically responsible for defective cladding. The answer depends on what failed, who designed or supplied it, the contracts and statutory duties in force, the building’s location and height, when the work was completed, and whether the question is about causing the defect or paying for urgent remediation.
In England’s cladding cases, a manufacturer or seller may face a product claim, a developer may have remediation obligations, a contractor or designer may be liable for defective design or installation, and a building owner may have to arrange or fund works. Leaseholder protections can prevent specified historical costs being passed on. Those routes can operate at the same time.

Responsibility for defective cladding: the short answer
Start by separating two questions:
- Who may have caused or legally contributed to the defect? This can include a product manufacturer or seller, developer, architect, engineer, contractor or installer.
- Who must arrange and pay for work now? That may be the building owner or another responsible entity under building-safety law, a developer under a remediation commitment, or a public funding scheme where no responsible developer can be identified or held responsible.
The party that pays first is not necessarily the party that ultimately bears the loss. An owner may fund works to protect residents and later pursue a manufacturer, contractor or developer for recovery. Conversely, identifying a possible defendant does not remove an owner’s immediate duties to keep the building safe.

Which facts decide who is responsible?
Before blaming a party, assemble the facts that determine which legal route is available.
- Location: England, Wales or Scotland, and the local scheme or regulator involved.
- Building use and height: residential or another use, and whether the building is at least 11 metres high for relevant England schemes.
- Defect description: the cladding itself, cavity barriers, insulation, fixings, design, installation, maintenance or a combination.
- Project history: original construction, later refurbishment, completion date, developer and contractors.
- Documents: specifications, fire-risk assessments, test certificates, product data, inspection reports, warranties, contracts and correspondence.
- Ownership and lease facts: the freeholder or responsible entity, lease dates, qualifying-lease status and the owner’s relationship with the developer.
- Causation: whether the alleged failure made a dwelling unfit for habitation on completion or created the life-critical fire-safety risk now being remediated.
A later safety concern, by itself, does not prove every element of a statutory claim. Technical evidence usually has to connect the product, design or workmanship to the condition of the building.
Can I make the cladding manufacturer or seller pay?
What section 149 can cover
Section 149 identifies several past product defaults that can support a claim, including:
- failure to comply with a requirement applying to a cladding product;
- a misleading statement by a person marketing or supplying the product; or
- manufacture of a product that is inherently defective. Parliament’s wording includes the phrase “a person manufactures a cladding product that is inherently defective.”
The product must have been incorporated into the external wall through building works. The dwelling must have been unfit for habitation when the works were completed, and the product default must have caused or contributed to that condition. These are cumulative, fact-sensitive requirements rather than a presumption that every recalled or unsuitable panel creates liability.
How a misleading product statement could fit
The Building Safety Act explanatory notes illustrate a causal chain in which a manufacturer makes an inaccurate marketing statement, a contractor relies on it and installs an unsuitable product, and leaseholders seek damages from the manufacturer. The example shows how product and construction actors can appear in the same claim; it is not a finding about any particular manufacturer or building.

Limitation periods are claim-specific
The explanatory notes describe a 30-year retrospective period for certain cladding claims and a 15-year prospective period for construction-product claims. Those figures are not a universal deadline. The applicable period depends on the precise cause of action, the building-completion date, the statutory wording in force and any issue about human-rights limits. A solicitor should calculate the date from the project records rather than relying on a headline number.
When is a developer responsible?
Government remediation commitments
Developers can have a direct remediation role separate from a court claim. Under the government’s developer remediation contract, signatory developers accepted obligations for necessary work addressing specified life-critical fire-safety defects in buildings at least 11 metres high that they developed or refurbished in England during the 30 years ending 4 April 2022. The contract and current scheme guidance must be checked for the particular building and defect.

Developer liability is not the same as every construction defect
A developer commitment generally concerns the defects and buildings defined by the commitment. It does not automatically decide a negligence, contract or product claim, and it does not mean every contractor engaged by that developer is liable. A project may involve a developer obligation to remediate while separate evidence is gathered for recovery against a designer, installer or product supplier.
Are contractors, architects and engineers responsible?
A contractor or design professional may have exposure based on what it designed, specified, installed, inspected, certified, represented or failed to do. Possible legal sources include the construction contract, professional appointment, statutory duties and general negligence principles. The relevant question is what the party undertook and whether its work fell below the required standard.

Evidence needed to assess construction responsibility
- approved drawings, specifications and changes;
- submittals identifying the exact cladding, insulation, membranes and fixings;
- installation records, inspection-and-test plans and photographs;
- fire-stopping and cavity-barrier details;
- handover certificates, warranties and building-control records; and
- expert evidence separating a product failure from a design or workmanship failure.
An installer is not automatically liable simply because defective cladding is present. Equally, a contractor cannot assume that reliance on a supplier’s statement ends the inquiry; the reasonableness of that reliance and the contractor’s own duties may matter. Responsibility must be assigned from the project evidence, not from the party’s job title.

Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Clear out junk files and repair common Windows errorsFree Scan →What must the building owner or responsible entity do?
The building owner or other legally responsible entity normally has the practical role of arranging inspection, interim safety measures, procurement and repair. In England’s leaseholder-protection framework, the owner’s relationship with the developer, the statutory definition of the relevant defect and building, the leaseholder’s status and the owner’s resources can determine who ultimately pays.
GOV.UK guidance states that where an owner meets the statutory developer test, it must pay all remediation costs for relevant defects, including cladding. Where the owner does not meet that test, qualifying leaseholders may still receive protection in relevant buildings. The exact outcome depends on the building and lease facts.
Practical responsibilities that remain with the owner
- commissioning competent fire-safety and façade assessments;
- keeping residents informed about risk and planned measures;
- implementing waking watches, alarms or other interim measures where required;
- appointing designers and contractors through a controlled procurement process;
- maintaining records of costs and decisions; and
- seeking recovery or scheme funding without delaying necessary safety action.
Can my landlord charge me for cladding remediation?
Qualifying leases and relevant buildings
A leaseholder receiving a service-charge or remediation demand is not automatically responsible for the whole cost. For a qualifying lease in a relevant building, the Building Safety Act provides specific protections, including full protection from unsafe-cladding remediation costs. Other protections can apply to non-cladding defects depending on statutory tests.
Non-qualifying leaseholders may have different protection depending on the owner’s relationship with the developer and other facts. Buildings outside the relevant statutory scope may be governed primarily by the lease, ordinary landlord-and-tenant law and other recovery routes. Do not decide eligibility from the building’s height alone.

What to request before paying or disputing a demand
- Ask for the legal and contractual basis of the charge.
- Request the building’s height measurement, defect assessment and remediation scope.
- Confirm whether the lease is said to be qualifying and what evidence supports that conclusion.
- Ask whether the freeholder or responsible entity meets the developer test.
- Obtain the proposed cost allocation and details of any government funding or developer commitment.
- Take advice promptly if a consultation notice, tribunal deadline or enforcement action is involved.
Keep paying ordinary undisputed service charges where required by the lease, but do not concede a disputed historical remediation liability without advice based on the lease and statutory facts.
Who pays if the developer has gone out of business?
England has a fallback funding route where a responsible developer cannot be identified, traced or held responsible. The Cladding Safety Scheme, administered through Homes England, provides funding for eligible unsafe-cladding remediation in that situation. It is a scheme with eligibility conditions, not a universal entitlement.
Applications are made by the Responsible Entity or its representative. Homes England describes that entity as the person or organisation legally responsible for repair and maintenance. The responsible entity still needs to establish that the building and proposed works meet the current scheme requirements.
Do not confuse scheme funding with a finding of fault
Funding can enable urgent works without deciding whether a manufacturer, contractor or developer caused the defect. Preserve contracts, product records and expert reports so that a later recovery claim is not lost merely because public or owner funding paid for the repair.

The same release estimated 239,000 dwellings in occupied private and social-sector 11-metre-plus residential buildings with unsafe cladding being monitored. That is an estimate within the monitored-building programme, not a count of individual leaseholders who are liable for costs and not a census of every affected building.
What could change under the proposed Remediation Bill?
A May 2026 government briefing for the King’s Speech described a proposed Remediation Bill. The briefing said the proposal would address legal barriers to pursuing manufacturers, create a legal duty to remediate for people responsible for building safety such as freeholders, and strengthen regulator powers.
The briefing establishes that those proposals were announced, not that they became law. As of the status described in the available material, the Bill’s legislative progress and final text had not been established. Treat any future change as dependent on enacted legislation, commencement dates and regulations; do not use the proposal as the current legal test.
A practical method for allocating responsibility
- Secure the building: record interim fire-safety measures and urgent risks before arguing about cost.
- Define the defect: obtain an intrusive or otherwise suitable assessment identifying the components and failure mechanism.
- Map the project: identify developer, freeholder, responsible entity, designers, principal contractor, specialist installers and product suppliers.
- Check the jurisdiction: separate England scheme rules from the law applying in Wales or Scotland.
- Test statutory routes: consider section 149 conditions, leaseholder protections, developer commitments and scheme eligibility.
- Check limitation: calculate dates for each proposed claim from completion and relevant events.
- Preserve evidence: issue document-preservation requests and retain samples, photographs, specifications and correspondence.
- Plan funding and recovery together: identify who must pay now while reserving rights against parties who may ultimately be liable.
- Obtain specialist advice: a construction-defect or building-safety solicitor can match the evidence to the correct claim and forum.
Responsibility compared by party and route
| Party | Possible route | Key evidence | Immediate practical role |
|---|---|---|---|
| Manufacturer or seller | Section 149 product claim for specified defaults | Product records, marketing statements, incorporation and causation | Usually not the party arranging the building works |
| Developer | Remediation contract, leaseholder protections or ordinary claims | Development/refurbishment history, signatory status and defect scope | May have to fund defined life-critical defects |
| Contractor or designer | Contract, professional duty, negligence or contribution claim | Design, specification, installation and inspection records | May be engaged to investigate or carry out repair |
| Owner or responsible entity | Building-safety duties, lease and statutory cost rules | Ownership, lease, building status and resources | Usually arranges safety measures and remediation |
| Cladding Safety Scheme | England funding where a responsible developer cannot be identified, traced or held responsible | Eligibility, responsible entity and compliant application | Can fund eligible works; it does not determine fault |
When to obtain legal and technical advice
Get advice before signing a settlement, accepting a developer’s scope, conceding a service-charge liability or allowing a limitation period to expire. A useful adviser will need the lease, title and ownership information, completion and refurbishment dates, fire-risk and façade reports, product data, contracts, warranties, correspondence and all cost demands.
Technical and legal questions should be coordinated. A façade engineer may establish how fire could spread and which components fail; a lawyer then tests whether those facts satisfy a product statute, contract, professional duty, lease protection or funding rule. Neither a job title nor the fact that a building is unsafe answers the legal question on its own.
