Short answer: Responsibility may rest with the construction contractor, the city, county, state or other road authority, or more than one party. The answer depends on what physically caused the damage, who controlled the work, whether construction crossed the acquired right-of-way, what the project contract requires, and the law and claim deadlines where the property is located. Document the condition immediately, notify the road authority and project team in writing, and confirm the correct claim route before making repairs that could erase evidence.
Why the answer changes from one project to another
Road construction is performed under a combination of public authority, engineering plans, contract specifications, easements and local liability rules. A city street, county road, state highway and privately maintained road can have different owners, administrators and claim procedures. The agency displayed on a construction sign may administer the project without owning every parcel or employing the crew that caused the damage.

Start by identifying four separate roles:
- Road owner: the public body or private entity legally responsible for the road.
- Project authority: the agency or developer that designed, funded or administers the work.
- Contractor: the company performing excavation, paving, utility relocation, grading or traffic control.
- Property owner and easement holders: the people or entities whose land may be inside a permanent right-of-way or temporary construction easement.
Ask the project office for the project number, project manager, contractor name, supervising agency and claims contact. Those details determine where notice must go and which records to request.
When the contractor may be responsible
Contractors can be responsible for damage caused by their operations, inadequate precautions or work outside the authorized area. Federal Highway Administration Federal Lands construction guidance, for example, places responsibility on the contractor to protect adjacent public and private property from construction operations and discusses repair or restoration when damage results from insufficient precautions or damaging work. It also addresses contractor liability for trespass or construction outside the acquired right-of-way.

That manual governs neither every federal project nor state and local work. Its value is showing the kinds of duties often found in construction specifications. Wisconsin Department of Transportation standard specifications similarly assign responsibility for damage to public or private property resulting from contractor operations. The specification edition incorporated into the actual contract controls; a generic contractor promise cannot substitute for the project’s signed documents.
Examples of conduct that can support a contractor claim
- Excavation, trenching or grading that removes soil supporting a foundation, retaining wall or driveway.
- Compaction, pile driving, blasting or heavy equipment vibration followed by new cracking or movement.
- Blocked, redirected or poorly installed drainage that sends water toward the house or under a slab.
- Concrete trucks, equipment or materials striking a driveway, wall, fence or other improvement.
- Work, storage or access beyond the permanent right-of-way or a temporary construction easement.
- Failure to use barriers, shoring, dust control, erosion control or other protection required by the plans.
Timing alone does not prove causation. A contractor or insurer may argue that a pre-existing settlement, plumbing leak, tree root, expansive soil, storm or ordinary wear caused the condition. Evidence connecting the mechanism to a particular operation is therefore important.
When the road authority may be responsible
A public authority can have duties separate from those assigned to its contractor. Liability rules vary widely. Some jurisdictions require proof of negligence, prior notice of a dangerous condition, a specified opportunity to repair, or compliance with special governmental-claim procedures. Immunity statutes may limit claims or require an early notice form.

British Columbia states that a person may claim for damage to a home, land or vehicle arising from highway construction or maintenance, but payment requires proof of negligence by the ministry and/or highway contractor. California’s transportation department describes a dangerous-condition claim on the state highway system as requiring a dangerous condition, actual or constructive knowledge by the department, and enough time to correct it. That test addresses the road-condition claims described by the department; it should not automatically be applied to every construction-related crack, settlement or driveway dispute.
An authority may also be involved because it selected the design, approved a change order, failed to enforce its specifications or directed work that affected private property. Whether those facts create a legal claim depends on the jurisdiction’s statutes, case law and immunity provisions.
Use the project boundary and documents to narrow responsibility
| Question | Why it matters | Records to request or preserve |
|---|---|---|
| Who owns and administers the road? | Ownership determines the agency, claim office and possible governmental-immunity rules. | Project sign information, road inventory or ownership confirmation, agency correspondence. |
| Where is the right-of-way? | Damage inside the acquired area may be treated differently from work or trespass on private land. | Right-of-way plans, parcel drawings, temporary easements and construction limits. |
| What operation coincided with the damage? | A specific mechanism—excavation, vibration, settlement or drainage change—is easier to investigate than a general allegation. | Daily notes, dated photographs, utility or excavation records, inspection reports and witness accounts. |
| What does the contract require? | Specifications may address adjacent-property protection, driveway adjustment, restoration, insurance and claims. | Relevant plan sheets, special provisions, specifications, change orders and preconstruction surveys. |
| What deadline applies? | Government claims may require formal notice well before an ordinary lawsuit deadline. | Written confirmation from the agency, claim forms, delivery receipts and a calendar of all dates. |
Driveway damage can receive special treatment
Separate the driveway approach—the portion connecting private property to the public road—from paving, landscaping or other incidental damage. Some laws provide a specific remedy when road work destroys an approach, even though they do not guarantee payment for every inconvenience.

Ohio example
Ohio Revised Code § 5543.16 states: “If in the construction, improvement, maintenance, and repair of any road, the approach or driveway of an abutting property owner is destroyed, the authorities constructing, improving, maintaining, or repairing such road shall compensate the property owner for the destruction of his approach or driveway, or in lieu thereof authorize the engineer to reconstruct it at public expense.” This is an Ohio statute, not a nationwide rule. Ask whether the work destroyed the approach, merely required an adjustment, or caused a separate defect such as cracking or drainage failure.

Planned driveway adjustments
North Carolina Department of Transportation construction material instructs that driveway adjustments should be planned and graded so the owner can maintain driveway use. On a project that changes grades or drainage, request the driveway plan, proposed elevations and any temporary-access arrangement. A claim may concern loss of access, defective reconstruction, physical damage, or all three; those are not necessarily evaluated under the same provision.
How to show that construction caused home damage
Cracks, sticking doors, sloping floors and water intrusion can have many causes. A useful record links the condition to a date, location and plausible mechanism without claiming more than the evidence supports.

Common mechanisms to investigate
- Vibration: repeated heavy equipment, pile driving or compaction may coincide with movement of brittle finishes or masonry.
- Excavation or loss of support: trenching near a foundation, wall or driveway can cause settlement if soil is removed or inadequately supported.
- Changed drainage: altered grades, blocked inlets or leaking utilities can saturate or erode supporting soil.
- Ground settlement: backfilled trenches and newly placed fill may consolidate over time, producing depressions or cracking.
- Direct impact: machinery or materials may physically strike an improvement.
For significant, progressive or safety-related damage, obtain an independent assessment from an appropriately qualified structural or civil engineer. The assessment should identify observed conditions, likely mechanisms, alternative causes and whether monitoring is needed. A crack-monitoring gauge can help record movement when paired with dated photographs, but it is a documentation aid—not an engineering opinion or proof of causation.
Step-by-step: protect a potential claim
- Make the area safe. If there is a foundation displacement, retaining-wall movement, exposed utility or dangerous access condition, keep people away and contact emergency or utility services as appropriate. Safety work should not be delayed merely to preserve evidence.
- Photograph before altering anything. Take wide views showing the road project and property together, then close-ups of each defect. Include a ruler or other scale where useful. Record the date, time, weather, construction activity and the first time anyone noticed the change.
- Create a chronology. Note equipment observed, blasting or pile-driving notices, excavation dates, drainage changes, access interruptions, conversations and every later change. Identify witnesses and retain original image files.
- Notify the road owner and project team in writing. Send the address, project number or location, a concise description, dates, photographs and a request for the correct claim procedure. Ask for the contractor, project manager, insurer or risk-office contact and all applicable notice deadlines. Keep proof of delivery.
- Request relevant project records. Ask about right-of-way limits, easements, driveway and drainage plans, preconstruction condition surveys, inspection reports, vibration or settlement monitoring, incident reports and restoration plans. Public-record access and exemptions differ by jurisdiction.
- Obtain repair estimates and preserve damaged materials. Get itemized estimates from qualified professionals. Do not demolish or discard damaged concrete, masonry or other material until it has been photographed and, when practical, inspected.
- Use insurance strategically. Notify your homeowner or auto insurer if the policy may respond. British Columbia advises considering one’s own insurer so necessary repairs can proceed while the insurer pursues a responsible party. Coverage depends on the policy, deductible and exclusions; notifying an insurer is not an admission that the authority or contractor is blameless.
- Calendar every deadline. Confirm whether an agency claim form, formal notice, presentment to a government risk office or lawsuit must occur first. Request written confirmation rather than relying on a job-site conversation.
Jurisdiction examples that must not be generalized
| Jurisdiction or agency | What the published rule or process says | Important limitation |
|---|---|---|
| Ohio | Revised Code § 5543.16 provides compensation or publicly funded reconstruction when covered road work destroys an abutting owner’s driveway approach. | Applies to Ohio and to the statutory circumstances; it is not a general rule for other states or every driveway defect. |
| British Columbia | A claim may include damage to a home or land from highway construction or maintenance, with payment requiring proof of negligence by the ministry and/or contractor. | The province’s process and negligence requirement do not establish the rule in U.S. jurisdictions. |
| California state highway system | The transportation department describes a dangerous-condition claim requiring a dangerous condition, departmental knowledge or reason to know, and enough time to repair. | This description concerns road-condition claims and may not govern all construction damage. |
| Indiana state claims | The Indiana Department of Transportation states that a property-damage claimant must submit the prescribed state form or written claim and identifies 270 days after the loss for notice. | Verify current law and applicability before relying on the 270-day period; it is not a national deadline. |
| North Carolina contracted work zones | The transportation department says it forwards a driver’s claim for damage in a contracted work zone to the contractor responsible for road conditions there. | The example concerns drivers and road conditions. Confirm the process for a homeowner’s building or driveway claim. |
Choosing the right claim route
Send an initial written notice to both the administering authority and the contractor or project claims contact when their identities are known. Doing so reduces the risk that each points to the other while a deadline runs. Ask the authority to identify whether the claim must be filed with a governmental risk office, directly with the contractor, through a project insurer or through another formal portal.
Describe facts rather than assigning legal conclusions: “A new vertical crack appeared in the east foundation wall on June 12, two days after trench excavation reached the property line.” Include the location, measurements, photographs, suspected operation and requested inspection. Avoid signing a release or accepting a final payment before understanding whether the damage is continuing and what rights the document waives.

Common mistakes and how to avoid them
- Assuming the nearest crew is automatically liable: identify the owner, administrator, contractor and controlling documents first.
- Waiting for the project to finish: delay can allow evidence to disappear and may run out a government-notice period.
- Relying on verbal assurances: put the report, requested inspection and response deadline in writing.
- Repairing without documentation: photograph, measure and obtain estimates before removing evidence when safety permits.
- Treating a local rule as universal: Ohio’s driveway statute and Indiana’s 270-day notice example illustrate why location matters.
- Overstating causation: report when and where the damage appeared, then obtain technical analysis for mechanism and alternatives.
- Ignoring access and drainage: a driveway may be usable yet improperly graded, and a house may show no crack until water reaches a settled area.
When to consult a professional
Prompt local legal advice is prudent when damage is substantial, worsening, disputed, outside the apparent right-of-way, or asserted against a public entity. A lawyer can identify immunity provisions, notice statutes, preservation duties, easement issues and the correct defendant. An engineer can address structural safety and causation; a surveyor may be needed to locate the right-of-way; and a drainage or geotechnical specialist may be appropriate where water or soil movement is involved. These roles answer different questions and do not replace one another.
The strongest initial file contains a dated chronology, original photographs, project identifiers, right-of-way information, written notices, agency responses, estimates, inspection findings and a record of temporary repairs. With that record, the responsible party and claim route can be evaluated under the law that actually governs the property.
