If an AI-enabled product, clinical tool, robot, vehicle or construction system contributes to bodily injury, responsibility is usually allocated under the law of the place and sector involved. Potential routes include defective-product liability, negligence or clinical negligence, professional duties, and newer statutory roles for automated vehicles. The manufacturer, software provider, deploying organisation, professional user, operator or several of them may be involved.
The European Union has adopted product-liability rules that expressly cover software, including AI, but their application date is 9 December 2026. Great Britain’s official materials take a fact-specific approach to clinical AI and are implementing an automated-vehicle framework in stages. The examples below help construction businesses investigate an incident without assuming that one party is automatically liable.

Why an AI injury does not produce one automatic defendant
AI is a component of a product or service, not a standalone legal category that decides every claim. Liability depends on what the system did, who supplied and controlled it, the way it was deployed, the governing jurisdiction, and whether the evidence connects a defect or breach of duty to the injury.
Recommended Free Tools
On a construction project, the same event could involve an AI camera, a machine-vision inspection tool, a predictive-maintenance model, an autonomous vehicle, a software update or a human decision based on an AI recommendation. Those facts can point to different legal theories. A manufacturer may face a product claim; a contractor or site operator may face negligence allegations; a professional may have duties that cannot be delegated merely because software supplied advice. An incident can therefore produce several defendants and contribution disputes rather than a single answer.

European Union: the revised product-liability route for AI software
Directive (EU) 2024/2853 updates the EU product-liability framework for newer technology. The European Commission says it covers all types of software, including AI systems, so an AI-enabled product can fall within product-liability analysis even when the harmful component is code rather than a physical part. The Commission’s overview is at Liability for defective products.
What can make an AI product defective?
The central question is whether the product provides the safety people are entitled to expect or that the law requires. The Commission explains that a manufacturer may be liable for a defect present when software or an AI system was released, including a defect that becomes apparent later after an update, an upgrade or a machine-learning feature. For a construction system, that could make the release configuration, later patches, model changes and operating instructions important evidence.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsA poor result alone does not establish liability. A claimant still has to establish a defect, compensable damage and a causal link between them. The directive adds mechanisms for requesting relevant evidence and for easing the proof burden where appropriate, but it does not guarantee recovery or eliminate the need to prove the essential elements of the claim.

Which injuries and losses are covered?
The directive recognises death and personal injury, including physical and psychological harm. It also covers property damage and destruction or corruption of data. A bodily injury on a building site therefore sits within an expressly recognised damage category, while associated property or data losses may raise additional questions under the same framework.
When do the new rules apply?
| Date | What it means |
|---|---|
| 8 December 2024 | Directive (EU) 2024/2853 entered into force. |
| 9 December 2026 | EU Member States must transpose the directive, and the new rules apply to products placed on the market from this date. |
| Before 9 December 2026 | The previous product-liability directive continues to apply to products placed on the market before the new application date. |
Entry into force in 2024 does not mean that every AI product immediately became subject to the revised rules. National transposition and the product’s market-placement date matter. The Commission’s official timetable and transition explanation are in the same overview.
How long can a claim be brought?
The Commission describes a general 10-year period during which economic operators remain liable after a product is placed on the market, extended to 25 years in certain health-related cases. Victims have three years to bring a claim. These periods must be checked against the applicable national implementation, the type of injury and the dates in the individual case; they are not a substitute for jurisdiction-specific legal advice.
The EU AI Liability Directive proposal was withdrawn
A separate proposal called the AI Liability Directive addressed certain non-contractual civil-liability issues involving AI. It is not an enacted directive. EUR-Lex records the Commission’s withdrawal of the proposal on 6 October 2025 in its 2022/0303/COD procedure record.

Withdrawal of that proposal did not withdraw or cancel Directive (EU) 2024/2853. When assessing an EU incident, distinguish the adopted product-liability directive from the withdrawn proposal, then check the Member State’s implementing legislation and the product’s market-placement date.
Great Britain: clinical AI responsibility remains shared and fact-specific
A written answer to the House of Lords published on 17 June 2026 set out the Great Britain government’s position on AI used in NHS clinical decision-making. It identified clinical negligence law, professional standards, product-liability regimes and oversight by the Medicines and Healthcare products Regulatory Agency, Care Quality Commission, Information Commissioner’s Office and National Institute for Health and Care Excellence. The answer is available at HL841.
The answer states that clinicians remain responsible for exercising professional judgment in patient-care decisions. It also recognises that a real incident may involve several parties, with responsibility apportioned according to the circumstances. The Department had commissioned NHS Resolution to assess how existing liability frameworks apply to AI uses. This is an official policy position, not a judicial rule that decides every dispute.
What that means for construction and occupational-health systems
A construction employer using an AI tool to triage an occupational-health referral, flag a possible injury or recommend work restrictions should not assume that the clinician, software supplier or employer automatically carries the whole risk. Questions include who selected the tool, what information it received, whether a qualified professional reviewed the output, what warnings and instructions accompanied it, and whether the deployment matched its intended use.

If an AI recommendation contributed to a worker returning to hazardous duties, possible routes could include professional or clinical negligence, negligence by the deploying organisation, or a product-liability claim against a supplier. The correct route depends on the evidence and the applicable Great Britain law. Human decision-makers must still apply professional judgment; an AI output is not a transfer of responsibility.
Great Britain: automated vehicles have a new but still developing framework
The Automated Vehicles Act 2024 creates a framework for automated vehicles on Great Britain’s roads. The Department for Transport says an authorised self-driving entity is responsible for the vehicle’s behaviour while it is self-driving and must keep the vehicle safe and lawful through ongoing duties. For a no-user-in-charge vehicle, an operator is responsible for non-driving tasks such as roadworthiness and responding to breakdowns. The Department’s safety-principles material is at Automated vehicles: statement of safety principles.
This distinction matters to construction fleets using automated haulage, delivery or site vehicles. The operating mode at the moment of the incident, the entity authorised for self-driving behaviour and the operator’s non-driving responsibilities may all affect allocation. It would be unsafe to assume that the person sitting in a cab, the fleet owner or the software developer always bears the same role.
Why the regime is not yet fully settled
The June 2026 safety-principles consultation describes pre-deployment assessment, manufacturer safety cases, in-use monitoring, incident investigation and continuous safety feedback. It says further secondary legislation, consultation and implementation work are being developed. The framework should therefore be treated as emerging rather than a completely operational set of rules for every vehicle and use case.

The Department for Transport defines a safety case as “the documentation that sets out the reasoning for how the ADS (automated driving systems) meets the regulatory requirements and is free from unreasonable risk.” Its minister Lilian Greenwood also cautioned: “While vehicle technologies have already provided significant advances in road safety and will continue to do so, technology is not foolproof.” Both statements appear in the consultation material.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.A practical method for analysing an AI-related construction injury
- Fix the jurisdiction and date. Identify where the injury occurred, which law governs the claim and, for an EU product, when the product was placed on the market. For EU products, the 9 December 2026 application date is different from the 8 December 2024 entry-into-force date.
- Describe the system and its operating mode. Record the hardware, software version, model or configuration, intended purpose, human overrides, connectivity and whether an update or machine-learning change occurred. For an automated vehicle in Great Britain, record whether it was operating in self-driving mode and identify the authorised self-driving entity and operator roles.
- Map every actor and their control. List the manufacturer, software provider, installer, contractor, site manager, vehicle operator, clinician or other professional, and the organisation that selected or deployed the system. Do not assume that the party with the most commercial visibility had control over the relevant decision.
- Preserve evidence immediately. Keep event logs, sensor data, video, model outputs, alerts, maintenance records, training records, risk assessments, instructions, warnings, procurement documents, contracts and update histories. Preserve the original data and a read-only copy with timestamps; changing settings after an incident can make causation harder to prove.
- Test the three EU product-liability elements where relevant. Ask whether the product was defective, what damage occurred and how the defect caused the injury. The EU directive’s evidence-access provisions can assist, but they do not remove those core questions.
- Check human and organisational duties. Examine supervision, competence, safe-system-of-work controls, professional judgment, maintenance, training, escalation and whether the deployment matched the supplier’s instructions. An accurate model can still be used negligently, and a safe product can be deployed in an unsafe way.
- Separate direct cause from contributing cause. Determine whether the AI output was decisive, one factor among several, or merely recorded after a human decision. Multiple parties may share responsibility, and the final allocation depends on the facts and governing law.
- Notify the right specialists. Inform insurers and preserve privilege through appropriate legal advice. A technical investigation should be independent of the team responsible for configuring the system, and access to personal or health data should be controlled.
Illustrative construction scenarios
AI camera fails to detect a worker in a restricted zone
Potential questions include whether the camera or its software was defective, whether lighting or placement fell outside the intended operating conditions, whether a warning was ignored, and whether the contractor relied on the alert as a substitute for physical controls. Evidence should include the model version, detection thresholds, calibration, missed-event logs, site layout, lighting, training and the work method in force at the time.
Autonomous or semi-autonomous plant moves unexpectedly
Investigators should establish the vehicle’s control mode, geofencing, remote-operator actions, maintenance and software updates. In Great Britain, an automated-vehicle deployment may engage the statutory roles described by the Department for Transport, but the developing framework does not answer every construction-site fact pattern. Product liability, negligence and contractual allocation may all need examination.

Identify who was qualified to approve the design or inspection, whether the tool was used within its stated purpose, what data and assumptions it used, and whether a competent professional checked the result. A professional duty cannot be treated as automatically discharged because software generated the recommendation. The legal route may differ between a defective tool, negligent deployment and negligent professional approval.
Evidence and governance that reduce uncertainty before an incident
- Define the intended use. State which decisions the system may support and which require a qualified person’s approval.
- Assign named owners. Record who controls procurement, configuration, updates, access permissions, maintenance, incident response and stop-work authority.
- Control updates. Keep release notes, approval records, rollback capability and testing results. The EU framework expressly recognises defects that become apparent after updates, upgrades or machine-learning features.
- Keep a human override. Make the safe shutdown or manual alternative practical, visible and tested rather than merely written in a policy.
- Audit performance in the real environment. Check conditions such as dust, glare, weather, occlusion, network loss and unusual loads that may differ from testing conditions.
- Write contracts that preserve evidence and cooperation. Address log retention, incident notification, access to model and update records, safety notices, training, maintenance and responsibilities for regulatory reporting. Contract language cannot remove duties imposed by applicable law, but it can prevent avoidable disputes about information and control.
- Train people on limits. Workers and supervisors should know what an alert means, what it does not mean, and when to stop work or escalate to a competent person.
Questions to put to advisers after an injury
- Which jurisdiction and sector-specific rules govern this incident?
- For an EU product, was it placed on the market before or after 9 December 2026, and which national transposition applies?
- Is the proposed case based on a defective product, negligence, clinical negligence, professional duty, an automated-vehicle role or more than one theory?
- Who had control of the system, the work activity and the relevant update at the time?
- What evidence proves defect, damage and causation, and what evidence can be requested from another party?
- Are limitation periods, reporting duties, insurance conditions or data-protection restrictions likely to affect the next step?
Bottom line for construction businesses
An AI system does not absorb responsibility for an injury and does not automatically make its developer liable. The strongest analysis starts with the jurisdiction, the product’s market date or operating mode, the people and organisations that controlled deployment, and reliable evidence of what happened. In the EU, the revised product-liability directive expressly reaches AI software but applies to products placed on the market from 9 December 2026, with transitional treatment for earlier products. In Great Britain, official materials place clinical judgment with clinicians and assign defined responsibilities in an automated-vehicle framework that is still being implemented. Treat AI as one part of the safety system, preserve evidence, and investigate every human and organisational decision around it.
