1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsIn England and Wales, you do not automatically need a construction expert witness to sue a builder. An expert is appropriate when a material technical issue—such as whether work is defective, what caused the defect, what repair is required, or what the loss is worth—cannot be resolved fairly from ordinary documents and factual testimony alone. The opinion must be proportionate to the dispute, and the court’s permission is required before you call an expert or rely on the report in proceedings.
The right time to instruct one depends on the decision the opinion must support, the procedure being used, the evidence already available and the cost at stake. An early, tightly scoped inspection can clarify a claim and encourage settlement; a premature, over-wide report can add cost without helping either party.

What a construction expert witness actually does
An expert supplies specialist opinion, not a second witness of fact and not a substitute for a judge. In a building dispute, the discipline might be building surveying, structural engineering, civil engineering, mechanical and electrical services, quantity surveying, fire safety or another defined field. The expert may be asked to inspect the property, analyse drawings and specifications, identify departures from the contract or accepted practice, explain causation, set out suitable remedial work and value the resulting loss.

The opinion must stay within the expert’s expertise. Whether a party is legally liable, whether a contract term was breached and what legal remedy follows are questions for the court (or the adjudicator), not conclusions for the expert to decide.

Issues that commonly justify an expert
- Whether workmanship or materials fall below the contract, drawings, building regulations or an accepted technical standard.
- Whether cracking, damp, movement, overheating, leaks or another symptom was caused by the builder’s work, design, maintenance, ground conditions or a combination of factors.
- What work is reasonably required to remedy the defect, whether opening-up is necessary and whether the proposed solution is technically sound.
- The reasonable cost of repair, the difference in value, or another technically informed measure of loss.
- Whether an alleged defect presents a safety or compliance risk that requires urgent action.
Issues that may not need one
If the dispute turns on an undisputed invoice, a delivery date, what was said at a meeting, or a document that clearly records the parties’ agreement, specialist opinion may add little. A simple, visible defect may be capable of being described with photographs, measurements, specifications and contractor quotations, although a technical opinion may still become necessary if cause, scope or value is contested.
When an early appointment is useful
An expert can be appointed before a claim is issued when a focused opinion will materially change the next decision. Examples include identifying the likely source of a leak before expensive opening-up, distinguishing defective workmanship from a design or maintenance problem, defining a safe repair scope, or testing whether a proposed claim is worth pursuing. A concise report can also give the other side enough technical information to negotiate rather than forcing both parties to plead positions they cannot yet evaluate.
The Construction and Engineering Disputes Pre-Action Protocol says that expert reports are generally not expected or required during the pre-action process. It adds that, where a report is succinct and central to the claim, it can be a helpful way of explaining the claimant’s position. That is a proportionality judgment, not a universal requirement.
The Technology and Construction Court (TCC) Guide treats the protocol as normal reasonable pre-action conduct and cautions against unnecessary cost. It does not require parties to marshal every piece of evidence or produce reports that may only be needed in litigation. If the other side’s approach is seriously disproportionate, proceedings or an application for the court’s assistance may still be possible.
Define the decision before instructing
Write down the technical question and the decision it will inform. “Is the building defective?” is usually too broad. A useful instruction might ask whether the specified roof falls and membrane were installed in accordance with the contract, what caused the observed water ingress, and what proportionate remedial scheme and cost follow. Limit the assignment to the expert’s discipline and avoid asking for a legal conclusion.

Preserve the evidence
Before inspection, preserve photographs, videos, drawings, specifications, programmes, payment records, variation instructions, notices, maintenance logs, test certificates and communications. Do not repair or remove evidence without recording its condition and, where practicable, giving the other party a reasonable opportunity to inspect. Tell the expert which documents are relied upon and identify factual assumptions clearly.
The construction pre-action sequence
The Construction and Engineering Disputes Pre-Action Protocol covers construction and engineering disputes, including professional negligence claims against architects, engineers and quantity surveyors. It is intended to give each side enough information to understand the case, consider settlement and decide what should happen next.
| Stage | Protocol timing | Expert-related point |
|---|---|---|
| Defendant acknowledges the letter of claim | Within 14 calendar days | The claimant’s letter identifies any experts already instructed and the issues their evidence addresses. |
| Defendant sends a substantive response | Within 28 days after receiving the letter of claim | The response identifies experts on whom the defendant intends to rely. |
| Parties meet | Normally within 21 days after the response | They should discuss how expert evidence is likely to be handled, including whether a joint expert is suitable. |
These periods are specific to this protocol, not a general timetable for every building claim. The protocol lists exceptions to completing the process before proceedings, including enforcement of an adjudicator’s decision, interim injunctive relief, summary judgment and matters recently dealt with by adjudication or another formal alternative-dispute-resolution process. If limitation may expire, proceedings can be started without completing the protocol, with an application for directions. Obtain advice on the particular limitation issue rather than assuming the protocol extends time.
When court permission is required
CPR Part 35 controls expert evidence in civil proceedings. Its central rule is that “Expert evidence shall be restricted to that which is reasonably required to resolve the proceedings.” Before relying on an expert report or calling the expert, the party must obtain the court’s permission. A report obtained during pre-action discussions does not itself give permission to use that report at trial.
- Identify the field and issues. State precisely whether the evidence concerns defect, causation, remediation, valuation, delay or another technical issue, and explain why ordinary evidence is insufficient.
- Estimate the cost. Give the court a realistic estimate for inspection, documents, meetings, report, questions and any attendance. Relate the estimate to the amount and importance of the claim.
- Name the proposed expert where practicable. Identify the person’s discipline and relevant experience. If no individual has been selected, explain the proposed expertise and the steps being taken to appoint one.
- Seek directions on scope and form. The court may restrict the evidence to a specified expert, field or list of issues. It may order a single joint expert or impose a timetable.
- Comply with Practice Direction 35. The report must meet the required format and include the expert’s declaration that they understand and have complied with the duty to the court.
Written evidence is the default. Permission to serve a written report does not automatically permit oral evidence at trial; oral testimony may require separate permission or a specific direction. Written questions are ordinarily for clarification, may be asked once and must be put within 28 days of service of the report unless the court permits otherwise or the parties agree.

The expert’s independence and the report’s contents
Under CPR 35, “It is the duty of experts to help the court on matters within their expertise.” That duty overrides any obligation to the instructing or paying party. An expert is not an advocate whose role is to select only favorable facts. The report should acknowledge material evidence that cuts against the instructed party’s position and explain uncertainties or competing causes.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →A reliable report normally records the expert’s qualifications, the instructions received, documents considered, site inspections and limitations, factual assumptions, methodology, photographs or measurements where relevant, the applicable technical standards, the reasoning linking observations to conclusions, and the remedial or valuation calculations. The substance of material instructions must be stated. If an instruction changes, the change and its effect should be disclosed. The expert must sign the required statement of truth and declaration of duty.
Single joint expert or separate experts?
The court may direct the parties to use one expert jointly on an issue. The protocol encourages parties to consider joint instruction when expert evidence is likely, but it does not require a joint expert in every dispute. The court’s order controls what evidence may be used.
| Decision factor | Questions to ask | What it may indicate |
|---|---|---|
| Amount and proportionality | Can the likely benefit justify the fees and delay? | A single expert or a tightly limited issue may be proportionate in a modest claim. |
| Technical complexity | Is one defined specialty sufficient, or are several disciplines involved? | One expert may suit a discrete defect; several disciplines may be needed for interacting structural, services and cost issues. |
| Nature of disagreement | Is the technical knowledge substantially established, or is a genuine range of opinion likely? | A joint expert can efficiently address an established issue; materially different professional views may justify separate experts. |
| Importance and issue type | Does the opinion decide liability, causation, quantum or a safety-critical question? | The greater the significance, the more carefully the scope and testing arrangements should be set. |
| Existing work and procedure | Has either party already instructed an expert, and what do the protocol or court directions allow? | Existing instructions do not remove the court’s control; directions may require a joint process or limit further reports. |
A joint expert does not mean an expert hired to split the difference. The expert remains independent, and each party must provide the information needed for a fair opinion. If one expert cannot address materially different technical positions or would leave important issues untested, separate experts may be justified.
Choosing the timing for common building disputes
Visible workmanship defect
For defective brickwork, finishes, windows or roofing, begin with a proportionate inspection and contemporaneous photographs. If the parties agree what is wrong but disagree about the repair specification or cost, a focused building surveyor or quantity surveyor report may be enough. Avoid commissioning a broad report on every alleged defect when only two items affect the claim.

Uncertain causation
For cracking, damp, movement, overheating or recurring leaks, appoint early if the cause will determine who is responsible or whether opening-up is safe. The instruction should distinguish observations from hypotheses and require the expert to consider plausible alternatives, such as design, ground, maintenance and workmanship causes.
Remedial scope and quantum
Where liability is relatively clear but the parties dispute the remedy or loss, a report limited to necessary work, reasonable specification, access and cost may resolve the real issue. A quantity surveyor’s valuation should identify assumptions, rates, preliminaries, contingencies and any betterment rather than simply adopting a contractor’s quotation.
Adjudication or urgent protection
An adjudication, an application for an interim injunction, or an imminent safety risk can require a faster and narrower opinion. The pre-action protocol’s ordinary sequence may not need to be completed in those circumstances, but the adjudicator or court will set the applicable timetable and evidential rules.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Costs and proportionality: a practical test
Before signing an instruction, compare the expert’s likely total cost with the value and importance of the issue, not just the headline inspection fee. Include document review, repeat visits, testing, meetings, report revisions, responses to questions and possible attendance. Ask whether a less expensive step—targeted opening-up, an agreed measurement, exchange of photographs or a joint site visit—can answer the immediate question.
- State the maximum initial scope and obtain approval before additional work.
- Separate issues that are agreed from those that genuinely require opinion.
- Use the narrowest competent discipline; do not ask a generalist to opine outside it.
- Record why the opinion matters to settlement, pleading, valuation or trial.
- Reassess proportionality when new facts reduce the number of live issues.
Common mistakes and how to avoid them
Assuming an expert is an automatic ticket to court
A pre-action report may help explain a position, but it does not secure permission to rely on the report later. Apply for permission and follow the resulting directions.

Instructing the expert to prove liability
Replace legal questions with technical ones. Ask what was observed, what standard or specification applies, what caused the condition, what work is required and what it costs.
Using an over-wide brief
A report covering every historical complaint can obscure the issues that determine the claim. Define the buildings, dates, elements, defects and questions in a schedule.
Failing to disclose material instructions or evidence
Withholding an unfavorable drawing, test result or maintenance record can undermine credibility. Give the expert a complete, organized document set and require the report to identify material instructions.
Confusing written permission with oral evidence
Check the order. Written questions and a written report do not automatically authorize cross-examination at trial.
A decision checklist before you appoint
- Confirm the jurisdiction and route: England and Wales civil proceedings, TCC litigation, adjudication, arbitration or another forum may apply different rules.
- List the technical issues and separate them from factual and legal disputes.
- Collect and preserve the records, photographs and physical evidence needed for inspection.
- Try a proportionate information exchange or joint inspection where it can answer the question.
- Obtain a scope and cost estimate tied to the amount and importance of the dispute.
- Decide whether a joint expert could address the issue fairly or whether genuinely different opinions must be tested.
- If proceedings are contemplated, plan the CPR Part 35 permission application and timetable before commissioning a report for court use.
The practical answer to “Do I need an expert witness to sue a builder?” is therefore conditional: appoint one when a material technical issue is disputed and a properly independent opinion is reasonably required, but do not treat an expert report as an automatic precondition. In England and Wales, proportional scope, early preservation of evidence and compliance with the court’s permission and directions matter as much as the expert’s credentials.
