Under U.S. federal OSHA construction rules, “competent,” “qualified,” and “certified” do not mean the same thing. A competent person must recognize existing and predictable hazards and have authority to correct them. A qualified person must demonstrate the ability to solve problems relevant to the work; a qualified rigger is qualified for the particular rigging work and conditions. A signal person must satisfy the specific knowledge, testing, evaluation, and documentation requirements in 29 CFR 1926.1428. “Certified” by itself is not a universal OSHA status.
This explanation is scoped to federal OSHA construction requirements, especially 29 CFR 1926 Subpart CC, which covers cranes and derricks in construction. State-plan rules, non-construction standards, collective agreements, and employer policies may add requirements.

What “competent person” means
OSHA’s general construction definition in 29 CFR 1926.32(f) describes a competent person as “one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.”
Both parts are required. Someone who can spot a dangerous condition but cannot stop the work, change the method, or obtain a correction does not meet the complete definition. Training and experience may provide the needed knowledge, and a task-specific OSHA standard may impose additional requirements. Competent-person status is therefore hazard- and authority-focused, not automatically a certification label.

What “qualified person” means
Under 29 CFR 1926.32(m), a qualified person has, through a recognized degree, certificate, or professional standing, or through extensive knowledge, training, and experience, successfully demonstrated the ability to resolve problems related to the subject matter, work, or project.
The key test is demonstrated capability relevant to the assignment. A document can support that determination, but the word “qualified” does not describe a generic level that applies to every construction task. The required knowledge and skill depend on the equipment, configuration, hazards, and work being performed.

When a rigger is a qualified rigger
Section 1926.1401 defines a qualified rigger as “a rigger who meets the criteria for a qualified person.” That does not create an all-lifts credential. The employer must consider the actual hoisting operation, rigging arrangement, load, equipment, and site conditions when deciding whether the rigger can perform the work safely.
A person may be qualified for one lift or rigging configuration and not for another. Employers are responsible for determining what rigging is needed for a particular hoisting job and what qualifications the assigned rigger needs.

Situations where the crane rule specifies a qualified rigger
OSHA identifies qualified-rigger requirements in specified circumstances, including hoisting during crane assembly or disassembly and certain work in a load’s fall zone, such as hooking, unhooking, guiding a load, or making an initial connection. The exact applicability depends on the operation; review the controlling provisions, including §§ 1926.1404 and 1926.1425, for the lift being planned.
How signal-person qualification works
Before a person gives signals to a crane operator, the employer must ensure that the person meets 29 CFR 1926.1428. The rule requires a defined evaluation process rather than reliance on a course title or wallet card.

Required knowledge and skills
The signal person must:
- Know and understand the signals used for the operation.
- Apply those signals competently.
- Understand basic equipment operation and limitations, including load swing and stopping dynamics and boom deflection.
- Know the relevant requirements in §§ 1926.1419 through 1926.1422 and § 1926.1428.
- Demonstrate the requirements through an oral or written test and a practical test.
Who may evaluate the signal person
The employer may use either a third-party qualified evaluator or an evaluator employed by the employer who is competent to assess the regulatory requirements. A third-party evaluator’s documentation must come from an independent entity whose independence and expertise support a competent assessment.

What the employer must document
Documentation must be available at the worksite while the person is employed and must identify the signal types for which the person qualified, such as hand signals or radio signals. If later performance shows that the person no longer meets the requirements, the employer must remove the person from signaling duties until retraining and reassessment confirm qualification.

An employer’s own evaluation is not portable to another employer. A new employer must determine how to satisfy its own duty under § 1926.1428.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What “certified” does—and does not—tell you
“Certified” describes a credential issued by a particular organization; it does not, standing alone, prove universal OSHA compliance. The qualified-person definition allows a recognized certificate as one possible basis for qualification, but it also allows extensive knowledge, training, and experience with demonstrated ability.
For signal persons, the regulation focuses on evaluator qualifications, required knowledge, oral or written testing, practical testing, and documentation. A generic course-completion certificate does not automatically satisfy those duties. OSHA also states that it does not endorse specific products or programs and does not decide from a written curriculum alone whether a program qualifies as a third-party signal-person evaluator.

Side-by-side comparison
| Term | Main test | Evidence or process | Important limitation |
|---|---|---|---|
| Competent person | Can identify existing and predictable hazards and has authority to correct them | Training and/or experience may support the knowledge; applicable standards may add requirements | Hazard-focused and authority-dependent; not inherently a certification |
| Qualified person | Has demonstrated the ability to solve relevant work problems | Recognized degree, certificate, or professional standing, or extensive knowledge, training, and experience | Must relate to the subject matter, work, or project |
| Qualified rigger | Meets the qualified-person criteria for rigging | Employer evaluates the lift, rigging, hazards, and site conditions | Qualification for one task does not automatically cover every lift |
| Qualified signal person | Meets § 1926.1428(c) knowledge and skill requirements | Qualified evaluator, oral or written test, practical test, and documented signal types | An employer’s evaluation is not portable to another employer |
| “Certified” | Depends on what the issuing organization actually assessed | Check issuer, scope, testing, practical evaluation, and employer requirements | The word alone is not proof of OSHA qualification or endorsement |
Employer compliance checklist
- Confirm the governing rule. Identify whether the work is covered by federal construction requirements, a state plan, another industry standard, or additional project rules.
- Assign competent-person duties correctly. Confirm both hazard-recognition ability and authority to take prompt corrective action, then check any task-specific requirements.
- Evaluate the rigger for the actual lift. Review the load, rigging configuration, crane operation, fall-zone exposure, hazards, and site conditions. Keep the basis for the assignment in the employer’s normal records.
- Qualify the signal person before signaling. Select a qualified evaluator, test the required knowledge and practical skills, and identify the hand, radio, or other signal types covered.
- Keep documentation accessible. Make signal-person documentation available at the worksite while the person is employed.
- Act on performance problems. Stop signaling duties when the person’s actions show the requirements are no longer met; retrain and reassess before return.
- Verify every certificate. Treat a certificate as evidence to examine, not as an automatic substitute for task-specific qualification or the employer’s evaluation duty.
Common mistakes to avoid
- Calling someone competent because they have experience but no authority to correct hazards.
- Assuming a rigger qualified for a familiar load is qualified for every load, configuration, or site.
- Accepting a signal-person card without checking the evaluator, testing method, and signal types covered.
- Assuming an employer’s signal-person assessment transfers automatically to a different employer.
- Describing a training provider or certificate as OSHA-endorsed. OSHA does not endorse particular programs.
