If renovation work has made your home unsafe or removed essential facilities, put safety and shelter first: leave if necessary, arrange a temporary place to stay, photograph the condition, and keep every additional-cost receipt. Then check your contract’s delay and payment clauses, ask the contractor in writing for a recovery plan, notify your insurer or warranty scheme, and contact the building or consumer authority for your location. Whether you can recover accommodation costs, pause a payment, or end the contract depends on the contract and local law.
First decide whether the house is actually usable
“Unusable” is not a single legal test. A home may be uncomfortable because one room is closed, or genuinely unsafe because structural work is exposed, electrical systems are incomplete, plumbing is disconnected, heating or cooling is unavailable, or dust and contaminants cannot be controlled. Housing, building, insurance, tenancy and contract rules can apply different thresholds. Do not assume that inconvenience automatically makes the property legally uninhabitable.

Leave immediately when there is a safety risk
- Get out if there is a credible risk of structural failure, fire, live wiring, gas, flooding, hazardous materials, or uncontrolled construction access.
- Ask the contractor or a qualified inspector to identify the hazard in writing. If emergency services or a local authority is involved, keep the incident number and report.
- Do not re-enter restricted areas merely to collect belongings until the site is declared safe.
List the essential facilities you have lost
Write down which necessities are unavailable and from what date: a functioning toilet or shower, potable water, electricity, a safe cooking area, secure doors and windows, heating, cooling, or a usable sleeping space. Note whether the loss affects the whole household, a child, an older person, or someone with a disability. This contemporaneous explanation helps an insurer, regulator, mediator or tribunal understand why alternative accommodation was necessary.

Choose temporary accommodation on evidence, not assumption
Use the safest practical option for the household and expected delay. Keep the booking confirmation, invoices, cancellation terms, transport costs, and a short note explaining why the home could not be occupied. Ask the insurer or warranty administrator about coverage before committing to expensive arrangements, but do not remain in a dangerous property while waiting for an answer. NSW guidance recommends preparing alternative-accommodation options during a building delay; that is practical advice, not a promise that the builder or insurer will pay.

Create a dated delay file
A clear record is often more valuable than a long argument. Create one folder, digital and backed up, containing the following.
- The signed contract, specifications, plans, schedules and any warranty or insurance certificate.
- Every variation, change order, quotation, invoice and proof of payment.
- Messages, emails, meeting notes and photographs showing progress, defects, missing work and site access.
- The original completion date, each promised milestone, extensions requested or agreed, and every missed date.
- The contractor’s explanations, including claimed weather, supply, labour, approval or design problems.
- Accommodation, storage, transport, meals or other extra-cost receipts, with the date and reason for each expense.
- Names, job titles and contact details for the contractor, supervisor, insurer, regulator and any inspector.
Use a simple timeline with four columns: date, event, evidence and financial effect. NSW Government guidance specifically advises retaining contract documents, invoices, receipts and communications when trying to resolve a building dispute; its home-building delays guidance is a useful record-keeping model even outside NSW.
Read the contract before accepting a new date
Find the clauses headed completion, extensions of time, delay, force majeure, variations, progress payments, suspension, termination, dispute resolution and damages. Check:
- What event qualifies for extra time and whether the contractor had to notify you by a particular deadline.
- Whether weather, approvals, owner-supplied items or changes have stated allowances.
- How a revised completion date must be documented and who must approve it.
- Which milestones trigger payment and what work must be complete before each instalment.
- Whether delay damages, rent, storage or other losses are addressed, limited or excluded.
- What notice, cure period or dispute step is required before suspension or termination.
Do not sign a broad extension simply to restore goodwill. Ask the contractor to identify the cause, days requested, work affected and new milestones. NSW advises checking delay terms before agreeing to an extension and warns that variations can alter both cost and quality. In Victoria, certain domestic building contracts must state reasonable allowances for listed foreseeable delays, including weather and other work-related factors. That statutory example applies in Victoria only; it should not be treated as a rule in another jurisdiction.

Send a written request for a recovery plan
Make the request factual and give a short response deadline that allows the contractor to investigate. Send it through the contract’s required channel and retain proof of delivery. Include:
- The contract date and agreed completion date.
- The rooms or systems still incomplete and the reason the home cannot currently be occupied.
- A list of missed milestones and any extension already approved.
- A request for the cause of each delay, the specific work remaining, labour and material arrangements, and a realistic completion schedule.
- A request to confirm whether a formal extension is being sought under a named contract clause.
- A request for a site meeting, inspection or written response by a stated date.
Ask for dates that can be checked, such as “rough-in inspection on 12 November” and “bathroom operational on 18 November,” rather than “back soon.” Singapore’s renovation-industry guidance recommends mutually agreed start and completion dates, a process for handling delays, clear pricing and express consumer agreement to variations. Its recommendations are jurisdiction-specific but provide a useful standard for a workable recovery plan: Competition and Consumer Commission of Singapore guidance.
Short letter you can adapt
“Our contract dated [date] stated completion by [date]. As of [date], [list incomplete work], and the property cannot be safely occupied because [specific facts]. Please provide by [response date] the cause of the delay, work remaining, a dated recovery schedule, and any extension requested under the contract. Please also confirm which milestones are complete and the amount properly due under the payment schedule. We reserve our rights while seeking a practical resolution.”
Keep payments and termination decisions disciplined
Do not stop paying automatically
Follow the agreed progress-payment schedule only for completed milestones, and inspect before paying. Keep a signed inspection record, photographs and bank confirmation. NSW guidance says owners should make progress payments as agreed and only after the relevant work is completed. It also warns that extra payments outside required progress payments may affect recovery under the NSW Home Building Compensation Fund (HBCF). A different jurisdiction may apply different rules, so obtain local advice before withholding any amount.

If a milestone is incomplete, write exactly what is missing and ask the contractor to correct the account. Do not label a payment “disputed” without explaining the contractual basis. A bank stop, chargeback or unilateral deduction can itself become a breach.
Do not cancel or hire a replacement contractor on impulse
Termination rights are usually conditional. NSW states that there are limited circumstances in which an owner can terminate and warns that a builder may pursue damages and expenses. A replacement contractor may also refuse to warrant work that it did not perform, and opening the site can destroy evidence of the original breach. Before termination, suspension or re-tendering:
- Obtain a written assessment of incomplete and defective work.
- Read the notice and cure requirements in the contract.
- Ask a local building regulator, consumer agency or construction lawyer whether the proposed step is permitted.
- Photograph and inventory the site, materials and stored belongings.
- Set a controlled handover process if another contractor must make the property safe.
Check insurance and warranty schemes promptly
Notify the insurer or scheme administrator in writing as soon as a covered event appears possible. Provide the policy or certificate number, contract, timeline, photographs, contractor correspondence and receipts. Ask four separate questions: Is this cause of delay covered? Is the work eligible by location and contract date? Are accommodation, removal or storage costs included? What notice, excess, limit and approval process applies?

NSW’s HBCF guidance describes cover in specified situations where a contractor cannot complete or rectify work because of events such as insolvency, death, disappearance or licence suspension. It advises notifying the insurer promptly in writing and checking the certificate. This is not general delay insurance: an ordinary late project may not qualify.

Victoria example
Consumer Affairs Victoria states that its Home Warranty insurance rules apply to qualifying work from 1 July 2026 and may cover incomplete, faulty or non-compliant work, subject to conditions. The page also describes possible accommodation, removal and storage expenses and currently states a repair-cost limit of up to $400,000 for that scheme (Consumer Affairs Victoria, accessed 2026). Confirm the policy that applies to the contract and work date at Consumer Affairs Victoria’s insurance and insolvency page; do not use that limit outside the stated scheme.

- Contractor: Send the recovery-plan request and keep the response.
- Insurer or warranty administrator: Lodge notice even if coverage is uncertain; ask what evidence and deadlines apply.
- Building or consumer authority: Use the agency for your state or country and follow its pre-complaint process.
- Mediation, tribunal or court: If negotiation fails, submit the contract, timeline, photographs, payment record and loss schedule in the required format.
Examples illustrate the difference between jurisdictions. New Zealand’s Consumer Protection guidance says: “If you and the service provider have not agreed on a time to finish a job, the provider must do so within a reasonable time.” It explains that incomplete work can involve the Consumer Guarantees Act and contract law, with remedies affected by the seriousness of the problem. Start with that service’s process at Poor quality or incomplete work, then consider the Disputes Tribunal if appropriate.
In NSW, the building regulator and HBCF processes are separate from a private damages claim; follow the route that matches your issue. Victoria provides separate information about disputes, defects and delays at Consumer Affairs Victoria’s disputes page. Keep the complaint number, submissions and deadlines. In Singapore, use the renovation-industry fair-trading guidance and the applicable consumer or dispute-resolution channel rather than importing Australian remedies.

Control costs while the project is unresolved
Make a weekly loss schedule with accommodation, storage, transport, utility reconnection, inspection and urgent safety work listed separately. Choose reasonable, documented expenses and avoid upgrades that would have occurred regardless of the delay. Ask before incurring non-emergency costs that an insurer might require pre-approval for. If belongings must move, photograph their condition, use an inventory and retain the storage agreement.

Protect the unfinished structure from preventable damage, but do not alter disputed work without documenting it first. Emergency measures such as shutting off water or making exposed wiring safe should be recorded with the reason, date, person and invoice.
Common mistakes that weaken a delay claim
- Relying on phone promises instead of confirming dates and variations by email.
- Accepting an extension without identifying the clause, days and new milestones.
- Continuing to occupy a dangerous site because insurance approval is pending.
- Withholding every payment when only one milestone is disputed.
- Allowing a new contractor to demolish evidence before an inspection.
- Assuming a policy covers accommodation because another scheme does.
- Describing the home as legally uninhabitable without checking the local test.
- Deleting messages, changing phones without backups, or losing original receipts.
A practical decision path
Use this sequence when the next step is unclear:
- Safety first: If a qualified person identifies danger or essential facilities are unavailable, relocate and document the reason.
- Evidence second: Build the timeline, photograph the site and preserve receipts before conditions change.
- Contract third: Identify the completion, extension, payment and termination clauses before signing or withholding anything.
- Recovery plan fourth: Require a written cause, dated milestones and a formal explanation for any extension.
- Coverage fifth: Notify the insurer or warranty scheme and ask about approval, limits and exclusions.
- Escalation sixth: Use the regulator, mediator or tribunal for your location if the contractor does not respond or the plan fails.
This order keeps urgent housing decisions separate from legal conclusions. It also preserves options: a documented, contract-compliant resolution is usually safer than an improvised cancellation.
Frequently Asked Questions
How long should I keep renovation-delay records?
Keep the complete file for the period stated by your contract, insurance policy and local limitation rules, and longer if a complaint, claim or tribunal matter remains open. Preserve original files and a backed-up copy rather than relying on screenshots alone.
Can I move my furniture into storage before the builder agrees?
If leaving items on site risks damage or blocks urgent safety work, move them and document the reason, condition, inventory, dates and reasonable cost. Ask the insurer or scheme administrator about pre-approval as soon as practicable; reimbursement is not automatic.
What if the contractor stops replying after I request a schedule?
Send one final notice using the contract’s formal service method, state a reasonable response date, and attach the unanswered request. Then contact the relevant building or consumer authority and insurer, taking care not to terminate or appoint a replacement contractor until local advice confirms the required process.
Can I live in part of the house while work continues?
Only if the remaining area is safe, secure, sanitary and suitable for the household. Obtain the contractor’s written separation and safety plan, identify unavailable facilities, and reassess if dust, noise, access or services make partial occupation unsafe.
