Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →A lumber-price increase does not, by itself, tell you whether your builder can charge more. The answer starts with the signed contract, the project’s governing law and the exact escalation, allowance or variation terms. Before you sign an amendment, withhold a payment or try to cancel, require the builder to identify the contractual basis and provide a written, checkable calculation. Because rules differ by jurisdiction and contract type, obtain advice on your actual documents before taking a step that could affect your rights.
Can a builder raise the price after you sign?
Sometimes, but only when the contract and applicable law allow the adjustment. A contract may contain a material-escalation or rise-and-fall clause, an economic-price-adjustment mechanism, allowances, provisional sums or a written-variation process. A genuinely fixed or lump-sum price may operate differently from a cost-plus or adjustable price. The label is not enough: the wording, incorporated documents and governing law control.

Start by preserving the complete contract record and asking for the claim in writing. Do not treat a verbal statement that lumber is more expensive as a change to the agreement, and do not assume that every fixed-price contract prohibits every increase. Your immediate objective is to identify the rule that applies and test the requested amount against it.
What to do first: a practical response sequence
1. Assemble every document
Collect the signed agreement, schedules, addenda, plans and specifications, selections, allowances, change orders, payment schedules and later amendments. Note which document controls if terms conflict. A clause hidden in an incorporated schedule can be as important as the headline price page.

2. Identify the pricing model
Look for the words fixed price, lump sum, cost-plus, allowance, prime-cost item, provisional sum, adjustable price, escalation, rise and fall, economic price adjustment, variation and change order. These descriptions point you to the provisions that need close reading, but they do not replace the actual clause.
| Pricing description | Question to answer in your documents |
|---|---|
| Fixed or lump sum | Does a specific exception permit an increase, and does local law impose conditions on that exception? |
| Cost-plus | Which lumber costs are reimbursable, what records are required, and what markup or fee applies? |
| Allowance or prime-cost item | What estimate was included, what evidence is required for the actual cost, and how is the difference charged or credited? |
| Provisional sum | What work or material does the provisional amount cover, and how must the final amount be documented? |
| Adjustable or escalation price | What event, index or cost evidence triggers an adjustment, and what notice and cap provisions apply? |
3. Ask for a written claim
Request the exact clause, an itemized calculation and the supporting records. Keep the request and every response dated. Ask the builder to state whether the amount is a pass-through of actual cost or includes a contractual markup.
4. Recalculate before agreeing
Use the clause’s own baseline, dates, covered products, quantities, trigger, formula or index and cap. Check credits for any qualifying price decrease and whether the claimed timing fits the clause.

How to find the clause that governs lumber
Search the contract and attachments for material escalation, lumber, market fluctuation, rise and fall, economic price adjustment, allowance, provisional sum, variation and change order. Then record the following details in a worksheet:
- Covered material: the species, grade, dimensions, engineered products or other lumber categories included.
- Baseline: the bid price, quote, index reading or date used as the starting point.
- Trigger: the percentage, dollar threshold or defined event that permits an adjustment.
- Measurement: the named published index or the method for proving actual cost.
- Quantity: the lumber quantity to which the adjustment applies, including treatment of waste, delivery, tax and freight.
- Limits: any cap, floor, deductible or maximum total adjustment.
- Direction: whether a qualifying decrease must reduce your price as well as an increase raising it.
- Notice: the required form, recipient and deadline for notice and supporting documents.
- Procurement timing: when the builder must order, lock or purchase the material, and how unexcused delay is treated.
- Procedure: the change-order, negotiation, dispute, cancellation or termination steps.
Construction-law analyses commonly distinguish two measurement approaches. A cost-based clause compares documented project cost with the bid baseline. An index-based clause uses a named published index. Neither approach is automatically valid for your project; the signed language and local law decide what evidence is sufficient. Objective baselines, defined limits and two-way treatment of increases and decreases make a clause easier to audit.
What to request from the builder
Your written request should make it possible for an independent reader to reproduce the calculation. Ask for:
Quick wins for a faster PC:

- the affected lumber specifications and quantities, tied to the plans or bill of materials;

- the trigger calculation showing that the contractual threshold was reached;
- the arithmetic from baseline to claimed increase, including delivery, tax, waste and markup treatment;

- the dates of notice and of ordering or purchasing the lumber;

For comparison, the federal clause FAR 52.216-4 Economic Price Adjustment—Labor and Material requires notice to the contracting officer and supporting data describing the cause, effective date, amount and proposed adjustment in its federal procurement setting. A private agreement may require different information, but a request that identifies the rule, evidence and arithmetic is far easier to evaluate than a lump-sum surcharge.

How to test the calculation
Check the covered products
Confirm that the claimed boards, panels or engineered products match the contract’s listed materials. A general statement that all lumber rose does not establish that every item in your project is covered.
Check dates and the trigger
Compare the baseline date, the date of the alleged increase and the notice deadline. Apply the stated percentage or dollar threshold exactly as written. An increase outside the covered period, or below the trigger, may not qualify.
Check quantities and unit prices
Reconcile the claimed quantity with the plans, takeoff or approved changes. Separate material cost from freight, tax, waste and markup so that each component is treated as the contract requires. Do not accept a market headline as a substitute for the supplier evidence the clause calls for.
Check caps, floors and decreases
Apply any maximum or minimum adjustment and look for a reciprocal credit when prices fall. A clause that allows increases but is silent on decreases may still be interpreted according to its wording and governing law; obtain advice rather than assuming one result.

Check procurement responsibility
Determine whether the builder was required to order by a particular date or could have locked the quoted price earlier. Some contract proposals protect the owner by excluding increases caused by the contractor’s unexcused delay. That safeguard is not universal, so verify whether your agreement actually contains it.
If the contract does not clearly support the surcharge
Respond in writing that you are reviewing the request and ask the builder to identify the contractual and legal basis with supporting records. Avoid language that accidentally admits the amount is owed. Continue complying with undisputed obligations while obtaining advice on payment timing and notice requirements. Do not unilaterally rewrite the price, stop work, withhold all payments or terminate unless your adviser confirms that the contract and local law permit that course and explains the required notice.
If the builder proposes a new price, compare the proposed amendment line by line with the original agreement. Confirm whether it changes the completion date, scope, warranties, allowances, dispute process or your right to benefit from later price decreases. A signature can waive objections or create a new payment obligation even when the original contract was silent.
Victoria, Australia: a specific consumer-law example
Victoria illustrates why location matters. Consumer Affairs Victoria says domestic building contract prices can change in specified circumstances, including agreed variations and eligible prime-cost or provisional-sum items. Its guidance says the contract should describe those items and estimates, and owners should receive invoices or other evidence of cost.

- Clog resistant tip writes on dusty, wet and oily surfaces and is optimized for rough surfaces such as OSB, cinderblock and concrete

For a variation, the agency generally requires the parties to agree in writing before the work is carried out, with the change, new price and completion date included. Its major domestic building contract checklist describes a written variation notice as generally required, subject to limited exceptions. Read the current price-change guidance for the circumstances and records that apply to your contract.
The agency’s builder guidance, last updated 8 July 2025, states that a cost-escalation or rise-and-fall clause is restricted for certain domestic building contracts at or below AUD 500,000 unless the required approval applies. The page says the Director had not approved any such clauses when it was updated. This is a Victoria-specific, dated statement—not a rule for another Australian state, a U.S. state or a private project elsewhere—so verify the regulator’s current position before relying on it.
Federal procurement rules: useful comparison, not homeowner law
U.S. federal procurement provides a model for how a detailed adjustment mechanism can work, but it does not govern an ordinary private homebuilding agreement. Federal Acquisition Regulation Subpart 16.2 discusses economic-price-adjustment clauses in federal fixed-price contracts. The framework contemplates identified materials and, for index adjustments, an appropriate index under the procurement conditions.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsFAR 52.216-4 limits adjustments to the listed materials and quantities and uses specified notice, evidence, thresholds and a cap in the federal clause. The contracting parties negotiate and modify the federal contract rather than treating a unilateral invoice as an automatic change. The comparison is useful because it shows the elements an auditable mechanism needs; it is not authority for a homeowner’s contract.
Comparing escalation-clause designs
If you are negotiating an amendment or a new contract, compare the mechanism along these dimensions. The best choice depends on the project and jurisdiction, but each option changes the evidence and risk you will carry.
| Design choice | What it measures | Owner-risk question |
|---|---|---|
| Cost-based | Documented actual project cost against the bid baseline | Can you audit supplier records, quantities and markup? |
| Index-based | A named published index at defined dates | Does the index track the exact lumber products used? |
| One-way | Qualifying increases only | Is there a reason decreases are not credited? |
| Two-way | Qualifying increases and decreases | Are both directions calculated with the same baseline and timing? |
| Open-ended | No stated ceiling | Could a large movement exceed your financing capacity? |
| Capped | A defined dollar or percentage maximum, sometimes with a floor | What happens after the cap is reached, and who bears the excess? |
| Broad coverage | Many inputs or an entire material category | Are unrelated products swept into a lumber adjustment? |
| Material-specific | Named products, grades and quantities | Does the list match the actual takeoff and approved changes? |
| No timing safeguard | No stated procurement deadline | Could avoidable ordering delay shift the market risk to you? |
| Procurement deadline | Adjustment limited by a required order or lock date | What proof shows the deadline was met or missed? |
Common mistakes that weaken an owner’s position
- Assuming the market decides the contract: a reported price movement is not the same as a contractual trigger.
- Relying on a phone call: undocumented explanations make dates, quantities and concessions difficult to prove.
- Reading only the signature page: schedules, specifications and addenda may contain the operative price language.
- Ignoring decreases: a valid adjustment may require a credit as well as a surcharge.
- Signing under time pressure: an amendment can alter completion, scope and dispute rights, not just the lumber line.
- Importing another jurisdiction’s rule: federal procurement provisions and Victoria consumer guidance do not automatically apply to your project.
- Adding an unverified market percentage: no current lumber-price statistic establishes your contractual entitlement without project-specific evidence.
A focused checklist for your next communication
- Send a dated request naming the clause, covered lumber, baseline, current evidence, trigger, calculation, cap and procurement dates you need.
- Compare the response with the signed documents and recalculate the amount using the contract’s method.
- Mark each disputed item separately: product, quantity, date, threshold, markup, credit and schedule effect.
- Keep paying or performing undisputed obligations while checking any notice deadlines with your adviser.
- Obtain local review before signing an amendment, withholding a payment, changing the scope or seeking termination.
The practical standard is simple: a builder asking for more money should be able to point to a term that permits it and show, with dated records, how the amount was derived. Your signed contract and local law—not the existence of a market increase alone—determine whether the request can become an enforceable change.
