Ask which land-use approvals apply and which other agencies must review each activity. Then obtain the activity-specific permits, complete a documented safety assessment, and have your insurer review the operation.
USDA Natural Resources Conservation Service states: “By opening your farm or ranch to the public, you are responsible for ensuring the safety and health of your visitors.” Ordinary agricultural zoning does not automatically authorize public events, tasting rooms, hayrides, petting areas, lodging, or large gatherings.

Start with a written description of the proposed operation
Planning officials can give a useful answer only when they understand what you actually intend to do. Prepare a one- or two-page description before the first meeting or email. Include:
- The complete property address, parcel numbers if available, acreage, existing zoning and the agricultural activities already conducted there.
- Every visitor use: farm tours, u-pick, animal contact, farm stands, classes, weddings, concerts, markets, tastings, hayrides, camping or lodging, rides, inflatables, fireworks and private rentals.
- Expected attendance on ordinary days and at peak events, including whether numbers are ticketed, reserved or open-ended.
- How often events occur, their duration, opening and closing hours, amplified sound and any seasonal schedule.
- Permanent and temporary structures, including tents, stages, fences, portable toilets, food booths, buildings used for assembly and any sleeping facilities.
- Vehicle access, employee and visitor parking, school-bus or shuttle arrangements, pedestrian routes, deliveries and emergency-vehicle access.
- Food preparation or sampling, produce processing, alcohol service, waste handling and proposed sanitation facilities.
Ask the planning office to identify the next decision-maker for each issue rather than assuming the planner is the only authority. Oregon’s guidance, for example, recommends beginning with county planning and explains that counties may adopt additional requirements under state criteria. Fairfax County’s published example shows that parcel acreage, attendance and the type of activity can change the approval path. Those examples illustrate the questions to ask; they are not rules that transfer to another county.

Questions for the planning or zoning office
- Is visitor access allowed as an agricultural use on this parcel, or must it be incidental or subordinate to farming?
- Does the proposal require a zoning interpretation, administrative permit, conditional-use approval, special-event permit or another land-use action?
- Are there limits on event frequency, duration, hours, noise, traffic, parking, sanitation, waste, lighting, structures or impacts on neighbors?
- Are temporary tents, stages, fencing, portable toilets, ticket booths or seasonal buildings regulated differently from permanent construction?
- What site plan, parking plan, attendance estimate, insurance certificate, fire review or public-notice process is required?
- Which fire, building, health, alcohol, amusement, transportation and environmental offices must sign off?
Request the answer in writing, including the code section or permit name, submission materials, review time and inspection requirements. A state guide or another farm’s approval cannot establish what is lawful on your parcel.
Match every activity to its own regulator
Make an activity inventory and check each line separately. Combining activities can multiply approvals: a wedding with catered food, alcohol, amplified music and a tent is not reviewed like a simple farm stand.
| Proposed use | Reviews to ask about | Issues that can change the approval |
|---|---|---|
| Farm tours, u-pick and farm stands | Planning or zoning; health department where food is sampled or sold; building and fire review for occupied structures | Attendance, hours, parking, visitor routes, sanitation and whether the use remains incidental to agriculture |
| Samples, prepared meals and food booths | Local health department; temporary-event or food-establishment licensing; food-handler and inspection requirements | Whether food is prepared on site, served by a caterer, sold packaged, or offered only as a sample |
| Alcohol, winery, cidery, brewery or tasting room | State or local alcohol regulator plus planning; health and fire review as applicable | Service location, event type, hours, age controls, food service and whether the use is allowed on the property |
| Hayrides and vehicle tours | Planning; fire or building officials where loading areas or structures are involved; insurer and any transportation or amusement regulator | Vehicle type, route, driver qualifications, passenger loading, roadway crossings, weather and separation from farm traffic |
| Animal-contact or petting areas | Planning; health department; animal-health or agricultural authority where required; insurer | Species, handwashing, supervision, animal welfare, disease controls, feed access and visitor age groups |
| Rides, inflatables and other attractions | Amusement-device regulator, fire marshal, building official and insurer | Equipment ownership or rental, operator training, inspections, anchoring, occupancy and emergency shutdown |
| Fireworks or public displays | Fire authority and the agency issuing public-display permits; planning and insurer | Display size, date, weather, separation distances, crowd control and emergency access |
| Weddings, concerts and large gatherings | Planning or special-event office; fire and building officials; health department; transportation or sheriff’s office where traffic control is needed | Attendance, event frequency, amplified sound, parking, temporary structures, toilets and emergency services |
| Camping or farm lodging | Planning, building, fire and health authorities; lodging or campground regulator where applicable | Sleeping capacity, utilities, bathrooms, accessibility, exits, kitchens, wastewater and length of stay |
Indiana’s agritourism resources, for example, explain that amusement or entertainment permits may be required under state rules, that fire-safety inspection is conducted, and that amusement rides and public fireworks displays require permits and inspections. Oregon guidance identifies the state liquor regulator for alcohol service and the Oregon Health Authority as an example of a licensing authority for temporary food events. Requirements in another state or county may be different.

Food, produce and alcohol: obtain health approvals before serving anyone
Food and samples
Contact the local health department with a menu and process description. Ask whether the setup is a temporary food event, a permitted food establishment, a farm-stand operation, a cottage-food activity or another category. Clarify whether sampling, prepared meals, mobile vendors, refrigeration, handwashing, utensil washing, wastewater, employee training and inspection are required. Produce sales and produce processing may have separate rules, so describe washing, cutting, packing and storage rather than calling everything a “farm product.”
Alcohol and tasting rooms
Contact the relevant state or local alcohol regulator before advertising tastings or private events. Confirm the license class, service area, hours, server requirements, age verification, security, food obligations and whether a temporary event endorsement is needed. Planning approval and an alcohol license are separate decisions. Oregon’s guidance specifically warns that agritourism on winery property is subject to particular limits; do not assume a winery, cidery or brewery license authorizes every event use.
Buildings, tents, fire protection and crowd capacity
Ask the building official and fire marshal to review every place where visitors gather, even if the structure is temporary. Confirm occupancy limits, exits, exit lighting, accessible routes, aisle widths, emergency lighting, fire extinguishers, alarms, electrical distribution, generators, cooking equipment, tent anchoring, flame resistance, setbacks and fire-department access. Obtain an inspection or certificate when required and post the approved occupancy limit where staff can see it.

For a tent, stage, portable toilet compound or seasonal building, provide a site plan showing exits, vehicle access, generators, cooking areas and separation from combustible materials. A structure that is acceptable for farm storage may not be approved for public assembly. Pennsylvania’s 2021 agritourism handbook is a useful prompt to check fire-code and occupancy questions, but it should not be treated as a current universal code source. Current local officials and adopted codes control.
Build a visitor-safety plan before opening
Conduct a documented walkthrough in daylight and after dark, during wet weather if possible. Mark the actual visitor route from arrival to departure and identify who controls each hazard. The plan should contain the following elements.
Separate people from farm operations
- Fence or otherwise control access to tractors, combines, workshops, chemical-storage areas, livestock facilities, ponds, silos, manure areas and other restricted locations.
- Keep visitor paths physically separate from equipment lanes, loading zones, delivery routes and backing vehicles. Use barriers, gates, signs and trained attendants rather than relying on verbal directions.
- Schedule machinery work away from tours and u-pick periods where possible. If work must continue, establish a controlled crossing and a named staff member responsible for it.
- Inspect paths for holes, mud, loose gravel, exposed roots, steep grades, low branches and overhead hazards. Provide stable surfaces and accessible alternatives where feasible.
Control animal-contact risks
- Use a designed contact area with species-appropriate barriers, supervision and a clear exit.
- Provide handwashing with running water, soap and a way to dry hands immediately after contact and before eating.
- Keep feed, toys, strollers and personal items out of pens; control children’s access and prevent visitors from entering animal areas without staff.
- Plan for bites, kicks, escapes, allergic reactions, zoonotic illness and animal distress. Define when an animal-contact area closes.
Manage weather, health and accessibility
- Set heat, lightning, high-wind, wildfire, flood and extreme-cold triggers that pause activities or close the site.
- Provide shade, drinking water, rest areas and a way to reach shelter. Tell visitors what footwear and clothing are suitable for the terrain.
- Keep first-aid supplies accessible and identify staff trained to use them. Plan for medical emergencies, lost children, severe weather and evacuation.
- Check routes, toilets, parking, seating and activity surfaces for accessibility. Do not place an accessible route through an active equipment area.
Plan traffic, parking and emergency access
- Use a written traffic plan showing entrances, exits, one-way movements, pedestrian crossings, accessible spaces, bus or shuttle loading and overflow parking.
- Keep fire lanes and ambulance access clear at all times. Assign staff to monitor gates and prevent parking on fields or roads needed by emergency vehicles.
- Use reflective signs or lighting for evening events and separate pedestrians from reversing vehicles.
- Record the site address, gate numbers and best emergency entrance so staff can give precise directions to 911 dispatchers.
Assign responsibilities and document incidents
Name the person in charge for opening checks, weather decisions, animal areas, traffic, first aid, evacuation and closing inspections. Brief every employee and temporary worker before a shift. Keep a log of injuries, near misses, equipment failures, complaints, weather closures and corrective actions. Review the plan after each event and whenever the layout or activity changes.

Review insurance against the actual visitor experience
Ask the farm’s insurer or broker to review the written activity list before opening. Discuss general liability, events, animal interaction, hayrides, rides and inflatables, food service, alcohol, lodging, volunteers, contractors and hired operators. Confirm whether existing farm coverage excludes public events or requires endorsements, certificates from vendors, minimum limits or written contracts.
USDA identifies increased liability exposure and new physical-injury risks when a farm opens to visitors. Insurance does not replace guards, inspections, training or maintenance, and a warning sign does not cure a dangerous condition. Keep written evidence of inspections, staff training, maintenance and corrective actions so the insurer and regulators can see how risks are managed.

Check state agritourism warnings and liability protections
Do not copy a sign from another farm or rely on a generic waiver. State statutes differ, and statutory protection usually depends on exact conditions. Check the current law for the state where the farm is located and ask counsel or the responsible agency how it applies to the planned activities.

What the examples show
- Florida’s 2026 law specifies a notice at the entrance and activity site, black lettering, a minimum letter size and clearly visible presentation. The law states that failure to comply prevents use of the statutory privilege.
- Ohio Revised Code section 901.80, shown as amended effective March 20, 2026, requires a particular warning in a visible location at or near each entrance or activity site and specifies minimum letter height.
- Virginia Code section 3.2-6401 lists exceptions that include negligence, known dangerous conditions and intentional injury. A warning does not erase those exceptions.
Because the wording, placement, letter requirements and exceptions vary, obtain the current statutory text before ordering an “agritourism liability warning sign.” If a law requires a notice, reproduce the required language and placement exactly; treat the sign as one condition of a broader safety and legal program.
Use a staged approval process
- Define the operation. Complete the address, acreage, activities, attendance, schedule, structures, food and alcohol description, traffic plan and emergency-access plan.
- Meet planning first. Ask for the applicable land-use category, permit or approval, submission checklist, hearing or notice requirements and limits on frequency, hours, noise, traffic and structures.
- Build the agency list. Contact health, alcohol, building, fire, amusement, transportation, lodging and environmental authorities identified by planning officials.
- Submit plans and schedule inspections. Do not open or sell tickets while an approval, occupancy inspection or required license is pending.
- Complete the safety walkthrough. Correct hazards, install barriers and signs, verify sanitation, test emergency communications and brief staff.
- Confirm insurance and contracts. Obtain written confirmation that the planned activities and vendors are covered and meet any certificate or endorsement conditions.
- Recheck after changes. A larger attendance limit, new tent, alcohol service, ride, concert, lodging area or different traffic pattern can require a new review.
Before you announce opening dates
Send the local planning office a written description of the address, activities, attendance, event schedule, structures, food and alcohol service, and parking plan. Ask which agencies must review it, obtain each activity-specific permit and inspection, then complete the documented safety and insurance review before inviting the public.
