What to Do When Construction Experts Disagree

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When two construction professionals give different opinions, do not choose the answer delivered most confidently or supported by the largest number of people. First protect anyone at risk, prevent avoidable damage, preserve the site record, and define the exact question in dispute. Then compare each opinion’s evidence, assumptions, methods, standards and reasoning. If the difference remains material, use a suitably independent specialist or the dispute process required by your contract and local law.

A technical opinion is not automatically a legal finding about defective work, causation, responsibility or payment. Those conclusions may require different evidence and, in a formal dispute, a decision-maker applying the relevant contract and law.

1. Deal with immediate safety and damage first

If the disagreement concerns a potentially unsafe structure, fire, electrical or gas danger, falling materials, or active water ingress, protect people before debating who is right. Leave hazardous areas, isolate services only when it is safe and within your competence, and contact the appropriate emergency service or qualified professional. A general article cannot diagnose whether a particular building is safe.

For non-emergency work, avoid irreversible actions that could erase evidence until the condition has been recorded and the relevant professionals have had a reasonable opportunity to inspect it. If urgent work cannot wait, photograph and video the condition from multiple angles, note the date and time, record who authorised the work, and retain removed materials where practical. This is sensible evidence preservation, not a universal legal rule; local advice may impose different requirements.

Use a short triage record

  • Describe the immediate hazard or damage and who may be exposed.
  • Record temporary controls, such as propping, covering an opening or isolating a service.
  • Identify the person who assessed the urgency and the time of the assessment.
  • List work that must happen now and work that can wait for inspection.

2. Define what the experts actually disagree about

“The experts disagree” is too broad to resolve. Separate the issue into answerable questions, because a structural engineer, building surveyor, services specialist, quantity surveyor and lawyer may properly answer different parts.

Observation

Is the reported condition present, exactly where is it, and how extensive is it? Ask which observations are directly verified and which areas were inaccessible.

Cause

What mechanism most likely produced the condition? Ask what alternative causes were considered and what evidence would distinguish them. Agreement that a crack, leak or movement exists does not establish why it happened.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Requirement

Which drawing, specification, approved change, regulation, code, standard or contract term applies? A disagreement may concern whether work fails a requirement, or merely whether one design is preferable.

Remedy

Which repair options address the condition, and what are their consequences, costs, disruption and uncertainties? A repair recommendation can differ even when the experts agree on the cause.

Responsibility and entitlement

Who bears responsibility, whether a notice was valid, or whether money is owed are often contractual or legal questions. Do not treat a technical conclusion as a final liability decision.

Write each disputed point as a sentence that could be answered with evidence. For example: “Is moisture entering through the roof junction shown on drawing revision C?” is more useful than “Which contractor is right?”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. Build one common evidence pack

Give every expert the same core record and identify anything not supplied. Keep original files where possible; label later annotations, measurements and edited images so nobody mistakes them for contemporaneous evidence.

  • The signed contract, scope, schedules, specifications and all drawing revisions.
  • Approved change orders, instructions, variations, permits and inspection records where relevant.
  • Dated photographs and videos, including wide views that show location and close-ups that show detail.
  • Site diaries, meeting minutes, delivery records, test certificates and commissioning information.
  • Emails, messages, notices, quotations, invoices and payment records.
  • Earlier reports, surveys and records of who attended each inspection.
  • A chronology showing when the condition was first noticed, reported, investigated and repaired.

Record access limitations: an expert who could not open a wall, enter a roof void or inspect a concealed connection must state that limitation. Preserve metadata and original photographs when possible, and distinguish a measured dimension from an estimate.

A transparency checklist from expert-report guidance

Health and safety regulator guidance on expert reports is framed around enforcement work, but its transparency checklist is useful more broadly. A sound report should identify the material instructions and questions, documents and assumptions, examinations and tests, who performed those tests, and the reasoning leading to the opinion. Facts that weaken the conclusion should not be omitted. Apply that checklist proportionately; it does not turn every private inspection into an enforcement report.

4. Compare the basis of each opinion, not the presenter’s confidence

Read the reports side by side and make a comparison table. The objective is to find the precise point at which the reasoning diverges.

Check Questions to ask
Relevant competence Does the person have qualifications and recent experience for this specific issue, such as structural movement, waterproofing, building services or valuation?
First-hand inspection What areas were inspected, when, for how long and with what access? What could not be seen?
Evidence used Which measurements, photographs, tests, records, drawings and standards support the opinion?
Assumptions Which facts were verified and which were supplied or assumed? Would changing an assumption alter the conclusion?
Method Was the inspection or test method explained and suitable for the question? Who performed the test and under whose supervision?
Alternatives and uncertainty Were other plausible causes considered? Are confidence limits, missing information or qualifications stated?
Reasoning Can a reader follow the path from observation to inference to conclusion?
Scope Does the opinion stay within the expert’s field, or does it make an unsupported legal, financial or specialist-services judgment?

England and Wales Practice Direction 35 expects an expert report to set out qualifications, relied-on material, material facts and instructions, examinations and tests, and any range of opinion with reasons for the expert’s own view. Those are useful questions even when no court case has started.

5. Ask both experts the same focused questions

Send a neutral, numbered list to each expert rather than a message that argues your preferred conclusion. Identical questions make answers comparable and reduce the risk that one professional is responding to a different brief.

  1. What precise question were you asked to answer?
  2. Which areas did you inspect, and what access or visibility limitations applied?
  3. Which documents, measurements, tests and standards informed your opinion?
  4. Which statements in your report are direct observations, and which are assumptions or inferences?
  5. What other plausible explanations did you consider, and why did you reject or rank them?
  6. What additional inspection or test would best distinguish those explanations?
  7. What evidence would cause you to revise your conclusion?
  8. Which parts of the issue fall outside your expertise?
  9. Which facts or propositions do you agree with the other expert, and at what exact point does your reasoning differ?

Ask for the smallest additional investigation capable of resolving the issue. A narrowly scoped moisture test, opening-up inspection or survey may be more useful than commissioning a broad new report with the same assumptions.

England and Wales: questions about an expert report

In civil proceedings in England and Wales, Civil Procedure Rules Part 35.6 permits proportionate written questions for clarification, generally once and within 28 days after the report is served, unless the court permits otherwise or the other side agrees. That is a court procedure, not a universal deadline for every construction disagreement. Obtain local legal advice before relying on it.

6. Use an expert discussion or an independent specialist when needed

Expert discussion

A short, agenda-led meeting can show that the conflict comes from different assumptions, incomplete records or different questions rather than irreconcilable science. Circulate the evidence and questions in advance. Keep a written record of agreed facts, unresolved issues, brief reasons for disagreement and any inspection or test that could resolve a point.

In England and Wales proceedings, CPR 35.12 allows a court to direct experts to discuss issues and, where possible, reach an agreed opinion. The court may require a statement identifying agreement and disagreement with reasons. Practice Direction 35 describes the purpose as narrowing issues, recording short reasons for disagreement and identifying actions that could resolve outstanding points.

Independent inspection or opinion

Commission another specialist only when the scope is clear and the person is genuinely suitable and independent for the question. Give the specialist the complete evidence pack, both existing opinions and a written instruction that identifies the disputed propositions. Ask for a report that separates observed facts, assumptions, analysis, alternatives, limitations and conclusions.

More opinions do not automatically produce a better answer. A third professional who receives incomplete records or repeats an untested assumption can increase cost without increasing certainty. Check qualifications, relevant project experience, conflicts, availability, inspection access, method, fee basis and expected timing before appointment.

Independent expert determination

RICS describes independent expert determination as a process suited to some construction issues, including workmanship, completion and specific technical disputes. Whether it is available, binding and appealable depends on the contract and applicable law. Confirm the appointment mechanism, scope, evidence rules, confidentiality, costs and legal effect before choosing it.

7. Check the contract and jurisdiction before escalating

Review the contract early for notice requirements, time limits, escalation steps, adjudication, mediation, arbitration or expert-determination clauses. A persuasive technical report does not preserve a contractual claim or defence if a required notice or limitation period is missed.

England and Wales procedure

CPR Part 35.3 states that an expert’s duty is to help the court on matters within the expert’s expertise and that this duty overrides obligations to the person instructing or paying the expert. Part 35.1 says expert evidence must be restricted to what is reasonably required to resolve the proceedings. These rules explain why an expert should be independent in reasoning, even when one party pays the fee.

The Pre-Action Protocol for Construction and Engineering Disputes applies to construction and engineering disputes in England and Wales, including certain professional-negligence claims. It promotes sufficient information exchange, informed decisions about settlement and next steps, proportionality and appropriate attempts to resolve matters without proceedings. Paragraph 3.1.2 specifically calls for consideration of an appropriate form of alternative dispute resolution. The protocol has scope and procedural exceptions, so it is not a substitute for advice on your project.

Elsewhere

Procedures in Scotland, Northern Ireland, the United States, Canada, Australia and other jurisdictions differ. RICS’s independent expert-determination standard page describes a scope based on law and practice in England, Wales and Northern Ireland; do not present it as a worldwide rule. Use a local construction lawyer, surveyor or dispute professional when safety, deadlines or significant sums are involved.

8. Choose the least costly route that can answer the question

Route Best suited to Check before proceeding
Clarification from existing experts The difference may come from missing explanation, assumptions or scope. Use identical focused questions and identify the documents or access each needs.
Joint or facilitated expert discussion A narrow technical disagreement where each expert can explain the reasoning. Set an agenda, confirm independence, agree who attends and record agreement and disagreement.
Independent inspection or opinion Existing opinions are materially incomplete or a different specialty is needed. Verify qualifications, conflicts, scope, access, method, cost and timing.
Contractual ADR or determination The contract provides a process or both parties can agree one. Check appointment, confidentiality, evidence, fees, deadlines and legal effect.
Formal proceedings The dispute cannot be resolved and enforcement or a binding decision is required. Confirm jurisdiction, limitation and notice deadlines, evidence rules, proportionality and legal advice.

Mediation, adjudication, arbitration, expert determination and court proceedings are not interchangeable. Their powers, speed, confidentiality, costs and ability to be appealed differ. Match the process to whether you need a technical answer, a payment decision, urgent relief or a final legal ruling.

9. Manage urgent repairs without compromising the dispute

Separate temporary protection from permanent rectification. State in writing that emergency measures are being taken to protect people or prevent further damage, without accepting an untested conclusion about cause or liability. Photograph conditions before work, during opening-up and after stabilisation. Keep invoices, delivery notes, removed components and contractor instructions.

Invite the relevant parties to inspect before concealment where timing allows. If they cannot attend, record the invitation, deadline and response. Do not exaggerate measurements, alter images or discard failed materials. Accurate records help both settlement and any later technical investigation.

10. Mistakes that make expert disagreements harder to resolve

  • Choosing by seniority, confidence, price or headcount instead of evidence and relevant competence.
  • Asking each professional a different question and then comparing answers as if the briefs were identical.
  • Assuming a visible symptom proves its cause or proves who is legally responsible.
  • Withholding an inconvenient photograph, earlier report, failed test or fact that weakens your preferred case.
  • Ordering destructive opening-up work without documenting the original condition.
  • Commissioning several broad reports before defining the disputed proposition.
  • Ignoring a contract notice, procedural deadline or required escalation step.
  • Presenting England and Wales court rules as if they applied in another country.

11. A practical decision checklist

  1. Is anyone in immediate danger, and what temporary control is required?
  2. Have you recorded the condition, date, location, access limits and people involved?
  3. Can you state the disagreement as one or more precise questions?
  4. Does each expert have the right specialist competence?
  5. Did both experts receive the same relevant documents and instructions?
  6. Which facts are agreed, which are assumed and which are disputed?
  7. What test, inspection or document could change the conclusion?
  8. Have you asked identical neutral questions and preserved the responses?
  9. Would a focused expert discussion resolve the difference?
  10. Does the contract require a notice, negotiation, mediation, adjudication, arbitration or determination?
  11. What local deadline or legal advice is needed before choosing a route?

The right outcome is not necessarily the opinion that sounds most certain. It is the conclusion that remains persuasive after the question, evidence, assumptions, method, uncertainty and contractual context have been made explicit.
